The handbk serves as a guide fr academic and nnacademic plicies. Students are respnsible fr using the handbk as a resurce when issues and questins arise. The infrmatin in this handbk is updated annually. In additin, changes may at times be made during the academic year. 6 SECTION 1: OVERVIEW This sectin prvides yu with a brief intrductin t the University f Wyming Fay W. Whitney Schl f Nursing, hereafter referred t as the Schl f Nursing r FWWSON. Legislatin t initiate the BSN prgram at the University f Wyming was passed in 1951 with students admitted that fall. The prgram received initial accreditatin frm the Natinal League fr Nursing (NLN) in 1955 and has maintained accreditatin since that time. Currently, all f the FWWSON undergraduate and graduate prgrams are accredited by the Cmmissin n Cllegiate Nursing Educatin (CCNE) thrugh The FWWSON has a well established undergraduate prgram with three ptins t btain the Bachelr f Science in Nursing (BSN) degree: Basic BSN a basic, entry-level BSN ptin fr students wishing t becme registered nurses at the baccalaureate level; Bachelrs Reach fr Accelerated Nursing Degree (BRAND) an accelerated BSN ptin fr students wh have already achieved a previus nn-nursing baccalaureate degree and wish t becme a registered nurse at the baccalaureate level; RN/BSN Cmpletin a BSN cmpletin ptin fr registered nurses r Wyming assciate degree nursing students wh wish t further their educatin t the baccalaureate level (nline prgram). The FWWSON has tw graduate ptins: nurse practitiner and nurse educatr. The nurse practitiner ptin has tw cncentratins: family nurse practitiner and psychiatric mental health nurse practitiner. Certificate ptins als are available at the graduate level fr nurses with a previus master s degree in nursing wh desire anther rle preparatin r ppulatin fcus. Missin apprved AP Meeting PHILOSOPHY The State f Wyming is predminantly rural with many cmmunities meeting the federal definitin f frntier. The University f Wyming is the nly institutin in the state that ffers baccalaureate and graduate educatin in nursing. As a leader in prfessinal nursing, utreach, and rural health, the FWWSON prgrams are designed t address the health and nursing care needs f rural clients, families, and cmmunities. Prfessinal nurses prvide caring, safe, and cmpetent care within their scpe f practice. All nursing faculty and staff are a member f at least ne cmmittee. Students may vlunteer r be invited t serve n the Educatin Cmmittees. The cmmittee representative serves as a liaisn between the students and the faculty. Students apprach trusted faculty with their prblems in rder t btain assistance in slving them. Students experience anxiety and stress when they are nt empwered t use apprpriate prblem slving strategies. Learning t use apprpriate prblem-slving strategies is empwering. Based upn these assumptins, the fllwing prcess shuld be used in the FWWSON by bth students and faculty. The purpse f the prcess is t facilitate student learning f a prblem-slving strategy that will empwer them t cpe with significant issues in their academic life. Cnfidentiality shuld be maintained. After rapprt is established prceed t the next step. 2. Validate. Determine whether r nt the issue has been discussed with the apprpriate faculty member r student (see Student Curse f Actin abve). It is vital t make this determinatin early in the cnversatin. If the student has nt taken this step, the student shuld be directed t d s. The student may need help in taking this step. Offer t facilitate this part f the prcess. The student may need t develp a plan fr appraching the instructr. Help in any apprpriate manner, but cntinue t reinfrce the necessity f discussing the issue with the apprpriate persn. 3. Clarify. If the student has taken the step f previusly discussing the issue with the apprpriate persn, clarify the reasn that the student is nw reprting the issue t yu. If the student des nt feel the issue was reslved apprpriately, direct the student t the next step in the prcess, which is fllwing apprpriate channels as nted under the Student Curse f Actin abve. 4. Whitney Schl f Nursing (FWWSON) Prfessinal Cnduct Cde was adapted frm thse used by the UW Schl f Pharmacy, the Jhns Hpkins Schl f Nursing, the University f Missuri Kansas City Schl f Nursing, University f Michigan Flint Department f Nursing, the Duke University Schl f Nursing, and the University f Luisville Schl f Nursing. UW Regulatins related t academic hnesty and ethical cnduct were incrprated int this plicy as well. We thank ur clleagues n campus and in nursing fr sharing their wrk. CODE Intrductin The University f Wyming Fay W. Whitney Schl f Nursing (FWWSON) has an bligatin t graduate nurses wh uphld the highest ethical and prfessinal standards. The Prfessinal Cnduct Cde has been develped t guide students wh are enrlled at all levels in the FWWSON. The Cde is designed t assure accuntability fr the prfessinal and ethical standards f the nursing prfessin. The FWWSON Prfessinal Cnduct Cde prvides guidance t students abut expected prfessinal behavirs in nursing. In additin, the university has thers cdes f cnduct that nursing students will be held accuntable t, including University f Wyming Regulatin (UW Reg) 6-802, which fcuses n academic dishnesty, and the UW Student Cde f Cnduct. Students are encuraged t cmmunicate immediately with the faculty member r preceptr when a prblem arises, either in the classrm r at a clinical site. 9. FWWSON jurisdictin fr unprfessinal behavir shall be limited, in general, t cnduct that ccurs n University premises, r at University-spnsred r University-supervised events including clinical experiences and study abrad prgrams, r, that ccurs ff University premises and has an adverse impact n the FWWSON cmmunity, its members, and/r pursuit f its bjectives, regardless f where such cnduct may ccur. Members f FWWSON cmmunity: any persn wh is a student, faculty, administratr r staff emplyed by r affiliated with the FWWSON. 8. Nursing Cursewrk: all required cursewrk including electives that make up the credit hurs fr graduatin frm a FWWON nursing prgram. 9. UW Reg Regulatin f the University f Wyming Prfessinal Cnduct The FWWSON is cmmitted t maintaining the highest standards f academic perfrmance, prfessinal behavir, persnal integrity, and respect fr each ther as individuals. Students must recgnize the special nature f their student status in relatin t their clients. Definitins belw prvide students with the expectatins f prfessinal behavir by which they shuld cnduct themselves while enrlled at the FWWSON. Students shuld query the faculty f the FWWSON whenever dubt exists as t whether a behavir is ethical and prfessinal. 1. Hnesty 8
13 Students shall deal hnestly with peple including, but nt limited t, clleagues, instructrs, representatives f the University, clients, nursing staff, any representative f clinical agencies, and ther members f the health care team. Students are expected t demnstrate hnesty and integrity in all aspects f their interactin with clients and staff particularly in assuring accuracy and cmpleteness in their actins and dcumentatin. Students shall be willing t admit errrs and must nt mislead thers r prmte themselves at the client s expense. In cases f cnflict f interest, the mral principle is clear- the welfare f the client must be paramunt. Students shall strive t reprt, using the apprpriate prcess, vilatins f the Prfessinal Cnduct Cde. 2. Respnsibility, Accuntability and Prfessinal Grwth Students accept individual respnsibility and accuntability fr actins and nursing cmpetency. T give safe care, students must assume persnal respnsibility fr being in gd physical and mental cnditin and the knwledge and skills necessary t give this care. Students must be familiar with and fllw the rules and regulatins f the FWWSON (lcated in the Student Handbk) and the University. Students will als bey federal, state and lcal laws. The FWWSON s gal is t prvide a learning envirnment that supprts self-assessment, inquiry and lifelng learning. Students must acquire the cmpetencies (attitudes, knwledge and skills) that the faculty determine essential. Students will seek apprpriate supervisin as necessary t prvide safe care. Students are expected t respnd t cnstructive criticism by apprpriate mdificatin f behavir. 3. Respect and Cmpassin Students shall cnduct their practice withut discriminatin n the basis f age, race, religin, sex, natin f rigin, sexual rientatin, r disability. Students will respect the dignity and rights f clients and their significant thers regardless f scial r ecnmic status, persnal attributes r nature f health prblems. 4. Cnfidentiality Students shall respect the rights f clients, clleagues, affiliated institutins, and ther health care prfessinals, and shall safeguard client cnfidences within the cnstraints f law. The client s right t cnfidentiality in regard t his r her health recrd, which includes cnfidentiality f persnal and scial histry, is a fundamental tenet f health care. 5. Prfessinal Demeanr Unprfessinal Behavir Students are representatives f the FWWSON, and shuld realize that their behavir may psitively r negatively affect the image f the FWWSON.. Students shall interact with all members f the healthcare team in a cnsiderate manner and with a spirit f cperatin. Unprfessinal behavir is the failure t bserve and maintain the standards f prfessinal cnduct, as utlined abve. Examples f prfessinal miscnduct cnsidered unacceptable in all nursing prgrams at UW include, but are nt limited, t dishnesty, lack f respnsibility and accuntability fr nursing, failure t uphld standards f prfessinal nursing practice, lack f respect and cmpassin fr thers, breaches f cnfidentiality, misrepresentatin, inapprpriate prfessinal behavir and lack f cllabrative and cllegial relatinships. Prfessinal cnduct assumes that the student uphld standards f academic hnesty (as utlined in UW Reg 802) and the UW Cde f Cnduct. In sme cases, there may be verlap between these dcuments and grievus miscnduct may result in sanctins under ne r mre f these plicies. Students shuld query the Dean f FWWSON whether an academic r prfessinal behavir is apprpriate, whenever dubt exists. Sanctins fr Unprfessinal Behavir As UW students, FWWSON students will be held t all University plicies regarding academic dishnesty and Cnduct Cde vilatins. Students may als be subject t FWWSON sanctins, depending n the nature f the behavir. The cnsequences f unprfessinal behavir vary with the level f seriusness. Any 9
14 level f unprfessinal behavir may be cause fr initiatin f the apprpriate frmal prcess and prcedure fr vilatin f the Prfessinal Cnduct Cde at the FWWSON, Cllege and/r University level. Depending n the nature f the vilatin, any f the fllwing types f sanctins (with crrespnding dcumentatin) will be applied. Mre than ne sanctin may be impsed fr any single vilatin. These sanctins may include: 1. Cunseling: The FWWSON may elect t cunsel the student as a first step tward slving a prblem f miscnduct. In additin, students may be referred and/r transferred t an apprpriate academic advisr fr discussin and cunseling. Individual cunseling shall be dcumented in the student recrd. 2. Remval frm a class: Students wh engage in acts that result in the disruptin f a class may be directed t leave the class. If the clinical instructr's evaluatin f the student nurse's behavir r health status indicates that the student is unlikely t prvide safe nursing care, the clinical instructr can deny the student nurse access t clinical learning experiences. 4. Reprimand: Depending n the gravity f the ffense, a reprimand may be the first disciplinary step r may fllw a recurrent vilatin that received previus cunseling by a specific faculty member and/r faculty advisr. An fficial letter detailing the ffence and the student s failure t maintain expected standards f cnduct will be placed in the student s flder and a cpy given t their advisr. 5. Prbatin: Prbatin may be impsed when the miscnduct is determined t be f serius nature. Besides all authrized sanctins relevant t each type f vilatin, the student may be placed in a status f warning by the Dean f FWWSON fr a specified perid. Further miscnduct during this perid will cnstitute grunds fr disqualificatin, suspensin r expulsin. 6. Suspensin: terminatin f the student s prfessinal student status fr a stated perid f time in prprtin t the seriusness f the ffense. 7. Expulsin: final terminatin f student s prfessinal nursing student status. 8. Restitutin: if the miscnduct has caused lss r damage t an individual, schl r University prperty, r injury t a persn, reparatin may be made by payment f mney r the perfrmance f services. Restitutin may be a disciplinary step applied simultaneusly with individual cunseling r any ther sanctin described in this dcument. The Prfessinal Cnduct Cde identifies areas f cnduct which are judged unacceptable fr individuals wh are either in r aspire t be in the prfessin f nursing. The Prfessinal Cnduct Cde and these Prcedures will be included in the Student Handbk. II. Hearing Officer Designatin: FWWSON Hearing fficers shall receive cmplaints thrugh the Dean f the FWWSON r his/her designee alleging miscnduct by students as utlined by the FWWSON Prfessinal Cde f Cnduct. The Dean f the FWWSON has primary authrity and respnsibility fr the administratin f the Prfessinal Cnduct Cde and the appintment f FWWSON Hearing Officers. The respnsibilities f a FWWSON Hearing Officer shall be perfrmed by such member r members f the university staff r faculty as may be appinted by the FWWSON Dean r designee n a cntinuing basis r fr the hearing f specifically designed cases. III. Prcedures fr Reprt f Vilatin, Preliminary Prcedures, Ntice, Cnferences/Hearings, and Suspensin a. Reprt f Vilatin: An alleged vilatin f the Prfessinal Cnduct Cde shuld be reprted t the FWWSON Dean r designee as sn as pssible after discvery f the incident. Any member f the University cmmittee, including students, staff and faculty, may file a cmplaint against a student suspected f vilating the Prfessinal Cde f Cnduct. Cmplaints shall be reprted prmptly withut unreasnable delay. b. Preliminary Prcedures: If the cmplaint alleges vilatins f regulatins r matter under the jurisdictin f ther university fficials, the Dean r designee shall refer the cmplaint t such fficial fr actin. Otherwise, the Dean r designee will make preliminary inquiry t ascertain whether the allegatins are supprted by available evidence and d allege a vilatin f the Prfessinal Cde f Cnduct. If nt, the Dean r designee shall dismiss the cmplaint. The Dean r designee may als assist in the reslutin f the matter thrugh an administratin dispsitin withut filing a frmal cmplaint. Otherwise, a FWWSON Hearing Officer appinted by the Dean r designee shall prceed t cnduct a prfessinal cnduct hearing accrding t the prcess utlined belw and t impse apprpriate disciplinary sanctins in cases in which the Hearing Officer determines the alleged miscnduct did ccur. At the discretin f the Dean r designee, a separate charging party and hearing fficer may be appinted fr a case. The hearing fficer shall exercise cntrl ver the prfessinal cnduct hearing. c. Written Ntificatin: The Dean r designee will ntify the accused, in writing, f the allegatins brught against him/her. The student shall receive a cpy f the Prfessinal Cnduct Cde and ther relevant dcuments alng with the written ntice. The student will be infrmed f the date, time and lcatin f the prfessinal cnduct hearing at least five (5) business days prir t t he hearing date. d. Prfessinal Cnduct Cnference: Any student accused f miscnduct wh is nt disputing the charge(s) will participate in a prfessinal cnduct cnference with a hearing fficer as utlined in Sectin IV. e. Prfessinal Cnduct Hearing: Any student accused f miscnduct wh is disputing the charge(s) will participate in a prfessinal cnduct hearing as utlined in Sectin V. f. Temprary Suspensin: The Dean r his/her designee may at any time temprarily suspend r deny readmissin t a student frm the FWWSON pending frmal prcedures when the Dean r 11

Prfessinal Cnduct Cnference infrmal prcess a. Admissin f respnsibility: Students that elect a prfessinal cnduct cnference admit respnsibility fr the miscnduct. The purpse f the cnference is t determine what sanctins are apprpriate fr the vilatin f the prfessinal cnduct cde. Students that agree t a cnference waive any rights t further hearings r appeals regarding the admitted miscnduct. b. FWWSON Hearing Officer: The designated hearing fficer will review the charges t determine the apprpriate actin r sanctin. c. Failure t appear: If a student accused f miscnduct fails t appear fr a prfessinal cnduct cnference, the hearing fficer may refer the student fr a prfessinal cnduct hearing. d. Appeal: A student that participates in a prfessinal cnduct cde hearing may appeal nly the sanctin(s) impsed by the hearing fficer. The frmal appeal shall be made in writing t the FWWSON Dean. Such dispsitin shall be final and there shall be n subsequent prceedings. V. Prfessinal Cnduct Hearing - frmal prcess a. A prfessinal cnduct hearing shall ccur within thirty (30) business days f the charge unless the Dean f FWWSON determines that it is in the best interests f the University r the student t pstpne the hearing, at which pint ntice will be given t bth the student and the charging party. b. Apprpriate accmmdatins will be made fr students wh have dcumented disabilities thrugh the University Disability Supprt Services Office. c. Discvery shall be limited t an exchange between parties f a list f witnesses fr the hearing, a brief summary f the infrmatin each witness is expected and any dcuments t be presented at the hearing. N depsitins may be taken. Interrgatins are nt permitted nr are written prehearing mtins. The parties may jintly cmmunicate with the hearing fficer by telephne n any pre-hearing matters except when the charging party and the hearing fficer at the same persn. The parties may then cmmunicate directly at any time. d. Nrmally, prfessinal cnduct hearings are nt pen t the public. At the request f the student accused f miscnduct, and subject t the discretin f the hearing fficer, the hearing may be pened t the public. e. Admissin f any persn t the prfessinal cnduct hearing shall be at the discretin f the hearing fficer. Witnesses, ther than the student accused f miscnduct, may be excluded frm the judicial hearing during the testimny f ther witnesses. f. Either party may present infrmatin, including dcuments, and/r a reasnable number f relevant witnesses in supprt f their psitin. g. The student accused f miscnduct may speak n his r her wn behalf; hwever students wh chse t remain silent shall nt have their silence used t their detriment. h. The hearing fficer may exclude any persn(s) disrupting a prfessinal cnduct hearing r wh fails t abide by the decisins f the hearing fficer. i. The hearing fficer will cnsider infrmatin that directly relates t the facts f the cmplaint r infrmatin regarding the apprpriateness f a particular sanctin. j. The hearing fficer may questin all witnesses in a hearing. k. Neither advisrs nr legal cunselrs may appear in lieu f the accused student. 12

The student may have an advisr r cunselr appear with the accused and t cnsult with such an adviser r cunselr befre and/r during the hearing; hwever, the adviser/cunselr will nt be allwed t questin witnesses and/r address the hearing fficer. The accused student must ntify the hearing fficer at three (3) business days in advance with the name and relatinship f the advisr and the name f any witness that will attend the hearing. m. In the curse f any hearing, the hearing fficer is authrized t request the appearance r additinal evidence f any student, faculty, staff member, ther emplyee f the University, r ther persn as witness. n. After the prfessinal cnduct hearing, the hearing fficer shall determine whether r nt the student is respnsible fr vilating the Prfessinal Cde f Cnduct fr which the student is charged.. If the student des nt appear at the hearing, the written statements will be the entire presentatin by that persn and the hearing fficer s recmmendatin will be made accrdingly. p. The hearing may take place by audi/visual telecnferencing fr students and/r faculty in Outreach prgrams in the FWWSON. The cnference will be scheduled by FWWSON persnnel and, at the discretin f the hearing fficer, may be set up with an independent prctr t accmpany the student at the distance site. q. If a case invlves mre than ne accused student, the hearing panel may elect t hear the tgether cases, but in that event shall make separate findings and determinatins fr each accused. r. All prcedural questins are subject t the final decisin f the hearing fficer. s. The student accused f miscnduct will be infrmed in writing f the determinatin and recmmendatins f the hearing fficer and the appellate prcess within twenty (20) business days f the clse f the prfessinal cnduct hearing. t. The standard f prf shall be by a prepnderance f the evidence which shall mean that the evidence as a whle shws that the fact sught t be prved is mre prbable than nt. VI. Recrd f Hearing/Ntice f Decisin The FWWSON Hearing Officer shall prepare a Ntice f Decisin which includes the findings f fact, findings f guilt r inncence, and the sanctins impsed. A cpy f shall be filed in the student s prfessinal cnduct recrds maintained by the Dean f FWWSON fr seven (7) years. VII. Further Appeal a. Further appeal shall be in accrdance with the Cllege f Health Sciences Appeals prcedures. b. Status during the appeal: In cases f suspensin, dismissal r expulsin where a ntice f appeal is filed within the required time, the accused student may petitin the FWWSON Dean in writing fr permissin t attend classes pending final determinatin f appeal. The Dean may permit the accused student t cntinue in schl under such cnditins as may be designated pending cmpletin f appellate prcedures, prvided such cntinuance will nt disrupt the University r cnstitute a danger t the health, safety r welfare f the University Cmmunity. Demnstrates behavirs as identified in UW s Plicy f Academic Dishnesty. 5. Vilatin f cnfidentiality. Level II Clinical Cncerns are actins with less ptential t cause harm. Such cncerns may result in actins ranging frm a written learning plan t curse failure. These cncerns include, but are nt limited t the fllwing: 1. Cmes unprepared fr the clinical experience. 2. Displays inadequate knwledge and skills necessary fr client care. 3. Fails t accept accuntability fr his/her wn actins. 4. Demnstrates disrespect, insensitivity and/r judgmental manner when dealing with thers. 5. Des nt abide by the dress cde fr activities directly related t the FWWSON. 6. Fails t attend clinical experiences as directed by faculty and/r fails t prvide prir ntificatin t the instructr/faculty and agency f an absence, tardiness, r departure frm assigned unit r flr (lnger than 5 minutes). Cnsequences f Clinical Cncerns When a student vilates the FWWSON Clinical Perfrmance Plicy, the fllwing actins will ccur: 1. The student will receive verbal feedback cncerning the clinical cncern(s) frm the faculty at the time f ccurrence. Immediate actin may be taken at this time. Level I cncerns may result in immediate remval frm the clinical experience. The Clinical Perfrmance Learning Plan shall be cmpleted by the faculty and given t the student. 2. The faculty, Prgram Crdinatr and Assciate Dean will determine the level f clinical cncern and develp an agreement with the student specifying an actin plan with a timeframe and ptential utcmes f the situatin. 3. The faculty and Assciate Dean will discuss the agreement with the student. The student, faculty, faculty advisr, Prgram Crdinatr and Assciate Dean will sign the agreement which will be placed in the student s SON recrd alng with the Clinical Perfrmance Learning Plan. Failure t adhere t the actin plan may result in failure f the curse r dismissal frm the prgram. 4. A fllw-up cnference t review the student s prgress will ccur accrding t the timeline f the actin plan. Dcumentatin will be attached t the riginal Clinical Perfrmance Learning Plan. 5. As UW students, FWWSON students will be held t schl plicies including the Prfessinal Cnduct Cde and university plicies regarding academic dishnesty and UW Cnduct Cde vilatins. BACKGROUND CHECKS AND MENTAL HEALTH/SUBSTANCE ABUSE POLICY BACKGROUND CHECK REQUIREMENTS Students enrlled in clinical training prgrams within the Cllege f Health Sciences are placed in educatinal and clinical settings where highly vulnerable clients such as minr children, individuals with disabilities, and/r the elderly, are rutinely served. These clinical/practice training sites (including schls, hspitals, pharmacies, and ther university sites) rutinely require criminal backgrund checks fr all students wh engage in clinical activities. Therefre, backgrund checks shall be required n all applicants t prgrams in the Cllege f Health Sciences prir t admissin int their prspective prgram. Students applying fr admissin int the nursing majr cmpnent f the BSN Prgram and the MS Prgram and Certificate Prgram (pst-master s) will be ntified by the FWWSON at the time f admissin the prcess fr cmpleting the required backgrund check. Previus backgrund checks (e.g. CNA Certificatin, LPN r RN Licensure) are nt acceptable t fulfill this expectatin. The results f the backgrund check may determine final admittance t the prgram. Students may als be required t update their criminal backgrund check. Each clinical training site will be infrmed if a student has passed a backgrund check prir t placement at that site; sme sites may require a mre current backgrund check. Clinical agencies may bar a student access t the facility fr clinical experiences based n the results f the backgrund check. If faculty and staff are nt able t place the student in an alternative setting, the student will nt be able t cmplete the prgram. In additin, students seeking readmissin int the 16

COMPOSITION Basic Structure The Student Affairs Cmmittee shall serve as the Health Sciences Student Appeals Bard (HSSAB) as specified in UniReg 560, II.F.5. The Chairpersn f the HSSAB shall be the current chairpersn f the Student Affairs Cmmittee, having been elected frm the membership and being a vting member. Exceptin: When the chairpersn is a faculty member f the unit where the grievance riginated, anther Student Affairs member nt assciated with the unit must chair the HSSAB. This individual will be elected by the members f the Bard. II. III. PURPOSE The Purpse f the HSSAB is t prvide a review f student appeals n the academic decisins r actins f Schl/Divisin staff, administrative fficials, faculty, r academic units. Each Divisin/Schl in the CHS shall have written prcedures fr infrmal reslutin f student disputes arising frm decisins r actins f faculty, staff and/r administratrs. Any student r student grup shall have the right t use these prcedures within the apprpriate unit. The appeal shuld first be initiated with the instructr r curse crdinatr. If a satisfactry utcme is nt achieved, the appeal may be frwarded t the dean/directr f the apprpriate unit and will prceed accrding t the appeals prcedures utlined within the unit. The right f student appeal at the cllege level is limited t allegatins f prejudice, capricius r arbitrary academic evaluatin r capricius r arbitrary treatment. JURISDICTION A. General Jurisdictin The HSSAB shall have jurisdictin t review the decisins f any Schl s/divisin s appeal cmmittee. B. Limitatins N decisin r actin shall be reviewed by the HSSAB unless all nrmal channels f relief have been exhausted by the appellant up t and including the Schl s/divisin s appeal cmmittee. C. Basic Authrity and Respnsibilities 1. The HSSAB may recmmend affirmatin r reversal f the decisin being appealed, and may make such recmmendatins fr further actins as may seem apprpriate. 2. The HSSAB shall have the final authrity in prcedural matters. 20
25 IV. PROCEDURES 3. The HSSAB will frward its recmmendatin(s) t the Dean f the Cllege, alng with a recrd f the hearing prceedings within five (5) days f the hearing. The Dean will make a final decisin, within ten (10) schl days (after receipt f the HSSAB recmmendatin) based n the recmmendatin(s) f the HSSAB and the recrds f the hearing. The Dean will ntify the parties in writing f her/his decisin immediately thereafter. The Dean shall be respnsible fr implementing her/his decisin. A. Initiatin f Appeal (Timeframe) B. Filing Appeal 1. The appeal must be presented t the Dean f the Cllege r designee n later than fifteen (15) schl days after the Appellant receives the decisin f the Schl s/divisin s Appeals Cmmittee frm the Directr/Dean r designee. If the decisin is received n a date that will nt allw fr a timely appeal in the current academic term, the time fr an Appeal may be extended t the fllwing academic term. 2. If n infrmal settlement can be reached, the student may elect t fllw the frmal appeals prcess. a. Fr appeals f final grades the written appeal must be in the Dean s Office, Cllege f Health Sciences, n later than fifteen (15) schl days after the first day f classes f the semester fllwing that in which the actin being appealed ccurred. If the actin being appealed ccurred during the spring semester, the student has the ptin f appealing in either the summer sessin r the fllwing fall semester. b. Fr appeals f grades given during a semester, the written appeal must be in the Dean s Office, Cllege f Health Sciences, n later than fifteen (15) schl days after receipt f the grade. 3. Within fifteen (15) schl days f the receipt f a written appeal, the Dean, alng with the Chair f the HSSAB, shall determine whether the appeal is within the jurisdictin f the Bard. a. If the appeal des nt fall within the jurisdictin f the bard, the Chair f the HSSAB shall ntify the appellant. b. If the appeal is within the jurisdictin f the HSSAB, the Chair shall ntify the appellant and the appellee and include a ntice f the time and place f the hearing. A written appeal shall cnsist f a letter t the Dean, Cllege f Health Sciences, presenting the actin being appealed, the basis f the appeal, and any supprting dcuments. The written appeal must include evidence that all nrmal avenues in the Schl/Divisin fr adjustment f the actin being appealed have been exhausted. A cpy f the decisin rendered by the Schl s/divisin s Appeals Cmmittee with the date f such decisin and the date that the appellant received ntificatin f the decisin must be included in the appeal. The appellant must als include a list f any witnesses. C. Ntice The Dean r designee will prvide the appellee with a cpy f the written appeal and any supprting dcuments including names f witnesses. The appellee may make a written reply t the HSSAB. The appellee must ntify the HSSAB f any witnesses. This written reply will be presented t the Bard alng with the written appeal at least three 21
26 (3) schl days befre the meeting. The Dean r designee will make a cpy f the reply available t the appellant alng with names f witnesses fr the appellee. D. Meetings The HSSAB will meet when ntified by the Chair during the nrmal academic year. A special bard may be appinted by the Chair if necessary during the summer term, nly if an extreme situatin exists. Meetings will be at the Bard's earliest cnvenience allwing all parties time t receive the applicable materials. Meetings shall be pen unless either party specifically requests in writing t the cntrary. If the HSSAB decides, during the hearing, that the penness f the hearing is hindering the Bard's functining, the Bard may clse the hearing and cnduct it in private. E. Disqualificatin f Members Any member f the HSSAB may request disqualificatin f him/herself r any ther member fr just cause, by ntifying the Chair f the Bard. Either appellant r appellee may request that a member be disqualified fr just cause prviding a written request t the Dean f the Cllege at least five (5) schl days befre the scheduled meeting. F. Recrding Secretary A recrding secretary will be assigned by the Dean t cmpile and disseminate all applicatins and materials fr bard members t review. The recrding secretary will tape recrd the hearings and its utcme and prvide a cpy t the student if requested. The transcriptins and/r recrdings and related materials making up the case file will be frwarded t the Dean f the Cllege within five (5) schl days. G. Hearing Prcedures 1. The cnduct f the Hearing will be infrmal and will be determined by the HSSAB itself. 2. During the hearing bth parties will be allwed t make a statement t the bard in supprt f their case. Fllwing this bth appellant and appellee will have an pprtunity t respnd t the ther's statement. 3. After the appellant and the appellee have presented their statements and respnses, questins may be raised. 4. Nne f the parties may be represented by legal cunsel at the hearing. 5. Witnesses may present statements n behalf f either the appellant r the appellee. Written statements by witnesses may als be admissible as determined by the Chair. 6. In the curse f any hearing, the HSSAB is authrized t request the appearance r additinal evidence f any student, faculty, staff member, r ther emplyee f the University as witness. 7. If the appellant r the appellee des nt appear at the hearing, the written statements will be the entire presentatin by that persn and the HSSAB s recmmendatin will be made accrdingly. 8. SAFETY Safety prcedures and universal precautins are cvered as they relate t the cntent area and are reinfrced thrughut the duratin f the prgram. INCIDENT REPORTS Based upn agency plicy, students and faculty are required t dcument any unusual incidents. In mst agencies, the frm used is called an Incident Reprt r Variance Reprt. Unusual incidents include accidents r injuries t self r thers and medicatin r nursing care errrs invlving faculty r student. Respnsibility fr filing a reprt is placed n the faculty. Hwever, writing an Incident Reprt can be initiated by students, faculty, r agency staff. The purpse f the reprt is t ntify the agency and University administratrs that an incident has ccurred. The reprt can als prvide legal prtectin. Tw Incident Reprts usually need t be cmpleted because bth the agency and UW have their wn frms. In rder fr students t make knwledgeable decisins abut any persnal risks encuntered, an Expsure Cntrl Plan is available and includes the prcedure t fllw if an expsure ccurs. It is als designed t develp awareness f ptentially hazardus bldbrne pathgens in the wrk place and t train students in apprpriate and safe wrk practices. Necessary infrmatin is available t infrm students f hw best t handle bldbrne pathgens and hw t utilize the prcedures utlined in this plan. It is imprtant that students assume respnsibility fr safe practice. All students will have access t pertinent safety infrmatin thrugh clinical experiences and curse wrk. When safety cncerns arise, students are encuraged t cntact their clinical instructr. A training prgram has been designed fr the benefit and prtectin f all students within this prgram. Every student must cmplete the training prgram befre entering the clinical site. The training prgram is called the CHESS (Cheyenne Health Educatin Shared Services) Orientatin. CHESS has representatives frm the University Of Wyming Schl Of Nursing, the nursing department at Laramie Cunty Cmmunity Cllege, the tw hspitals in Cheyenne and Laramie, and ther healthcare agencies in the area. CHESS was develped t cnslidate the rientatins that are required at each clinical facility. Hepatitis B vaccinatin is mandatry fr all students attending prfessinal clinical training fr the Schl f Nursing. LEGAL RESPONSIBILITIES IN CLINICAL EXPERIENCE An active, unencumbered RN license fr the state in which yu will be cmpleting the clinical curse is required. As a part f the educatinal prgram, RN students are entrusted with the respnsibility f prviding certain kinds f nursing care t clients/patients. In several curt decisins, the curts have taken the psitin that anyne wh perfrms duties custmarily perfrmed by prfessinal nurses is held t the standards f prfessinal nurses. Thus, a student nurse is held t the standard f a prfessinal nurse and will be persnally liable fr negligence if injury results. NURS 4975 PROFESSIONAL PRACTICUM: COMMUNITY-FOCUSED NURSING Students are expected t lcate a clinical site in their gegraphic area and initiate discussin with the manager and ptential preceptr. Students are t submit the practicum placement request frm psted n the nursing website t the curse crdinatr. An educatinal agreement (cntract) regarding a student using that site is required between the university and clinical site. If an agreement cannt be negtiated, an alternate site wuld need t be chsen. Students will cmplete their clinical experience (NURS 4975) in a public health setting r an apprved cmmunity setting within their cmmunity.
