Last Thursday and Friday, at least ten or more students of Tafuna High had fights that saw a vice principal threatened by a student, a school counselor shoved, and general mayhem exploding as school officials intervened, trying to calm the incidents, but had to resort to calling police to the scene to seek control. Students were taken into custody. While the fights began on campus, they did eventually spill onto the streets outside the school on both days, where Rep. Galu Satele Jr., who had raised concerns about the incidents during last Friday s House session, witnessed them. According to Satele, the one on Thursday spilled out onto the streets, close to the fast food restaurant by the intersection, with students throwing rocks at each other and traffic being forced to a halt for about 45 minutes while waiting for police to arrive on the scene. The Friday fights were a continuation of Thursday s incident, according to school and government officials; and Satele witnessed students being chased on the road from inside the school campus. He told his colleagues that just hours after the House confirmed Dr. Jacinta Galeai as director of Education, he witnessed a big problem involving students of Tafuna High School, that same afternoon with a brawl around the road, just outside of the school campus. 2 Page 2 samoa news, Monday, August 29, 2011 (all ANSWERs on page 14) UH embarks upon online outreach program to teach Aquaculture By Jeff Hayner Samoa News Reporter An online Aquaculture ertificate program called ATOLL is in the works at this time through the University of Hawaii outreach college program, according to EphraimTemple, the Sea Grant program coordinator at the American Samoa ommunity ollege (AS) under the ommunity and Natural Resources (NR) Land Grant program. Temple also works for the University of Hawaii in the Sea Grant college program. This program will be open for high school students, as well as American Samoa ommunity ollege (AS) students and anyone in the community. Because it is through the outreach college, it is open enrollment and it is a one year certificate program, said Temple. Dr. Benny Ron who was here in February for the aquaponics workshop, will be here this coming November with his manager for the program, Dr. Barbara McLain from the University of Hawaii who is managing the online certificate program. They will be coming in November when there will be a public meeting with parents, their children and AS students and we would like teachers from the Department of Education (DOE) to come as well, to learn what this program is all about. Teachers could possibly use this for professional development and the students could use it for in getting ready to go to college. There will be more information out about the online Aquaculture ertificate program in the near future, he said. In October we are planning another aquaponics workshop and we are going to have a specialist come down from Hawaii who has expertise in doing worm aquaponics. Here at Land Grant at AS, we try to show as many different styles of farming as we can. There are some methods that are better for some than for others. What will be taught at this next workshop, is how to use worms in an aquaponic system to raise plants and fish, he concluded. ombining hydroponics and aquaculture, aquaponics builds on the sound principals of hydroponics and substitutes the use of manmade fertilizers with fish water that is rich in nitrates for the plants that are being grown. It is a balanced system where the fish and plants live in the same closed recirculating system symbiotically, with the fish providing nutrients for the plants and in turn, the plants purifying the water for the fish. For the farmer, this means less money spent on fertilizer while two products are produced in a relatively small area. Togiola Tulafono s reappointment of Soliai Tuipine Fuimaono for another term as the territory s chief election officer, to oversee local elections and head the Election Office, was introduced late last week in the Fono. In his Aug. 22 nomination letter, Togiola informed the Fono that Soliai has nearly two decades of experience as the chief election officer, having first been appointed and confirmed in He said that he has full confidence in Soliai. Prior to heading the Election Office, Soliai was a senator representing Ituau county from 1985 to He has served on various ASG boards, including as Vice hairman of the Development Bank. Between 1977 and 1984, he was the Director of the Laboratory Division at LBJ Medical enter and Director of the Red ross Blood Bank for the Territory. LAWMAKER SEEKS MORE INFO ON NEW ASG ENTITIES As the Fono continues with its joint budget hearings for fiscal year 2012 budget, Rep. Taotasi Archie Soliai said its appropriate for lawmakers to at least obtain additional information from the Executive Branch on at least two new ASG entities on the fiscal year 2012 budget book. Specifically, said Taotasi is the Shipyard Service Authority, whose budget for FY 2012 is $1.42 million but there is no information on how this entity is generating revenue because it s part of the Enterprise Fund which lists ASG entities that generate revenue. Taotasi, who was speaking to his colleagues during last Friday s House session, said it would also be appropriate to get a copy of the executive order creating the shipyard authority as well as the business plan for the shipyard authority. He said the executive order creating the Office of Information Technology, the new entity in FY 2012, should also be supplied by the executive branch as well as other pertinent information for this new office to help lawmakers understand. The FY 2012 budget for this office is $200,000 and it s part of the executive branch. NEW HOUSE OF REP. SERGEANT-AT-ARMS The House majority voted early last week to elect Vavao Lemusu as the new House Sergeant-At-Arms, because the previous officer, Seti Muasau retired from government service. Lemusu worked in the Fono for some 16 years and was assistant to Muasau in the last ten years. Besides the Sergeant-At-Arms, other elected posts for the House are the Speaker of the House, and hief House lerk. NEW OURT JUDGEMENT BILL INTRODUED An administration bill appropriating $321,757 to settle a High ourt judgment against the American Samoa Government for breach of contract by failing to pay for construction services provided by Pacific International Engineering, Ltd. (PIE) was introduced late last week in both the Senate and House. The judgment also includes court costs and post-judgment interest to begin to accrue at the statutory rate of 6 percent per year as of the entry date of the judgment, which was handed down last October. Gift ertificates make the perfect gift and are available at our Box Office! by Teri Hunkin Samoa News staff writer If a person s actions are a picture book of their creeds as Emerson once aptly wrote, then it is clear Dr. Wendy Switalski believes in helping people, and in particular the residents of the tiny U.S. territory of American Samoa. Dr. Switalski has been to the territory nine or ten times last count; three times this year alone. She s a Doctor of Audiology, in layman s terms a hearing specialist, and the sounds she most loves to hear are the voices of people who have been helped by her very able skills. Said Dr. Switalski on her most recent visit to the territory, I love it here the people have always been so welcoming and warm. And the care is really needed in this area. We see so many ear infections in the children, which cause hearing loss that puts kids at risk for speech, language and general learning delays... and most of it completely preventable. It was because of Dr. Switalski, and her efforts, that the Ear, Nose and Throat (ENT) clinic at LBJ has brand new, state of the art testing equipment, donated through a mainland company, Otometrics. According to their website, Otometrics is the world s leading manufacturer of hearing and balance instrumentation. Dr. Switalski first learned of American Samoa through a friend who sold audio testing equipment here several years ago. She also learned, through her friend, that early hearing tests for children were not being performed routinely, and many children suffered hearing loss and developmental delay because of it. The dire need for early hearing tests prompted Wendy s husband, Tom (who also heard the stories) to volunteer his wife to travel here and lend a hand, which not without irony put her in contact with Dr. Jean Asuega, who headed up the DOH Helping Hands program an office set up to give newborns and infants developmental support in their formative years. urrently, Dr. Asuega s primary focus is the Helping Babies Hear program, where she still works closely with Dr. Switalski and other audiology professionals who help fill in the gaps in territorial health care for infants and toddlers. While she has a busy private practice in Detroit, Michigan, Dr. Switalski came here the first time about four years ago with a colleague, Jill raig, an audiologist from Portland. The pair worked long hours on that first trip, and Dr. Switalski said they were simply blown away by the need for services. She spoke with high praise for Dr. Malaela Tuioletai, (Dr. Tui as he is known) and the staff of ENT clinic at LBJ, whom she called the real heroes in terms of the caseload they work with, their limited resources, and their positive spirits in spite of all. After that first visit which she called exhausting and exhilarating at the same time she went looking for other ways to support the ENT clinic. Through her husband, and with his help, she petitioned Otometrics, a major supplier of auditory testing equipment based in Illinois, for support. She wanted to make sure that Dr. Tui and the ENT staff at LBJ had what they needed to conduct efficient and professional hearing tests. Otometrics management heard her stories, acknowledged her concerns, and wanted to be part of the effort to advance hearing care in the territory. Through Dr. Switalski, and because of her commitment to caring for the children, Otometrics came through, and the company has donated a state of the art Audiometer to the ENT clinic at LBJ. Including shipping and installation, which was all provided free of charge, the donation was worth nearly $16,000. According to Dr. Switalski, one of the real advantages of this highly sophisticated piece of equipment, is that it allows the care givers to send records via computer directly to the electronic medical records omputerized Patient Record System (PRS), which eliminates the need for paperwork and allows tests to be performed quickly. Because tests are digitized, they can also be sent off-island easily for advice and consultation. As the head of the ENT clinic, Dr. Tui spoke of the donation by saying, This is state of the art equipment which is used all over the mainland U.S. It was donated and shipped without any cost to LBJ or the part Helping Hands program, and we are grateful to have it. He explained that ENT works closely with the Part program and together they provide early childhood screening and hearing intervention. He noted that The equipment is used for everyone, adults and children alike, and with our limited resources it s a real blessing for us here. He also commended the ENT technician, Maina Saelua, saying, We are fortunate to have Maina as our audiology technician as he is certified with training from Seattle, Washington. With the new equipment in the capable hands of Maina Saelua and the dedicated ENT staff at LBJ, residents can now be provided hearing services second to none. 5 On going ASPA budget saga continues, House reps want legal opinion hearing by Fili Sagapolutele Samoa News orrespondent The ongoing saga of the American Samoa Power Authority (ASPA) claiming the Fono has no oversight over its annual budget reached another milestone this time the House is calling a hearing to get a legal opinion before calling ASPA up again for an ASPA FY 2012 budget hearing. Rep. Puletuimalo D. Koko, chairman of the House ASPA ommittee, during Friday s House session, called for the hearing tomorrow. He made the call after several House members again voiced their disappointment and concerns over statements made by ASPA board chairman Asaua Fuimaono regarding the ASPA budget. Rep. Galumalemana Bill Satele, who first raised the ASPA budget issue, said he is very disappointed with ASPA and its claims. He said the House should request an official copy of the law on which ASPA has based its claim and if ASPA is lying, then all board members should be removed from office. He said that in all of the years he worked in the government this is the first time he has heard of this type of claim by a government entity and it does not sit well with him. Rep. Tautolo harlie said he joins other lawmakers in rejecting the ASPA claim, adding that such a statement about the Fono having no business when it comes to the ASPA budget which has been widely reported by the media does not sound good and it s insulting to the Fono. He requested that the Fono attorney be called before the House to provide an explanation about the law pertaining to ASPA s budget. He said the House should get a legal interpretation of the law as soon as possible and suggested taking ASPA to court to resolve this issue once and for all if ASPA still insists that the Fono has no business in their budget. Tautolo s call picks up one made at last week s ASPA budget hearing before the joint Fono budget hearings that ended quickly when Fuimaono made the claim that the FY 2011 numbers listed in their budget were incorrect, pointing to the one ASPA is using is the one passed by the ASPA board and not the one passed by the Fono. At the time, several senators and House representatives made the call to take the issue to the court for a final say, or at the least that the issue needed to be resolved before an ASPA budget hearing could continue. The issue is who has authority when it comes to ASPA s budget, the Fono or the ASPA board? said Tautolo, adding that if this issue is not resolved now, it will continue to reoccur in the future. Tautolo and other lawmakers agreed that the House should get a legal opinion before ASPA officials are called back to the joint Fono budget hearings for their FY 2012 budget review. The Fono has not yet scheduled a new hearing date for the ASPA budget. He also said that there is wide public concern, including from himself, about the ASPA rates, which are too high and not affordable for low-income families, the ones greatly affected by these rates. It s a serious issue for all of us, he said. Rep. Toeaina Faufano Autele suggested getting an official opinion from the Attorney General, adding that the Fono attorney s opinion on this matter is just that the opinion of the Fono attorney. House Vice Speaker Talia Fa afetai Iaulualo, who was acting speaker on Friday s session, agreed with his colleagues over their concerns with Fuimaono s statement, but added that the House Speaker Savali Talavou Ale has already written to the ASPA board chairman about this issue. Savali has informed Fuimaono that the Fono does and always had oversight on budgets for all government entities, including ASPA. Sanchez hairman American Samoa Shipyard Services Authority NEW YORK (AP) -- Stripped of hurricane rank, Tropical Storm Irene spent the last of its fury Sunday, leaving treacherous flooding and millions without power - but an unfazed New York and relief that it was nothing like the nightmare authorities feared. Slowly, the East oast surveyed the damage - up to $7 billion by one private estimate. The center of Irene crossed into anada late Sunday, but for many the danger had not passed. Rivers and creeks turned into raging torrents tumbling with limbs and parts of buildings in northern New England and upstate New York. Flooding was widespread in Vermont, and hundreds of people were told to leave the capital, Montpelier, which could get flooded twice: once by Irene and once by a utility trying to save an overwhelmed dam. Meanwhile, the nation s most populous region looked to a new week and the arduous process of getting back to normal. New York lifted its evacuation order for 370,000 people and said subway service, shut down for the first time by a natural disaster, will be partially restored Monday, though it warned riders to expect long lines and long waits. Philadelphia restarted its trains and buses. All in all, New York Mayor Michael Bloomberg said, we are in pretty good shape. At least 21 people died in the storm, most of them when trees crashed through roofs or onto cars. The main New York power company, onsolidated Edison, didn t have to go through with a plan to cut electricity to lower Manhattan to protect its equipment. Engineers had worried that salty seawater would damage the wiring. And two pillars of the neighborhood came through the storm just fine: The New York Stock Exchange said it would be open for business on Monday, and the Sept. 11 memorial at the World Trade enter site didn t lose a single tree. I voted for the $87 billion before I voted against it. From Mitt Romney this month to John Mcain in 2008 and John Kerry four years earlier, presidential candidates are caught telling the truth by accident in every campaign, blurting a phrase that is both factual but politically ill-advised. Those moments speak to the deeply contradictory nature of American politics. quite a while in a low key way, Black said. If that s the first mistake he s made so far, it s a pretty good batting average. Another GOP contender in 2012, Texas Gov. Rick Perry, has had his own moments of inadvertent truth-telling. The Supreme ourt said as much last year when it eased restrictions on campaign spending by corporations, saying businesses deserve the same freedom of speech individuals enjoy. But it was smart for Romney to say, given the nation s high unemployment and deep resentment of Wall Street? Probably not. Democrats, predictably, pounced. President Barack Obama said he disagreed with the notion that corporate tax breaks are good for ordinary Americans. It s possible that Romney s comment won t damage his campaign because Republican primary voters tend to view business interests more favorably than do Democrats. But because of his wealth and history at Bain apital, a private equity firm that created jobs in some places but made them disappear elsewhere through consolidation, the remark could reinforce the perception that Romney is disconnected from the concerns of working people. The gaffes that get traction tend to be the ones that fit a narrative that already exists about the candidate, said Marc Hetherington, a political science professor at Vanderbilt University who studies campaign rhetoric. Since corporations are very unpopular right now, it could really stick to someone like Romney who is so identified with the business community. Massachusetts Sen. Kerry, the 2004 Democratic nominee, learned a hard lesson about reinforcing an existing story line. He opposed money the war in Iraq and voted against the legislation when it came up for final consideration. But he had gone along with an earlier version. At one point, he told supporters: I actually did vote for the $87 billion before I voted against it. He was trying to explain that he wanted to ensure troops had the necessary equipment, but at the same time hoped to convey a message of opposition to the war. The result was the Republicans cast Kerry as a flip-flopper in contrast with President George W. Bush s image of strength and resolve. Bush narrowly won re-election that year. In the fall of 2007, Hillary Rodham linton found herself in an uncomfortable spot just as Obama was gaining traction in the Democratic primary in part by railing against special interests. Before a liberal audience and with Obama on stage nearby, linton launched a spirited defense of lobbyists - inadvertently burnishing her reputation as a protector of the status quo in Washington. A lot of these lobbyists, whether you like it or not, represent real Americans, she said. They represent nurses, they represent social workers, they represent corporations that employ a lot of people. It was true, but ill-timed and problematic, particularly in front of a progressive audience that already doubted linton s commitment to liberal issues. Mcain, the Republican presidential nominee in 2008, faced a similar situation that September after the collapse of the Lehman Brothers investment bank and at the outset of the global finance meltdown. The fundamentals of the economy are strong, Mcain said. He was trying to reassure a jittery nation that its workers, whom he called the backbone of the economy, were resilient and productive. Few probably would disagree with that explanation, but as the stock market tanked his sound bite sounded jarringly off base. It was a searing misstatement for the Arizona senator who had never seemed comfortable discussing the economy. harlie Black, a top adviser to the Mcain campaign at the time, attributes Mcain s loss more to the financial crisis than that comment. Black also doubted Romney would suffer from his comment, given his campaign performance thus far. The storm system knocked out power for 4 1/2 million people along the Eastern Seaboard. Power companies were picking through uprooted trees and reconnecting lines in the South and had restored electricity to hundreds of thousands of people by Sunday afternoon. Under its first hurricane warning in a quarter-century, New York took extraordinary precautions. There were sandbags on Wall Street, tarps over subway grates and plywood on storefront windows. The subway stopped rolling. Broadway and baseball were canceled. With the worst of the storm over, hurricane experts assessed the preparations and concluded that, far from hyping the danger, authorities had done the right thing by being cautious. Max Mayfield, former director of the National Hurricane enter, called it a textbook case. They knew they had to get people out early, he said. I think absolutely lives were saved. Mayfield credited government officials - but also the meteorologists. Days before the storm ever touched American land, forecast models showed it passing more or less across New York ity. I think the forecast itself was very good, and I think the preparations were also good, said Keith Seitter, director of the American Meteorological Society. If this exact same storm had happened without the preparations that everyone had taken, there would have been pretty severe consequences. In the storm s wake, hundreds of thousands of passengers still had to get where they were going. Airlines said about 9,000 flights were canceled. Officials said the three major New Yorkarea airports will resume most flights Monday morning. Philadelphia International Airport reopened Sunday afternoon, and flights resumed around Washington, which took a glancing blow from the storm. In the South, authorities still were not sure how much damage had been done. North arolina Gov. Beverly Perdue said some parts of her state were unreachable. TV footage showed downed trees, toppled utility poles and power lines and mangled awnings. Virginia Gov. Bob McDonnell had initially warned that Irene could be a catastrophic monster with record storm surges of up to 8 feet. But the mayor of Virginia Beach, Va., suggested on Twitter that the damage was not as bad as feared, as did the mayor of Ocean ity, Md. One of two nuclear reactors at alvert liffs, Md., automatically went offline because of high winds. onstellation Energy Nuclear Group said the plant was safe. In New York, some cabs were up to their wheel wells in water, and water rushed over a marina near the New York Mercantile Exchange, where gold and oil are traded. But the flooding was not extensive. Whether we dodged a bullet or you look at it and said, `God smiled on us, the bottom line is, I m happy to report, there do not appear to be any deaths attributable to the storm, Bloomberg said. New York officials could not pinpoint when transit service would be fully restored but warned that the Monday commute would be rough. The New York subway carries 5 million riders on an average weekday. The casinos of Atlantic ity, N.J., planned to reopen Monday at noon after state officials checked the integrity of the games, made sure the surveillance cameras work, and brought cash back into the cages under state supervision. All 11 casinos shut down for the storm, only the third time that has happened. In Philadelphia, the mayor lifted the city s first state of emergency since The storm was blamed for the collapses of seven buildings, but no one was hurt and everyone was accounted for. People kept their eyes on the rivers. The Schuylkill was expected to reach 15 feet. The 21 deaths attributed to the storm included six in North arolina, four in Virginia, four in Pennsylvania, two in New York, two in rough surf in Florida and one each in onnecticut, Maryland and New Jersey. In an early estimate, consulting firm Kinetic Analysis orp. figured total losses from the storm at $7 billion, with insured losses of $2 billion to $3 billion. The storm will take a bite out of Labor Day tourist business from the Outer Banks to the Jersey Shore to ape od. Irene was the first hurricane to make landfall in the continental United States since 2008, and came almost six years to the day after Katrina ravaged New Orleans on Aug. 29, As the East oast cleans up, it can t afford to get too comfortable. Off the coast of Africa is a batch of clouds that computer models say will probably threaten the East oast 10 days from now, Mayfield said. The hurricane center gave it a 40 percent chance of becoming a named storm over the next two days. Folks on the East oast are going to get very nervous again, Mayfield said.

15 Al-Qaida s No. 2 reported killed by U.S. in Pakistan WASHINGTON (AP) -- U.S. and Pakistani officials said Saturday that al-qaida s secondin-command, Atiyah Abd al-rahman, has been killed in Pakistan, delivering another big blow to a terrorist group that the U.S. believes to be on the verge of defeat. Al-Rahman was killed Monday in the lawless Pakistani tribal region of Waziristan, according to a senior administration official who insisted on anonymity to discuss intelligence issues. A Pakistani intelligence official said alrahman died in a U.S. missile strike in Machi Khel village in North Waziristan on Monday. Since Navy SEALs stormed Osama bin Laden s compound and killed him in May, the Obama administration has been unusually frank in its assessment that al-qaida is on the ropes, its leadership in disarray. Defense Secretary Leon Panetta said last month that al-qaida s defeat was within reach if the U.S. could mount a string of successful attacks. Now is the moment, following what happened with bin Laden, to put maximum pressure on them, Panetta said, because I do believe that if we continue this effort we can really cripple alqaida as a major threat. A Libyan national, al-rahman never had the worldwide name recognition of bin Laden or bin Laden s successor, Ayman al-zawahiri. But alrahman was regarded as an instrumental figure in the terrorist organization, trusted by bin Laden to oversee al-qaida s daily operations. When the SEALs raided bin Laden s compound, they found evidence of al-rahman s deep involvement in running al-qaida. Senior al-qaida figures have been killed before, only to be replaced. But the Obama administration s tenor reflects a cautious optimism that victory in the decade-long fight against al-qaida could be at hand. It does hold the prospect of a strategic defeat, if you will, a strategic dismantling, of al-qaida, incoming IA Director David Petraeus said in July. Since bin Laden s death, counterterrorism officials have hoped to capitalize on al-qaida s unsettled leadership. The more uncertain the structure, the harder it is for al-qaida to operate covertly and plan attacks. Al-Zawahiri is running the group but is considered a divisive figure who lacks the founder s charisma and ability to galvanize al-qaida s disparate franchises. The U.S. official would not say how alrahman was killed. The Pakistani official did not say how the country s main intelligence agency, the ISI, knew that al-rahman was dead. This official did not give his name in keeping with agency rules. Intelligence officials had said at the time that four people were killed in the attack. A IA drone strike was reported that day in Waziristan. Such strikes by unmanned aircraft are Washington s weapon of choice for killing terrorists in the mountainous, hard-to-reach area along the Pakistan-Afghanistan border. Al-Rahman has been thought to be dead before. Last year, there were reports that alrahman was killed in a drone strike; neither U.S. officials nor al-qaida ever confirmed them. The officials who confirmed the death Saturday said it represented the consensus opinion of the U.S. government. Born in Libya, al-rahman joined bin Laden as a teenager in Afghanistan to fight the Soviet Union. He once served as bin Laden s personal emissary to Iran. Al-Rahman was allowed to move freely in and out of Iran as part of that arrangement and has been operating out of Waziristan for some time, officials have said. samoa news, Monday, August 29, 2011 Page 15 Puerto Rico senator resigns in photograph controversy SAN JUAN, Puerto Rico (AP) -- A Puerto Rico lawmaker has resigned following reports that explicit photos of him surfaced on an iphone application for gays and bisexuals, the head of the U.S. territory s Senate announced Sunday. Sen. Roberto Arango, a Republican who represents the capital of San Juan for the island s governing party, presented his letter of resignation after a weekend meeting, Senate President Thomas Rivera Schatz said. Schatz did not release the lawmaker s letter, but said the circumstances that led to the resignation are very lamentable. Local media published photos from the application showing a man s nude upper body with a cell phone obscuring his face. Another photo showed a rear view of a nude man on his hands and knees. Another showed a fuzzy image of a face that seemed to match Arango s. Arango has neither confirmed nor denied suggestions by local media that the photos might be of him and apparently was not asked if he had posted them. During a recent interview with WAPA TV in Puerto Rico, the senator said he has taken pictures of himself with a cell phone to document his recent weight loss. I really don t remember having taken those pictures of myself, but it doesn t mean I didn t take them, he told the station. I really don t remember. Arango did not return calls Sunday. A graduate of Louisiana State University and a food importer before turning to politics, he was chairman of a business council for the national Republican Party and municipal director of the Republican Party in Puerto Rico, according to his Web page for Puerto Rico s Senate. Pedro Julio Serrano, founder of the gay rights group Puerto Rico for Everyone, said Arango voted in favor of Resolution 99, a proposal that would block any attempt to permit same-sex marriages in the U.S. territory. He also helped block a measure to ban sexual discrimination in the workplace and opposed adoption rights for gays. This isn t a moment to kick someone when he s down, but I have to denounce Sen. Roberto Arango s complicity with a fundamentalist agenda that promotes the exclusion and marginalization of lesbian, gay, bisexual and transgender people, Serrano said. Local news media said that the pictures first appeared on an iphone application for gays and bisexuals and that they themselves later received copies from unidentified sources. In recent days, Puerto Rican Gov. Luis Fortuno had said that if the man was indeed a legislator, he should resign. That echoed the sentiments of other lawmakers, including local House Speaker Jenniffer Gonzalez. Vaifale, who has been in custody since December after his arrest and unable to post bail, was initially charged with sodomy, deviate sexual assault, sexual abuse in the first degree and endangering the welfare of a child the only misdemeanor charge. Earlier this year both sides told the court they were unable to reach a resolution and Vaifale s trial was then set for Aug. 22nd, this year. But under a plea agreement presented and accepted by the court this week, the defendant pled guilty to sodomy while the remaining charges were dismissed. Vaifale will be sentenced Sept. 23. According to the criminal complaint, the parents of the 8-year old victim, on Jan. 3, reported to police that the defendant sexually assaulted their daughter on the evening of Dec. 30, It also says that Vaifale later apologized to the family of the victim. During a pre trial conference hearing last week, the defense moved to dismiss charges against Silulu on the basis that the government has failed to provide a police report but the prosecutor argued that the police investigator for this case was off-island and will provide the report upon returning to the territory. The case against Silulu stems from a police controlled buy of illegal drugs in which a police confidential informant was used to purchase illegal drugs from the defendant, who remains in custody unable to post bail.
