Eric D. ampbell, who is in federal custody, was indicted in ay this year by a federal grand jury in Atlanta, charging him with three counts of wire fraud; two counts of aggravated identity theft and one count of conspiracy to commit money laundering. However, under a plea deal with prosecutors in October, ampbell pled guilty to one count of wire fraud, a crime punishable by a maximum of 20 years imprisonment and a fine of $250,000. ampbell was scheduled to be sentenced Jan. 6 next year, but his attorney, Nicole. aplan filed a motion on Nov. 30 for continuance, because the pre sentence interview by the federal probation office could not be conducted in time for the deadline, due to her obligations in other cases, and family illness. Accordingly, ampbell sought a one month continuance to give the probation office and counsel sufficient time to conduct the pre sentence interview and then complete their report, according to the defense motion. On Dec. 1, U.S. District ourt Judge Thomas W. Thrash Jr., granted the request in the interest of justice and set a new sentence date for Feb. 6, According to the plea agreement, part of the amount of money lost and attributed to the action of the defendant is at least $1 million but less than $2.5 million. Additionally, there were more than ten victims involved and the federal government intends to ensure that money owed all victims is part of the restitution. The indictment listed 23 projects where ampbell used forged and fraudulent bonds and power of attorney documents. Among the projects listed was the local federally funded $7.99 million project by Whitehorn onstruction for the Airport Road project. (all ANSWERs ON PAGE 14)

3 DHR Director: Time-keepers are key to an on time ASG payroll by Joyetter Feagaimaali i-luamanu Samoa News Reporter Human Resources Director Sonny Thompson is keen on eliminating the long standing practice of In-House time (omp Time) since the transfer of payroll services to HR three months ago. Thompson in a memo issued last week to all Departments and Agencies noted that the time-keepers are key to the success of capturing hours worked. According to the memo, since the transfer of Payroll Services, DHR has placed a priority and a significant investment on its human capital to include a thorough review of system components that have impeded the timely process and disbursement of employee payroll checks. We take this opportunity to extend our sincere appreciation for your continuous support and flexibility during this transition period, he said, and noted that there have been numerous communiqués related to FLSA (Fair Labor Standards Act) ompliance. The root of our predicament can be traced to the role of time-keepers, to ensure accurate invoices (time-cards) of Hours Worked are accurately transcribed on the Scantron Forms (Bubble Sheets) before submission for payment to Payroll Services. The memo was issued after the cabinet meeting where Governor Lolo atalasi oliga was hard on the issue of overtime. Thompson s memo pointed out the quick reference guide which HR believes will serve useful to time-keepers on growing trends that might delay the payment of employees (i.e. Unsigned Leave Slips, Inaccurate Hours Reported, Expired NTE Dates, Funding Expiration, etc). All of this factors into the delay in payment of payroll checks, he noted. We believe that if executed accordingly, we will effectively minimize or eliminate the need to include supplemental payroll runs altogether and cost-savings for government operations in the long run, said Thompson. During the cabinet meeting Lolo pointed out to the directors the need for their administration to seek ways to address wage related issues which ASG has been cited for by the US Department of Labor. He noted that ASG has already paid out more than a million dollars to ASG employees for overtime, and $1.1 million to its workers for back wages and other wage related issues. The governor also pointed out that the semi autonomous entities have better payroll systems and called on those directors to provide recommendations on how ASG can efficiently monitor and record time that employees work in order to eliminate labor violations. The HR Director, during his presentation at said cabinet meeting, noted that in July 2013 ASG paid out $916, to the Department of Public Safety, in August, 2014 $177, went out to the Department of Health, Treasury, and Port Administration, while in September 2014 a payment of $7, went out to the DOH. He said last month $17, was paid out to the Department of Education with the divisions of Transport and erate and the payout totaled up to $1,118, Thompson said management enforcement and time keepers are the key to our collective success and that they must report all hours worked to Payroll Division. Time keepers are also required to report all hours from invoice (Time-ard) to Scantron Form (Bubble Sheets) and they need to enforce the overtime policies through disciplinary actions, if necessary and must prohibit the practice of In-House T. Work not requested but suffered or permitted is work time. Violations may be subject to disciplinary action. Again, Any work required of the employee or permitted by an employer must be compensated. This includes: Wait Times; eal or Rest Periods; Time on Premises (engaged in work benefiting the organization). Thompson said that workday in general, means the period between the time on any particular workday at which such employee commences (his/her) principal activity or activities and the time on any particular workday at which he ceases such principal activity or activities. samoa news, Friday, December 5, 2014 Page 3 UN chief hoping for draft of a global climate deal UNITED NATIONS (AP) U.N. Secretary-General Ban i-moon said Thursday he will travel to the climate conference in Peru next week and is hopeful that delegates will draft an agreement to reduce greenhouse gas emissions blamed for global warming. Ban said he is encouraged by new targets for fossil fuel use announced recently by the United States and hina, the world s two biggest polluters, as well as the European Union and Germany. He said he is also encouraged by the recent launch of the Green limate Fund, a U.N. initiative set up to support developing nations grappling with rising seas, higher temperatures and extreme weather events. The U.N. is very close to the $10 billion target for the fund, he said. All these encouraging developments and demonstration of political will and commitment (are) very encouraging, and I do hope that we will be able to have a draft text of the agreement, Ban said. He called the Lima meeting crucial. Delegates from more than 190 countries are trying to produce a draft agreement that would be negotiated over the next year and adopted at a conference in Paris in December The two-week meeting in Peru s capital, Lima, ends Dec. 12. Divisions between rich and poor countries have slowed negotiations on a new climate pact over the years. But the breakthrough U.S.-hina emissions deal, announced last month by Presidents Barack Obama and Xi Jinping, injected new hope into the climate talks. No explanation has been given as to why the American chair of WPF had to leave prematurely. He gave journalists on a stake out outside the main meeting hall the slip by exiting through a back door a short while ago. His Government of Samoa-provided limousine left the sprawling Faleata onvention entre through a back-gate. We spoke to delegates, who confirmed Dr arnell s departure. They said all they were told was that the chair has an international flight to catch yesterday afternoon and he needed to leave at 3.30p.m. Since the meeting had not adjourned, it can be assumed that an acting chair was appointed in the absence of Dr arnell. It could not be established who was named the acting chair. The WPF met behind closed doors and the ommission Secretariat had already indicated that the media wouldn t be allowed in to cover its final session yesterday. Indications from delegates are that some of the Pacific members push for catch effort reductions in the high seas failed, although there could be some movement in the island states insistence for Distant Fishing Water Nations of hina, Japan, South orea and Taiwan to provide their catch data to ommission members including scientists. There seemed to be some progress too in the Pacific push to control bycatch of endangered species like sharks. The WPF was expected wrap up its five-day meeting in Apia yesterday afternoon. eanwhile, Fiji has become the 10th country member of the Pacific Forum Fishery Agency to sign up to the Tokelau Arrangement, an FFA-initiative aimed at managing the albacore tuna fishery. Head of Fiji s delegation at the WPF in Apia, Permanent Secretary of Fisheries, Inoke Wainiqolo said although the Arrangement is non-binding, Fiji is keen to support regional initiatives. His deputy Sanaila Naqali said annual catches of albacore tuna in Fiji s 200-mile exclusive economic zone has been on the decline in recent years, and the Fijian Government intends to control the number of fishing licenses it would issue. This he said has been on the decline in recent years, from a high of 120 licenses a couple of years ago to only 60 fishing licenses this year. DISAPPOINTENT ON JAPAN S SIPJA TUNA STANE The Parties to Nauru Agreement (PNA) and Tokelau s proposal on skipjack tuna was withdrawn from the Western and entral Pacific Fisheries ommission (WPF) as Japan refused to agree to the measure. The measure would have set a reference point, or agreed level of fishing for skipjack tuna, the most common tuna used primarily in canned tuna. PNA manages the world s largest healthy stock of skipjack tuna, providing 50% of the world s supply. On the floor of the WPF, PNA expressed disappointment while addressing the commission in a closing statement on their proposal, which had the approval of most members except Japan. It said despite understanding Japan s concern for the declines in its coastal fisheries, they would have greatly strengthened the WPF management of skipjack tuna and related fisheries if they had agreed to the proposal on skipjack tuna. 5 Governor pleased with the OU between Tokelau and Tri-arine OU in the works between ASG and Tokelau as well by Fili Sagapolutele Samoa News orrespondent Gov. Lolo atalasi oliga is pleased with Tokelau s decision to enter into a fishing agreement with Tri arine International and the governor is expected to mention the agreement when he meets in Apia with Ulu o Tokelau, uresa Nasau. Nasau and Tri arine signed on onday a emorandum of Understanding which will increase the economic benefits of the tuna fishery for Tokelau, as well as provide enhanced fishery monitoring and guaranteed long-term access to affiliated fishing vessels. As part of the OU, the Tokelau government will provide fishing access to longline vessels targeting both albacore and the tropical tuna, which will supply Tri arine s new tuna processing plant in American Samoa. (See Wednesday s edition for details.) Responding to Samoa News inquiries on the administration s reaction to the OU between Tokelau and Tri arine, the governor s executive assistant Iulogologo Joseph Pereira first pointed out that the visit last Friday to the territory by officials and representatives of the Pacific islands reflects collaboration between the two canneries Tri arine and Starist and the American Samoa Government to preserve the competitive advantage of our two major economic assets, the canneries. The thrust of this collaboration is to secure the assistance of the Independent Island microstates with regard to allowing the US fishing fleet, especially the locally based fishing vessels, to fish within their Exclusive Economic Zones, or EEZs, and to compel foreign fishing vessels fishing within their EEZ to off-load their catches at our two tuna canneries, he said. Thus the governor is pleased and appreciative of the decision by Tokelau to enter into the OU with Tri-arine to ensure that the above aspirations are achieved, Iulogologo pointed out. Lolo left yesterday for Apia to meet with Nasau to finalize a proposed OU between the governments of American Samoa and Tokelau, which was first discussed between the two leaders at a meeting in late October this year in Pago Pago. Iulogologo said this OU will be signed between the governor and Nasau, who is in Apia for the Western and entral Pacific Fisheries ommission meeting, which closed yesterday (Samoa time). The signing of this OU between the two leaders also supports the relationship established by the contents of the Tri-arine-Tokelau OU, Iulogologo said. One of the key areas for cooperation between the two countries is fisheries development to ensure that mutual benefits are created with sensitivity towards resource preservation. He also says that the fisheries development issue is important as the governor wants to make sure that all local boat owners benefit from any and all agreements. Asked if details of the ASG/ Tokelau OU will be made public, Iulogologo said that once the OU is officially signed the contents will be made available to the media. While in Apia, the governor will also meet with Samoa Prime inister Tuilaepa Sailele alielegaoi and Samoa s Head of State, Tui Atua Tupua Tamasese Efi, he added. In late October this year, Nasau and his four-member delegation were in the territory to discuss various issues beneficial to both sides. Following the meeting with the governor, Nasau told Samoa News that both sides agreed to further discuss issues of mutual agreement for American Samoa and Tokelau, under a proposed OU which needed to be finalized. (AP) Authorities are looking into whether a man accused of falsely posing as a U.S. Army ranger broke the law while out shopping in suburban Philadelphia. The iddletown Police Department and military investigators are looking into whether the man illegally profited by wearing military fatigues while shopping Friday at the Oxford Valley all in Bucks ounty, said iddletown Police hief Joseph Bartorilla. The man was questioned by Ryan Berk, an Army veteran who served in Afghanistan. Berk recorded the incident and the video has garnered more than 2 million views between two ou- Tube accounts. Berk was shopping with his girlfriend and her son when Berk noticed a few things off with the man s uniform. A patch was misplaced and his boots were untucked, said Berk, 26. That s when I initially had a suspicion. SIENTISTS TRAVEL TO ROSE ATOLL ARINE ONUENT ore turtles will be tagged and seabirds monitored at Rose Island as a team of scientists from the Dept. of arine and Wildlife Resources, the National Park of American Samoa, the National Oceanic and Atmospheric Administration, and the US Fish and Wildlife Service travel to the onument to conduct further studies of these animal species. The goal is to find out where turtles which hatch on Rose Island spend their time. Eight turtles were tagged with satellite monitoring devices last year and since then, one has been tracked to Fiji while two others have made their way to the Solomon Islands and islands near Papua New Guinea. DWR marine biologist ark cdonald explained earlier this year that after baby turtles hatch, they are not able to swim against the ocean currents to return to Rose Island, so they literally go wherever the waters take them, and they end up staying away for years. However, when those same turtles are ready to lay their own eggs, they always return to their birthplace. 7 samoa news, Friday, December 5, 2014 Page 7 US: ommunity policing key to leveland reform LEVELAND (AP) A commitment to community policing is one of the key reforms the U.S. Department of Justice expects from the leveland police after issuing a report that says officers too often use excessive force and violate people s civil rights. Assistant Attorney General Vanita Gupta said at a news conference Thursday led by Attorney General Eric Holder that accountability and community policing make the job of delivering police services easier and safer. The DOJ spent 18 months investigating use of force policies in leveland after a series of well-publicized incidents, including the killing of two unarmed civilians in a hail of police gunfire after a high-speed chase. The Justice Department s finding will result in city officials, community leaders and others devising a plan to reform the police department. That plan must be approved by a federal judge and will be overseen by an independent monitor. The report issued by the DOJ takes to task the entire department, from patrol officers to police brass. It criticizes officers for endangering the lives of citizens and fellow officers by unnecessarily firing their guns, hitting suspects in the head with their weapons and punching and using Tasers on people who are already handcuffed. This was the second time the Justice Department has conducted an investigation of excessive force by leveland police. In 2004, the DOJ left it up to leveland to fix its problems. We understand the progress we seek will not come overnight, Attorney General Eric Holder said at Thursday s news conference. Efforts at changing the department s culture by instituting community policing tactics were tried in the 1990s without much success. ayors in leveland have for decades struggled to rein in a police department that patrols neighborhoods where people often are distrustful. Police officers, in turn, often don t trust the people they re sworn to protect. ayor Frank Jackson was among those that urged the DOJ to come to leveland to investigate the department. The report references an interview with a former police commander who believes the culture within (the department) is antithetical to a community policing mentality and that officer training instills in officers an us-against-them mentality. One of the primary facets of community policing requires officers to leave their patrol cars and to engage residents instead of just answering radio calls and arresting them. The DOJ report detailed various instances of how police used force, lethal and otherwise, where investigators believed de-escalation such as a conversation would have been more effective. The department s investigators refer to an incident in which an officer punched a handcuffed 13-year-old boy who had kicked him and tried to escape from a patrol car. The supervisor, the report said, called the punches arguably the best response. hief alvin Williams stood to the side of Jackson during the news conference. He said the DOJ report would be difficult to share with his 1,500-member department but vowed to implement change. Justice Department findings on leveland police (AP) In a report Thursday, the U.S. Justice Department concluded leveland police officers too often violate people s civil rights because of inadequate training and a lack of supervision and accountability. Some of the findings: Officers fired guns at people who did not pose an immediate threat of death or serious bodily injury to officers or others. Officers used guns in a careless and dangerous manner, including hitting suspects in the head with their firearms and firing in ways that place innocent bystanders in danger. Officers used stun guns and pepper spray instead of trying to de-escalate situations. Officers punched suspects who have been handcuffed as punishment after a person struggled with an officer or did not comply with demands. Officers arrested and assaulted mentally ill people after family members called police for help. Officers reported receiving little supervision, guidance, and support, leaving them to determine for themselves how to perform their jobs. Supervisors endorse questionable and unlawful conduct. Investigations of officers use of force appear to be designed to justify officers actions. The department is often antagonistic toward the community it serves. The mistrial was declared after hief Louis ealoha unexpectedly testified about the criminal history of the relative accused of taking his mailbox last year. ealoha was the second witness on the first day of the trial against Gerard Puana, the uncle of ealoha s wife, atherine ealoha. The chief was under direct examination by Assistant U.S. Attorney Larry Tong, who was asking how Puana looked at the time of the mailbox theft and how he was able to identify Puana in blurry surveillance footage showing a man hoisting the mailbox into a car and driving away. How he looks in this video is how he looked when he was charged and convicted for breaking into his neighbor s house, ealoha responded. Puana s public defender, Alexander Silvert, stood up, slapped a palm on the defense table and objected. The jury was sent out of the courtroom, and Silvert asked for a mistrial. ealoha, an officer for more than 30 years, should have known better than to bring that up, completely destroying my client s credibility with evidence that should not be admitted, Silvert argued, adding that it wasn t a conviction, but rather a deferral of a guilty plea. Tong said ealoha s answer was unexpected. After a brief recess, U.S. District Judge Leslie obayashi returned to the bench, saying she had no choice but to grant a mistrial. ealoha s response was unsolicited, she said. obayashi set a new trial date for ay 27. Fong Lee, Fiscal Operation Specialist, and s. Linda Lau, Dietician, as well as had a meeting with the Department of Labor on the Senior ommunity Service Employment Program (SSEP) State Plan. The SSEP is a community service and work-based job training program for elders that is authorized by the Older Americans Act. The program provides training for low-income, unemployed seniors. SSEP participants gain work experience in a variety of community service activities at non-profit and public facilities, including schools, hospitals, day-care centers, and senior centers. The program provides over 40 million community service hours to public and nonprofit agencies, allowing them to enhance and provide needed services. Participants work an average of 20 hours a week, and are paid the highest of federal, state or local minimum wage. This training serves as a bridge to unsubsidized employment opportunities for participants. Participants must be at least 55, unemployed, and have a family income of no more than 125% of the federal poverty level. Enrollment priority is given to veterans and qualified spouses, then to individuals who are over 65, have a disability, have low literacy skills or limited English proficiency, reside in a rural area, are homeless or at risk of homelessness, have low employment prospects, or have failed to find employment after using services through the American Job enter system. They say Fenlason drove his truck off the road Sunday evening then went home to get his other pickup to haul out the stranded vehicle. He was on his way back when the second truck ended up off the road. He went home again and got his ATV to try to pull out the trucks. The crocodile grabbed 29-year-old Jacques van der Sandt in its jaws on Wednesday night and disappeared under the water at a golf course next to a staff residential area within the park boundaries, according to ruger National Park officials. Rangers killed the crocodile after a two-hour search following the attack, according to a park statement. It said the body of Van der Sandt, the son of a park employee, was recovered with tooth marks on the back and front but did not have any mutilation. Oubaas oetzer, a police officer, said the crocodile attacked van der Sandt while he was standing at waist height in the water and reaching below the surface to feel for golf balls on the bottom of the dam. One guy challenged the other to see who can retrieve the most golf balls, oetzer said. He described van der Sandt as a keen golfer who grew up in the park and had probably seen crocodiles in the dam in the past.

Simi s co-defendants, Falefatu Asi and Samuelu Wright, are each held on bail of $100,000 and each has been charged with first-degree robbery and stealing. During the hearing yesterday before Associate Justice John L Ward, everyone was asked to leave the court room and it s unclear if or when Ward will unseal the plea. The lead investigator in this case is Detective Sgt. Amituana i Filemoni. ourt filings say that Asi was the driver of the vehicle that picked up Simi and Wright following the alleged armed robbery. It s further alleged that Asi and Alatuna each received $100, while Wright held $120. This matter has been postponed to next month for the hearing on the suppression motion. The plea agreement terms are unclear at this time. AN ENTERS GUILT PLEA IN FIREAR ASE Jim apu will be sentenced next month after the High ourt accepted the plea agreement that was signed by the defendant. According to the plea agreement, the defendant is charged in a three count information of unlawful use of a weapon, a class D felony; possession of an unlicensed firearm, a class A misdemeanor and public peace disturbance. The plea deal says that the defendant will enter a guilty plea to possession of an unlicensed firearm and upon his guilty plea the government moved for the court to dismiss the more serious charge of unlawful use of a weapon, as well as the PPD charge. By defendant s plea of guilt he admits that on June 27, 2013 in Nu uuli the defendant had in his possession a 38 special handgun which he retrieved from a room in his home without having first obtained a license from the ommissioner of Public Safety. Defendant also admits that on the same date and time the defendant discharged the handgun. apu admits that his conduct on the day in question was without legal justification or excuse. During the plea hearing the defendant was told as per plea agreement that sentencing recommendations by counsel are not binding on the court, which has the sole responsibility for determining an appropriate sentence within the limits of the law. Defendant also understands and accepts that he will not be allowed to withdraw his plea of guilty should the court decree a different sentence than that recommended by counsel. (AP) A Florida man killed his wife and another woman Thursday, then headed to the church where his wife worked and fatally shot the pastor, authorities said. Police were searching for Andres Andy Avalos, 33. The anatee ounty sheriff s office said he killed James Tripp Battle, 31, at the Bayshore Baptist hurch. A witness to the shooting told deputies at the scene about the other two victims, said sheriff s spokesman Dave Bristow. We don t know exactly what transpired, Bristow said.
