(Faaauau itulau 12) House bill focusing on provisions of gov t land Senate hears long list of problems at prison Overcrowding, too many foreigners, negligent officers by Joyetter Feagaimaali i-luamanu Samoa News Reporter The ongoing problems at the Territorial Correctional Facility fall on the shoulders of the police officers negligence, and not carrying out their duties as officers sworn to protect and serve the community that was the explanation from Deputy Commissioner of Public Safety Leiseau Laumoli when he appeared before Senators yesterday morning during a hearing regarding the problems encountered at TCF. The Deputy Commissioner was accompanied by Warden Lt. Maifea Lumana i before the Public Safety Committee, chaired by Sen. Mauga T. Asuega. Leiseau said that he and the Commissioner continue to remind the corrections officers of their duties, which are supposed to be carried out 24 hours a day and seven days a week. He said he advises them to be sure about the safety of the officers who work there and also the safety of the prisoners who are placed under their supervision. He said the correction officers at the jail failed in carrying out their duties, which is why a laptop computer made its way into the jail. Inmates had access to the laptop, which took photos of them posing in their cells at the TCF they were later posted on Facebook last year. Leiseau said the investigation into this matter is almost complete, and they are hoping, with further investigation, to retrieve information from the laptop to see if the inmates have ongoing plans at the TCF. He assured the senators that once the investigation is completed the laptop will be returned to its owners. With regards to the inmate responsible for taking the laptop into the jail, Leiseau said a report has been forwarded to the Attorney General s office to determine what should be done regarding this issue. The senators also heard from Warden Lumana i, who told them that currently the jail is overcrowded. Each cell was built for two inmates, but currently they have up to six inmates in each cell which is just 4 x 8 feet. Currently, there are eleven female inmates, and 174 male inmates. The Warden said he s now looking at having the inmates who have committed similar crimes be housed together; those who have committed (Continued on page 16) Y K by Fili Sagapolutele, Samoa News Correspondent There is a move in the House to overhaul government land transactions through a bill introduced last week that would, among other things, define public use of land for eminent domain purposes and for government land acquisition, including not leasing communal lands acquired to private commercial enterprises. The bill, which sponsors Reps. Tapumanaia Galu Satele Jr. and Va amua Henry Sesepasara, say is in accordance with the protective policy provisions of the local constitution, also seeks to prohibit leasing of condemned communal land to private enterprises. The bill s preamble states in part that the local constitution calls for the government, as a policy, to protect persons of Samoan ancestry against alienation of their lands and destruction of the Samoan way of life and language. In order to implement this basic, fundamental doctrine and to preserve and protect the communal land system, it is the intent of this act to clarify the government s public use of land and place appropriate restrictions on such use, the bill states. Among the proposed amendments cited in the bill, two new provisions are added to Section 2, ASCA , titled Eminent domain Compensation. [photo: Jeff Hayner] Faleomavaega introduces a bill to aid US Nationals applying for citizenship by Fili Sagapolutele Samoa News Correspondent Congressman Faleomavaega Eni has moved forward with introduction of federal legislation (H.R.4021) that would make is easy for U.S. nationals living in American Samoa to apply to the U.S. government for U.S. citizenship. The bill, introduced Tuesday and assigned to the U.S. House Committee on Judiciary, seeks to amend provisions of the federal Immigration and Naturalization Act and waive certain naturalization requirements for U.S. nationals living in the territory. In an official statement submitted to the U.S. House for records, Faleomavaega explained that American Samoans must travel thousands of miles to Hawaii or California and live there for 3 months before they can apply for citizenship, and pointed to the financial burden of traveling to the U.S. placed on U.S. Nationals in American Samoa as preventing many from applying for citizenship. My bill will lift this burden and help U.S. Nationals, who by definition owe a permanent allegiance to the United States, to apply for citizenship directly from American Samoa, said Faleomavaega, whose statement was obtained by Samoa News through Congressional records. He said the bill will also eliminate the requirements of knowledge of English and U.S. government for U.S. Nationals seeking citizenship. He emphasized that American Samoa has been a territory of the U.S. for over 100 years and has in many ways adopted parts of American culture. For example, he said the local education system is modeled after the U.S. education system and students learn both English and about the U.S. government in American Samoan schools. The requirement of English proficiency and knowledge of the U.S. government was intended for foreign nationals who applied to become U.S. citizens, he contends. It is futile to test American Samoans on their knowledge of English and the U.S. government, since they learn these subjects in American Samoan schools. The Congressman further contends that American Samoa has a per capita enlistment rate in the U.S. military that rivals any state. American Samoans have also joined the U.S. Armed Forces and fought and died for the United States during World War II, the Korean war, the Vietnam war, the Persian Gulf wars, and most recently the wars in Iraq and Afghanistan, he pointed out. Despite these sacrifices of American Samoans, U.S. nationals still must travel to the U.S. and wait for 3 months prior to apply for naturalization, he said. My bill will have a dramatic positive effect on the lives of U.S. nationals living in American Samoa by removing the hardship of traveling to the U.S. to apply for naturalization. In a separate statement released yesterday, Faleomavaega said, As American Samoans we are considered non-citizen nationals, but have defended the United States in times of war as if we were citizens. I am hopeful that my colleagues in the U.S. House of Representatives and the U.S. Senate will stand and support this critical legislation which recognizes the sacrifices and contributions by our people to the United States and give U.S. nationals living in American Samoa an option to apply for U.S. citizenship directly from American Samoa. he added. Introduction of the bill comes following public hearings on the draft proposal held last month at the Fono Guest Fale where Faleomavaega stressed that the measure is only an option for those who do not want to travel to the U.S. and reside there in order to apply for U.S. citizenship. He also pointed out that during a joint Fono hearing last year, it appeared from comments by lawmakers that they were supportive of the proposal, but he has not heard any official comments from the governor, who was sent last year a copy of the draft bill. Members of the public who testified at the forum were supportive of the bill and agreed that this measure will lessen the burden on those wanting to remain in the territory and still apply for citizenship. However, two other witnesses believed that the best solution to address this matter is to have it put forth in a referendum for the upcoming November general election. Faleomavaega told the audience this can be done via a Fono resolution, that can be put forth for voters to decide. 4 Page 4 samoa news, Thursday, February 16, 2012 A lawmaker says, no cussing in the class for teachers PHOENIX (AP) -- A teacher s role may be to expand a student s vocabulary, but one Arizona lawmaker wants to make sure that doesn t include four-letter words. A state legislator has introduced a bill that would punish public school teachers if they use words that violate the obscenity and profanity guidelines set forth by the Federal Communications Commission. State Sen. Lori Klein introduced the measure because a parent in her district complained about a high school teacher using foul language. The words were totally inappropriate, and teachers that don t keep their language clean aren t setting a good example for students, she said. You re there to be educated, Klein said. You re not there to talk smack. Critics say the bill is unnecessary and any discipline needed should be handled by schools and districts, not the Legislature. Klein, a Republican from Anthem, made national headlines last fall when she pointed her gun at a reporter while demonstrating the weapon s laser sight during an interview. Klein s proposal may be constitutional, but not necessarily wise, said James Weinstein, a Constitutional Law professor at Arizona State University Weinstein said the FCC has made exceptions for offensive language based on context, and that could make things complicated. FCC standards aren t exactly black and white, said Anjali Abraham, a lobbyist for the American Civil Liberties Union. The organization has some concerns about the bill, Abraham said. A spokeswoman for the National Conference of State Legislators said the organization is not aware of any other state with a law similar to the Arizona proposal. If the bill becomes law, a teacher whose speech or conduct violates FCC regulations would receive a warning, and after three incidents, the teacher would face a week of suspension without pay. A teacher would be fired after the fifth offense. The proposal applies to K-12 teachers, and is limited to speech in a classroom setting. Klein told the Senate committee Wednesday that she wished the issue could be left to school boards, but she didn t feel they were protecting young, impressionable kids from offensive language. Floyd Brown, the parent in Anthem who complained to Klein, knows better than most what kind of impression words can make. Brown is a longtime Republican strategist who produced the infamous Willie Horton ad during the 1998 presidential campaign, which tied Democratic candidate Michael Dukakis to the release of a convicted murderer serving a life sentence. Brown is also the founding chairman of Citizens United, the group whose lawsuit led to a 2010 Supreme Court ruling that barred the government from limiting corporation and labor union spending for political purposes. Last year, Brown s daughter Olivia came home from high school upset that a teacher was using the F-word in class. Brown brought the issue to school administrators, but they didn t take him seriously, he said. Brown said he pulled his daughter, then a sophomore, out of the school and she s now being homeschooled. I m not going to subject my daughter to that kind of environment, Brown said Brown said he took his complaint to Klein because he lives in her district. A representative for the school district said the school received no complaints about staff using inappropriate language, which would violate the district s professional conduct policy. [photo: Banner Fanene] NHS Cancer Leukemia Awareness & Fundraiser This Week By Pe a Mann, Special to American Samoa Media Twenty-two month s after being diagnosed with the blood cancer Leukemia, local girl now Hawaii resident Sharring Niusulu, continues to beat the odds. Born & raised in American Samoa, the Aua Elementary-Faga itua High-ASCC graduate is grateful that she has lived another year since visiting home last February. Sharring was able to fly home with her husband, compliments of a dear friend, to take part in the American Samoa Bone Marrow Drive Nearly 900 names were added to the National Bone Marrow Registry from that effort. While a bone marrow match was not found for Sharring from those 900, the memory of that special time lingers with Sharring s young cousin Vatauomalotetele Vatau or TauTau Fanene. Vatau, a Senior and National Honor Society student at Nu uuli Voc-Tech High School, has put together for this week, a cancer awareness & fundraising campaign called Vatau s Hope Drive. Vatau explained that For Valentine s Day I started this Hope Drive for leukemia cancer awareness and to raise funds to help Sharring. Because of this sickness, she is unable to live a normal pain-free life. She often tells us that she doesn t want to burden anyone. The hard working Senior added, I just want to do something to help her live! She is our family hero, a Leukemia Warrior! When Sharring, who lives in Waipahu Hawaii learned of Vatau s Hope Drive, she posted last week on Facebook, Oh my gosh! I m in tears right now, reading your message and so very happy for you and this wonderful project. Honestly, you, members of your school/staff, members of our family and everyone who participated in last year s Bone Marrow Drive have truly made an impact on my life and I m certain, I speak for all cancer patients in need of bone marrow transplants when I say how THANKFUL we all are that everyone came together for such a worthy cause. 5 samoa news, Thursday, February 16, 2012 Page 5 GOP pushes back against any further cuts in nukes WASHINGTON (AP) -- Congressional Republicans on Wednesday vowed to block the Obama administration from sharply cutting the U.S. nuclear force, calling potential reductions of as much as 80 percent in the number of deployed weapons reckless lunacy. Pointing to the growing number of trouble spots, from Iran to Syria to Egypt, members of the House Armed Services Committee said any significant cuts would undermine the U.S. ability to deter aggression. The Associated Press reported on Tuesday that the administration is weighing several options for new reductions from the current treaty limit of 1,550 deployed strategic warheads. Defense Secretary Leon Panetta and Army Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, told the committee that no decision has been made and maintaining the current level is one of the options. But that did little to assuage GOP lawmakers. I just want to go on record as saying that there are many of us that are going to do everything we possibly can to make sure that this preposterous notion does not gain any real traction, said Rep. Trent Franks, R-Ariz. The most modest option under discussion would return the United States to a level not seen in more than half a century, when the Soviet Union and the U.S. pushed ahead in a Cold War nuclear arms race. The administration is weighing at least three options for lower total numbers, cutting to around 1,000 to 1,100, 700 to 800, or 300 to 400. Although Dempsey said maintaining the status quo is one option, further cuts are consistent with President Barack Obama s 2009 promise to pursue the elimination of nuclear weapons and the 2010 Nuclear Posture Review, which called for an implementation study by the Defense Department to review the nation s nuclear deterrence requirements with an eye toward further reductions in the size of the arsenal. Last March, National Security Adviser Tom Donilon said the administration was making preparations for the next round of nuclear reductions. Rep. Mac Thornberry, R-Texas, complained that such a step would encourage other nations to advance their nuclear programs. Fearing Iran s nuclear ambitions, the United States and the international community have imposed tough sanctions on Tehran. If they see that we are going to come down from 1,500 to some number in the low to middle hundreds, it does nothing but encourage our enemies and discourage our friends, Thornberry said. And the result of that is more nuclear weapons programs all across the world, which would seem to me to be something that we would not want to have happen. Panetta said a number of options are being discussed but provided no specifics. He insisted any decision would be part of a treaty that would have to be ratified by the Senate. As you know, reductions that have been made, at least in this administration, have only been made as part of the START process and not outside of that process. And I would expect that that would be the same in the future, Panetta said. Lomitusi Filiga, in his 40 s, is charged with public peace disturbance; however the government is looking into filing additional weapon charges against the defendant. Police affidavit says the defendant, who was allegedly intoxicated at the time, pointed a 38 handgun at a family member in Fagatogo on Tuesday. The complaining witness walked over to the Central Police station in Fagatogo and filed a complaint with police, who later apprehended the defendant. Police said they had to place the defendant into custody for his own safety, because he was intoxicated. According to police, the defendant said he was just playing around and he was not serious. Assistant Attorney General Camille Phillipe said she s waiting for the police report from the investigating police officer. Filiga is represented by the Public Defender s office. Bail for the defendant was set at $1,000 and he s scheduled to appear again on February 21, Police have confiscated the weapon involved in this matter. NEMAIA POAMO, MIGO MISA AND SEFO SIAULAIGA The government case against the three men charged in the brutal beating death of Sio Faumui also known as Chico in June last year has been rescheduled again to a later date. This matter was scheduled for jury trial yesterday before the High Court. Nemaia Poamo, Migo Misa and Sefo Siaulaiga aka Raponi Siaulaiga are each charged with murder in the second degree. The government alleges that Siaulaiga, Misa and Poamo assaulted Faumui of Iliili with their hands and left him lying unconscious about 15-feet from the main road in Malaeimi. It s also alleged that Poamo and Siaulaiga further beat the victim with rocks and Misa used a beer bottle to strike Faumui s face. According to the government s case, Poamo and Migo punched and kicked Faumui at least 15 to 20 times. Faumui suffered multiple facial injuries. All three have admitted to police that they assaulted Faumui, according to court affidavits. The date for the next hearing is yet to be scheduled. What was your understanding of the relationship? Deputy District Attorney Shannon Presby asked. We were good friends, Ruetten said. We saw each other on and off, and on some of those occasions we had sexual intercourse. The tall, gray-haired Ruetten was overcome several times during his testimony, pulling tissues from a box on the witness stand to wipe his eyes as he spoke of Sherri Rasmussen, his murdered wife. He also told of his friendship with Lazarus that dated back to their days as students at UCLA. There was only necking and fooling around in their college years, he said. Jurors were shown pictures of them together as college kids, including one of Ruetten with his arm around Lazarus in her cap and gown at graduation. Ruetten, 53, wearing a dark business suit, testified that he met Rasmussen in 1984 at a party and they quickly became a couple. When they were engaged, he said, he felt no need to tell Lazarus because he had not seen her for months. However, he said she later learned of the engagement, summoned him to her condo and through tears expressed her love for him. She also asked him to have sex with her, which he said he did but now considers it a stupid move. He stressed that nothing changed that night. Here s the deal, he said. It was clear she was very upset that I was getting married and moving on. Later, he said, he confessed the incident to Rasmussen and told her: Don t let this mess us up. I want nothing more in the world than to be married to you. He also said he ended all contact with Lazarus, who has pleaded not guilty to the murder of Rasmussen. Ruetten identified blissful photos of the couple s wedding on Nov. 23, Lazarus did not look up as the photos flashed on a courtroom screen. Rasmussen was killed on Feb. 24, 1986, bludgeoned and shot to death by an intruder at the condo where she and Ruetten lived. Prosecutors are trying to show that Lazarus sought revenge for being spurned by Ruetten. Later in the day, Ruetten told of returning home from work on Feb. 24, 1986, to find his wife dead on the living room floor. I was reeling, he said. I was in shock. He said he put a blanket over his wife s face, called 911 and made himself available to police for interviews. But he said he never lived in the condo again, quit his job and moved out of Los Angeles. He said he didn t mention Lazarus to police as a possible suspect in the murder because, It never crossed my mind that she could be involved. He said he was later assured by a homicide detective that Lazarus was not a suspect, and that his wife was most likely killed by burglars. He went to live with his parents in San Diego, and in 1989 he made contact with Lazarus again and met up with her in Hawaii. When he moved back to the Los Angeles area the next year, he said he contacted her and they had sex again at least twice. In those times when you saw the defendant, did she ever ask about Sherri s death? asked Presby. No, said Ruetten. When the case was reopened in 2009, he said he voluntarily gave a DNA sample. Presby asked if he had anything to do with the killing and he said no. On cross-examination, Lazarus lawyer, Mark Overland, stressed that the relationship with the police woman was more serious than Ruetten said. Ruetten acknowledged that Lazarus knew his entire family and in September 1984, unaware of his relationship with Rasmussen, Lazarus threw a surprise 25th birthday party for Ruetten. Under Overland s questioning, Ruetten insisted, I always just made it clear we were just friends and this wasn t going toward marriage. Another witness, retired Los Angeles police officer Mike Hargreaves, said he lived at Lazarus condo for a year and recalled that she woke him once in the middle of the night and said Ruetten had broken up with her. She said John told her he was going to marry someone else, Hargreaves said. He said Lazarus, who was exceptionally fit, suggested they do buddy sit-ups together and she felt better after that. Ruetten s sister, Gail Lopes, showed jurors a letter to her mother from Lazarus that was postmarked Aug. 6, In it, Lazarus told Mrs. Ruetten: I m truly in love with John and the past year has really torn me up. I wish it didn t end the way it did, and I don t think I ll ever understand his decision. In subsequent years, Lazarus married and adopted a daughter. She rose to the rank of detective and was honored for her work in the art forgery section. She was arrested in 2009 after forensic experts, examining the file on Rasmussen s murder, linked her DNA to a bite mark on the slain woman s arm.

And then there s the sweat-inducing, tear-generating, mouth-on-fire Trinidad Moruga Scorpion. With a name like that, it s not surprising that months of research by the experts at New Mexico State University s Chile Pepper Institute have identified the variety as the new hottest pepper on the planet. The golf ball-sized pepper scored the highest among a handful of chile breeds reputed to be among the hottest in the world. Its mean heat topped more than 1.2 million units on the Scoville heat scale, while fruits from some individual plants reached 2 million heat units. You take a bite. It doesn t seem so bad, and then it builds and it builds and it builds. So it is quite nasty, Paul Bosland, a renowned pepper expert and director of the chile institute, said of the pepper s heat. Researchers were pushed by hot sauce makers, seed producers and others in the spicy foods industry to establish the average heat levels for superhot varieties in an effort to quash unscientific claims of which peppers are actually the hottest. That s something that hadn t been done before, Bosland said. The question was, could the Chile Pepper Institute establish the benchmark for chile heat? he said. Chile heat is a complex thing, and the industry doesn t like to base it on just a single fruit that s a record holder. It s too variable. The academic institute is based at the university s agriculture school and is partially funded by federal grants, as well as some industry groups depending on the project. The team planted about 125 plants of each variety - the Trinidad Moruga Scorpion, the Trinidad Scorpion, the 7-pot, the Chocolate 7-pot and the Bhut Jolokia, which was a previous record-holder identified by the institute and certified by Guinness World Records in Randomly selected mature fruits from several plants within each variety were harvested, dried and ground to powder. The compounds that produce heat sensation - the capsaicinoids - were then extracted and examined. During harvesting, senior research specialist Danise Coon said she and the two students who were picking the peppers went through about four pairs of latex gloves. The capsaicin kept penetrating the latex and soaking into the skin on our hands. That has never happened to me before, she said. Chile peppers of the same variety can vary in heat depending on environmental conditions. More stress on a plant - hotter temperatures or less water, for example - will result in hotter fruit. The Trinidad Moruga Scorpion s new notoriety is already making waves in the industry and among those who love their hot, spicy foods. As with all the previous record holders, there will be a run on seeds and plants, said Jim Duffy, a grower in San Diego who supplied the university with seeds for four of the super-hot varieties. Like Cabbage Patch dolls right before Christmas or Beanie Babies, it s like the hot item. Not even Duffy or the researchers would dare to pop a whole Trinidad Moruga Scorpion in their mouths, but there are plenty of videos on social networking sites where heatloving daredevils have tried. The blood flow increases and the endorphins start flowing. Their faces turn red, the sweat starts rolling, their eyes and noses water and there s a fiery sensation that spreads across their tongues and down their throats. Land leases and sale of land for the benefit of private commercial enterprise are not public uses, according to the (c) amendment. Consistent with the native land protective policies established by treaty and by the American Samoa Revised Constitution, all fee titles in communal land that have been acquired or to be acquired by eminent domain shall revert to their prior communal owner when the public use for which it was acquired ceases, says the (d) amendment. Another major amendment proposed in the bill deals with Section 3, ASCA titled Authority to purchase property Transfer of Title. It currently states in part that the government shall have the power and authority to purchase property for public purposes from the owners and to compensate them by private agreement. One amendment would change the word purposes to read uses as defined in (c) The bill adds another new provision which reads: The public uses for a parcel of land acquired by the government must be specified in the executed document transferring. Any fee title in communal land that has been acquired or to be acquired by the government by purchase shall be subject to the same limitation set forth (d). A final amendment proposal cited in the bill calls for the creation of a new provision titled Restriction on Government Leasing and states that: The government shall not lease the communal lands it has acquired by eminent domain or purchase to private commercial enterprises. Additionally, Government land leases for private commercial enterprises existing at the time of enactment of this statute into law shall remain in full force and effect until expiration or earlier termination pursuant to the terms of the lease. Currently there are too many sex offenders in jail, said Lumana i. Sen. Fuata Dr. T. I atala asked about the homemade brew in the TCF, which he heard about from the media. The Warden replied that the incident occurred last year, and it goes back to the police officers not carrying out their duties, by checking on the inmates constantly. Fuata also asked about the types of items allowed in jail for the inmates, and which items are not. The Warden explained the inmates are allowed personal hygiene items, such as clothes, soap, toothbrush etc. The Senator asked if cell phones are allowed in prison, because he has overheard that there are many cell phones being used in jail. The Warden said phones are prohibited in jail, but it s a big problem the TCF is still encountering. Fuata also inquired about rehabilitation programs for the inmates who are incarcerated. The Warden replied that there are programs available at TCF, which he is working hand in hand with the Criminal Justice System to implement, because they are funding some programs for the TCF. He cited talking in group sessions for an alcohol rehabilitation retreat and the sewing program for women by Leuga Turner. He added there are also several ministry programs, where different ministers visit the TCF each day, twice a day. Sen Paogofie Fiaigoa asked of the 174 inmates how many are foreigners? The Warden responded that 85 percent of inmates are foreigners. Paogofie asked if these foreigners were returned to their home countries, would there still be a need for new buildings, adding, Our government is suffering because of these foreigners there s three meals a day and if they were returned, it would be better. Sen. Lualemaga Faoa noted the problems occurring at the TCF are due to the negligence of the police officers, and yet it is their duty and responsibility to make sure TCF and everyone at TCF is taken care of. Lualemaga asked the Warden and Leiseau for copies of procedures, rules and regulations under which the TCF is currently operating. Sen. Alo Dr. Paul Stevenson told the witnesses to file a report with the Senators explaining what types of problems they are encountering whether it s the facilities, or the manpower. Leiseau added that it s the dishonesty of police officers that is another reason why these problems exist.
