Samoa News understands that last Friday, the board told Fleming to suspend his initial move to terminate the positions. In response to Samoa News inquiries, Fleming pointed out that redefinition as it directly relates to the overall hospital reorganization plan until further notice is to provide employees affected by this initial first of many stages in this restructuring process an opportunity to meet with the board to express their concerns and views about the proposed changes to their current positions and current hospital organization. He added, The hospital reorganization process was never intended nor designed to terminate any current staff, but rather to insure that LBJ is organized in the most efficient and effective manner with the right staff doing the right jobs, at the (Continued on page 13) Treasurer tells House members that $3 Million loan is paid off by Joyetter Feagaimaali i-luamanu Samoa News Reporter Lawmakers were told during a House Budget Committee hearing last week by ASG Treasurer Dr. Falema o Pili that the $3-milliondollar loan which was funded from the Workmen s Compensation Account for LBJ Medical Center has been paid off. The wage tax, which is to be paid by every wage earner in the territory, was meant to first pay off the loan and thereafter, the proceeds would go to the hospital: 50% for hospital operations and 50% to fund the medical referral program. When Chairman of the House Budget Committee Rep. Timusa Tini Lam Yuen inquired about the status of the loan, Falema o said the loan was paid off. Falema o explained that in May, the Hospital received $200,000 and another $300,000 will be handed over later this week, per a mandate that all revenues collected from the wage tax are to go towards funding the hospital s operations. Samoa News points out that in April, Falema o reported that only $800,000 had been repaid on the $3 million loan. When asked at the time about its status, the Treasurer said $800,000 had been paid off and Dec. 31, 2014 was when the government planned to pay off the loan. Manu a Rep. Fetu Fetui Jr, thanked Falema o for informing the House of the great news that the $3 million loan had been paid off; however, he then brought up the issue of payroll deductions and asked the Treasurer if he anticipates restoring the system for government employees, as it has affected a lot of people who depend on it to pay their bills. Fetu said his heart goes out for the people of Manu a who have to fly from Manu a to Tutuila to pay their bills and the airfare is almost $200, unlike before, when payroll deductions made it easier for Manu a residents. He said one of the repercussions of discontinuing payroll deductions include some people losing their insurance because their premiums for both local and off island companies were deducted straight from their checks. Chen & TG] A female off-duty police officer was hit by an aiga bus while riding her motorcycle from her Masefau home to the DPS Central Station on Saturday. The accident occurred in Aua, on the main road at the turn-in to the hall of the Catholic Church during afternoon bingo games. Bingo players, who were eyewitnesses, reported that a verbal altercation between two bus drivers resulted in one of them trying to drive out onto the road and failing to see if there was oncoming traffic. Eyewitnesses heard the cop scream as she fell off her bike and not long afterwards,police officers arrived on the scene in full force. This photo was taken as the cops tried to load the motorcycle onto the back of a police vehicle. Luckily, the female officer escaped with no serious injuries except some scratches and bruises.

(AP) If finding a high school ring doesn t seem like a big deal consider this: Until a few days ago, the last time Dick Diedrich saw his ring he was living in suburban Chicago with his parents and Harry Truman was in the White House. Diedrich, 82, now has his class of 1949 ring from J. Sterling Morton High School in Cicero thanks to a Waukesha, Wis., man who returned it to him after finding it with a metal detector in a lake near his home. The ring s journey back to its proper owner in Illinois began with Mike Geiger s phone call earlier this month to the Mattoon home of Dick Diedrich and his wife of 60 years, Doris. He said, I think I have something that goes back to your high school years, Dick Diedrich said. At that point the story with the ring popped into my head. It seems that back in high school, Diedrich exchanged rings with his then-sweetheart, Doris. He said she only took his ring off when they were dissecting frogs in biology class. In mid-1948, Doris put it on a shelf to wash her hands after biology class and when she turned around the ring was gone, as was another girl in the washroom. She was quite confident it got stolen, Diedrich told The Associated Press. That s how things stood until Geiger called. He explained to Diedrich that he was using a metal detector at a lake near his home when he discovered the ring and pulled it from the water. It really was in excellent shape for being so old, said Diedrich. Gieger did a little detective work, Diedrich explained. He contacted the school s alumni association and was told that out of the 1949 class of about 1,500 students, there were two graduates with the initials R.D., including Richard Dick Deidrich. Geiger called the other R.D., but he wasn t very friendly, so he called Diedrich, the newspaper reported. Believing he had the right R.D., he mailed Diedrich the ring. Diedrich said he wanted to send Geiger a reward, but he said he was just pleased to be able to return it. He sent him one anyway, along with a nice letter. Deidrich has continued to do research to make sure that the ring is, in fact, his. But he said Geiger is convinced the ring is in the hands of the rightful owner. It s your ring he told me. Keep it and enjoy it, Diedrich said. So the bottom line is, I m now sitting here at 82 years old with my class ring 63 years later. by Joyetter Feagaimaali i-luamanu, Samoa News Reporter UNCLE SENTENCED TO 20 MONTHS IN JAIL FOR RAPING NIECE A man who admitted to raping his 15-year-old niece was sentenced to 20 months in jail, as part of his 15-year probation term. Samoa News is withholding the name of the defendant to protect the identity of the victim in this case. The government initially charged the defendant with rape, sexual abuse in the first degree and endangering the welfare of a child; however, in a plea agreement with the government, the defendant pled guilty to rape and the remaining charges were dismissed. During sentencing, the defendant apologized to the government, his family, and the victim in this case. The defendant was sentenced to 15 years in jail; however, execution of the sentence is suspended and the uncle is placed on probation for a term of 15 years under the condition that he serves 20 months in jail and remain a law-abiding citizen while on probation. Furthermore, the defendant is not to be released for any reason except for genuine medical emergencies or a court order. Following the completion of his prison term and upon release from custody, the defendant is ordered to depart the territory, and remain outside for the remainder of the probation term. The uncle was also ordered to register as a sex offender with the Sex Offender Registry and to undergo HIV Testing, which is mandated for registered sex offenders. According to court records, the 15-year-old victim went missing for nearly a week and was found in a deserted building in Pava ia i. She initially told police she ran away from home because her brother always beats her and her 32-year-old uncle always touches her when he gets drunk. JURY TRIAL SET FOR UETI SCHWENKE A man who is being charged with second-degree assault will have his day in court during a jury trial scheduled for September The defendant, Ueti Schwenke, is currently out on bail. According to court records, the case is a result of a land dispute that occurred over Fanene communal land in Nu uuli earlier this year in February. The government alleges that the dispute resulted in a fight between two families and several people were injured. Police investigation uncovered that the dispute started over a load of dirt delivered to the land. ADDITIONAL CHARGES TO BE FILED AGAINST FUALAAU TUUA Assistant Attorney General Camille Philippe has informed the court the government is looking at filing additional charges in the case of Fualaau Tuua who is being charged with forgery and stealing, based on allegations that she stole a check, and then forged and cashed it. The prosecutor told the court the defendant is being accused of similar conduct and the government needs more time to file additional charges. Chief Justice Michael Kruse has re-scheduled the pre-trial conference for this matter in two weeks. Meanwhile, Tuua remains behind bars at the Tafuna Correctional Facility with bail set at $20,000. According to the government s case, on November 2, 2012 the head of security at the American Samoa Community College contacted DPS alleging the defendant stole a check from the business office and cashed it at a store in Nu uuli. Court filings note that the owner of the store went to the ASCC Business Office with a copy of the expired check cashed at his store and arrangements were made for a new check to be issued; however, during the process of issuing the new check, it was revealed the check was never picked up by the payee the person the check was made out to. The owner of the check along with an employee of the ASCC Business Office went to the store to see footage of the person who cashed the check. The defendant was a college student working in the Business Office at the time. According to the storeowner, the defendant paid $500 after she learned that the Business Office had found out about what she had done. 3 samoa news, Monday, July 29, 2013 Page 3 Senate endorses a former senator as LBJ board member by Fili Sagapolutele, Samoa News Correspondent The Senate last Friday confirmed former Senator Velega Savali Jr., as a new member of the LBJ Medical Center Board of Directors. Velega replaces board member Sandra King-Young, who resigned after being appointed early last month by the Governor to serve as the State Medicaid Officer. The Medicaid Office falls under the jurisdiction of the Governor s Office. Velega s confirmation means King-Young, who was also the LBJ board chair, will now officially step down from the board. Samoa News understands that her departure from the board was delayed due to the fact that the board needed a quorum three board members to legally convene and make decisions. Although the governor appointed five members to the board earlier this year, the Senate had approved only King-Young, Rep. Faimealelei Anthony Allen and Mase Akapo. The other two nominees, Tofaeono Dr. Victor Williams and Leiataua Leuga Turner, were both off-island for family emergencies during the Senate confirmation hearing of board members in April. With the Fono going into a three-week mid-session recess at the close of business last Friday, nominations of Tofaeono and Leiataua will probably be taken up after Aug. 19th when the Fono reconvenes. During Friday s Senate session, there were only eleven senators present and the nominee needed 10 votes to be confirmed. Just before the Senate vote, Sen. Soliai Tuipine Fuimaono told his colleagues that Velega is well qualified for the post and that he has been working in the government for many years. Sen. Tuiasina S. Esera agreed and added that Velega is a good leader and called for full support of the nominee. Sen. Laolagi F.S. Vaeao echoed his colleagues characterization of the nominee, adding that Velega is also a ranking traditional leader from Manu a District #2 comprising Ofu, Olosega and Sili villages which is the district Laolagi represents in the Senate. I humbly ask with a humble heart for the Senate s support in confirming Velega, said Laolagi. The secret ballots were cast and the result was a unanimous vote to confirm. Immediately after Senate President ProTemp Nua Saoluaga announced that the nominee was confirmed, Tuiasina quickly said out loud, now we can breathe properly instead of holding our breaths while awaiting the results. The comment sparked laughter from the senators as well as the audience in the Senate gallery. (Samoa News notes Tuiasina s comment is probably in reference to the Senate confirmation hearings for members of the American Samoa Employees Retirement Fund and the Scholarship Board or the ASG Student Financial Aid board, last week. For the ASERF, only two members were passed, and during the SB hearing, an unusual recess was called to give the senators time to take a breath and rethink issues that may be unclear to their colleagues before resuming the voting this occurred after one of the board appointees was rejected.) SENATE HEARING In his nomination letter to the Senate leadership, Gov Lolo Matalasi Moliga said Velega brings to the board a long and distinguished history of service to the people of American Samoa including serving in the Senate. He brings significant financial experience to the board, after working as Legislative Financial Officer before joining the executive branch as ASG Treasurer for several years, said Lolo. In his opening remarks during the hearing, Velega said he thought about being nominated to the board by the governor and he prayed for guidance in making a final decision. In the end, he said the decision was that he wanted to continue to serve the government and people of the territory through the governor s appointment. Sen. Mauga T. Asuega said a major issue faced by LBJ board and management is finances and Velega has an excellent financial background to help the hospital. In addition, Mauga said, Velega is also a former senator and a person of great integrity. Velega s financial expertise was also echoed by Sen. Magalei Logovi i, who stated that he had worked closely with Velega in the executive branch in past years and Velega speaks his mind, which is something needed by the board. If Velega knows something is wrong or a decision is wrong, he will say it without holding back, Magalei said. Sen. Avegalio Aigamaua agreed and recalled when Velega was a member of the Senate and would argue on issues that he truly believes in, with the main goal of making sure there is a better American Samoa for everyone. Chen, Samoa News Correspondent The Department of Youth and Women s Affairs (DYWA) will be launching Le Fatuga Samoa on August 6 at 4 p.m. at the DOE Career Guidance Office (Old Election Office) in Utulei. The program is being funded by the Amerika Samoa Humanities Council as a major grant program. The project will achieve the following; Youth leaders/representatives will learn how to compose Samoan original songs and/or music; Youth will learn the correct usage of our Samoan language in composing Samoan original songs and/or music; Youth will appreciate the use of Samoan ancient musical equipment still being used today; The live coverage competition will develop youths level of confidence about themselves and eliminate stage phobia; Youth will learn to collaborate with each other by brainstorming ideas to compose their songs under time constraints; and The networking with other youth groups will develop friendships which will enrich the individuals of today and tomorrow. The principal humanities scholar is HC Pulefaasisina Palauni Tuiasosopo and DYWA will select four resource people who will eventually become judges/coaches for the competition. According to DYWA Acting Director Pa u Roy Taito Ausage, the principal scholar will meet with 20 youth directors/participants every day for one week and present various cultural themes, like how Samoan songs are composed on these themes, and how music is put together to form tunes for such songs. The youth representatives will learn to compose one song of up to ten minutes based on a given theme, and have his/her youth group comprised of 2 to 10 singers will sing it during an audition which will be conducted by DYWA, the scholar, and three other resource persons to be chosen. Live competitions will he held every week for five weeks where all 20 groups will compete. There will be three coaches/judges with exceptional experiences in the area of Samoan music composition who will be in charge of five youth groups. The public will utilize Blue Sky phones to text in their votes for the group of their choice and the results of the competition will be based on the number of text votes and the votes of the three coaches/judges. The competition criteria will be made known at a later date. Pa u told the Samoa News that both audiences of youth leaders and/or youth groups as well as the viewers will benefit throughout the project. Youth groups involved in the project will see the need to expand the composition of Samoan songs and the use of Samoan musical equipment for learning purposes, and understand the core practices in this area. In addition, the audience will be entertained and appreciate Samoan song compositions, he said. The opportunity for youth leaders and/or participants to learn Samoan music compositions from the likes of HC Pulefaasisina Palauni Tuiasosopo is a lifetime experience that will have a lasting impression on them, he added. The scholar will undoubtedly engage the thinking of the participants in composing Samoan songs based on themes with profound significance and meaning. This is the intellectual benefit - the ability of youth participants to learn the art and skill of Samoan songwriting and/or composing. The youth will also develop the art of good listening skills and the ability to perform in front of live audiences. They will also learn to collaborate and network with each other in getting their project completed on time. Since the project focuses on Samoan songwriting and composition, Pa u said the participants will learn how our Samoan cultural language is used in the song composition and relate to various cultural practices - ancient and/or modern, that may also contribute to improving the cultural lives of our youth. Faleasao Harbor dredging project part of 14 budget by Fili Sagapolutele, Samoa News Correspondent Gov. Lolo Matalasi Moliga is requesting $1.5 million from the fiscal year 2014 budget to carry out dredging maintenance for Faleasao Harbor in Manu a, as an application for the project is filed with the U.S. Army Corps of Engineer. The request is included under the Special Program budget category. In his budget summary letter, the Governor said the Army Corps informed him that maintenance dredging for Ta u and Ofu harbors will not happen until late 2015 or early With this disclosure, Lolo says dredging of Faleasao harbor (on Ta u island) becomes critical to ensure that an alternative harbor is accessible by the MV Sili. It s also been determined that the cost of the dredging work at Faleasao must be borne by the American Samoa Government as it is not considered a federal facility, Lolo added, pointing out that the MV Sili has incurred damages because of the unsafe depths of the Manu a harbors. To maintain the current development efforts happening on the Manu a islands, Lolo told lawmakers it is imperative that the MV Sili has a safe harbor at which to load and unload its cargo. He said that completion of a smaller size vessel could accommodate movement of cargo from Faleasao to Ofu in the event the MV Sili cannot safely enter Ofu harbor. Therefore, it s critical to complete this Faleasao dredging project as soon as possible upon issuance of a federal permit by the Army Corps, the Governor said. Last month, Lolo wrote to the Army Corps Hawai i District thanking them for their assistance and help in expediting approval of the federal permit so that dredging for Faleasao can begin as soon as possible. Under the FY 2014 budget for Capital Improvement Project funds, $1.01 million is allocated to the Port Administration for Manu a Harbors but no other details are included in the budget document. BACKGROUND Based on a recommendation by Congressman Faleomavaega Eni, the governor said earlier this month that his administration will be taking the necessary steps to have the federal government designate the Faleasao wharf as a federal area, which will expedite needed improvements using federal funds. The most urgent project is the Faleasao dredging maintenance which is not under the administrative and funding purview of the Army Corps, Lolo said. Dredging of the Manu a harbors was among the projects to be funded under the $20-milliondollar loan ASG received more than 5 years ago from the ASG Employees Retirement Fund, but the project ran into problems. During a Senate Investigative Committee hearing last August, then Port Administration Director Matagi McMoore told senators that $2 million was for the dredging project, and this covered the two barges and the excavator. The committee was probing the spending of the $20 million loan. Port Administration Deputy Director Chris King testified during the same hearing that the U.S. Coast Guard had not approved the use of the barges, which were to dredge the Manu a harbors. He said the excavator was to sit on one barge while the other was for spoilers (or to support the dredging process). As of two weeks ago, the barges were said to be deteriorating, being anchored along Pago Harbor while the new administration tries to find ways to recover any money by selling the barges, which are spud barges for use only on rivers and lakes. Dredging the harbors in Manu a has been discussed in the Fono several times and there were calls made during the previous administration to carry out the work but nothing was ever done. Large explosion targets courthouses in east TRIPOLI, Libya (AP) Two large explosions hit courthouses in the city of Benghazi late Sunday, leaving part of one of the buildings a pile of rubble, two security officials said. An official in Benghazi said 10 people were wounded, two seriously, in the explosion outside one courthouse. Video posted by residents online showed several vehicles destroyed by that explosion. The video also showed residents standing in a crater in the ground outside the building. Another courthouse in the eastern part of the city was also hit, said a security official in the capital, Tripoli. The courthouse in the north of Benghazi was the site of the first protests against dictator Moammar Gadhafi in early 2011 that led to his ouster. It continues to be a hub for protests. The explosion erupted just before a planned protest outside one of the buildings to mark the second anniversary of the death of Gen. Abdul Fattah Younis, a former Gadhafi security minister who defected from the regime to join the rebels fighting him. He was killed in July 2011 by his comrades while in custody after he was arrested on suspicion of treason. Board suspends termination of positions Continued from page 3 Velega won t argue for personal gain, but for the betterment of everyone, said Avegalio. An important issue raised by Sen. Soliai Tuipine and was agreed to by Mauga, is for the board take a serious look at re-starting the off-island medical referral program to assist patients who need off-island care. Soliai urged Velega and the board to find money to fund this useful program, which is needed when patients cannot be treated at the LBJ Medical Center. (The referral program has been on hold for more than three years now due to the lack of funding.) As a military veteran, Sen. Tuiasina S. Esera urged Velega who is also a military veteran to look at improving the LBJ s status so that TriCare, the health care program for active military members, retirees and their families, is available at the hospital. Tuiasina said TriCare provides millions of dollars in health care money for veterans but local veterans and their families have to travel to Honolulu because the program is not available here due to problems at LBJ that require fixing. He didn t elaborate further on the problems or status. Towards the end of the hearing, Mauga reminded Velega that the hospital is very important to the welfare and health of residents. He said the governor has stated over the months since taking office that everybody matters and the Senate knows that Velega will feel the same when he is confirmed as a member of the board. To me, everyone is treated the same, was Velega s response in his parting statement. He told senators that he has checked with the Veterans Administration and was told that the VA cannot accept the current standards of LBJ; hence the reason military health care is not used at the local medical center. Velega said he wants to elevate those standards so that local veterans and their families are served at the local hospital. He pointed out that the hospital is in need of the Fono s support when it comes financial needs and other matters.

He told lawmakers that carrying out the payroll deduction system cost the government $156,000 and added that the Treasury Department will be traveling to Manu a to conduct payroll cashing for ASG employees in Manu a, and this will be done bi-weekly. The Treasurer informed House members that he is working with the Manu a Liaison Officer Sualevai N. Sualevai on this project. Falema o said another issue he has spoken to the governor about is having all ASG employees checks direct deposited, which he said would make things easier. But, he added, some people want to see their check in paper form. The Manu a faipule told the Treasurer that it s not the government s priority to take cash to Manu a, because payroll deduction not only affects the employees but also the businesses. Ma oputasi Rep. Va amua Henry Sesepasara said there was a resolution regarding payroll deduction and the governor was requested to reconsider the matter. Va amua told the Treasurer to think back and remember the years when he was a House member and the times when constituents would raise issues such as this. He then asked Falema o to talk about the $156,000 savings from canceling payroll deduction. The Treasurer explained that since payroll deduction was discontinued, there has been no more overtime for treasury employees and the workload has been lessened. Va amua then told Falema o that there have been complaints about the Treasury Department and its employees, regarding the hiring of new people and yet, the payroll deduction was eliminated to save money for the government. The faipule urged Falema o to reconsider his move and asked, Is it worth the government saving $156,000 over ASG employees who are in great suffering from this issue is it worth it? Falema o responded that this move benefits everyone as a whole the government and its people and the question that I ask, is it the government s responsibility to serve our people in this manner? Is it the government s job to serve the needs of a few people and what about everyone else? This benefits some of the government employees yet it s tax payer money that is used to pay for these services and my answer is I m for the people. He continued, Is it right for a government employee to have five payroll deductions five times a week? Some of them take zero money home! The Treasurer told lawmakers that there are more than 4,000 ASG employees and about half were using the payroll deduction system, and it takes $156,000 from each payroll to provide this service. An emotional Tualauta faipule Rep. Florence Vaili Saulo, who owns a local insurance company with most, if not all, of its ASG clients paying premiums using payroll deduction, told Falema o that the discontinuation of the payroll deduction system has affected local companies, which are founded and owned by locals who have the goal of being successful. She pointed out that she has lost hundreds of clients due to this move. Rep Taotasi Archie Soliai intervened but that did not stop Vui from getting her point across to the Treasurer on the impact the move has made on local companies.
