1 Terms f Reference Data Base Management and IT cnsultant t supprt the wrk f the Labr Inspectin in the Republic f Mldva n verseeing the implementatin f the sftware/data base and prvide caching t lcal staff n the use and maintenance f the system Lcatin: Primary Categry: Type f Cntract: Pst Level: Languages Required: Mldva Wmen s empwerment Individual Cntract Lcal Cnsultant Rmanian, Russian, English Expected wrklad: Up t 200 days ver a perid f 1 year: September 2011 August 2012 Starting Date: (date when the selected candidate is expected t start) 1 September 2011 Backgrund In December 2009 the Swedish Internatinal Develpment Agency (Sida) and the United Natins Develpment Fund fr Wmen (nw part f UN-Wmen) have entered int an Agreement fr the implementatin f the Prgramme Wmen s Ecnmic Empwerment thrugh Increased Emplyability in the Republic f Mldva. The Prgramme is aimed at addressing the needs f the rural and sub-urban ppulatin, especially pr wmen in exercising their scial and ecnmic rights thrugh increasing access t quality infrmatin and services in emplyment and scial prtectin areas. This will be achieved thrugh imprving lcal services, building capacity f the relevant institutins as well as imprving plicy and legislatin based n the gaps identified thrugh their practical applicatin n the grund. The prgram is designed t be fulfilled within fur years in line with the Gvernment pririties set fr as well as the Refrms launched by the State in the areas f labr market and scial prtectin. The Prgram s Develpment Objective is t make wmen in rural and sub-urban areas f Mldva be infrmed, empwered and able t better benefit f their scial and ecnmic rights. Fr that purpse, the Prgramme will strive twards achieving the fllwing utcmes: Outcme 1: Mldvan wmen living in pverty in rural and sub-urban areas are able t make infrmed decisins that enable them t access quality services; Outcme 2: Key plicy, service delivery and media institutins in MOL have increased resurces, structures, prcedures, incentives and capacities t implement plicies that prmte and prtect wmen s human rights t access t emplyment and scial prtectin; Outcme 3: Labr and Scial Prtectin laws and plicies prmte wmen s emplyability. Ratinale The baseline infrmatin cllected suggests that supprt shuld be prvided t imprve the crdinatin within the Ministry f Labur, Scial prtectin and Family (MLSPF), t mainstream gender int the peratins f the MLSPF departments respnsible fr prmting plicies n labur and emplyment, as well as t raise

2 the prfile f gender issues within the Natinal Emplyment Agency (NEA) and the Labur Inspectin (LI). Cnsidering the imprtance f the LI fr the enfrcement f WHR in the wrkplace, it was recmmended that activities t supprt the LI planned in the prgram are scaled up. It is imprtant t nte that the current prpsal n imprving the Gender Equality Law (Law n. 5 f 9 February 2006, MO47-50 f 24 March 2006)) implementatin mechanism, strngly recmmends adding Labur Inspectrate as ne f the key public institutin fr identificatin f discriminatin in the wrk place. Thus, it is imperative t assist the LI in intrducing a mechanism fr recrding and acting upn cases f wmen s discriminatin n the jb place. Fr example, in 2009, the LI inspected 7,073 cmpanies, which emply ver 239,000 emplyees, ut f which 119,000 wmen and 102 minrs. Apprximately half f the inspectins (3,550) were geared twards checking wrkplace safety and health standards. As a result f these cntrls, 38,071 different vilatins have been recrded. 1 Althugh accrding t LI representatives, cases f WHR vilatins are ften identified during cntrls (such as dismissal r refusal t hire pregnant wmen r wmen with small children, hiring wmen n an unfficial payrll, and failing t prvide adequate wrk cnditins), n mechanism exists fr recrding such vilatins r even fr reprting sex-disaggregated data. Cnsidering the current limitatins within the LI, including limitatin in increasing staff numbers, as a result f excessive hiring in the public sectr in the past and the recent ecnmic crisis, it was decided t supprt the LI in the use f infrmatinal technlgy t make its wrk mre efficient fr the direct benefit f wmen and the verall wrkfrce. This includes assisting the LI in purchasing and/ r develping a specialized sft/prgrams supplemented with sme basic equipments fr target lcalities fr the Labr Inspectrate t be able t bth benefit frm the electrnic data base f nrms and regulatins as well as enable them t recrd and mnitr the cases f vilatins f WHR n the jb place thrugh effective use/applicatin f IT. Since this will be a first time LI using IT tls in their wrk, UN Wmen will cntract an IT cnsultant t help LI in ensuring the develpment and applicatin as well as management f the data base. Objectives Under the verall guidance f WEE CTA and supervisin f Prgramme Analyst, as well as in clse cperatin with the Labr Inspectin, the cnsultant will have t (i) supprt the versee the implementatin f the develped system/data base and (ii) prvide n-the-jb training t LI staff t effectively manage and maintain the database/sftware. Duties and Respnsibilities: Specifically, the cnsultant will be required t: Wrk in cnjunctin with internatinal cnsultant and the lcal cmpany t develp the data base/sftware n ensuring the develpment and applicatin f the system f indicatrs; Maintain and update written instructins, frms and guidelines fr the data base/mnitring system fr all reginal LI ffices as well as fr the central ne; Prvisin f hands n advice/training bth fr IT staff as well as fr the labr inspectrs in respect f sftware applicatins, with particular emphasis n: data inputs; prvisin f mnthly reprts f the audit f results; database develpment and implementatin; maintenance and update f the cmpanies database. Audit the accuracy f infrmatin being prvided thrugh the reprting; data cllectin and mnitring system and fllw up any discrepancies t ensure crrective actin has been taken; Prvide advice and guidance int the types f qualitative and quantitative data (key indicatrs) that shuld be cllected within the database. Include quantitative and qualitative indicatrs fr mnitring; 1 Labur Inspectin, Infrmatin nte n wrkplace accidents and eliminatin and preventin f delays in payment f salaries in 2009,

3 Ensure that the reprts prduced by the database/sftware are in cmpliance with the requirements f LI and in accrdance with the Technical Specificatins prvided by internatinal cnsultant; Deliverables In cnjunctin with LI IT staff, and upn request f LI management, cnduct regular audits (site visits) f LI territrial ffices t evaluate the level f use f the data base and prvide pst develpment supprt packages e.g. cnsultancy, training etc. in relatin t the needs f the lcal LI rganizatins. The Deliverables shall be submitted in electrnic frmat t the designated fficer at WEE Prgramme and shall include the fllwing: - Mnthly reprts n the activities carried ut within the framewrk f this TR; - Detailed guidelines/written instructins n the use f the system and update it accrding t the needs; - Training and caching activities prvided t Labur Inspectrs and Data Base manager. All dcuments have t be prvided in Rmanian and English and apprved by UN Wmen WEE Prgramme Management. By prviding highest state-f-the-art technical expertise, the utputs shall result in the successful implementatin and achievement f WEE Prgramme s bjectives. Management Arrangements: Organizatinal Setting: The cntractr will wrk under the guidance f the UN Wmen WEE Prgramme Chief Technical Advisr and under the direct supervisin f Prgramme Analyst. The cntractr will wrk clsely with the Labur Inspectin representatives fr substantive aspects f the assignment. Cntributins: The WEE Prgramme Analyst will put at the cntractr s dispsal all available materials and necessary infrmatin fr tasks achievement and will facilitate the meetings, as needed. Travel Transprtatin fr all envisaged field trips will be prvided by UN Wmen WEE prgramme in Mldva. Financial arrangements: Payment will be disbursed in mnthly installments based n actual days wrked and upn submissin and apprval f deliverables and certificatin by the WEE Prgramme Analyst that the services have been satisfactrily perfrmed. 4 Languages: At least 2 years experience wrking with gvernmental rganizatins r prgrams in the develpment f sftware and database management systems is required; Experience f defining and mnitring perfrmance indicatrs is an asset; Experience f "mnitring and evaluatin" f prjects is an asset; Fluency in Rmanian, gd knwledge f Russian, upper intermediate level f English is required. Evaluatin Prcedure: A tw-stage prcedure will be used in evaluating the candidates: A) Technical evaluatin (max.350 pints) 70% B) Financial evaluatin (max.150 pints) 30% Technical evaluatin will be represented thrugh desk review f applicatins n the basis f its respnsiveness t the Terms f Reference (TOR). The candidates will be evaluated in tw stages: technical evaluatin and financial evaluatin. Nr. Criteria Maximum pints 1. Relevant University Degree (under-master s 20 pts, Master s 30 pts, and abve 40 pts) 2. At least 5 years f prfessinal experience in database management (at least 5 years 30 pts, each year ver 5 year 15 pts, up t a maximum f 80 pts) 3. At least 3 years f prfessinal experience in data base design and maintenance is required (at least 3 years 30 pts, each year ver 3 year 15 pts, up t a maximum f 80 pts) 4. At least 3 years f prfessinal experience f infrmatin management r mnitring data is required (at least 3 years 20 pts, each year ver 3 year 10 pts, up t a maximum f 50 pts) 5. At least 2 years experience wrking with gvernmental rganizatins in the develpment f sftware and database management systems is required (at least 2 years 20 pts, each year ver 2 year 10 pts, up t a maximum f 40 pts) 6. Prficiency in Rmanian. Gd knwledge f Russian. Upper intermediate level f English is required (Rmanian 20 pts, Russian 20 pts, English - 20 pts). Maximum ttal technical scring: 350 In the Secnd Stage, the financial prpsal f candidates, wh have attained minimum 70% scre in the technical evaluatin (at least 245 pints), will be cmpared. The cumulative analysis scheme will be applied with a ttal scre being btained upn the cmbinatin f weighted technical and financial attributes. Cst under this methd f analysis is rendered as an award criterin, which will be 30% ut f a ttal scre f 500 pints. The Individual Cntract (IC) will be awarded t the candidate btaining the highest cumulative scre. The fllwing frmula will be applied in calculating the financial scre: S = Fmin / F * 150 S Fmin F Winning candidate - scre received n financial evaluatin; - the lwest financial ffer ut f all the submitted ffers qualified ver the technical evaluatin rund; - financial ffer under cnsideratin The winning candidate will be the candidate, wh has accumulated the highest aggregated scre (technical scring + financial scring)
