HISTORIC PRESERVATION WORK PLAN FY 14 The program activities listed below are as mandated by the National Historic Preservation Act of 1996 and its promulgating regulations (36 CFR 800) as required and authorized by the National Park Service: Conduct an on-going comprehensive survey of historic properties in the Territory and maintain an inventory of such properties. Identify and nominate eligible properties to the National Register of Historic Places. Advise and assist Federal and Territorial agencies in carrying out their historic preservation responsibilities. Consult with appropriate Federal agencies on all undertakings that may affect historical properties in order to protect, manage, reduce or mitigate harm to such properties. Ensure that historic properties are taken into consideration at all levels of planning and development. Provide public information, education and training, and technical assistance in historic preservation. GOAL OBJECTIVES In addition to our ongoing mandated activities, the following are our more specific goals for calendar year 2010: Survey and Inventory Conduct an archaeological survey in Manu a to document prehistoric and historic archaeological sites. National Register of Historic Places Nominate at least two historic properties to the National Register of Historic Places based on the archaeological and architectural historic surveys. Rehabilitation Produce construction drawings for the restoration of the Michael J. Kirwan Educational Television Center (KZVK building). Ensure a professional assessment of the Sogelau Flag Pole site in Fagatogo is carried out for a rehabilitation of the same. Conduct assessments of historic sites in Manu a for possible rehabilitation work. Education Develop historic preservation education materials for American Samoa. Improve/update web page (ashpo.org) and access to historical information. Encourage academic research. Planning Solicit the views of the public for planning for the Historic Preservation Office. Develop our new five year plan for Seek funding for the rehabilitation of the Fagatogo Hydroelectric Plant. Develop local legislation to establish an American Samoa Historic Preservation Act to protect, preserve, and maintain American Samoa s historic properties. Outreach Educate community about historic preservation and economic development. Work with the American Samoa Visitor s Bureau to develop a plan for heritage tourism in the Territory. 4 Page 4 samoa news, Saturday, March 22, 2014 THE BOB FRANKEN COLUMN Scamming Overtime By Bob Franken If it wasn t before, it s certainly clear now why the nation s super-rich oligarchs work relentlessly to sabotage the Obama presidency. Take the new POTUS order to expand overtime pay and thwart a system that effectively cheats employees out of what they ve earned. It s just one example of how he and his administration are a threat to the few who have burrowed into our legal framework to get away with their shameless tactics to hoard the other people s money. Their overtime scam is particularly sleazy. What they have been allowed to do by lawmakers and regulators is declare low-level workers to be supervisors if they oversee fellow employees as just a tiny part of their job, while they actually spend nearly all their time performing the same tasks. By designating them salaried, the corporate masters are able to get around the long-standing requirement that working more than 40 hours a week results in time-and-a-half compensation. Right now, the Bush-era pay dividing line is $455 per week. This president has directed his Labor Department to increase that to an as-yet-undetermined amount, saying We re going to update those overtime rules to restore that basic principle that if you have to work more, you should be able to earn more. That would seem to be fairly straightforward, but not in today s setup. The 1 percenters have their hand puppets, mainly Republicans. And these are talking puppets. When their buttons are pressed, they react to any economic initiatives from the White House by reciting that they re job killing. Never mind that they offer little proof or that the various proposals are simple fairness -- they are job killing. In fact, there is ample evidence that spreading the wealth just a teeny bit would enhance growth, but it s ignored. We witness the same dance of distortion when it comes to the Obama campaign to increase the minimum wage beyond its subpittance level. What would that be? You guessed it: job killing. By that reasoning, the best way to save jobs is to pay the employees nothing. But let s not go down that road. Those who hold all the power -- meaning the very few who control the nation s financial resources -- will do whatever it takes to prevent any disruption of their complex schemes to protect their advantages and support the country s poisonous inequality. Their most effective tactic is to subvert our election system, not just by putting up impediments to open ballot access, but more by flooding the campaign with propaganda, much of it misleading, and deceive the voters into ousting anyone who wants reform and installing those who will won t make waves. So when a federal Consumer Protection Agency somehow slips through the cracks and becomes reality, their lobbyists fan out to dilute its power while the ones whose corrupt practices might be challenged beckon their political rag dolls to gum up the works, chanting job killing as they move in lock step. Banking regulations? Efforts to strengthen regulation of the most blatant abuses, the ones that caused our financial collapse? Wait for it... they re job killing. These obese cats will use whatever it takes to neutralize anything that threatens their privilege, and they ll work overtime to get their way. (AP Photo/Ocean County Prosecutors Office) Compiled by Samoa News staff USEPA-OIG TO CONDUCT OVERSIGHT WORK ON THE TERRITORIES The U.S. Environmental Protection Agency s investigative watchdog arm plans to begin research next week into the federal agency s oversight of American Samoa, Guam and the Commonwealth of the Northern Mariana Islands regarding support grants agreements. This was according to a Mar. 11 memo from USEPA s Office of Inspector General to Jared Blumenfeld, USEPA Regional Administration for the Region 9, which covers western states and the three U.S. Pacific territories. The memo says OIG plans to begin preliminary research into USEPA s assistance agreements with the three territories next week. The preliminary research objectives are to determine whether the USEPA: has controls and processes in place to ensure proper oversight of Guam, American Samoa and CNMI assistance agreements; and, is ensuring that the assistance agreements effectively and efficiently protect human health and the environment. Research will be conducted at the Region 9 s Pacific Islands Office and the USEPA s Office of Water and as well as in the Pacific Territories. The memo went on to say that at the end of the preliminary research phase, we will determine whether additional work is warranted and, if so, whether the objectives should be modified. OIG plans to hold the kickoff meeting by next Monday. No specific date is on the memo as to when the OIG will visit American Samoa and when the research work will be completed. VISITORS BUREAU TO ATTEND SAN DIEGO TRAVEL SHOW In its ongoing efforts to promote American Samoa as a tourist destination off-island, the American Samoa Visitors Bureau will participate in the San Diego Travel & Adventure Show set for Mar. 29 and 30, says ASVB executive director David Vaeafe. The consumer show at the San Diego Convention Center will feature over 150 destinations from around the US and the world, says Vaeafe in the ASVB s March enewsletter, which also says that over 10,000 consumers are expected to visit the show over the two days looking for summer holiday escapes. The San Diego travel show follows a travel trade event on Mar that ASVB also attended the Cruise Shipping Miami Convention in Florida as a member of the South Pacific Cruise Alliance show casing the Pacific and meeting cruise line executives. SPCA members are American Samoa, Samoa, French Polynesia, Cook Islands, Fiji, Tonga, New Caledonia and Pitcairn Island. FEMA ASSISTING AMERICAN SAMOA With the arrival of a new administration in American Samoa, the Federal Emergency Management Agency (FEMA) continued to work with the American Samoa Government and its new leadership to demonstrate improved grants implementation and monitoring, according to a FEMA report last month to the federal Interagency Group on Insular Areas (IGIA). Support continued to be provided to their efforts to improve communications infrastructure and to encourage the development of mass care/emergency assistance plans, it says and cited for example, that FEMA Region Office in Oakland supported the Grants Management Technical Assistance Program training provided to all ASG staff (last year), with emphasis on U.S. Department of Homeland Security and U.S. Justice Department grants. In addition to providing grant administration training, the workshop provided an opportunity for ASG staff to cross-train and to develop productive relationships to better implement the programs, it says. HAWAIIAN AIR RANKS HIGH IN ON- TIME PERFORMANCE FOR JANUARY Hawaiian Airlines start off the new year with the highest marks, leading the nation in on-time performance and fewest flight cancellations in January, based on the January 2014 Air Travel Consumer Report by the U.S. Department of Transportation. Hawaiian s flights arrived on schedule 92.8% of the time throughout January, according to the report, which also says the Honolulu-based carrier, was the top airline with the least flight cancellations at 0.0 percent, representing one cancellation out of 6,019 total flights for January. In addition, the airline had the second lowest rate of mishandled bags, with 2.41 reports for every 1,000 passengers served. By denying the bill the Senate approves the lease. A local statute states that lease of government property is subject to Fono approval. The original lease was for nine years, 11 months and 29 days, which should be completed by April 27, The new proposal is for an extension of 30 years, which will expire April 30, According to the governor s letter to Fono leaders, these premises are exclusively to establish a fast food business and subleasing for office space. ASG recognizes the importance of commerce in the development and improvement of the local economy, said Governor Lolo M. Moliga at the time the lease was proposed. The area of the lease is acres, and the rental, according to the lease, is $300, which would be paid on the first of each month. The lease states Te o cannot sublease the premises unless approved by the government, and failure to do so may constitute material breach of lease. REV KALEPO VAITAOTOLU NOMINATED TO THE FINANCIAL AID BOARD Another nominee was submitted to the Fono this week to sit on the American Samoa Student Financial Board and a resolution in this matter was introduced in the Senate this week. TUALAUTA REP SEEKS REPORTS FROM DPW Rep Larry Sanitoa requested through the house Public Work s Committee for DPW Director Faleosina Voigt to present to lawmakers reports for the ongoing and pending projects and the funding source, and the list of Road projects under Road Maintenance Fund and costs and road Maintenance Plan to address ongoing problems with the territory s drainage. Furthermore, Sanitoa requested an update on DPW s plan for the main road by the Industrial/Lyons Park. He said this road was to be used as an alternate route once the work started on the Airport Road. Furthermore, he sought to get hot mix to patch pot holes on roads like Fagaima, Industrial/ Lyons Park and many other most traveled roads throughout the Island. RESOLUTION INTRODUCED FOR DPW TO STUDY & CONSTRUCT ROADS IN WEST This week a resolution was introduced calling on the governor to direct the Director of Public Works to provide an assessment, prepare a feasibility study and immediately implement the construction of the roads, both public highways as well as village access roads, for the Leasina, Aitulagi and Tualatai Districts. It particularly further urges the director to work in conjunction with federal departments and agencies to provide relief for the poor road construction in these areas. According to the resolution throughout the years, the territory has suffered major infrastructure challenges, particularly the conditions of its highway and village access roads. The main roads leading to the low-lying areas of Malaeloa, continue to endure deplorable conditions, many times worse than those seen in other areas of the islands and the residents in the districts agree that during the distribution of funds for the development their roads are the forgotten paths, despite being an area frequently traveled by residents, who visit the village or use it as an alternate road to Leone village. Addressed also, is the lack of sidewalks along the road, leaving villagers to walk on the road a threat to their safety; yet Malaeloa s mountains receive the highest recorded rainfall per year, and it s one of the villages that often is affected by the rain runoff. The damage caused by the water flow from the runoff, including erosion of the road, is a serious concern to the residents. The conditions are so poor that many cars have had to create their own paths around the damaged roads. It s prudent for the DPW to given serious attention to the road conditions in the village of Malaeloa and it would be wise to prepare a study for a long term solution, as well as working together with federal counterparts to see that the needs of the district are met.

7 samoa news, Saturday, March 22, 2014 Page 7 NTSB: Helicopter rotated 360 degrees before crash SEATTLE (AP) Surveillance video shows that a Seattle news helicopter began rotating at takeoff before it pitched forward into a fiery crash that killed both men aboard and burned a third man on the ground, the National Transportation Safety Board said late Friday in a preliminary report. Video culled from three security camera recordings near the crash site shows the aircraft began rotating counterclockwise during takeoff Tuesday morning and rose slightly, nearly level, from a rooftop helipad, the agency said. The helicopter continued rotating counterclockwise for about 360 degrees before it pitched forward, nose low. It continued the counterclockwise rotation in a nose low attitude until it disappeared from the camera s field of view, the agency said in its one-page statement. Available video apparently did not show the actual crash on a street next to the Space Needle, where the KOMO- TV chopper burst into flames, setting several vehicles ablaze and spewing burning fuel down the street. Multiple witnesses reported seeing the helicopter lift off and begin a counterclockwise rotation, then pitch downward, still rotating, and crash. They indicated the fire began after the crash, the NTSB said. Witnesses earlier told reporters they heard unusual noises coming from the aircraft as it lifted off from the helipad atop KOMO s sixstory headquarters after refueling. The initial NTSB report did not discuss any noises. The helicopter came to rest on its right side and all major structural components were located in the immediate area of the main wreckage, the NTSB said. Wreckage debris was found in a 340-foot radius of the main wreckage. The initial report did not attempt to pinpoint a cause for the crash. A final report could take as long as a year, agency officials have said. Agency investigators moved the wreckage to a secure hangar in Auburn, south of Seattle, where they are reconstructing the helicopter. The wreck killed both men on board pilot Gary Pfitzner, 59, and former KOMO photographer Bill Strothman, 62. The two worked for Helicopters Inc., of Cahokia, Ill., which owned the Eurocopter AS350 aircraft. The agency continues combing through pilot and maintenance and company records associated with the flight, the NTSB s Dennis Hogenson said earlier. Investigators are focusing on the helicopter s engine, the airframe, the pilot and the environment. A Seattle man in a car, Richard Newman, 38, was seriously burned when the helicopter crashed and caught fire. Newman underwent surgery Friday and afterward was reported back in intensive care in serious condition, a Harborview Medical Center spokeswoman said. He suffered burns covering nearly 20 percent of his body, on his back and arms. The agency cautioned that the initial report was preliminary information and subject to change. But unlike cases in other states, U.S. District Judge Bernard Friedman did not suspend his decision while the Michigan attorney general pursues an appeal. At least three counties Washtenaw, Oakland and Muskegon said they would start issuing licenses Saturday unless a higher court intervenes. Other counties plan to follow suit on Monday. Friedman released his 31-page ruling exactly two weeks after a rare trial that mostly focused on the impact of samesex parenting on children. The challenge was brought by two Detroit-area nurses originally seeking to overturn Michigan s ban on joint adoptions by gay couples. The judge noted that supporters of same-sex marriage believe the Michigan ban was at least partly the result of animosity toward gays and lesbians. Many Michigan residents have religious convictions whose principles govern the conduct of their daily lives and inform their own viewpoints about marriage, Friedman said. Nonetheless, these views cannot strip other citizens of the guarantees of equal protection under the law. Seventeen states and the District of Columbia issue licenses for same-sex marriage. Since December, bans on gay marriage have been overturned in Texas, Utah, Oklahoma and Virginia, but appeals have put those cases on hold. Attorney General Bill Schuette, a Republican, asked a federal appeals court to freeze Friedman s decision and prevent same-sex couples from marrying while he appeals the case. The decision was filed in Detroit shortly after 5 p.m., when most county clerk offices were closed and couldn t issue licenses. We ll be ready to go first thing Monday morning. As he was standing there and looking out at the retreating water in the bay area, cars were speeding by and people were yelling at him to get away from there. I heard them but I was more fascinated by what was happening right before my eyes than to heed to their warnings. Then he saw the first wave making its way inland. It hit the Fagatogo village, ASCO Motors, Tool Shop, and all around that area, but he stayed on. I saw Pago Pago village being crushed by the wave and observed the water rushing back into the sea carrying cars, parts of houses and much debris. It was a sight I would never forget, Silva explains softly. Then another wave rolled his way and hit the canneries and the Marine Railway. That was when panic choked him back to reality and he jumped into his pickup truck and tried to drive uphill on an unpaved road that was nearby, but the wave was too quick for him. It swept his truck up with him inside and carried them up the hill. In his frightened state of mind, he began to kick hard on his truck s rolled up window. He saw that his car was on top of the roof of a house and there was a tall tree standing next to it. The water was starting its fast descent as he managed to break the window of his car and made a frantic jump for the branch of the tree. As he held tight with all his might, he watched the water heading back to sea and taking his truck with it. Silva heard people calling from further up the hill for him to come down the tree and join them. He later found out that they owned the house and tree that saved his life. When it was safe for him to come down from the tree, Silva thanked them and said he had to find his truck and return to Lauli i, as he was worried about his mom and family. He then had to negotiate his way through the rough debris that littered the main road and everywhere and was surprised when he found his truck. It was sitting on top of another car with its wheels in the air and an electric pole lay on top of it. Silva turned around and started walking toward Lauli i. But he was stopped by another young man from his village who begged him to help look for his younger sister and to try and pull his mom out of their car that was leaning against the rail on the seaside. They tried to pull the woman out but failed in their first attempt. At that time, many cannery workers were also on the road walking home. Silva said they appealed to them for help but did not find one kind hearted Samaritan among them. So they continued and finally succeeded. The Talavalu player claimed the woman was still alive at that time. A nurse that happened to be around that area and was leaving for the LBJ tried to resuscitate her but the woman did not survive. Silva walked all the way to Lauli i and was relieved to find that his mom and family were safe. He later learned that the little girl whose mom they tried to save was found dead in the water the day after. I thank God for saving my life and for His protection. I should have listened to my mom s advice that morning. I could have died, Silva sighs. Before the tsunami incident, Silver described another life threatening accident that could have cost him his life. He said he was almost crushed to death in a traffic accident that happened in Salelologa, Savai i. He explained that he was in a pickup truck with eight others as they drove to the wharf at Salelologa to see off a friend who was traveling to Apia on a Sunday morning. The accident occurred when they headed for home from the dock. This is Silva s account of what transpired. There was a six wheel truck that was parked in the middle of the road and our driver decided to go around it. But suddenly the truck came alive and swerved on our side and hit our pickup. Our car went flying in the air and flipped three times before it rested off the road in an upside down position. Those in the bed of the pickup were dumped everywhere, while the driver and I were trapped inside. I smelled gas that was gushing out of the gas tank and I urgently started kicking hard on the door at the passenger side of the pickup. It gradually gave way and I helped the driver out while some Salelologa villagers rushed in to help. Luckily, no one was smoking a cigarette that morning or we d have been toasted inside the car. Some passengers in the pickup truck, according to Silva received serious injuries while he and others escaped with only bruises and cuts on their bodies. Silva was at Salelologa to spend his summer school break with his mom s family when the traffic accident occurred. I was young at the time and it scared the hell out of me. Luckily I suffered only minor injuries, he recalls. In all my summer visits, my aunt, Fiufetoa i Vaipouli, who was the principal at the Mata Ae Vave High School in the village of Iva would enroll me at her school. She told me that she did not want to see me waste my time sitting around. That arrangement continued every summer I spent with her. (Samoa s educational institutions are open at the time when the territory s schools take their summer breaks.) Although I was born here (American Samoa), I was raised in Salelologa during most of my juvenile life and it was there also that I learned how to play rugby, Silva explains. He attended Faga itua High School in 2001 and graduated in He played soccer and volleyball there but did not take part in the Viking s football team. In 2011, Silva was selected for the Talavalu team, as he was one of the most outstanding players from the Moli Ole Ava. He played for American Samoa in Hawai i, Fiji (twice), and Samoa. He is now in Hong Kong with the Talavalu team. His dad, Norbert, from Portugal died in He is buried at his mom, Molia s family land in Salelologa, Savai i. It was his wish that he be laid to rest there, Silva says. His mom, Molia Nili arrived from Savai i this week to give him her support. According to Silva, who does not have a job at this time, his mom gave him some heartfelt advice. If you don t work, don t go to school, then use the talent well that God has given you to make something out of your life. Play hard, play good, and give it all you got. [photo: TG] Solofa appeal denied by Fili Sagapolutele Samoa News Correspondent The federal appeal s court in Washington D.C. has affirmed a lower court decision in the conviction and sentencing of former local Department of Education official Paul Solofa, who is currently serving his prison term at the Federal Detention Center in Honolulu. Solofa was convicted in early 2012 by a jury at the federal court in Washington D.C. of witness tempering and obstruction of justice. Early last year, Solofa appealed his conviction as well as the jail term of 35 months. The federal charges against Solofa stemmed from the time he was head of the DOE Finance Office several years ago. The defense had argued in appeal documents that the defendant during trial didn t get effective assistance from his trial attorney who failed to raise an entrapment defense and that the court erred by handing down a much longer jail term than is required by federal sentencing guidelines. The government disagreed with the appellate defense attorney s argument, saying the court didn t make any error in sentencing and that the trial defense attorney s performance was neither deficient nor prejudicial... because Solofa did not have a viable entrapment defense. Oral arguments were heard last December before Senior Circuit Judge David B. Sentelle and Circuit judges Thomas B. Griffith and Sri Srinivasan. After reviewing all briefs and hearing oral arguments, their decision which was released yesterday, states in part we affirm Solofa s conviction and sentence. Samoa News will report in Monday s edition on details of the decision issued by Griffith as well as reactions from the U.S. Justice Department and Solofa s attorney for the appeal phase. Prosecutors had accused Solofa of being the mastermind behind the Department of Education school bus spare parts kick-back scheme, but have remained silent on why Solofa was never charged with bribery, or whether he will ever be charged.
