(Faaauau itulau 14) DOE DELAYS SCHOOL OPENING UNTIL MONDAY, AUG. 19 Twelve schools cited by Dept. of Health for sanitation problems by Joyetter Feagaimaali i-luamanu Samoa News Reporter The Department of Health inspection of the public and private schools on sanitation issues in the cafeterias, restrooms and classrooms has led to a decision by the Department of Education to delay the start of the new school year, which was slated for this coming Monday August 12, Instead, school opening will be postponed one week and school will officially begin on Monday, August 19. This was announced by DOE Director, Vaitinasa Dr Salu Hunkin-Finau who noted that out of the 46 private and public schools, ten public and two private schools have been cited for sanitation problems. Dr. Hunkin-Finau stated that They (DOH) looked at the cafeterias, bathrooms and total grounds including the classrooms; it s not just bathrooms and cafeterias, which are in a much more critical condition, and these issues need to be addressed right this moment. The schools that were cited and recommended by DOH to close down included two high schools Fagaitua High School and Nu uuli Vocational Technical High School; while Elementary Schools consisted of Afonotele, Aua, Coleman (Pago Pago), Le atele (Fagasa), Matafao ECE Program, Pava ia i, Siliaga (Aoloau) and Tautalatasi Tuato o Alofau. Two private schools are on the list: Marist St Francis Elementary and Ta iala Academy. I plan to work hard as a prosecutor by being fair and unbiased and represent ASG well during my time here. I am grateful for the opportunity to serve as a prosecutor here in American Samoa. The defendant was facing three counts of third degree assault (domestic violence) which are all felony counts and three counts of Public Peace Disturbance. According to the plea agreement that was read in court, the government moved to amend the three felony assault charges to third degree assault misdemeanors, which Tuamoheloa pled guilty to, while the remaining charges were dismissed. Associate Justice Lyle L Richmond accepted the plea agreement and scheduled sentencing for August 26, According to the government s case, the girlfriend filed an official complaint at the West Substation in Tafuna, where she claims that she was assaulted by the defendant the same day. The incident is alleged to have occurred last week Friday. The case was assigned to Police Officer Latarah Ah See, say court documents. According to the documents, the girlfriend claimed she was assaulted outside her work place in Futiga and was threatened by the defendant that he would kill her if she was to report this incident to police. The girlfriend stated that the defendant was a controlling and jealous person, who sometimes forbade her from going to work or leaving their house until he returns from work. According to the government s case, the defendant went as far as trying to take the girlfriend s car keys and important documents to prevent her from going anywhere. Court filings further state that the defendant would allegedly beat up his girlfriend when she s around men. On the day of the alleged incident, the girlfriend went to the defendant s work place five minutes late, he became upset and punched the victim several times in front of his co-workers, and the victim claimed she was afraid for her life. She stated that this was not the first time he had assaulted her. Court filings say that on February 27, 2013 the defendant allegedly punched the girlfriend s face so she contacted the police. She alleged that on the following day the defendant strangled her and punched her arm. She also told the police that she had only been dating Tuamoheloa for two months and it was just days after they started seeing each other he started to show a violent and jealous side. The girlfriend also told of a time the defendant was upset that she was talking to another man, he beat her in the car and abused her verbally and prevented her from leaving and she was trapped in the vehicle. Police viewed scratches on the left side of the girl s neck and bruises on her face and arm. The government claims the defendant has a previous conviction of domestic violence from August of last year. PETERS JAILED IN STEALING CASE Andrew Peters, also known as Luaao Andrew Fagota was sentenced to 20 months in jail, as part of his five year sentence in a robbery case. The defendant was charged with robbery second degree, stealing, three counts of third degree assault, two counts of aiding a child to posses or consume alcohol, underage drinking, public peace disturbance and property damage third degree stemming from allegations that he gave beer to minors and also attacked one or two people for no reason, the government claims. In a plea deal with the government, the defendant pleaded guilty to second degree robbery while the remaining charges were dismissed. Associate Justice Lyle L Richmond sentenced the defendant to five years in jail, however execution of sentencing was suspended and he s placed on probation for five years under the conditions that he serve 20 months in jail. According to the government s case, on Feb. 2, 2013, police received a call about boys and girls drinking in a shack behind a store in Pago Pago. Police arrived at the scene and several juveniles took off on foot. One of the juveniles arrested mentioned that Peters had bought the beer. The government claims that on the same evening a female contacted the police to report that Peters had assaulted her friend in front of a store in Pago Pago. Good Saturday morning to all good friends and loyal fans of Hawkeye. Hawkeye arose and looked out his window through the closed curtains, and said to himself: Self, think. And then he thought, and said to himself; Oh Oh Oh, Tut Tut, I think it will be a beautiful day! And it was. One of the Hawkeye readers asked the Hawk why he was always making fun of his old dead redneck daddy. Hawkeye s answer was: Who is making fun? This is history! Hawkeye was reading in one of the regular magazines that he and Sweet Leanor receive where the Italians have allowed the ruins of the ancient city of Pompeii to once again be reduced to ruin. This is supposedly due to a gross lack of funding as the Italians are hurting for Tupe, (Money) just as is the rest of the world. What a shame to allow such a piece of ancient history be reduced once again in to ruin! Pompeii is the City that served as a vacation spot for the Ancient Roman Centurions and royalty in the early days prior to the 79AD eruption of Mt. Vesuvius which towers to this day over the ancient city of Pompeii. If Hawkeye were ever to win the Powerball lottery, he would definitely donate some of the funds towards the preservation of this once fine city. Since Hawkeye s younger days, and reminiscing over his early visits to Pompeii, it has always remained as one of the first places that Hawkeye would consider revisiting. This was a city of fun and sin which abounded more or less twenty four hours a day. It was ancient party times W.O.C. (with out censorship) this in itself leaves so much to the imagination, and also leaves Hawkeye with a constant urge to walk the streets of Pompeii once again as the number one item on his Bucket List! Hawkeye also has completed reading an article pertaining to the Fading Ice Caps. It is said with a high degree of authority that the Greenland Glacier is falling off in to the sea at the alarming rate of 172 Feet per day! This is totally unacceptable! It is now thought based on recent research by a high school drop out that the Ice is not melting from the inside out as believed earlier, but melting at an alarming rate due to the lack of reflection generated by the sun! Snow is known to have the most reflective power of heat from the sun due to its being super white to the point that Homo-sapiens have to wear Snow Blinders in order to arrest the glare. It is now believed that the snow has changed color from Industrial Pollution and forest fires, and that the snow and Ice have lost their ability to reflect the glare of the sun, thus causing the Ice Caps to disappear into the sea at an alarming rate. [photo: AF] Pago Pago grocery store may be selling contaminated food as DOH looks the other way by Samoa News Staff It s a case of contaminated frozen food products, alleged bribery, and a flurry of questionable immigration issues. Last Wednesday morning, several people, including a representative of Samoa News, witnessed a refrigerated container full of frozen food products belonging to T.M. Inc./Super M, a grocery store located in Pago Pago, being unloaded and cleaned out. According to a Samoa News confidential informant, on that day, two representatives of the Department of Health s Environmental Health Division (one who has been identified to Samoa News) and a co-worker (whose identity is unknown), pulled up to the store parking lot in an official DOH licensed vehicle. The two men came armed with a camera and ordered the store employees to unlock the refrigerated container. The DOH representatives proceeded to take photos of the container, saying the frozen food products were contaminated. Witnesses told Samoa News that afterwards, one of the DOH staff locked the container and took off with the keys, telling the workers that the contents of the container were contaminated and needed to be cleaned out, and he would be returning the next day (Thursday) to carry out a follow-up inspection. (It was not understood how the DOH rep expected the workers to clean out the container since he had locked it and taken off with the keys). As of press time yesterday, neither of the two inspectors, nor any other DOH inspector had returned to the store for the announced inspection. The Samoa News representative who was at the site that day reported a bad stench coming out of the container as it was being unloaded in front of the store next to the main road. A man, later identified as one of the incorporators of the business T.M. Inc./Super M confronted the Samoa News representative and said, you people have no right to be here asking questions, and inquiring about what is going on here. According to the company s Articles of Incorporation, Tausaga Vaoalii, along with Tauolo Vaoalii and Mele Sumile, are the local business partners of the store owner, a Chinese man by the name of Mu. When the Samoa News representative asked about the possibility that the DOH inspectors were bribed that day with $500 to look the other way, the business partner became irate, walked towards the Samoa News employee, and threatened to call his lawyer. No citation was issued as is standard procedure for any and all businesses which have been found to be selling contaminated goods. According to Samoa News sources, later that same day the store owner returned with the container key and ordered employees to unload the contents of the container and clean it out. How and when the keys were returned to the store owner is not known. Sources who have inside knowledge of business dealings for this particular establishment report that DOH inspectors frequently stop by the store to pick up envelopes in exchange for by-passing inspections. Witnesses claim that one of the DOH representatives told the employees his visit was to give them a warning to clean out the container and get rid of the contaminated items before DOH inspectors stop by to conduct inspections. (It is NOT standard procedure to warn business owners about forthcoming DOH inspections, as this will give them time to discard expired food items). The frozen foods that were unloaded that day included numerous cases of chicken, sausages, crab meat, pork, and a large fish. (See photo on the front page). (AP) A small plane crashed into a residential neighborhood a few blocks from an airport while trying to land, setting fire to two houses and likely killing up to six people, authorities said. Just before noon Friday, the multi-engine, propeller-driven plane struck two small homes near Tweed New Haven Airport. The aircraft s left wing lodged in one house and its right wing in the other. Late Friday, officials from a number of agencies were still at the scene trying to determine how many people had been killed. Officials said the total was between four and six. The victims of the crash have not been identified. We haven t recovered anybody at this point, and we presume there is going to be a very bad outcome, East Haven fire Chief Douglas Jackson said Friday. National Transportation Safety Board investigator Robert Gretz said at a news conference Friday night there were casualty reports of two or three people in the plane and two or three people in one of the homes. He said the reports were unconfirmed and that local and state authorities were at the scene looking for victims. Shortly after the crash, officials had said at least three people were missing: the pilot and two children, ages 1 and 13, in one of the houses. Later, Gov. Dannel P. Malloy said the plane also may have been carrying two passengers. However, officials were still trying to verify whether that was true. Less than two hours later, Malloy said rescuers had spotted two bodies, including one of an adult, but hadn t recovered them. The plane s fuselage had entered one of the houses, and the recovery effort was focusing on the home s basement, he said. Chinese doctor detained over baby trafficking BEIJING (AP) Local authorities have detained nine people, including an obstetrician, on suspicion of baby trafficking at a hospital in northwestern China, state media reported. Among the detained suspects is Zhang Shuxia, an obstetrician at the hospital who abducted newborns by sometimes falsely claiming the infants were born with congenital problems, it said. He entertained Dallas Mavericks fans with a goofy dance troupe. Friends and family members described him as a gentle giant. But the Texas man with an imposing 6-foot-7, 335-pound figure had a violent history, as court documents showed he d threatened to kill his estranged wife and her sons. Bowser, 44, has been charged in this week s Dallas-area shootings that killed four people and wounded four others. He was being held Friday on a combined $3 million in bonds, and has at times refused to talk with detectives. Erbie and Zina Bowser had begun divorce proceedings in 2011, when court documents show Erbie Bowser made threats against Zina, telling her that if she tried to take any of their belongings, I will bury you. Zina Bowser said he took a pocketknife from a drawer, opened it and said, Call the police and I will execute your kids, documents show. After that, a Dallas judge granted a protective order, banning Erbie Bowser from coming within 200 yards of his estranged wife and her children. The judge wrote in his report: Family violence has occurred and is likely to occur in the future. Bowser is now charged with four counts of capital murder two in Dallas and two in DeSoto as well as two counts of aggravated assault in Dallas. Bowser s aunt, Billie Fulmer, told the Dallas Morning News, It s not like Erbie to do this. Something pushed him over the edge and I don t know what it was, Fulmer told the newspaper. He must have snapped. About 10:30 p.m. Wednesday, police received a call from a Dallas residence. There, they found two women who were fatally shot Bowser s girlfriend Toya Smith, 43, and her 17-year-old daughter Tasmia Allen as well as two wounded boys, Smith s 14-year-old son and 17-year-old family friend Dasmine Mitchell. Mitchell identified Bowser as the lone shooter from a lineup of suspect photos, according to an arrest affidavit released Friday. Police say not long after the first shooting, Bowser traveled to the Dallas suburb of DeSoto and shot and killed Zina Bowser, 47, and her daughter, 28-year-old Neima Williams. Two boys, ages 11 and 13, were wounded. DeSoto police spokesman Ron Smith said Friday they don t plan on releasing any new information at this time. Bowser s lawyer didn t immediately return calls seeking comment Friday. All four survivors were in critical condition, police said Thursday. Hospitals didn t immediately return calls Friday. Bowser, who d played in three football games at Texas Christian University in the late 1980s, served as a staff sergeant in the U.S. Army from October 1991 to November 2000, but never deployed overseas. He worked for nearly a decade as a special education teacher in the Dallas suburb of Mesquite. School district spokeswoman Laura Jobe said Thursday he resigned in 2010 on good terms. He was also a football coach at West Mesquite High School for a couple seasons, she said. Public records show Bowser had started a nonprofit organization in 2010 aimed to help children, but it has been inactive since shortly after he registered it with the state. He also had performed from 2002 to 2009 with the Dallas Mavericks Dallas Mavs ManiAACs, a men s dance troupe. Beauty queen charged with possessing bombs SALT LAKE CITY (AP) Prosecutors filed charges of bomb possession Friday against a recently crowned Utah beauty pageant winner. Kendra McKenzie Gill was arrested last weekend with three accomplices for what one described as a prank. All four face the same set of four felony charges, prosecutor Blake Nakamura said Friday. The 18-year-olds were arrested Saturday after driving around neighborhoods and allegedly tossing plastic bottles filled with caustic chemicals at people they knew. Nobody was injured. We don t really understand a clear reason for their behavior, Nakamura said. The reason we charged them is obviously, what they possessed was indeed explosives, and we re alleging they were throwing them near homes and at people, and therefore, had the potential to cause a great deal of harm. Felony bomb possession is punishable by 1 to 15 years in prison. Gill was crowned Miss Riverton, topping a slate of nine beauty contestants earlier this summer in the Salt Lake City suburb. She showed off years of piano training with a Scott Joplin number and took home a $2,000 scholarship. Others charged Friday were John Patrick Reagh, Shanna Marie Smith and Bryce Christopher Stone. All four are due to make their first court appearance together Aug. 26 in Salt Lake City. Each has been released on $50,000 bond. Nakamura said some or all of the teens had attorneys, but he didn t know the lawyers names. All four acknowledged they were tossing bombs powered by a toilet bowl cleaner reacting with aluminum foil on sidewalks, front yards or in streets to scare some of their other friends, Unified Fire Authority investigator Steve Bowen said in a court affidavit filed Friday. Texas teenager finds his mother s body in freezer MINERAL WELLS, Texas (AP) Authorities say a teenager has discovered the body of his mother in a freezer at her North Texas home. Mineral Wells Police Chief Dean Sullivan says the body was discovered Thursday evening and that the death is being investigated as a possible homicide. He says no suspects have been identified. Police are withholding the name of the woman, believed to be in her 40s. Texas Rangers are assisting in the investigation. Authorities are awaiting autopsy results. The teenager called the police after finding the body in a deep freezer often used to store meat and other foods for long periods. It s not clear what led him to look in the freezer. Mineral Wells is about 50 miles west of Fort Worth. Police: W. Pa. man beat wife with frozen meat ALIQUIPPA, Pa. (AP) Authorities say a western Pennsylvania man beat his wife with a package of frozen ground beef, then ran away when police were called. Police were called to the Aliquippa home of 51-year-old William Neugebauer on Tuesday for a report of a dispute with his wife. They found Wendy Neugebauer suffering from swelling on her rib cage, where she told police her husband hit her with the meat. Police say William Neugebauer ran away, but they found him a half hour later when he returned home. He was then arrested. The Beaver County Times reports that he faces a preliminary hearing Tuesday on charges including simple assault, reckless endangerment, harassment and public drunkenness. He remained jailed Friday unable to post $10,000 bond, according to online court documents. No attorney is listed for him. The Daily Breeze of Torrance says Daniel Juarez entered pleas Thursday to four felony counts. Two similar charges were made against him last fall. Prosecutors contend that Juarez lied on campaign finance forms about the source of nearly $25,000 in cash that he deposited in his personal bank accounts. Authorities say the donations were intended for his 2009 election campaign and for a memorial fund for a police officer killed in a motorcycle crash. Juarez remains free pending trial. The sitter s intriguing smile, however, might remain a mystery. Murder suspect commits suicide in So. California jail RIVERSIDE, Calif. (AP) A suspect in the kidnap and murder of a man whose body was found in a burned car has killed himself at a Southern California jail. The Riverside Press-Enterprise says a cellmate discovered 18-year-old Richard Gonzalez hanging from a bedsheet in his cell Wednesday night at a detention center in Rancho Cucamonga one day before his scheduled court hearing. He was pronounced dead at a hospital. Authorities say there s no evidence of foul play. The Fontana man was charged with kidnapping and killing 40-year-old Alejandro Padilla during a robbery. Padilla s body was found in a burned car in Rialto on July 26. Another man, 18-year-old Edward Anthony Morales, has pleaded not guilty to murder and other charges in the case. Two other people have been charged as accessories. Hawaii legitimizes Kauai rescue tubes LIHUE, Hawaii (AP) The state this week moved to formally approve the presence of hundreds of rescue tube stations that have saved the lives of dozens of people in Kauai waters. The Garden Island newspaper reports that the state and the Kauai Lifeguard Association signed documents Wednesday legitimizing the stations, which have been around for about five years. Monty Downs, Kauai Lifeguard Association president, said the program can now continue on Kauai and expand to other islands. Rescue tubes obviously aren t in the same ballpark as having lifeguards on our beaches, but their presence has been responsible for quite a number of lives saved, Downs said. There have been 67 documented cases where lives were saved with the rescue tubes, Downs said. The rescue tube station program started in 2008, when a citizen hung a lifeguard s rescue tube on a shoreline shrub at Larsen s Beach. A beachgoer soon after used the tube to rescue someone pulled out to sea. The lifeguard association picked up on this and began setting up rescue tube stations. Downs said beaches up to the high water mark are owned by the state, and for five years the state kept a benevolent eye on the developing program. The good news is that they didn t tear them down, Downs said, and because of that there are a fair number of people walking around, people who wouldn t have been alive were there not a rescue tube, and a person to use it, at the beach where they got in trouble. There are today more than 200 stations on Kauai s beaches, as well as some on the Big Island and on the Outer Banks of North Carolina. Downs said the program has been able to help Kauai with its tough, tough ocean safety challenge. More than a dozen people have drowned on Kauai this year. The defendant was charged in this case after he was released from jail in burglarizing a taxi and taking off with an iphone. TAPENI PIO ENTERS GUILTY PLEA IN SEXUAL CASE A man charged in a sexual case has entered into a plea agreement with the government. Tapeni Pio was charged with rape, sodomy and two counts of sexual assault. In the plea deal that was read in open court, the defendant pled guilty to two counts of sexual assault while the remaining charges were dismissed. Associate Justice Lyle L Richmond, accepted the plea agreement and scheduled sentencing on August 26, According to the plea agreement, defendant admits that he had sex with a 15 year old girl, a minor. Store may be selling contaminated food Continued from page 4 Samoa News was informed by a Pago Pago resident that an elderly woman was hospitalized recently with a bad case of food poisoning, alleged to have been caused by contaminated chicken purchased from the same store. In addition, Samoa News was told that not all of the items that were unloaded that day were discarded, as was instructed, but that some of the items are hidden in the back of the store, while some were put back into the store s indoor freezer. Samoa News sent a photographer to the store yesterday morning to snap a photo of the chicken in one of the store s freezers. The chicken had bad freezer burn and looked like it had been defrosted and then re-frozen. (See photo). Because of the language barrier, Samoa News was unable to obtain comments from the store owner. The store in question is apparently one of a chain of three stores, two located in Pago Pago and another in Leloaloa. The other store in Pago Pago is located on the road heading towards Fagasa, close to the entrance to Uifaatali Peter Coleman Elementary School. That store was reportedly shut down because of immigration issues but Samoa News understands that the business operates during odd hours opening for a few hours, closing down, and then opening back up again. On Thursday, August 1, immigration officers conducted a random check at the T.M. Inc. branch in Leloaloa where three of the workers there were said to have expired immigration papers, and were not living with their sponsors. One of the sponsors was identified as a Nuuuli man. Because it was the first day of the month, immigration officials pointed out that the documents allowing them to enter the territory had expired the night before, on July 31 and noted that foreigners, by law, are to reside with their sponsors. As of press time yesterday, Samoa News was unable to confirm the exact whereabouts of the Chinese workers - whether they are in the government s custody or hiding out somewhere on island. Samoa News sought comments from the head of the DOH Environmental Health Division, Papalii Marion Fitisemanu on Thursday afternoon. According to Papalii, there were no scheduled store inspections that day. As a matter of fact, this whole week, DOH inspectors have been divided up into teams to carry out inspections solely for Department of Education facilities, namely the cafeterias, explained Papali i. When asked what actions will be taken against any and all inspectors found to be accepting bribes or forewarning businesses about upcoming inspections, Papalii said in cases like that, disciplinary action must and should be carried out but only after internal investigations are conducted and a full report is made, confirming any illegal activity. Matters like this should not be taken lightly and if I find any discrepancies with the way any of the these inspectors are doing their job, necessary action will be taken, he said, adding that he will definitely look into the accusations. This effort should not fall only on the government, rather it should be a community project given that these are our children using these facilities, said Vaitinasa. The DOE Director noted that while she totally appreciates the DOH s move, this should have been done years ago. It s obvious DOH have not being doing their duty and now they have decided to do it just in time for school to start. Had they done it earlier during the summer that would have given us enough time to fix the problems but nonetheless I m grateful for their work. According to the DOH report which was provided to Samoa News by DOE, after the DOH inspections, recommendations were made for the DOE to work closely with DPW, ASPA, DPS and EPA. It notes that the DOE school lunch program needs to cooperate with DOH. DOE Sanitation team needs to work together to conduct regular facility visits and implement action plans, and recommend an immediate government task force of multi-disciplinary individuals, departments and agencies and private entities to deal with immediate citations. The DOH report had photos of rodents and insects found in the storage food areas. According to the report the Fire Department also needs to be more involved in training school staff. EPA and ASPA need to monitor water, sewage and disposal on school premises. There should also be a long term outlook on building permit regulations and include Public Health input for sanitation standards. Every school must have a security, fence or retaining wall. Fumigation must occur annually and all cooking areas should be equipped with exhaust vents. All school lunch workers should possess a valid health card and proper attire and every kitchen must have an inspection checklist. All unserviceable equipment should be inventoried and removed from the campus, says the report. Yes, it s reality TV but with a lot more depth as much as 10,000 feet. It s live coverage of deepsea exploration off Nantucket and tens of thousands of people are tuning in. They re watching an eel suddenly attack a squid, oohing-and-aahing over hot pink starfish and listening as excited researchers discover a canyon so downright alien that sea life lives on methane escaping from the sea floor instead of sunlight. They re watching science as it happens, however weird and wild. We ve been calling it Deep Sea TV, said National Marine Fisheries Services scientist Martha Nizinski, in a ship-toshore interview. It s much better than any other reality show being broadcast. For years, the world of the deep sea floor has mostly been the province of scientists. A handful of researchers would huddle on a ship and watch the video from below, take notes, and two or three years later write a scientific paper. Now, as the National Oceanic and Atmospheric Administration s ship Okeanos Explorer and its robotic submarine explore thousands of feet deep, the view is broadcast live, usually from 8:30 a.m. to 4:30 p.m. EDT, for other scientists and everyday people to follow along to the tune of 50,000 visits. Leona McKinney of Hiram, Ga., started watching from home over three weeks ago. I ve watched every day since then. In fact, I m watching now. I m hooked on it, she said in a phone interview Wednesday. The expedition, which costs about $40,000 a day, continues until Aug. 16. As the robotic sub roams the Atlantic Ocean off Massachusetts, scientists can call in or send messages with requests to see this or that. In past years, the ship explored the Pacific Ocean, but the next several missions will be off the East Coast with officials considering a deep Puerto Rico trench dive in the winter with live coverage, of course. Aboard the ship, researchers do more than watch; they explain the science and the action for viewers. It s a bit like color commentary from sports, said U.S. Geological Survey scientist Amanda Demopoulos, whose voice is often heard calling the underwater action. These are mysterious ecosystems. We don t always know what we re going to find. The expedition seems to be gaining loyal viewers, Nizinski said. We re giving everybody a really good diversion and keeping them from doing their work, she said.
