[ata: AF] Buckle up & CRASHES 157 LOCAL HIGHWAYS Save a Life! 0 LOCAL HIGHWAYS to date to date Former ASPA oil supplier disputes owing ASG over $88 Mil. in taxes by Fili Sagapolutele, Samoa News Correspondent Absent a trade or business in the territory, the American Samoa Power Authority s former oil supplier has questioned how the government determined that the company owes over $88 million in taxes for years 2009 to ExxonMobil Asia Pacific PTE, an indirect subsidiary of U.S. based Exxon Mobil, raised this and other issues in a petition filed last month with the High Court after getting in October 2013 four Notices of Deficiencies for the years at issue from the ASG Treasury Department. Besides ASG, other defendants named in the suit are Treasury Department and ASG Treasurer Dr. Falema o Phil M. Pili and Gov. Lolo Matalasi Moliga. ASG claimed in the notices that the petitioner owes $88.6 million in income and corporate taxes for 2009 to The notices provide a break down of taxes allegedly owed for each year. However, the petitioner said it disputes the amounts cited in the notices and that Treasury s determination of these amounts is based on certain errors. Also disputed by the petitioner and considered errors is Treasury s determination of the company s total income, total deductions and taxable income for the years at issue. SUPPLY AGREEMENT The petitioner took over in December 2008 the supply of petroleum fuels for ASPA and the Petroleum Supply Agreement with ASPA was executed outside of the territory, said court documents, which also says that petitioner had no employees based in American Samoa during the years at issue. The supply agreement extended through Nov. 30, 2013 calls for the petitioner to supply and deliver petroleum to ASPA using medium range tankers (MRTs), which were required to meet certain requirements set by ASPA. During the tax years at issue, Standard Tankers, LLC a wholly owned subsidiary of Exxon Mobile charted the MRTs from an unrelated third party Vessel Owner, which operates and remains in control of the MRTs. During the years at issue, the petitioner made approximately one delivery per month to ASPA, said court documents and noted that between 2003 and 2009 about 20 different MRTs made deliveries to ASPA. Additionally, all deliveries were made to a discharge terminal owned by ASG and operated by entities unrelated to the petitioner. And as required by the supply agreement, on or before Nov. 30 of each year, ASPA and petitioner met in person to discuss performance as well as relevant market trends. According to the petitioner, all such meetings occurred outside of Am. Samoa. Furthermore, the petitioner provided to ASPA as a courtesy at no additional cost services such as advice related to product specification and forecasting. None of these services were provided in American Samoa as they were done via phone or , the petitioner said. And pursuant to the supply agreement, the price for each petroleum product delivered to ASPA was exclusive of any duties, fees, taxes, government levies and cost or payments at the discharge port was borne by ASPA, it says. 3 samoa news, Saturday, April 12, 2014 Page 3 by Fili Sagapolutele Samoa News Correspondent PRE FLAG DAY EVENTS KICKED OFF YESTERDAY This year s Flag Day celebration, marking the 114 years since American Samoa became part of the U.S. family, began yesterday at Veterans Memorial Stadium with the TMO/ Marist 7s Rugby tournament, which ends today. Tomorrow, Sunday, festivities switch to Utulei with the 3p.m annual Flag Day Church Service, which is to be held at the Gov. H. Rex Lee Auditorium. This event is coordinated by the Governor s Office. Events then shift to the Su igaula o le Atuvasa at Utulei Beach Park, from Monday to Wednesday, where the community and visitors will witness cultural performances and band performances. The Department of Youth and Women s Affairs (DYWA) and the Art Council host this part of the program. This year, performances over the 3 days hosted by the DYWA will run from 1p.m. to 4p.m.; while the Arts Council program takes over at 5:30p.m until the last group showcases their talents. For Monday s program, groups scheduled to perform in the DYWA time slot are Su e Luaao Band, Faleniu Dance Group and the Malo E Lelei Dancing Group, according to the official program. During the Art s Council time slot, special remarks will be delivered by Acting Gov. Lemanu Peleti Mauga, followed by four groups taking the stage. They are Poloa Methodist Youth, Tuvalu Association, Siona Le Mauga Paia Leone and Laulii CCCAS Youth. Also on Monday, the cruise ship Golden Princess, on its maiden voyage to the Port of Pago Pago, will arrive around 10a.m. with more than 3,000 passengers from Lahaina, Hawai i and depart 7p.m. for Apia. Part of next Wednesday s events includes the Fautasi race regatta, and the time for the race is expected to be announced soon. Also, at the Samoana High School Gym, there will be the international boxing tournament set to begin late afternoon. On Thursday, the Veterans Memorial Stadium in Tafuna is the venue for the official Flag Day ceremony, with this year s celebration dedicated to the private sector, for their contribution to the territory. The governor s chief of staff Fiu Johnny Saelua said on KVZK-TV the stadium gates are to open around 6a.m. for groups, organizations and schools to assembly on the field, with VIPs expected to start arriving around 8a.m. He also said food vouchers valued at $7 will be made available to the community (free of charge), who come to the stadium for the celebration, and the vouchers are only valid for purchase of food from stands located inside the stadium. STARKIST TO OPERATE TWO-DAYS NEXT WEEK StarKist Samoa will operate on Apr. 14 and 15, but production will shut-down starting Apr. 16 and work is scheduled to resume Apr. 21. The company is one of the two companies performing siva and pese in the April 17 Flag Day ceremony, says Michelle Faist, spokesperson for StarKist Inc. The other company performing is Bluesky Communications, while other businesses are welcome to participate in the Flag Day parade, but should register with the Office of Samoan Affairs, said Fiu Johnny Saelua, the governor s chief of staff. Asked for a reaction about StarKist being given the honor to perform this year, Faist told Samoa News via from the company s U.S. headquarters that, StarKist Samoa employees are honored and excited to be performing during the annual Flag Day celebration. StarKist Samoa employees are united by the motto, Think for all not one. Our employees have truly demonstrated this as they have worked hard to prepare for this special performance, she said. STARKIST SCREENS FOR PINK EYE As the largest private employer in the territory, Samoa News asked StarKist Inc., about the impact of the pink eye outbreak on the company s operations in American Samoa. The outbreak has already affected many employees in government and local businesses. StarKist spokesperson Michelle Faist said from the company s headquarters in Pittsburgh, At StarKist, the health and well-being of our employees is a priority, and we are committed to taking all necessary precautions during this epidemic. StarKist employees are screened each day to ensure they are healthy to work. In addition, we are hiring additional workers to temporarily replace employees who are directly or indirectly impacted, she said via . The pink eye outbreak has caused closure of all public schools on Tutuila for the rest of this week, as well as all Catholic schools. Public schools resume next Monday, while Catholic schools go on their spring-break (which coincides with their Holy Week celebrations) and will resume classes on Apr. 21. Several ASG departments are reporting that employees with pink eye have been told to stay home and this is a recommendation already made by the Department of Health. Some business owners say they are also telling employees with the pink eye to stay home until they are well enough to return to work. One restaurant owner says staff is being screened to ensure no one with pink eye is serving/preparing food. YOUTH EMPLOYMENT FUNDS APPROVED Acting Gov. Lemanu Peleti Mauga, who is also the lieutenant governor, signed into law on Apr. 8 the $200,000 supplemental appropriation for fiscal year 2013, allocating this money to help fund the ASG Summer Youth Employment Program. In signing the bill into law, Lemanu informed Fono leaders that every year the federal Workforce Investment Act (WIA) provides $500,000 to support this summer program, administered locally by the Department of Resources. This program provides our young people an opportunity to experience on a firsthand basis life in the workplaces of American Samoa, in both the public and private sector, Lemanu wrote, adding that the $200,000 will enable a 40% increase in program participation and for that we are grateful. 4 Page 4 samoa news, Saturday, April 12, 2014 THE BOB FRANKEN COLUMN America in Decline By Bob Franken Here s advice for any of those who might want to use the latest Fort Hood, Texas, shooting to make the case for more restrictions on guns: Don t bother. After all, the horror of Sandy Hook Elementary School -- where 26 people, including 20 children, were mowed down by a mentally ill man -- resulted in no meaningful action by lawmakers, so why would three more victims on a military base make any difference to politicians who are terrified of the National Rifle Association and its accomplices. Never mind the repugnant absurdity that those who were shot dead or wounded, by someone who was being treated for psychological problems, had served in combat zones and finally made it safely home. Even the realization that this occurred on a military base near the same arms shop where both assailants bought their weapons won t matter to our craven officeholders Yes, there will be handwringing. It s already going on. Again. And it s certainly justified. But the people who could make a difference are paralyzed by their fear of the NRA, which can whip millions of gun owners into a frenzy whenever it wants. What is so bizarre is how the very same people who demand patriotic fervor over American Exceptionalism refuse to heed the warning signs of how our nation is slipping. In New York Times columnist Nicholas Kristof s piece We re Not No. 1! We re Not No. 1!, he cites a new Social Progress Index that lists the United States as 16th in the world in overall livability, 70th in health and low in other specific rankings. Obviously, we are a nation in decline. Another newspaper column, this one in The Washington Post from Oxford professor emeritus Stein Ringen, reminds us that two millennia ago, Greek democracy faded into history after just 250 years. It was done in by growing economic inequity and, more importantly, by politicians who were afraid to correct the problems of that glorious nation. His obvious point is that the United States of America is sliding down that same slippery slope. There are so many issues that desperately need to be addressed. This was the second annual performance for this department, and the evening promised many literary journeys from Negro Spiritual Ensembles with roots in the Harlem Renaissance to a poem from Thomas Hardy sung by Mekelian Tia with the gentle beauty of an Elton John song. Also seen on stage were poetry readings, monologues and clever scenes from A Raisin in the Sun by L. Hansberry, done by Mrs. Ta amu s class, and The Mating Season of Flying Monkeys written by A. Wuehler and given the proper amount of sassy banter by students Lufilufi Peneueta and Talato And speaking of flying monkeys, there was a quick visit by a character from the Wizard of Oz, as Warren King sang from the famous movie, If I Only Had a Heart. The official Xinhua News Agency said Saturday that a crude oil pipeline run by the stateowned China National Petroleum Corp. had a leak that tainted the source water feeding a local water plant in the northwestern city of Lanzhou. Xinhua says the leak has affected 2.4 million. The city of Lanzhou says it has been monitoring levels of benzene in its water pipes to ensure public safety. But Shindo said he made the visit in his private capacity to pray for the Japanese soldiers who died in the battle of Iwo Jima, one of the most iconic battles of World War II. The yearlong 4,250 mile journey along the world s longest river will see the former British army captain pass through seven countries. After four months trekking through Rwanda, Tanzania and Uganda, Levison Wood is now in South Sudan, a country with little infrastructure that has been destabilized by four months of fighting between pro- and anti-government forces. The 31-year-old said it took three years to plan the walk from Rwanda to Egypt. I ve always had a passion for Africa since I was young. The river Nile has always interested me and I thought, what s the biggest expedition I could ever think of? And walking the Nile it was, he told The Associated Press. Though he faces many dangers on the walk from both man and beast, Wood noted that past explorers didn t have the luxury of a satellite phone or Google maps. We ve had some close calls with buffalo, elephants and very close call with a crocodile in Murchison Falls, a national park in Uganda, he said Thursday. The toughest challenge I m finding is to keep the momentum going and not get too dismayed when there are delays, On average Wood walks 20 miles a day, but he is seldom alone. His guide from Congo, who goes by the name Boston, has been a long-time companion. In South Sudan three AK-47 wielding soldiers from the commando battalion flank him as security. Another South Sudanese man on a bike ferries supplies. South Sudan has been a challenge to say the least, Wood said. And when I set off on Nov. 25 I obviously didn t predict a civil war kicking off mid-december. Further complicating matters is the camera crew following Wood to shoot a four-part documentary series for U.K. and U.S. audiences on Britain s Channel 4 and America s Animal Planet. Wood and his crew were arrested while filming near the only bridge that crosses the Nile in South Sudan. Weaving through the chaotic traffic in Juba, South Sudan s capital, Wood and his crew set a blistering pace. Their South Sudanese guide occasionally barks orders to stop filming near a national memorial or military installation. There are safety concerns for this leg of the trip. The Nile passes through Jonglei state, a region that has seen heavy fighting in recent months. As that s the front line, I ll have to make a decision when I get there whether I have to move away from the river, he said. Then, a well-known Juba curiosity strolls past: a lanky man who is totally naked. The team laughs. No comment, Wood says to his probing cameraman. While South Sudan appears to be the toughest part of his trip, it was in Uganda where tragedy struck. Experienced American adventure journalist Matt Power, who was walking with Wood, died from heat exhaustion March 10. Wood said the death forced him to reconsider his plans. We took a week off just to contemplate what happened and have a think about, Is this something we really want to be doing?, he said. After speaking with Power s wife and family, Wood, with their blessing, decided to continue. It is one of those things that really brings home the reality that this is not an easy thing to do. It s incredibly difficult and dangerous in parts and all I can do is be as prepared as I can be and hope the same doesn t happen to me, he said. 10 Page 10 samoa news, Saturday, April 12, 2014 UN climate report balances science and the politics BERLIN (AP) After racing against the clock in an allnight session, the U.N. s expert panel on climate change was putting the final touches Saturday on a scientific guide to help governments, industries and regular people take action to stop global warming from reaching dangerous levels. As always when the Intergovernmental Panel on Climate Change adopts one of its high-profile reports, the week-long talks in Berlin were slowed by wrangling between scientists and governments over which words, charts and tables to use in the roughly 30-page summary of a much bigger scientific report. The painstaking process is meant to clarify the complex world of climate science to non-scientists but it also reflects the brinksmanship that characterizes international talks on climate action so far unsuccessful in their goal to stop the rise of man-made carbon emissions blamed for global warming. Sometimes it s framed as if what the IPCC does is just the facts, ma am, and that of course is not accurate, said Steve Rayner, an Oxford scientist who has taken part in three of the IPCC s previous assessments, but not this one. It s not pure science and it s not just politics, but a blend of both, Rayner said. In Berlin, the politics showed through in a dispute over how to categorize countries in graphs showing the world s carbon emissions, which are currently growing the fastest in China and other developing countries. Like many scientific studies, the IPCC draft used a breakdown of emissions from low, lowermiddle, upper-middle and high income countries. Many developing countries objected and wanted the graphs to follow the example of U.N. climate talks and use just two categories developed and developing according to three participants who spoke to The Associated Press on condition of anonymity because the IPCC session was closed to the public. By contrast, U.S. delegates wanted the tables to be even more specific, showing which countries belonged to each income category, according to comments to a draft being edited line-byline in Berlin and obtained by The Associated Press. That reflects a nagging dispute in the U.N. talks, which are supposed to produce a global climate agreement next year. The U.S. and other industrialized nations want to scrap the binary rich-poor division, saying large emerging economies such as China, Brazil and India must adopt more stringent emissions cuts than poorer countries. The developing countries are worried it s a way for rich countries to shirk their own responsibilities to cut emissions. The deadlock over the graphs appeared to have ended early Saturday after 20 hours of backroom negotiations led by IPCC vice chairman Jean-Pascal van Ypersele, a Belgian. I offered some Belgian Easter chocolate eggs to the participants of the Contact group at midnight: they helped! van Ypersele wrote on Twitter early Saturday. Another snag: oil-rich Saudi Arabia objected to text saying emissions need to go down by percent by 2050 for the world to stay below 2 degrees C (3.6 F) of warming, participants told AP. One participant said the Saudis were concerned that putting down such a range was policy-prescriptive, even though it reflects what the science says. The final document, to be released Sunday, is expected to say that a global shift to renewable energy from fossil fuels like oil and coal are required to avoid potentially devastating sea level rise, flooding, droughts and other impacts of warming. The report on mitigating climate change was the third of the IPCC s 4-part assessment on climate change, its first since Swedish environmental economist Thomas Sterner, a lead author of one of the chapters in the report, said the IPCC process can be frustrating to scientists. There s a fight over every comma sign, he told AP. In a blog post from Berlin he said scientists addressing the meeting were told to Keep our statements short and concise, avoid jargon, do not lecture the delegates, do not become emotional. Chris Field, who co-chaired another IPCC session in Japan last month and sits on the panel s executive committee but did not have a direct role in the Berlin session, said one way to think about the process is that scientists have control of a two-way valve and can move findings into or out of the summary for policy-makers. The governments have a one-way valve and can only move things out of the document. The role of this one-way valve is important in thinking about why the findings of the IPCC always feel so measured and carefully couched, he said. Many of the government interventions are incredibly helpful in making the text clearer, he added. It is a pretty amazing process. But some of the interventions are not quite as time efficient. A new earthquake shakes Nicaragua; nation staying alert MANAGUA, Nicaragua (AP) A magnitude-6.6 earthquake shook Nicaragua on Friday afternoon, sending people running frightened into the streets less than 24 hours after a magnitude-6.1 quake rattled the Central American country. There were no immediate reports of new casualties or serious damage, but the U.S. Geological Survey said the quake was felt in El Salvador and neighboring Costa Rica. The new tremor, centered 34 miles (56 kilometers) south of the capital city of Managua, surprised people at restaurants and supermarkets, where the shelves swayed strongly, throwing many products to the ground. It also disrupted the water service in many towns around the capital, where people continued to feel aftershocks as the government deployed soldiers and police officers to oversee emergency response. Firefighters paid visits to villages south of Managua and reported seeing cracking in the walls of houses and other buildings. There are a lot of homes that will have to be demolished completely, said Rosario Murillo, government spokeswoman and Nicaragua s first lady. Earlier, the government raised the number of people injured in the Thursday evening quake from 23 to 200. It also said that a 23-year-old woman had died of an apparent heart attack after the quake. No deaths had been reported as a result of Friday s shake. Although the magnitude of Friday s earthquake was higher, it struck much deeper, making it less likely to cause damage. Hospitals began discharging patients with minor illnesses so they could have beds available in the event of injuries from an aftershock or new quake. President Daniel Ortega said that he raised the country s alert level to red, meaning government officials were evacuating everyone at risk of harm from aftershocks or new quake. The alert also meant schools and businesses closed in the capital and in the northwestern city of Leon. There was much less traffic in the streets. Despite the warnings, hundreds had gathered at the Metropolitan Cathedral of Managua for a religious act in preparation for Holy Week when the stronger earthquake hit. There are now more guards and other prison staff than there are prisoners in the Netherlands for the first time, according to data released by the Justice Ministry on Friday. Crime rates have fallen slightly in recent years, but aren t notably lower in the Netherlands than in neighboring countries, and many Dutch people think sentences for violent offenders are too light. In 2008, there were around 15,000 inmates, in a country of 17 million. As of March of this year, there were just 9,710 inmates remaining, compared with 9,914 guards. And the number of inmates included 650 Belgian criminals the Netherlands is housing as part of a temporary deal. In the U.S., the figure is more like one guard or staff member per five prisoners. The overall U.S. incarceration rate is more than 10 times higher. Justice Ministry spokesman Jochgem van Opstal said we re studying what the reason for the decline is. They paid an effective federal income tax rate of 20.4 percent and donated significantly less to charity than they did the year before. The 42-page document, which included the couple s Illinois state income tax return, shows the Obamas reported donating $59,251 to 32 charities, which helped lower their overall tax bill. The Obamas also redeemed a $295,000 short-term U.S. Treasury note they acquired in April 2012, selling off the security in January The proceeds were the same as the original price of the note, so the Obamas incurred neither a profit nor a loss on the sale. They also sold three other longterm Treasury notes worth $1.2 million and posted a capital loss of $112,515. The White House did not say why the Obamas sold the notes. For tax purposes, the Obamas reported only a $3,000 capital loss from the sales. Taxpayers are allowed to carry over capital losses to the next year if the loss is more than $3,000. Under the carry-over provision, taxpayers can list just $3,000 as their total capital loss for the year. The White House said the year-toyear difference in Obama s charitable giving was largely due to declining proceeds from sales of his children s book, Of The I Sing: A Letter to My Daughters. Obama in 2011 designated those proceeds to Fisher House. Proceeds have declined every year since. Excluding charitable contributions tied to book royalties, Obama gave away 10.5 percent of his adjusted gross income last year, up from 7.6 percent in 2012, the White House said. The Obamas Illinois income tax return showed them paying $23,328 in income taxes to their home state. Separately, Vice President Joe Biden and his wife, Jill, $96,378 in federal taxes last year on adjusted gross income of $407,009. They paid an effective federal income tax rate of 23.7 percent, according to the returns, which were filed jointly and also posted on the White House website on Friday. The Bidens paid $16,444 in taxes to their home state of Delaware. Jill Biden also paid $3,470 in income tax to Virginia from her work as a professor at Northern Virginia Community College. The Bidens donated $20,523 to seven charities last year, which was about onethird of the money the Obamas gave away. The bulk of the Bidens charitable donations, $15,300 in royalties from a children s book written by Jill Biden, was donated to the USO, a military service organization.
