USDOL s regional press office says OSHA began its inspection in May after a worker suffered a fatal fall at the construction site of Samoa Tuna Processors, where Paramount conducted work. Additionally, total proposed fines stand at $107,910 and the company has 15 business days from receipt of the citations and proposed penalties to comply, request an informal conference with OSHA s area director, or contest the findings before the independent Occupational Safety and Health Review Commission. OSHA s Honolulu Area Office director Galen Blanton said the fatal fall tragedy could have been prevented if workplace safety standards had been followed. This incident reinforces the critical importance of focusing on fall protection in the workplace. Fall-related incidents are a leading cause of occupational injuries and death. Employers have a responsibility to uphold and model these safety standards, he said in a news release. The complaint filed against Maeli Isumu Pitoitua followed after the woman s husband contacted police that an inmate had been seen at his residence in the early morning hours of June, Isumu, who s facing one count of escaping from confinement, made his initial appearance in District Court yesterday; he s represented by Assistant Public Defender Matthew Trick, while prosecuting this case is Assistant Attorney General Tiffany Oldfield. Margaret Mitchell WASHINGTON (AP) The United States is spewing 50 percent more methane a potent heat-trapping gas than the federal government estimates, a new comprehensive scientific study says. Much of it is coming from just three states: Texas, Oklahoma and Kansas. That means methane may be a bigger global warming issue than thought, scientists say. Methane is 21 times more potent at trapping heat than carbon dioxide, the most abundant global warming gas, although it doesn t stay in the air as long. Much of that extra methane, also called natural gas, seems to be coming from livestock, including manure, belches, and flatulence, as well as leaks from refining and drilling for oil and gas, the study says. It was published Monday in the Proceedings of the National Academy of Science. The study estimates that in 2008, the U.S. poured 49 million tons of methane into the air. That means U.S. methane emissions trapped about as much heat as all the carbon dioxide pollution coming from cars, trucks, and planes in the country in six months. That s more than the 32 million tons estimated by the U.S. Environmental Protection Administration or the nearly 29 million tons reckoned by the European Commission. Something is very much off in the inventories, said study co-author Anna Michalak, an Earth scientist at the Carnegie Institution for Science in Stanford, Calif. The total U.S. impact on the world s energy budget is different than we thought, and it s worse. EPA spokeswoman Alisha Johnson said her agency hasn t had time to go through the study yet, but hopes it will help refine our estimates going forward. While the world has a good handle on how much carbon dioxide is pumped into the air, scientists have been more baffled by methane emissions. They have had to use computer models to estimate how much methane is going into that air. This study, however, was based on nearly 13,000 measurements from airplane flights and tall towers, the most used in any such research. The information was collected in Scientists have yet to analyze their data from 2012, and that will capture more of any impact of the natural gas boom from hydraulic fracturing, Michalik said. Studies recently have shown conflicting results about how much methane escapes during fracking and other forms of fossil fuel drilling. Outside experts praised the study. Robert Howarth at Cornell University called it very compelling and quite important. This is the most comprehensive study yet. Michalak said because of the way they measured methane just looking for it in the air as opposed to tracking it from a source it is hard to say what is putting more methane into the air. But she said by looking at concentrations especially within Texas, Oklahoma and Kansas the scientists have a good idea: Cows, oil and gas. Nearly one-quarter of the U.S. methane emissions came from those three states. Texas is by far and away the No. 1 state for refineries that turn oil into gasoline. Texas and Oklahoma have been big oil and gas drilling states and Kansas is a big cow state. Cows seem to be spewing twice the methane that scientists previously thought, Michalak said. While burps and flatulence are part of the methane emission from cattle, University of California Santa Barbara professor Ira Leifer said a bigger factor is manure. If you shovel it into an artificial lagoon you are creating the perfect production for methane, but it cuts down on the smell and your neighbors complain less, he said. 3 samoa news, Tuesday, November 26, 2013 Page 3 ASPA ends 2013 with extra $$$, uses it to pay down line of credit by Fili Sagapolutele Samoa News Correspondent The American Samoa Power Authority collected just over $9 million more in revenues for fiscal year 2013 compared to what had been budgeted for the fiscal year which ended on Sept 30, 2013 and the additional revenue helped the authority pay a bit more on its Line of Credit to one of the local banks, says ASPA executive director Utu Abe Malae. ASPA FY 2013 budget stood at $ million, but its fourth quarter performance report states total year-to-date of actual operating and grants revenue period ending Sept. 30 was $ million, which consisted of operating revenues of $ million and $14.90 million in grant money. Asked what had helped ASPA boost revenues, Utu first confirmed there is $9.72 million resulting in savings through the Fuel Surcharge passed on to customers of about $600,000. Overall for FY 2013, ASPA collected $ million (or $125,177,173) in revenues while total expenditures came to $ million ($123,922,853), giving the authority a surplus of $1.25 million (or $1,254,320), and as noted, this money helped ASPA with an increase in its payment on their line of credit. PERFORMANCE REPORT The 4th quarter report states that of total revenue of $ million for the period ending Sept. 30, 2013 the Electric division collected $63.10 million (or 50%); Water with $10.26 million (or 8%); Wastewater $6.16 million (or 5%), Solid waste $3.22 million (or 3%), and Fuel division of $42.41 million (or 34%). Of the total expenditures, the report says, Electric division expenses were $61.52 million (or 50%); Water $10.74 million (9%); Wastewater $5.32 million (4%); Solid waste $4.32 million (3%) and Fuel division $41.99 million (34%). According to the report, total expenditures were $8.46 million or 7.3% over total budget projections for FY The report says in the period ending Sept. 30, some $10.64 million went to personnel; $78.48 million for materials and supplies; $205,053 for Travel; $9.23 million for Contractual Services; $10.31 million for Equipment and $15.04 million in All Others. (AP) Gun advocates asked the U.S. Supreme Court on Monday to overturn a lower court s ruling against state laws designed to buck federal gun rules. Earlier this year, the 9th U.S. Circuit Court of Appeals upheld a district judge s decision against the 2009 Montana Firearms Freedom Act. The law attempts to declare that federal firearms regulations don t apply to guns kept in the state where they were manufactured. Other pro-gun states have passed similar measures. The Justice Department has argued successfully that the courts already have decided Congress can use its power to regulate interstate commerce. Some gun-control advocates sided with the federal argument, saying firearm freedom acts would allow felons to obtain guns without background checks and make it harder to trace guns used in crimes. Gun advocates have long said only the Supreme Court can decide the case because it will have to limit the reach of Congress to regulate guns. The Supreme Court is expected to decide next year whether to accept the request. The advocates, led by the Montana Shooting Sports Association, have had legal support from the attorneys general from the pro-gun states of Montana, Utah, Alaska, Idaho, Michigan, Nebraska, South Carolina, South Dakota, West Virginia, and Wyoming. States that have formally passed a version of Firearms Freedom Act include Alaska, Arizona, Idaho, Kansas, Tennessee, South Dakota, Utah and Wyoming. MSSA president Gary Marbut has said he wants to manufacture a small, bolt-action youth-model rifle called the Montana Buckaroo for sale in Montana. The Bureau of Alcohol, Tobacco and Firearms told Marbut such a gun would be illegal under Montana law, prompting a lawsuit by the group against the U.S. attorney general. Marbut said high court decisions dating back to 1942 dealing with certain interstate commerce need to be reversed. The request to the Supreme Court argues the rulings have allowed more concentration of power with the federal government, creating problems like more national debt and the potential for abuses of power. Without the centralization of so much regulatory power in the federal government, tyranny would be a lot less likely to occur, the argument reads. 4 Page 4 samoa news, Tuesday, November 26, 2013 Six-year-old Ashe Fruean pokes at what was left of the backbone, tail, and fins of the 20-ft. sperm whale that washed up in the Faganeanea/Avau area last Wednesday and made its way to Laulii on Saturday morning. Villagers were awoken to the sight and smell of the decomposed whale that was later removed by employees of the Department of Marine and Wildlife Resources (DMWR). DMWR Director Dr. Ruth Matagi-Tofiga was at the scene and told Samoa News the whale was dragged five miles out to sea on Wednesday but nonetheless, if the current is strong, the remains will be brought back to shore, she said. The carcass will basically be taken wherever the waves and current take it. Laulii residents were ready to dig a hole on the beach to bury the remains but Matagi-Tofiga insisted that DMWR workers load the carcass on to a flatbed truck and escort it to the Futiga landfill for burial. She explained it is their duty is to dispose of any and all remains after taking the necessary samples - which they did on Wednesday when the whale was first discovered. She said whale bones and teeth are sought after and very valuable, with people using them to make jewelry and accessories. We can t have people taking off with the ivory and using them to make money, she said. That s why we are disposing of the remains properly. According to Matagi-Tofiga, passers-by reported seeing other parts of the same whale in the waters at the Tafuna Industrial Park area over the weekend. She said it is very hard for them to determine how the whale died, because when it was discovered, its body parts were not intact, meaning other sea mammals or fish might have attacked the whale and/or feasted on it. Samples taken from the whale have been sent to an off-island lab for testing to determine if the animal was sick, and how it died. Matagi-Tofiga said it is unusual for the sperm whale to make an appearance in local waters at this time of year, as this is the season humpback whales usually come here to give birth. This stranding was the second one of its kind in the territory this year. The first occurred in Afono this past March, involving a beaked whale. [photo: B. Chen] Police officer accused of a rape in patrol car SAN ANTONIO (AP) A San Antonio police officer is accused of handcuffing and raping a 19-year-old woman in a case decried by the police chief, who calls it unthinkable. Officer Jackie Len Neal, an 11-year member of the department, was placed on paid administrative leave as a sexual assault case against him is pending. I am outraged. This is a punch in the eye to the Police Department. According to an arrest affidavit, Neal asked the woman to step out of her vehicle about 2 a.m. Friday after tailing her for several blocks. The affidavit said Neal told the woman her vehicle had been reported stolen. The woman produced a sales slip, but Neal patted her down, ignoring a request for a woman to do that, according to the affidavit. Neal then allegedly placed the woman in handcuffs and raped her in the back of his car. Police say a GPS device in Neal s patrol car confirms he was parked on the street in question for about 18 minutes on Friday, according to the Express-News. The woman contacted police, who opened a case against Neal. He was arrested at about 2 a.m. Saturday. We won t tolerate it for a second, McManus said, according to San Antonio TV station KENS. And I think the swiftness of the investigation and the arrest is indicative of that. Neal was released from jail later Saturday morning. A listed phone number for Neal was disconnected, and court records listing an attorney were not immediately available. by Joyetter Feagaimaali i-luamanu, Samoa News Reporter SEX CASE DISMISSED AFTER ALLEGED VICTIM CHANGES STORY A step-father who was charged with sexual abuse first degree and third degree assault on allegations he sexually abused his 27-year-old step-daughter, was released from jail yesterday. Samoa News cannot name the defendant in this case in order to protect the identity of the alleged victim. Defendant s release followed a dismissal motion filed by the government, who was prosecuting the case. Assistant Attorney General Tiffany Oldfield told the court yesterday the alleged victim came into the AG s office wanting to recant her statement, saying that nothing happened and therefore they (government) could not proceed with this case, as without her testimony the government could not move forward. Assistant Public Defender Joel Shiver told the court the complaining witness had made a false allegation against her step-father out of spite. Chief Justice Michael Kruse granted the dismissal motion in this matter. KRUSE ORDERS JURY TRIAL IN CASE OF BAKER A baker who allegedly failed to deliver a wedding cake she was paid to bake was scheduled to have her pre-trial conference yesterday, however both parties asked for a continuance noting there are on-going plea negotiations. The baker, Sianini Foster of Pago Pago is charged with stealing, a class C felony. Chief Justice Michael Kruse however ordered the matter be set for jury trial, noting if there s a plea deal that s finalized have it filed with the court. According to the government s case, on Dec. 15, 2012 a woman filed a complaint with the police, where she told police that she had paid Foster $920 to make a wedding cake, but on the wedding day the family was told there was no cake and the defendant could not be reached.
