3 Spanish Yuth Guarantee Implementatin Plan 3 I. Intrductin On 28 February 2013 the Cuncil f Ministers f Emplyment, Scial Affairs and Cnsumptin agreed t establish the Yuth Guarantee, frmally adpted by agreement f the Cuncil n 22 April 2013 [1]. In additin, n 7 and 8 February 2013, in recgnitin f the particularly difficult situatin f yung peple in certain regins, the Eurpean Cuncil prpsed a Yuth Emplyment Initiative fr the regins f Eurpe in which the rate f yuth unemplyment is higher 25%. The purpse f the Yuth Guarantee is t guarantee that all yung peple aged under 25 receive a gd ffer f emplyment, further educatin, apprenticeship r training within fur mnths after they cmplete their frmal educatin r find themselves unemplyed. Applicatin can be gradual fr cuntries with greater budgetary cnstraints and a greater number f unemplyed peple nt in training and a higher rate f yuth unemplyment. Subsequently, the Eurpean Cuncil indicated that Member States having access t the Yuth Emplyment Initiative funds shuld submit a Natinal Yuth Guarantee Implementatin Plan befre the end f In respnse t this mandate, the Plan described here establishes the framewrk fr implementing the Yuth Guarantee in Spain. II. Cntext and Apprach Backgrund The Natinal Implementatin Plan fllws the guidelines given in the Cuncil Recmmendatin n the Yuth Guarantee which include respect fr gender cnsideratins and the diversity f the yung peple cvered by the Guarantee as well as adaptatin t natinal, reginal and lcal circumstances. This Plan is als in line with the Entrepreneurship and Yuth Emplyment Strategy submitted last February, which is an essential tl fr prmting yuth emplyment and entrepreneurship as part f the Gvernment s glbal strategy fr prgressing twards ecnmic recvery. The Entrepreneurship and Yuth Emplyment Strategy is a prject that results frm a prcess f dialgue and participatin with Scial Agents. It cvers 100 measures aiming t facilitate access t the labur market fr yung peple thrugh emplyment r self-emplyment. The 15 emergency measures which are expected t have an impact in the shrt term, were apprved immediately thrugh Ryal Decree-Law [1] Cuncil Recmmendatin f 22 April 2013 n establishment f the Yuth Guarantee (2013/C 120/01).
4 4 Spanish Yuth Guarantee Implementatin Plan 4/2013 f 22 February n Measures t Supprt Entrepreneurs and Prmte Grwth and Jb Creatin. The Entrepreneurship and Yuth Emplyment Strategy als prvides fr measures that are imprtant elements in the implementatin f the Yuth Guarantee s it is the framewrk fr this Plan fcusing n sme f the elements f wrk with yung peple. In additin, the drafting f this dcument takes int accunt the new financial framewrk fr Eurpean Unin Structural and Investment Funds. This framewrk, in which the evaluatin f utcmes will be a key element, alters substantial aspects f the prgramming and management prcedures in rder t guarantee that funds are cncentrated n the tp pririties, ne f which is yuth emplyment. These funds will g tgether with thse f the Yuth Emplyment Initiative. This Initiative prvides Spain with a ttal f millin Eurs in current prices t refund expenditure n direct actin fr yung peple wh are unemplyed and are nt in training: millin Eurs frm the specific budgetary line fr yuth emplyment millin Eurs frm the specific Eurpean Scial Fund investment. This Plan therefre aims t ptimise the resurces which, by virtue f the Yuth Emplyment Initiative and Eurpean funds in general, especially thse frm the Eurpean Scial Fund, are available fr Spain and amunt t ne f the key financial levers fr prmting the Guarantee. In additin, it is based n the preliminary wrk dne in this cnnectin n a Eurpean level. It takes int accunt the evaluatin f the Eurpean Public Emplyment Services regarding recmmendatins fr establishing the Yuth Guarantee as well as the sharing f experiences in services fr yung peple prmted by the Eurpean Cmmissin. Yung peple neither in educatin nr emplyment Yung peple aged under 25 frm ne f the ppulatin grups that have been mst affected by the prcess f jb destructin that began in In 2012, ut f a ttal f 4,156,100 yung peple aged between 16 and 24 in Spain, 945,000 were unemplyed and 858,000 were nt in educatin, emplyment r training, the s-called NEETs. This categry cvers inactive yung peple but mst f them are yung peple wh are actively searching fr emplyment. These figures illustrate the serius emplyment situatin fr yung peple in Spain which might lead t discnnectin frm the labur market and lng-term exclusin.
5 Spanish Yuth Guarantee Implementatin Plan 5 Spain has ne f the highest rates f yung peple aged under 25 nt in educatin, emplyment r training ( NEETs ) 1 in the Eurpean Unin, five pints abve the average and nly surpassed by Bulgaria, Italy and Greece. In general, all the Eurpean Unin cuntries have seen rising figures, with the exceptin f Germany r Austria where the rate has drpped ver the last year. The rising trend has been mre marked in Spain (frm 12.2% in 2007 t 18.8% in 2012) than in Eurpe, where it increased by just 2 percentage pints. In abslute terms 2, the figure has risen frm 620,000 yung peple in this situatin in 2007 t almst 860,000 in There was 45% grwth between 2007 and 2009, when the maximum figure was reached (903,300). Since then, it has drpped by 5%. 1 The NEET rate, accrding t the Eurstat methdlgy, is calculated n the basis f all yung peple within a certain age grup rather than just thse in the labur frce (as with the EPA yuth unemplyment rate). Mrever, in rder fr a yung persn t be cnsidered NEET, there are tw requirements which must be simultaneus: they must neither wrk nr study. 2 The Spanish Natinal Statistics Institute (INE) nly gives infrmatin n the number f yung pèple aged between 16 and 24 wh d nt study and are nt in training in abslute terms. This means that, in rder t analyse the NEET rate and make cmparisns n a Eurpean level, it is necessary t use the Eurstat NEET rate which includes yung peple aged 15 t 24.
6 6 Spanish Yuth Guarantee Implementatin Plan The basic characteristics f this grup f yung peple, taking the data fr 2012, are as fllws: Unemplyment prblem: 72% f NEETs are unemplyed, that is, they are actively searching fr jbs. In 2007, the prprtin was belw 50% (47%), which indicates that there is a direct link between the increase in unemplyment and the number f NEETs during the crisis. In fact, the number f yung peple within this categry wh are still inactive drpped by 25% frm 2007 t The main prblem is, therefre, a lack f jb pprtunities. 58% have prir wrk experience. 16% are lng-term unemplyed. This figure is 11 pints abve that fr 2007 when it was just 5%. Almst 80% f unemplyed NEETs state that they are registered with a public emplyment service. This figure has grwn cnsiderably since 2007 when it was just 57%. Data frm the Labur Frce Survey (EPA) als indicate that 25% f thse wh are nt actively searching fr emplyment are als registered 3. 74% are aged between 20 and 24. Their weight in the grup as a whle has increased by mre than 10 pints with the crisis, which is the main reasn fr the grwth in the grup in general. By educatinal level, 10% have higher-level studies and 25% have nt cmpleted their cmpulsry secndary educatin. These prprtins are very similar t thse f Every year the Spanish Natinal Statistics Institute (INE) checks this declaratin with the real registratin figures and finds a high degree f cnsistency.
7 Spanish Yuth Guarantee Implementatin Plan 7 Adjustment t yung peple s prfiles The ppulatin grup described abve is very hetergeneus as it cvers bth yung peple wh drpped ut f schl and wh therefre have n skills nr wrk experience as well as peple with high-level qualificatins, extensive skills and wrk experience but wh have been unsuccessful in their jb searches. The Plan therefre cntains measures in line with yung peple s different prfiles and targets, in different ways, bth registered jb-seekers and thse wh have nt chsen that methd f activatin as well as thse wh have little cnnectin with the labur market. A key element in the Yuth Guarantee actins will be t achieve gd knwledge f the persnal characteristics that are relevant fr emplyment, s that yung peple receive the mst apprpriate service fr their respective prfiles. The Plan has been drawn up taking int accunt the shared respnsibility f yung peple in achieving successful integratin in the labur market as well as the emphasis placed by the Recmmendatin n measures prmting labur mbility at natinal and Eurpean level. The huge challenge this represents fr the Public Administratins invlved in dealing with this grup under the cnditins given in the Cuncil Recmmendatin explains why this Plan adpts an apprach based n the fllwing guidelines: The Cuncil Recmmendatin establishes an ambitius target in the lng term with regard t the attentin t be paid by the Public Administratins t yung peple nt in educatin r emplyment. The aim is t achieve a structural change in the functining f the Administratins, extending what are currently the best practices fr dealing with yung peple in Spain and elsewhere. The aim f the Guarantee is that attentin shuld be paid t yung peple as early as pssible. This early attentin requires a preventive apprach fr which it is essential t prevent early schl drp-uts. This requires clse cllabratin between the educatin and emplyment authrities and measures fr taking actin befre yung peple cmplete their studies r drp ut. Anther key bjective f early actin is t deal with yung peple requiring attentin. The aim is t prevent the unemplyment situatin frm lasting t lng as this will reduce their pssibilities f successfully re-entering the labur market. There are als actins t crrect as early as pssible any mismatching between yung peple s skills and qualificatins and the needs f the labur market, in rder t reach an apprpriate inclusin. Basically, the aim is t prevent unemplyment as far as pssible and, where apprpriate, t minimise perids f unemplyment. Such targets are desirable under any circumstances but are f special imprtance fr yung peple.
8 8 Spanish Yuth Guarantee Implementatin Plan Such preventin and early actin shuld be based n a glbal apprach cvering educatin, emplyment and scial aspects. Transfrmatin f emplyment plicies and fcus n utcmes The Plan aims als t be an instrument fr change s that plicies targeting yung peple and emplyment plicies in general can be mre utcme-based. This is in line with the attentin paid by the new framewrk fr prgramming Eurpean Funds and the assessment f utcmes f plicies that btain refunds frm Eurpean Funds. Evaluatin frms a key part f the cnceptin, develpment and, bviusly, evaluatin f prgrammes that use Eurpean resurces. In rder t prgress twards this bjective, the Plan includes measures t meet the requirements fr evaluatin and cntrl f the Eurpean Scial Fund and the Yuth Emplyment Initiative and, in particular, measures t identify the training r emplyment situatin f yung peple cvered by the Guarantee after six mnths and ne year after receiving attentin. Therefre, fllwing the Eurpean recmmendatin, it prmtes cllabratin by all stakehlders resulting in jint wrk with participatin by all institutins that can cntribute t wrk with yung peple. A leading rle will be taken by the Public Emplyment Services, as well as the Educatin and Vcatinal Training systems, scial services, lcal administratins and scial agents. Als relevant is the participatin by private placement agencies, entities in the third sectr that have extensive experience in labur market integratin and training, private enterprises and business rganisatins such as chambers f cmmerce. The Plan als aims t ffer mechanisms t prmte cllabratin, dialgue and cnsensus leading t cnsistent integratin f plicies targeting successful inclusin f yung peple in the labur market. All this will be within the framewrk f the Natinal Emplyment System and its structures as a whle, as well as measures and actins t implement emplyment plicies, irrespective f a mre extensive, integrated apprach. The aim is t bring abut a real, tangible change that yung peple will ntice and that will have measurable effects n emplyability and integratin. Hwever, it cannt be cnsidered an actin with immediate effects as it invlves a prcess that is cnceived n a Eurpean level as ne f learning ver time. The learning will be gradual and based n actins that have prved t be effective and it will be mutual allwing all t learn frm the mst successful actins. Special attentin will be paid t incrprating the results f evaluatins. During the initial stages, therefre, the Eurpean Recmmendatin cnsiders the pssibility f gradual implementatin fr cuntries having special budgetary difficulties and the highest unemplyment rates. Mrever, it is cnceived as a Plan that must evlve and develp especially during the first few mnths. During the first half f 2014, the General State Administratin and the Autnmus Cmmunities must specify the varius peratinal prgrammes f the
9 Spanish Yuth Guarantee Implementatin Plan 9 Yuth Emplyment Initiative and the Eurpean Scial Fund as these instruments will be key fr drawing up the financial aspects f this Natinal Implementatin Plan. During the first six mnths, decisins will be taken n hw t establish cllabratin with the entities that will have a rle in implementatin f the Yuth Guarantee, especially the Autnmus Cmmunities, as well as the instruments t be used fr this. The results f this wrk will be included where necessary in an updated versin f this Natinal Plan. Prcess f cnsultatin and participatin The Plan has been enriched with cntributins frm varius interested parties in a prcess f cnsultatin prir t apprval and submissin. Participants in this prcess included the business rganisatins CEOE and CEPYME, the trade unin rganisatins UGT and CCOO, and ther scial partners such as assciatins representing the Scial Ecnmy and self-emplyed wrkers, chambers f cmmerce, assciatins f yung entrepreneurs such as CEAJE, and ther entities f interest including the Spanish Yung Peple s Cuncil. The Autnmus Cmmunities als participated and varius technical meetings were held with them thrugh the Sectrial Cnference n Emplyment and Labur Affairs held n 18 December III. Natinal definitin f the Guarantee The Cuncil Recmmendatin 4 defines the Guarantee as a recmmendatin t States that they ensure that within 4 mnths f leaving schl r lsing a jb, peple under 25 shuld receive a gd-quality ffer f emplyment, further educatin, an apprenticeship r a traineeship. It als recmmends that, when the Yuth Guarantee Scheme is designed, Member States shuld bear in mind matters f a general nature such as the fact that yung peple d nt frm a hmgeneus grup cming frm similar scial envirnments, as well as the principle f mutual bligatin and the need t face the risk f perids f inactivity. The Yuth Guarantee shuld be put int practice based n a cnsistent system f supprt measures and shuld take int accunt natinal, reginal and lcal circumstances. One f the central measures f Yuth Guarantee Schemes is t adpt appraches based n assciatin s that the public authrity in charge f establishing and running the Yuth Guarantee Scheme, which shuld be precisely identified, can prmte jint wrk by the different entities. 4 Cuncil Recmmendatin f 22 April 2013 n establishing the Yuth Guarantee (2013/C 120/01)
10 10 Spanish Yuth Guarantee Implementatin Plan The territrial rganisatin f the Spanish State has a high degree f decentralisatin f educatin, training and emplyment plicies s implementatin f the Yuth Guarantee in Spain will largely be n a reginal and lcal level. Hwever, and in rder t guarantee implementatin thrughut the cuntry, a natinal crdinatin mechanism has been set up within the Ministry f Emplyment and Scial Security. The General Administratin will als take direct actin within its pwers in the framewrk f the Natinal Yuth Guarantee Scheme. The natinal definitin given in this Plan als takes int accunt the recmmendatin that the starting pint fr the Yuth Guarantee fr yung peple registered as jbseekers shuld be when they actually register. And, fr thse wh d nt register, a starting pint has t be explicitly defined. In bth cases, the yung peple shuld explicitly express their desire t frm part f the new Yuth Guarantee Scheme in rder t set up the prcess. Therefre, fr implementatin in Spain, the Guarantee is defined as fllws: The Yuth Guarantee will adpt an integrated, preventive apprach with early actin by all institutins that can help imprve emplyability and integratin in the labur market fr yung peple s that, after the perid f implementatin: It will be pssible t ffer yung peple aged under 25 wh are nt in emplyment r training and wh apply, by the means prvided, fr attentin under the Yuth Guarantee a gd quality jb ffer r a training r educatinal actin, cntinued vcatinal training, apprenticeship r traineeship, within fur mnths after the applicatin and, in any case, nce the frmalities f checking the infrmatin prvided are cmplete and, where apprpriate, when the applicant s prfile is cmplete. There will be cmplementary measures r prgrammes f actin targeting yung peple aged belw 25 nt in emplyment r training and wh are discnnected frm the labur market, helping t activate them in cllabratin with the entities and agents invlved. Fr the abve purpse, the fllwing cncepts are defined: Jb ffer. An ffer guaranteeing that the yung persn, in line with their persnal characteristics, especially age, training and experience, has the pprtunity t acquire useful, sustainable experience f integratin in the labur market. Jb ffers under this categry shall last fr at least six mnths. Part-time ffers shuld be fr at least 50% f the rdinary wrking hurs. The jb ffers cnsidered shall be thse that are channelled directly thrugh the public emplyment services, including thse frm the EURES system, by private placement agencies that cllabrate r directly by private enterprises in whatever terms are established. Training actin. These will be actins that prvide yung peple with training in areas such as languages and infrmatin and cmmunicatin technlgies
11 Spanish Yuth Guarantee Implementatin Plan 11 and invlving a minimum training time f 150 hurs fr peple with n training and/r experience and f 90 hurs fr thse wh need the training t extend their skills. Educatinal actin. Participatin in secnd pprtunity prgrammes r in medium r higher-level Vcatinal Training prgrammes. Cntinued vcatinal training actin. These are actins ffered within the framewrk f vcatinal training fr emplyment and include training with an emplyment cmmitment. Apprenticeship. A jb with a Training and Apprenticeship Cntract, as well as in a wrkshp-schl prgramme ( Escuelas taller ) r a wrk and training centre ( Casa de Oficis ). On-the-jb training. A jb with a wrk practice cntract as regulated by the Wrkers Statute r in a nn-labur wrk experience psitin in cmpanies as regulated by Ryal Decree 1543/2011 f 31 Octber, which cvers nnemplyment wrk experience, prviding they meet the cnditins f the quality framewrk apprved by the Eurpean Unin. Actins fr self-emplyment and entrepreneurship. These are actins that guarantee the start f self-emplyed activity that is sustainable ver time, with registratin in the Special Regime fr Self-Emplyed Wrkers f the Scial Security Measures r prgrammes serving yung peple wh have nt registered r wh have nt requested attentin. These are measures r prgrammes targeting the whle f the yung ppulatin and prviding infrmatin n services and the supprt available under the Yuth Guarantee scheme r measures and prgrammes based n early interventin and activatin fr yung peple wh are discnnected frm the labur market. IV. Implementatin f the Guarantee Agents invlved in implementing the Natinal Yuth Guarantee Plan The fllwing stakehlders will participate in implementatin f the Natinal Yuth Guarantee Plan: 1. Participants in the prcess f cnsultatin n the design, implementatin and evaluatin f the Natinal Yuth Guarantee Plan Scial partners. Amngst the mst relevant scial agents are the entrepreneurs rganisatins CEOE and CEPYME, the trade unin rganisatins UGT and CCOO, the yung entrepreneurs rganisatins, the Yuth Cuncil and yung peple s assciatins. Others will be the mst representative rganisatins in the scial ecnmy, fr selfemplyed wrkers and in equal pprtunities, as well as private bdies in the third sectr that participate in management f the Eurpean Scial Fund.
12 12 Spanish Yuth Guarantee Implementatin Plan The rle t be played by yung peple s rganisatins is especially relevant fr including the pint f view f yung peple and fr ensuring that the initiative is published and made knwn, especially amng yung peple wh are nt registered with the Public Emplyment Services. The Ministry f Emplyment and Scial Security will ensure that scial agents at every level participate actively in the design and implementatin f plicies targeting yung peple, as laid dwn in the Recmmendatin n the Yuth Guarantee. It will als ensure that yung peple s representatives r yung peple s rganisatins participate in the design and implementatin f the Yuth Guarantee system in rder t adapt the services ffered t the needs f the beneficiaries and t act as multipliers in awareness activities Public Administratins. It will als be necessary t invlve certain bdies at different levels f the Public Administratin whse pwers require them t participate t a greater r lesser extent in the Natinal Yuth Guarantee Plan. The relevant agents in this grup include the fllwing: Natinal Public Emplyment Service, the General Directrate that administers the Eurpean Scial Fund in Spain, the Autnmus Cmmunities, the Spanish Federatin f Municipalities and Prvinces, the Ministry f Educatin, Culture and Sprt, the Ministry f Finance and Public Administratins, etc. 1.3 Private sectr agents. Participants in the drafting f the Implementatin Plan will include relevant agents frm the private sectr, especially thse participating in the Operatinal Prgramme fr Yuth Emplyment f the Eurpean Scial Fund Agents invlved directly in implementatin f the Natinal Yuth Guarantee Plan General State Administratin. The Ministry f Emplyment and Scial Security will be the public authrity in charge f establishing the Yuth Guarantee Scheme and crdinating assciatins at every level and in every sectr. A key rle in this cntext will be played by the natinal crdinatr f the Yuth Guarantee in Spain: the General Directrate fr Self-Emplyed Wrkers, the Scial Ecnmy and Crprate Scial Respnsibility, which is respnsible fr administratin f the Eurpean Scial Fund in Spain and implementatin f the Yuth Emplyment Initiative; and the State Public Emplyment Service, which sets up measures and crdinates the public emplyment services.
13 Spanish Yuth Guarantee Implementatin Plan 13 Finally, an especially relevant rle will be played by the Ministry f Educatin, Culture and Sprt and the Ministry f Finance and Public Administratins, which will channel participatin by lcal entities Autnmus Cmmunities. In view f the pwer structure f the Spanish State, the Autnmus Cmmunities will have a key rle t play in the implementatin and management f the Natinal Yuth Guarantee Plan. Implementatin f the Yuth Guarantee will invlve the departments r cuncils that have pwers in the fllwing fields: Emplyment, especially thrugh the Reginal Public Emplyment Services. Educatin. Scial Affairs. Yuth 2.3. Agents utside the Public Administratins In additin t the abve-mentined scial agents, ther participants in implementatin f the Yuth Guarantee will include any entities, bth public and private, that can make useful cntributins t fulfilment f the Guarantee, especially by participating in the Operatinal Prgramme fr Yuth Emplyment f the Eurpean Scial Fund. Prcedure The Yuth Guarantee Scheme will guarantee that the Yuth Guarantee is applied thrughut Spain and will ensure that all yung peple requiring attentin receive it under equal cnditins. Attentin will be ffered t yung peple wh request it, whether registered as jb seekers r nt. Methds fr requesting attentin will be ffered s that applicants thrughut Spain can be crrectly identified n an equal basis. The attentin ffered and the ffers made in the framewrk f the Guarantee will be linked t the creatin f a full prfile f the characteristics f the candidate fr attentin. This prfile will indicate clearly the educatinal r training needs f the persn in questin and will be the basis fr deciding what type f actins, ut f all thse defined in the catalgue, can be ffered t that individual. The reginal administratins will be able t decide whether the prfile shuld be cmpleted with a persnal interview by specialist staff in all cases r just sme, depending n the basic characteristics in the prfile. Such interviews will make it pssible t find ut mre abut the situatin and characteristics f the yung peple in rder t better define their prfile and ffer actins t imprve their emplyability. The managers f the scheme appinted by the reginal authrities will be respnsible fr ensuring that the Guarantee is effective fr all applicants.
14 14 Spanish Yuth Guarantee Implementatin Plan Nevertheless, pririties may be set n the basis f age, prir labur experience, time unemplyed, level f skills and time f the applicatin. Special attentin will be paid t yung peple mre in need. Fr this purpse, wrk will be dne with specific grups f disadvantaged yung peple and with thse wh have never wrked r have paid Scial Security cntributins fr less than 120 days. Pririty will als be given t yung peple wh have nt already received attentin frm the system. In the case f thse wh have already received assistance, the utcme f the actins will be analysed and an assessment made f whether it is apprpriate r nt t ffer further actins in rder t reach the gals established, especially bearing in mind the principle f shared respnsibility. Finally, if there is equality in all the requirements, pririty will be given t greater age as such peple will be nearing the end f their applicability fr attentin under the prgramme. The prcedure fr attentin will invlve tw stages: An initial stage in which the persnal characteristics f the applicant that are relevant fr attentin are identified. This stage will take place within a maximum perid f 30 days and will include the fllwing actins: Registratin f the applicant in the specific cmputer system f the Yuth Guarantee. Determinatin that the applicant meets the requirements fr attentin under the Yuth Guarantee Scheme and identificatin f the persn s main characteristics. If they d nt meet the requirements, they will fllw the channels determined by the apprpriate public administratins. Inclusin in the list f beneficiaries: applicants wh fall within the grup cvered by the Yuth Guarantee will be included in a list stating the basic features f their prfile and, therefre, the pririty they receive and the type f ffer which is mst suitable, including the pssibilities f self-emplyment and entrepreneurship. The basic features f the prfile will be the fllwing: - Backgrund f any frmer actins. - Wrk experience - Qualificatins and knwledge f languages. - Time f applicatin. - Age f applicant. Cmpletin f the prfile with identificatin f the mst apprpriate actins by the Public Emplyment Services in the Autnmus Cmmunities r, as decided by these Cmmunities, by any ther institutins such as scial services, yung peple s rganisatins r third sectr entities, etc.
15 Spanish Yuth Guarantee Implementatin Plan 15 - In additin, pririty fr attentin may be established in additin t that already given (peple at risk f scial exclusin, disabled persns, lack f family supprt, etc.) - As far as is pssible, in the case f yung peple wh have already received attentin, the need fr actins in additin t thse already taken will be evaluated. A secnd stage in which attentin fr applicants under the Guarantee is develped, in line with the pririty established and the suitability criteria f the measures included in the single catalgue. The maximum length f this stage will be fur mnths after the applicatin, and pririty will be given t yung peple wh have n wrk experience and n skills, as well as lng-term unemplyed yung peple. The public administratins may make these perids shrter in their respective areas as the scheme is implemented. The prcedure fr managing and applying the Yuth Guarantee will be develped fllwing agreement f the Sectrial Cnference n Emplyment and Labur Affairs, at least in regard t the fllwing matters: Determinatin f beneficiaries thrughut Spain. Creatin f a single list. Minimum cntent f candidate prfiles. Drawing up f the catalgue f measures and actins reflecting minimum intensities. Funding The Yuth Guarantee Scheme will receive supprt frm the fllwing funds:
16 16 Spanish Yuth Guarantee Implementatin Plan Eurpean funding The Recmmendatin establishing the Yuth Guarantee Scheme encurages the Member States t make full and ptimum use f the funding tls f the chesin plicy during the perid in rder t supprt the creatin f Yuth Guarantee systems. Fr this reasn, Spain will give maximum pririty t the design and implementatin f measures t favur emplyment fr yung peple, including the pssibilities f funding frm specific hiring subsidies frm the Eurpean Scial Fund. Yuth Emplyment Initiative (YEI): Accrding t the Eurpean Cmmissin s cmmunicatin f 4 Nvember 2013 addressed t Ministers f Emplyment and Scial Security and f Finance and Public Administratins, the budget assigned t Spain fr the Yuth Emplyment initiative is as fllws: Ttal Allcatin in eurs ,481, ,956, ,438,516 Allcatin in current eurs 530,054, ,442, ,496,315 50% f the specific budget allcatin frm the Yuth Emplyment Initiative fr Spain has been reginalised in accrdance with the weight f yung peple aged under 25 wh are nt in emplyment, educatin r training in each Autnmus Cmmunity in Spain, and the remaining 50% has been distributed in accrdance with the ppulatin f yung unemplyed peple aged under 25. In bth cases, the statistic fr the annual average in 2012 is used, accrding t the Labur Frce Survey perfrmed by the Spanish Natinal Statistics Institute. Once the abve amunt has been determined, 50% f the Yuth Emplyment Initiative will be managed directly by the Autnmus Cmmunities, and the rest by the General State Administratin. Eurpean Scial Fund (ESF): In cmpliance with the regulatins gverning the Yuth Emplyment Initiative, Spain must allcate an amunt that is at least equivalent t the funding frm the Eurpean Scial Fund. Use f the Yuth Emplyment Initiative is subject t tw main restrictins: The amunt frm the Yuth Emplyment Initiative and the cmpulsry minimum allcatin frm the Eurpean Scial Fund must be allcated fully t the first tw years f the prgramming perid fr , that is, it must be fully used between 2014 and 2015.
17 Spanish Yuth Guarantee Implementatin Plan 17 The amunt resulting frm the Initiative and frm the cmpulsry minimum allcatin frm the Eurpean Scial Fund must be used exclusively fr direct actins with the peple targeted by this Initiative. The fllwing has als been taken int accunt: In view f the special needs f the grup targeted by the Yuth Emplyment Initiative, it will be necessary t draw up and take actins thrughut the Eurpean prgramming perid f and nt just during the first tw years. In additin, implementatin f the Yuth Guarantee Scheme will require the creatin f a number f structural measures which, since they d nt directly address the grup cvered by the Initiative, cannt be funded by it. S, in view f these restrictins, an amunt larger than the cmpulsry minimum required by the Yuth Emplyment Initiative will be charged t the Eurpean Scial Fund. This prvisin will be used thrughut the Eurpean prgramming perid f and during 2014 and 2015 it will finance structural actins that cannt be funded frm the Yuth Emplyment Initiative. Between 2016 and 2020 it will finance bth structural actins and actins addressing the target ppulatin directly. The fllwing are the figures in current Eurs and in terms f aid frm the Eurpean Scial Fund which will cntribute t the funding f the Yuth Guarantee Scheme thrugh the Operatinal Prgramme fr Yuth Emplyment: Cmpulsry minimum allcatin Additinal allcatin Ttal 1,886,992, ,748,158 2,358,740,788 Natinal surces f funding: Funding frm the Yuth Emplyment Initiative is gverned by the same rules as the Eurpean Scial Fund. This means that Spain will receive an advance payment frm the Yuth Emplyment Initiative and frm the Eurpean Scial Fund which, fr the prgramming perid f , will be as fllws: In 2014 and 2015 an advance payment f 1% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received each year 5. In 2016 an initial advance payment f 1% and an annual advance payment f 2% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received. 5 Fr the ESF part which is nt linked t the specific allcatin frm the Yuth Emplyment Initiative, fr calculating the amunt f the annual pre-funding up t and including 2019, the amunt f aid fr the whle prgramming perid will exclude the amunts frm the perfrmance reserve relating t the prgramme.
18 18 Spanish Yuth Guarantee Implementatin Plan In 2017 an annual advance payment f 2,625% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received. In 2018 an advance payment f 2,75% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received. In 2019, an advance payment f 2,875% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received. Frm 2020 t 2023 an advance payment f 3% f the amunt f aid fr the Operatinal Prgramme fr the whle prgramming perid will be received. This system f advance payments will mean that the General State Administratin, the Autnmus Cmmunities and the ther entities participating in the management f the funds will have t budget fr and pay in advance almst all the funds frm the Yuth Emplyment Initiative and the Eurpean Scial Fund t fund the Yuth Guarantee Scheme. The natinal funding will cme frm the General State Budget fr actins carried ut In the framewrk f the General State Administratin and the Autnmus Cmmunity budgets fr actins carried ut within the scpe f the Autnmus Cmmunities. In additin and in line with the Eurpean Unin Regulatins, in the case f bth the Yuth Emplyment Initiative and the Eurpean Scial Fund, natinal funding may cnsider cntributins frm private entities. In additin, the Strategy fr Entrepreneurship and Yuth Emplyment cvers ther actins that directly supprt implementatin f the Natinal Yuth Guarantee Scheme but which are f a type that cannt be c-financed frm the Eurpean Scial Fund. This is the case f the reductin in cntributins t the Scial Security thrugh Scial Security reductins. Operatinal Prgramme fr Yuth Emplyment In rder t implement the Yuth Emplyment Initiative (YEI) and set up the Yuth Guarantee Schemes, Spain will set up an Operatinal Prgramme fr Yuth Emplyment within the framewrk f the architecture and design f the Eurpean Scial Fund fr the prgramming perid f This prgramme will allw us t implement the Yuth Guarantee systems as early as pssible and ensures that they will be integrated in the prgrammes c-financed by the EU since the start f the Multi-Annual Financial Framewrk fr The mst imprtant aspects f this Operatinal Prgramme are the fllwing: Scpe: This is a natinal prgramme in which there will be a natinal part (financed and managed by the General State Administratin) and a reginal part (financed and managed by the Autnmus Cmmunities). This means that bth State and reginal bdies will participate.
19 Spanish Yuth Guarantee Implementatin Plan 19 Time frame: Althugh the allcatin frm the Yuth Emplyment Initiative shuld be cncentrated in the first tw years (with their crrespnding N+3), an Operatinal Prgramme is planned t extend thrughut the prgramming perid f Target ppulatin: The target ppulatin fr actins under the Operatinal Prgramme fr Yuth Emplyment will be yung peple aged between 15 and 24 wh are nt in educatin, emplyment r training, irrespective f their level f training. Actins: These are mstly thse cvered by the Strategy fr Entrepreneurship and Yuth Emplyment and given in the catalgue f actins in this dcument. Fr the first time with regard t the Eurpean Scial Fund in Spain, a cmmn catalgue f actins fr all the intermediate bdies participating in this prgramme will be drawn up. Fund allcatin: The prgramme is cvered by a minimum apprximate allcatin f millin current Eurs in terms f aid, f which millin will cme frm the specific allcatin frm the Yuth Emplyment Initiative. The ttal cst f the prgramme will be millin current Eurs. Of the allcatin fr this Operatinal Prgramme, millin in terms f aid will be cncentrated and prgrammed cmpulsrily in 2014 and 2015 with their crrespnding n+3, that is a ttal cst f millin Eurs. The rest f the allcatin fr the Operatinal Prgramme will be prgrammed fr cmplementary actins t set up prjects fr yung peple that are nt eligible under the Yuth Emplyment Initiative (e.g. teacher training), and t cntinue the prject until With respect t the distributin f funding, the Operatinal Prgramme will act in the fllwing pririty areas: Pririty area 1. Prmtin f sustainable, quality emplyment and f labur mbility. Pririty area 5. Sustainable inclusin in the labur market f yung peple nt in educatin, emplyment r training, in particular in the cntext f the Yuth Guarantee. There will als be an additinal prvisin fr technical assistance. The bdies participating in management f the Operatinal Prgramme are the fllwing: Managing Authrity: Administrative Unit fr the Eurpean Scial Fund (Ministry f Emplyment and Scial Security).

Audit Authrity: State Public Accunts Department and Autnmus Cmmunity Accunts Departments. Intermediate bdies: Intermediate bdies f the General State Administratin. Intermediate bdies f the Autnmus Cmmunities. Private intermediate bdies. Catalgue f measures and initiatives As explained abve, the Strategy fr Entrepreneurship and Yuth Emplyment is aligned with the bjectives f the Yuth Guarantee in that it cvers actins based n the cnvictin that there is n single slutin fr all unemplyed yung peple. It is therefre a matter f measures designed t reslve the situatin and meet the particular needs f the different prfiles f yung peple whether r nt they have training r experience r receive unemplyment benefit, etc. The Strategy includes specific actins fr yung peple aged under 30: The grup f yung peple nt in educatin, emplyment r training can be estimated at 858,000 yung peple in 2012, accrding t the Labur Frce Survey (EPA). Yung peple wh have n training because they drpped ut f schl early, ften drawn by jbs in sectrs that tday ffer n pprtunities. In Spain there are ver 450,000 unemplyed yung peple wh, accrding t the public emplyment service registers, have nt cncluded Cmpulsry Secndary Educatin. Yung peple wh have training but need experience. Accrding t the public emplyment service registers, tday there are 339,635 unemplyed yung peple with sufficient qualificatins fr wrk placement cntracts. Yung peple with n wrk experience. In Spain tday 398,547 unemplyed yung peple are registered as nt having had a jb r having experience f less than three mnths, accrding t the State Public Emplyment Service and the Scial Security. Lng term unemplyed yung peple, that is, thse wh have been unemplyed fr ver ne year. Tday they number ver 256,698, accrding t the State Public Emplyment Service and the Scial Security. Yung peple wh receive unemplyment benefit but wuld like an pprtunity. They number 215,505.
21 Spanish Yuth Guarantee Implementatin Plan 21 Yung entrepreneurs wh d nt wish t enter the labur market as emplyees but want t set up their wn prject. And measures aiming t guarantee fair treatment and equal pprtunities fr all, irrespective f their persnal and/r scial circumstances, and t meet their specific needs with special attentin n thse wh are underprivileged and/r at risk f exclusin. This is hw, especially fr implementatin f the Yuth Guarantee, the actins cvered in the Strategy are cnsidered, as well as thers t be set up specifically fr yung peple aged under 25. This catalgue f actins will be cmmn fr all the intermediate bdies participating in implementatin f the scheme and cmprises fur main lines f actin: 1. T imprve mediatin. Actins invlving vcatinal guidance, labur infrmatin and assistance in jb seeking: Supprt fr yung peple in jb seeking r while setting up an entrepreneurial activity shuld be a pririty fr all agents invlved in the design f plicies t prmte their inclusin in the wrld f wrk. Persnalised attentin, access t infrmatin and advice at the start f r as a cmplement t training prgrammes, knwledge f labur rights and the efficiency f public emplyment services can becme key elements fr helping yung peple t find r keep a jb. The Ministry f Emplyment and the Autnmus Cmmunities will implement specialised prgrammes fr infrmatin, guidance and supprt fr yung peple, within the Sectrial Cnference n Emplyment and Labur Affairs. The aim is, basically, t ensure that all yung peple are fully infrmed abut the services and the supprt available, strengthening cperatin amng emplyment services, suppliers f vcatinal guidance, educatin and training
22 22 Spanish Yuth Guarantee Implementatin Plan centres and yuth supprt services, as laid dwn in the Recmmendatin n the Yuth Guarantee. In additin, the activity f public emplyment services fr unemplyed persns wishing t set up a self-emplyed activity will be prmted and extended with the participatin f the rganisatins that represent self-emplyed wrkers. The adptin f agreements with the scial agents will be prmted fr activities aiming t infrm and train entrepreneurs and wrkers legal representatives n the different types f cntract that are legally allwed. This will meet the aim f prmting assciatins between emplyers and labur market agents (emplyment services, varius levels f the administratin, trade unins and services fr yung peple), in rder t prmte jb pprtunities, apprenticeships and wrk experience fr yung peple. Mdernisatin f Public Emplyment Services: The setting up f the Natinal Yuth Guarantee Scheme will begin with the actins needed t adapt the public emplyment services t the specific requirements f the Guarantee. Amngst ther actins, attentin fr yung peple in the framewrk f the Yuth Guarantee will be prvided by dedicated staff wh shall, amngst ther activities, be respnsible fr: Prfiling. Handling the data bases and the infrmatin system. Specialist labur guidance fr yung peple cvered by the Yuth Guarantee. The csts f mdernising and adapting the public emplyment services t the Yuth Guarantee Scheme can be cvered with reimbursable expenses frm the Eurpean Scial Fund, including the 1% advance payments fr 2014 and 2015, and will receive pririty in the perfrmance indicatr s mnitring system which determines the distributin f funds t the Autnmus Cmmunities in the Sectrial Cnference n Emplyment. This mdernisatin and adaptatin will include retraining f staff t be specifically in charge f dealing with yung peple. The Annual Emplyment Plicy Plan fr 2014 (PAPE) will place pririty n the mdernisatin and adaptatin f the public emplyment services t the Yuth Guarantee Scheme. This will fcus n re-training fr prfessinals, special ffices and adaptatin f the infrmatin systems. In additin, as laid dwn in the recmmendatin n the Yuth Guarantee, mutual learning activities will be prmted n a natinal, reginal and lcal scale amngst all the parties participating in the fight against yuth unemplyment in rder t imprve the design and utcme f future Yuth Guarantee schemes.
23 Spanish Yuth Guarantee Implementatin Plan 23 Single Emplyment and Self-Emplyment Prtal: This prtal will huse full infrmatin f use t yung peple and will make tls available t them that can help in jb seeking r at the start f an entrepreneurial activity. In this way, n a single website and with the cllabratin f the Autnmus Cmmunities and the Scial Agents, it will be pssible t see any jb vacancies in the public data bases as well as any private nes added, thus guaranteeing that all ffers cmply with legal requirements. Infrmatin will als be given n the main surces f jbs fr yung peple wh are studying, thus helping them chse between different pssible pathways. This Prtal will aim t be cmpatible with the mst usual channels fr finding infrmatin (scial netwrks, blgs, fra, etc.) as well as with the cmputerised tl fr accessing the Yuth Guarantee Scheme. The Prtal must be cnstantly updated, must be knwn by all guidance services and must be subject t cnstant evaluatin by users. Actins with placement agencies: The legislatin tday allws temprary emplyment agencies t act as placement agencies. It is essentially a matter f setting in mtin whatever mechanism is available t reduce the time spent unemplyed and facilitate the transitin int a jb. In rder t achieve crdinated implementatin f the new system f publicprivate cllabratin, the regulatin n public sectr cntracts has been changed t allw fr Framewrk Agreements t be reached in the area f the Natinal Emplyment System. The Framewrk Agreement prpses, during a perid f tw years (which can be extended fr a further tw years), that a number f agencies be pre-selected with which cntracts can be signed by the varius Public Emplyment Services), n the basis f cmmn cnditins but in line with their specific needs (fr different gegraphical areas r different grups f peple). It als establishes a flexible system fr remuneratin f private agencies in which the fcus is n utcmes. It cvers payment fr a filled vacancy lasting a minimum f six mnths, establishing differences between different grups f peple, such as yung peple cvered by the Yuth Guarantee, n the basis f characteristics determining their emplyability, such as their age, the time they have been unemplyed r their persnal circumstances. The Framewrk Agreement, in which the main cncerns expressed by the sectr have been cnsidered, has extensive supprt frm the Autnmus Cmmunities, having been presented at the Sectrial Cnference n Emplyment and Labur Affairs n.11 April The Cmmunities discussed the agreement and furteen f them jined it. After the necessary Agreement f the Gvernment and the frmalities, the Agreement shuld be ready in early Frm then n, the new design will be
24 24 Spanish Yuth Guarantee Implementatin Plan available fr public-private cllabratin in the prvisin f agency services and shuld have a very psitive effect n imprving mediatin fr yung peple, these being ne f the tp-pririty grups. Mbility prgrammes: The Ministry f Emplyment and the Autnmus Cmmunities will encurage the creatin f natinal and Eurpean mbility prgrammes fr yung beneficiaries f the Yuth Guarantee, taking up the synergies created amng the instruments existing within the framewrk f the Eurpean Unin. This will cmply with the Recmmendatin t prmte wrker mbility, by infrming yung peple f jb ffers, traineeships and apprenticeships as well as any supprt available in different areas, regins and cuntries, fr example thrugh services and systems such as EURES, which encurage mbility and wrk within the EU; they als ensure that yung peple wh find wrk in anther area r anther Member State receive the supprt needed t adapt t new surrundings. Educatin-emplyment mediatin prgrammes: These prgrammes will wrk n infrmatin and advice fr yung peple aged frm 15 t T imprve emplyability. As laid dwn in the Cuncil Recmmendatin n the Yuth Guarantee, the aim is t imprve skills and cmpetencies and thus t crrect any imbalance and meet the needs fr labur in services, especially in sectrs within the green ecnmy, the ICTs and health care. Secnd chance prgrammes: The bjective is t train yung peple wh drpped ut f schl at an early age t enter the labur market but wh nw cannt find jb pprtunities. As laid dwn in the Recmmendatin n the Yuth Guarantee, the aim is t ffer yung schl drp-uts and yung peple with limited educatin pssible channels fr returning t educatin and training r secnd-chance educatinal prgrammes that will prvide them with learning envirnments that meet their specific needs and allw them t btain a qualificatin. Cnsidering that emplyability and training are clsely related, specific secndchance prgrammes will be prmted in cllabratin with the Autnmus Cmmunities: A specific prgramme and financial aid fr unskilled, unemplyed yung peple s that they can vluntarily resume a prcess f training. This type f aid will be adapted t the family incme and will be linked t getting a degree and a cmmitment t activity r active jb seeking thrugh the public emplyment services when the prgramme cmes t an end, in line with whatever prcedure is decided n.
25 Spanish Yuth Guarantee Implementatin Plan 25 Once students have btained their cmpulsry secndary educatin certificate (ESO) students shuld be eligible, if they s wish, fr intermediate-level Vcatinal Training r, if they want t wrk, they shuld be able t enter the labur market by participating in labur integratin prgrammes. Access t cmpulsry secndary educatin qualificatins. The rules fr btaining the cmpulsry secndary educatin certificates fr thse aged ver 18 and Bachillerat certificates fr thse aged ver 20 will be changed, and the tests will be adapted t the different age grups. Access t the new cycle f Basic Vcatinal Training will als be taken int accunt. New training actins leading t Prficiency Certificates at level 1 will be made available fr yung peple aged under 25 wh d nt have the cmpulsry secndary educatin certificate. In parallel, all actins at schl level aiming t prevent schl drp-uts will be strengthened. In rder t increase the rate f students wh btain the cmpulsry secndary educatin qualificatin, alternative pathways and additinal supprt will be prvided fr students needing them, as well as individualised attentin and tests fr early detectin f learning difficulties. Training with an emplyment cmmitment: The Ministry f Emplyment and Scial Security and the Autnmus Cmmunities will step up training prgrammes with an emplyment cmmitment, especially fr yung peple. At least 30% f the yung peple wh participate in this type f training shuld have gained emplyment in a maximum perid f three mnths nce their training is ver in the frm f a part-time r full-time cntract lasting at least six mnths. Yung peple wh have nt cmpleted the training actin may jin a firm under a type f cntract that includes training. The pssibility will be studied f pening up this type f prgramme t selfemplyment and entrepreneurship by registering a percentage f beneficiaries f the training in the Special Scial Security Regime fr Self-Emplyed Wrkers fr at least six mnths. Training, especially in languages and infrmatin and cmmunicatins technlgy: The Ministry f Emplyment and Scial security and the Autnmus Cmmunities will prmte their training prgrammes, especially fr yung peple cvered by the Yuth Guarantee, and especially training in languages and in technlgical tls. The training in languages and ICTs that is already available in preparatin fr emplyment and in fficial language schls will be expanded and adapted t the needs f yung peple.
