In particular, the Futiga Landfill is expected to reach critical capacity by 2015, and according to the American Samoa Strategic Energy Plan (ASSEP), a waste-to-energy solution could mitigate the imminent crisis. Samoa News has obtained a copy of the ASSEP, which will be forwarded to Governor Lolo. oliga for approval before the American Samoa Power Authority (ASPA) and the Territorial Energy office (TEO) carry out implementation. According to the ASSEP, the plan puts American Samoa at the forefront of progress, innovation, and change in the field of energy, while also making the most out of its own natural resources The Futiga landfill is the only one on island, and the American Samoa Renewable Energy ommittee (ASRE) has determined that the Strategic Energy Plan should be deployed to preemptively address the crisis and assist the government in finding a solution. The Futiga Landfill accumulates approximately 70 tons of solid waste landfill daily. The ASSEP notes, there are several technologies existing today that can assist with this problem. A waste to energy plant, that also embraces recycling, needs to be at the forefront of this very serious problem. The Strategic Plan strongly encourages an approach that recognizes the environmental impact of hazardous refuse reduction methods. Senators: law may conflict with right to discipline children by Fili Sagapolutele Samoa News orrespondent Senators in a hearing on an administration bill on hild Abuse raised concerns about the need for parents to discipline their children to set them straight and the use of the current statute by children to defy their parents versus the need of to protect children. oncerns voiced by the High ourt regarding the language in the current hild Abuse statute are being addressed by an administration bill introduced late last month in the Fono that criminalizes certain behavior and expands the definition of child abuse. The bill also criminalizes the act of child neglect and amends numerous sections of current law to reflect changes in the ASG agencies assigned responsibility for dealing with these issues. urrent law has the Department of Health named as the responsible agency, but the new bill gives that responsibility to the Department of Human and Social Services. The new administration bill further criminalizes and expands the definition of the child abuse statute as well as criminalizing the act of child neglect. The Lolo administration s bill was the subject of a Senate Judiciary ommittee hearing last week Thursday, where Fono legal counsel Nathaniel Savali told senators this measure was a joint effort some two years ago between the Fono legal counsel and attorneys with the Attorney General s Office following a court decision which ruled that current law is unconstitutional and the law needed to be amended. He says input was also sought from the court for this final version. Sen. agalei Logovi i said he supported the measure as presented to the Senate, but at the same time, he doesn t want the proposal to conflict with the rights of a parent to discipline a child. Normal parental discipline cited in provision of current law ASA means all actions by parents, such as administration of blows by hand, strap, or light switch upon buttocks or any firm handling, scolding or light taps, insufficient to seriously bruise or produce medical injury or disability. Savali told senators that proper discipline of a child is also allowed under provision of the law called light lashing. Several senators pointed out that disciplining a Samoan child has always been part of the culture, but current law has turned such discipline into abuse of a child. Senators also noted that the law is protecting youngsters with some of them talking back to their parents and disobeying parent s wishes. However, they were also supportive of the proposed amendment with the goal to protect children. Sen. Faletagoai I. Tuiolemotu said he wanted to see some statistics or cases where child abuse and child neglect are on the rise simply because of parent s efforts to discipline their children. He says such statistics are important for the Senate to review in order to further understand where this issue stands. He also pointed out that some youngsters are using current law to disobey their parents, adding that there are many problems in the community, such as break-ins and other crimes involving juveniles. This statement was echoed by Sen. Nua Saoluaga, who was outspoken and passionate about the need for parents to discipline their children to set them straight. Nua referred to the discipline in Samoan as sasa ( English translation for sasa is spanking). He said parents are trying to discipline their children, but the law is (ontinued on page 14)

When the famous Hollywood sign was constructed in 1923, it read Hollywoodland. It was an advertisement for a new housing development and was expected to be in place only about a year and a half. The sign became such a recognizable symbol of the new film industry in Los Angeles that it has been refurbished and rebuilt as necessary for 90 years. In January of 2004, the Food and Drug Administration approved the use of maggots as a medical device for cleaning wounds. If you re planning a trip to Laramie, Wyo., you might want to make a pilgrimage to the Ames Pyramid. At the end of a 2-mile dirt road, in the middle of featureless pastureland, you ll find this 60-foot-tall monument seemingly plunked down at random. The pyramid was built in 1882 near a line of the Union Pacific railroad and in honor of the railroad s financiers. It was thought that the monument would be a welcome distraction to railroad passengers traveling through the plains of Wyoming. The decline of railroad travel, however, caused many tracks to be removed, including the line that ran by the pyramid. Now only cows are left to admire this relic of the industrial age. I know, because I turned down the first offer often enough and held out for the 50 cents. arilyn onroe Higher DPW budget shows decrease in road maintenance Employee numbers are also slightly down by Joyetter Feagaimaali i-luamanu, Samoa News Reporter Salaries for Public Works employees and funds to maintain the main roads were among the issues discussed during the budget hearing for Department of Public Works before lawmakers last week. Wednesday. According to their submission, the total DPW budget for F2014 is around $500,000 less, although the number of employees has decreased, slightly. The DPW F 2014 budget is $5,172,500 while the F2013 was $4,611,000. In F2013, there were 248 employees, but for F2014 there are 242 employees. One of the issues raised during the hearing involved the $300,000 allocated for two backhoe machines to assist maintenance of the main road, a point with which Senator Leatualevao Asifoa did not agree. He noted there s too much money allocated for the machines which no doubt are useful however he said this money could be used to cover the potholes on the roads. He also noted the backhoes cannot be used as a tool to cover the potholes. Tualauta faipule Florence Vaili Saulo asked Director Faleosina Voight why Public Works is allocating money for maintaining the roads yet the roads are still in bad condition, and are very critical in some areas. According to the budget book for DPW, there s $590,500 for road maintenance which has been decreased from the F2013 amount of $600,000. Vice Speaker I aulualo Talia Faafeatai noted that another ongoing predicament is that not only the government but also individuals have reached into their own pockets to pay for loads of dirt to cover the potholes, yet during rainy days, all that covering is removed by the rain. The DPW Director, in her reply, said DPW is looking at outsourcing maintenance, given that this is one of major costs for her department. Senator Nuanuaolefeagaiga S. Nua asked Faleosina to conduct a visit with the anu a roads in Ta u ma Fitiuta, given that some parts are damaged and in need of repair. The Director responded that DPW understands the road problems yet they cannot do anything, given the shortage of funds to fix the roads. She then asked the Senators to increase DPW s budget with an additional $3million for Tutuila Island and $2million for anu a for repairs & maintenance of roads alone. For DPW salaries, Rep Larry Sanitoa noted salaries for contract employees with DPW working in anu a are high yet longtime employees in anu a are still getting the same low salaries. He pointed out that for the additional employees with the DPW office in anu a the salaries range from $32,000 to $40,000 for contract workers yet employees who have been with DPW for more than 20 years are making $20,000, while maintenance crews are only making $9,000 annually. He urged Faleosina to seriously consider those who are working at hard labor and yet making minimal salary, and that DPW should consider raising the salaries for these employees, given their long and dedicated service to the government. Rep augaoali i Leapai Sipa Anoa i also noted that the DPW inspectors should also get raises in their salaries given the many responsibilities of that position. Faleosina replied that this is one of the governor s goals to hike salaries of government employees. (ANSWERs on page 14)

They led the students in an experiment in geology of the rocks and stones of Ofu and Olosega, and finished up demonstrating the new 4-rotor helicopter that they are using to map the reef. Students from Stanford s Aeronautics Department are producing the world s best coral reef map using the copter s cameras. They flew the little copter at the school and had it snap a photo of the students. The researchers are working with the American Samoa Department of arine and Wildlife Resources and the US National Park of American Samoa to understand how some Samoan corals are so tough in the face of climate change. Fetu Fetui Jr. calls for salary increase for Sec. of Samoan Affairs Learns directors get phone allowances by Fili Sagapolutele, Samoa News orrespondent abinet directors are given phone allowances as part of their contract, along with their salaries, according to Budget and Planning Office director atherine Aigamaua-Saelua during yesterday s joint budget hearings, where some lawmakers suggested a pay hike for the Secretary of Samoan Affairs, Satele Galu Satele, Sr. Satele, who oversees the Office of Samoan Affairs, was first up at yesterday s budget hearing for his office, whose official name is the Department of Local Government. Senate President Gaoteote Tofau Palaie said Satele s salary is only $60,000 annually compared to other directors whose departments have gone through budget hearings, who are making $65,000 to $70,000. Gaoteote asked Aigamaua-Saelua if there are any other benefits, bonuses, or special allowances given to cabinet directors, because none are cited in any of the budget documents. Aigamaua-Saelua, who is present during all budget hearings, revealed that all directors, in addition to their annual salary, are given phone allowances as part of their contract. She says the phone allowance is included in the All Others budget item but she didn t have the exact amount for phone allowances. The director s response was followed by a call by Rep. Fetu Fetui Jr. to increase the Secretary of Samoan Affairs salary by $5,000 a year and this was supported by Sen. Tuiasina S. Esera, who suggested a $70,000 annual pay. Tuiasina says Satale s pay scale is only $5,000 more than the annual salaries of the three district governors each making $55,000 a year. Sen. auga T. Asuega requested a government review for the Secretary of Samoan Affairs post, saying this was the same salary he received during his tenure as Secretary of Samoan Affairs a couple of years ago. Samoa News should point out that Office of Samoan Affairs budget shows the annual salary for the deputy secretary is $55,000. Additionally, cabinet directors are gubernatorial appointees whose salaries are set by the sitting governor. Department of Local Government s total F 2014 budget stands at $2.17 million, with 125 workers compared to F 2013 budget of $2.01 million with the same number of employees. During the hearing, Rep. Florence V. Saulo requested Satele to look at adding more village mayors for Tualauta county, the most populous county in the territory, especially in the Tafuna area with many business establishments. Another issue raised was the Small Village Fund and Satele said this fund is currently administered by the Governor s Office, which takes all requests for projects to be funded with this money. The fund is listed under the Special Programs budget category and in F 2014 $150,000 has been allocated for the fund. Justification of this allocation cited in the budget document states that at times, villages will need financial assistance for the purchase of materials to address village activities dealing with local water distribution systems, walkways, streams and rock walls. 4 Page 4 samoa news, Tuesday, September 10, 2013 VA transferred to Governor s Office by Joyetter Feagaimaali i-luamanu, Samoa News Reporter The office of Veterans Affairs has been transferred under the governor s office as of September 1, This was revealed in a letter sent to the Director of the VA Office, Taua a Sam Vaouli, on the use of the VA building at the Tafuna Industrial Park, sent out from Governor Lolo atalasi oliga. According to the letter, the VA building was constructed to accommodate the needs of the Veterans of all branches and was not intended to address the needs determined by one association or a group of Veterans. Furthermore, the structure was to handle the activities and to render services to all the Veterans. This Facility is government owned and its use is therefore determined by the American Samoa Government. This building was not built to be leased to an association but constructed so that the government can provide the kinds of services demanded by the Veterans, said the Governor. The letter also stated that the government is covering all of the operating costs for the VA building. POLI DELARATION The administration and management of the VA complex is under the purview of the governor s office and it alone will determine the use of the facility and activities permitted for its utilization. These activities must be for the benefit of the Veterans and any proceeds resulting from these activities will be utilized to supplement funding for the operation of this Facility. PERITTED ATIVITIES Activities hosted and accommodated in the VA facility must directly benefit the Veterans. eetings of different veteran associations and organizations are considered legitimate use, however meeting dates and times must be registered and approved by anagement to avoid schedule conflicts. One of the intended uses of the facility is to provide a venue to house recruiters when they visit American Samoa for convenience and accessibility. Activities which involve serving food and drinks, including alcohol, must comply with the internal procedures established by the Facility anagement in consultation with all veterans. According to the letter, only the governor or acting governor possess the sole authority to waive any part of this policy or internal procedures once they have been approved and adopted. Also, the Director for the VA office is empowered to enforce this policy and all addenda offshoot procedures approved by the governor on use of the VA facility. Deviation from strict enforcement of this policy will result in personnel disciplinary action which may include termination, stated the letter. Our Angel Rings are for saving lives not toys Once again Utulei angel ring goes missing by B. hen, Samoa News orrespondent Angel Rings or flotation devices strategically placed around the territory s most frequented beach areas have been known to save lives but there is still the problem of people removing the rings, playing around with them, and taking them home. The Angel Ring program is spearheaded by the Rotary lub of Pago Pago who began installing the Angel Rings five years ago. This is according to Rotary lub President Dennis Wellborn who, over a telephone interview with Samoa News yesterday afternoon, urged the public to refrain from removing the flotation devices because they are there to save lives. Wellborn said that last month, the Angel Ring set up at Utulei Beach - which is frequented by local residents as well as tourists - went missing once again. Last year, former Rotary lub President Bill axey reported that Angel Rings placed at Utulei Beach were replaced four times since they were installed there. Utulei Beach is very difficult to monitor because so many people go there to swim, Wellborn said, adding that people think it s a toy so they play around with it and think nothing more of it. A complete Angel Ring unit comes with a price tag of $1,800 and Wellborn said the project was made possible through monies collected from Rotary lub fundraisers. The flotation devices are obtained from the United States oast Guard, which is always represented in the Rotary lub membership. The USG always has somebody from their office involved with Rotary, Wellborn said. He explained their USG member helps them keep everything supplied as far as Angel Rings are concerned. He added that three Angel Rings are currently being tagged with the Rotary lub logo and once completed, they will be placed where needed. Wellborn s plea to the public and Rotary lub members: If you re driving by or walking around and you see anyone playing around with the Angel Rings, walk up to them and tell them to knock it off. We want to make people aware of the purpose of having these flotation devices around and want them to know how important these things are. Wellborn said the missing Angel Ring from Utulei Beach will be replaced next week. He reported that recently, Angel Rings were credited with saving the lives of two youngsters who were swimming at the Sliding Rock (Le ala) area. We don t know the total number of all the people whose lives have been saved by the Angel Rings but it s always good to have the Angel Rings around. The Rotary lub president said in Vaitogi alone, four lives were saved by Angel Rings in the five years since the program started. Wellborn also pointed out that in Faganeanea, a fishing boat got stuck on the reef and the Angel Ring there was used to get people to and from the boat. urrently, Angel Rings can be found in the villages of Utulei, Vailoatai, atu u, and Faganeanea, with two rings in Vaitogi. Wellborn said the rings are scattered in different locations across the island but it is not as concentrated as we would like it to be. He said they are looking at installing several more Angel Rings but they need feedback from the public on which locations the rings would best be used and needed. Our goal right now is just to keep the rings that are already up, in place, Wellborn said. He applauded the efforts of Vaitogi village in keeping the Angel Rings in place. The village council members and high chiefs of Vaitogi understand how important the Angel Rings are and they have issued a moratorium that prohibits anyone from touching or removing the Angel Rings. It s not that easy to put a stop like that in an area like Utulei Beach which is in the middle of the population base, Wellborn said. The Angel Ring program was initiated after several drowning incidents in the territory. It was originally started in Australia by an Australian Rotary lub that wanted to offer someone in distress in the water a chance to hold on until help arrived. Angel Rings have long ropes attached to them. When the ring is tossed out into the water, the person needing help can grab on to the ring and hold on to it until they can be rescued.

Deadline for filing applications September 16, 2013 at 04:00 p.m. by Joyetter Feagaimaali i-luamanu,samoa News Reporter ASE AGAINST ERLIN ULI DISISSED The government has moved to dismiss the criminal case against erlin Uli, one of the Uli twins who was charged with escaped while on work release on several occasions. erlin is currently serving ten years in jail with his twin brother arlon following their conviction on two counts of unlawful possession of a controlled substance. The defendant was charged with four counts of escaping while on program release. His brother arlon Uli s case was acquitted last month during a jury trial. erlin s case was scheduled to go before a jury trial however Assistant Attorney General Tony Graf filed a motion to dismiss the case. The dismissal motion was granted by Associate Justice Lyle L Richmond. Graf told Samoa News that after conducting further investigation into this matter he found that the evidence does not support the criminal charges filed against erlin. He noted the work release contract for erlin was incomplete. According to the government s case, a police detective was assigned to investigate allegations that erlin, who s out on work release, was leaving his work place. AN IN ASSAULT ASE PLAED ON PROBATION Aukusitino Fanene of Pago Pago, who pled guilty to third degree assault, has been placed on probation for one year, during his sentencing last week. Fanene was initially charged with second degree assault, however he took the plea offer by the government and pled guilty to a lesser charge of third degree assault. This incident is in connection with an assault that occurred at his residence last year. The defendant initially intended to fight his case with a jury trial. During sentencing, he apologized for his actions and pleaded with the court for another chance. Associate Justice Lyle L Richmond sentenced the defendant to one year in prison, however execution of sentencing was suspended on condition that he s placed on probation for one year. The defendant was released from police custody last Friday following his sentencing. According to the government s case, it was reported to the police that an assault incident occurred on Nov. 17, 2012 in Pago Pago. A witness told police that he observed the defendant strike the victim eight times with a folding chair on the head and body. AN PLEADS GUILT FOR ASSAULTING GIRLFRIEND, SIGNS PLEA DEAL A man accused of assaulting his girlfriend in a nightclub parking lot has entered into a plea agreement and is scheduled to be sentenced next month. Ernie Tao was charged with second degree assault, however with the plea deal the defendant pled guilty to third degree assault, a lesser charge amended from the felony. Associate Justice Lyle L Richmond accepted the plea agreement. The 23-year-old of Faleniu was released from jail last week Friday on his own recognizance, pending sentencing. He is represented by Assistant Public Defender ike White, while prosecuting is Assistant Attorney General Julie Pasquale. According to the government s case, police received a call from a security guard at the Bowling Alley regarding an assault in the parking lot several months ago. The defendant admitted he had punched and kicked his girlfriend on the back and on the head. FAGAIA AN HARGED WITH ISDEEANOR STEALING A man accused of stealing canned food denied the stealing charge against him when he made his initial appearance in the District ourt last week Friday. Isara Tonise of Fagaima spent the night in jail. Florence Saulo, who asked if such a funding is necessary and if the office itself is necessary. She also asked how many cases have been handled by this office so far this year. Saulo s inquiries were made during yesterday s Fono joint budget hearing for the Department of Legal Affairs, which is overseen by Attorney General Afoa LS. Lutu, who responded that his tenure is new under the current administration and when he came into office there were cases settled from last year. He also pointed out that the Independent Prosecutor is needed when there are instances of conflict of interest involving the Attorney General s Office or any entity of the government. Additionally, this money is needed to pay an IP in the event that such a prosecutor is needed throughout F The IP is established by law and the court may also assign specific matters to the IP to handle. Saulo further asked about the government s plans to address the influx of Asian merchants into the territory and Afoa responded that the AG s Office and the Immigration Office have plans in the works but he could not reveal details at this time. He indicated the government does not wish to make details public due to the fact that when it is time for action, the ones they are looking at are no longer there. Responding to a committee question, Afoa said the Immigration Office needs to hire additional staff to carry out its work. Besides the AG s Office and Immigration, other divisions under Legal Affairs are the Territorial Registrars Office and Weights & easures. The total department budget stands at $2.47 million, which is an increase compared to the current F 2013 budget of $2.26 million. Attorney General Afoa L.S. Lutu said during the hearing that it was the first time he had seen this measure and requested time to review the bill. BAGROUND A similar bill was introduced in Fall of 2011, with Rep. Larry Sanitoa being the key sponsor. Sanitoa told Samoa News at the time that the measure was the result of collaborative work between the Fono legal team and the Attorney General s Office to address concerns raised by the High ourt in 2009, when it rejected a plea agreement in the government s case against Teutusi Satele, who was accused of assaulting a student on a school bus. Under the plea agreement, the defendant pled guilty to an amended charge of child abuse in violation of local law, ASA the Abuse of a child statute. After reviewing this law, the court found no criminal conduct prescribed thereunder. Although the defendant admitted, under terms of the plea agreement, that he had hit a child we hold that a crime is not indicated under ASA because this particular statute contains no prescriptive language and is therefore ambiguous, said the judges at the time. The 2011 bill, as well as the new administration bill further criminalizes and expands the definition of the child abuse statute as well as criminalizing the act of child neglect. Johnson was reported missing July 8 when he failed to show up for work. Graham later reported that she had spotted his body. Graham made an initial court appearance onday before U.S. agistrate Judge Jeremiah. Lynch on a charge of seconddegree murder. She is currently in custody. Her attorney, public defender Andrew Nelson, declined to comment. Johnson s family and friends were relieved after calling for an investigation since his body was recovered July 12. Two months probably isn t very long for an FBI investigation, but when you re waiting for answers, that s a lifetime, family friend Tracey aness said. aness said Johnson was excited about his wedding and in love with Graham. Graham initially told investigators that Johnson left their house late July 7 with unidentified friends in a dark-colored car with Washington state license plates. That night, she texted a friend and said she was about to talk to Johnson about her reservations about having gotten married the previous weekend. The friend, identified only by initials, told the FBI about receiving the text from Graham just before 9 p.m. in which Graham said, Oh well, I m going to talk to him. The friend responded, I ll pray for you guys. Graham replied, But dead serious if u don t hear from me at all again tonight, something happened. Another friend said Graham reported receiving an July 10 saying Johnson had left with three friends, went hiking, had fallen and was dead. The next day, Graham reported to park officials that she had spotted Johnson s body. A ranger thought that was unusual, but Graham explained, It was a place he wanted to see before he died, authorities said. Graham was interviewed July 16 and acknowledged lying about her husband s death, authorities said.

According to the ASSEP, While recycling is a very effective program to reduce what goes into the landfill, it only buys time as the landfill will still continue to grow. Reduction of the landfill will require a waste-to-energy strategy. The report points out that large landfills in the USA often use methane gas recovery. While this is a waste-to-energy strategy, it is not a reduction strategy that is recommended for the Futiga landfill, the report states. The ASSEP points to gasification, which is a new technology that offers the ability to reduce landfill refuse safely and effectively without harmful emissions. New developments in the field of waste-to-energy allow for further breakdown of solid waste and landfill refuse into usable products, such as liquefied materials compatible with diesel, and carbon which can be used locally or exported for sale. As noted in the report, Biomass, Gasification, Anaerobic Digestion and Waste-to-Energy Strategies are as follows: 1. Technology assessment and site economics 2. Investigate New Technologies for WTE and Waste Reduction to Recyclable aterials 3. Fish oil and waste: technology selection and comparison analysis 4. Re-visit waste characterization study and conduct WTE feasibility evaluation 5. Anaerobic digestion economic and technical feasibility to wastewater treatment 6. Study small scale biomass power potential 7. Biodiesel options; small scale 8. Generation of electricity from SW 9. Production and use of biodiesel in existing diesel power plants By putting forth the ASSEP, American Samoa is pursuing a path of sustainability that will ensure that the needs of the present are met without sacrificing the needs of future generations. This path will also lead to economic security through stable energy pricing and reliable electricity production. ASPA When contacted for comments, ASPA Executive Director Utu Abe alae explained that a Request for Proposals (RFP) is currently being advertised and will close later this month. The proposal is for a Waste to Energy project which is distinct from the metals recycling program, Utu wrote in an correspondence to Samoa News yesterday. We are looking at proven technologies that can use solid waste as feed stock for a small power plant, or the manufacturing of valuable products or by-products. Utu explained that the objective is to reduce the amount of solid waste that is buried at the landfill in Futiga or anywhere else in American Samoa, adding there is only a small amount of land on small islands. In the meantime, the ASPA executive director reports they have shipped almost all of the scrap metal from the anu a Islands to Tutuila. The metal is being chopped up and baled and shipped to New Zealand en route to hina where it is being recycled. After review by the governor, the ASSEP draft will be sent to the National Renewable Energy Lab which was contracted by the Department of Interior to work with the American Samoa Renewable Energy ommittee (ASRE).
