2 Schl Enrlment Prcedure 1. Scpe (audience and applicability) These prcedures apply t all Department f Educatin schl staff (Kindergarten Year 10) with principals and General Managers having key respnsibilities. These prcedures must be fllwed t cmply with the Enrlment, Attendance and Participatin Plicy. 2. Purpse The aim f these prcedures is t prvide clarity and details fr schls in relatin t the requirements fr schl enrlment under the Educatin Act Definitins Independent student: a student wh lives independently, supprts himself/herself financially and lives away frm his/her parents. An independent student is required t prvide evidence f his/her independent status. Parent: the term parent will be used fr brevity, but als includes a guardian r ther persn having the care r cntrl f a child. Schl: under the Educatin Act 1994 means a state schl and a centre, unit r institute f the state r TasTAFE, which prvides educatinal instructin at any level up t, and including, the final year f secndary educatin; and a schl registered by the Schl Registratin Bard (independent and Cathlic schls). Schl-aged child: defined under the Educatin Act 1994 and refers t a child wh is at least five years f age as at 1 January in any year, and wh unless exempted r excused under the Educatin Act, must be enrlled at a schl r be prvided with hme educatin fr that year and subsequent years until the child cmpletes the schl year during which he r she attains the age f 16 years. A child wh, n 1 January in any year, is at least fur years f age and has nt attained the age f five years is entitled t be enrlled at, and attend Kindergarten. Prcedure details 4.1 Legal requirements All children wh are permanent Australian residents and at least five years f age as at 1 January in any year must be enrlled in a schl, r be prvided with hme educatin until the end f the year in which they turn 16, unless exempted r excused in accrdance with the Act. (Educatin Act 1994 Sectin 4). Exceptins fr families wh are nt Australian residents are explained at Sectin Frm the age f 16, all yung peple are required t participate in a full-time eligible educatin r training ptin fr at least ne year (Yuth Participatin in Educatin and Training Act 2005 (Guaranteeing Futures), Sectin 3). 4.2 General enrlment prcedures Schls must fllw the EduPint enrlment prcess fr the enrlment f each child in their schl. Student Administratin Training Resurces website Enrlment Creatin Tab. Schls must use the Student Infrmatin Frm [Frm A] and the Cntact Infrmatin Frm [Frm B] fr each enrlling child. Schls may als use the Supplementary Infrmatin Frm [Frm C]. The schl principal must request a student s Birth Certificate, Australian passprt, freign passprt and visa r ther evidence f the student s identity at enrlment. Nn presentatin f evidence f identity des nt preclude a student s attendance at schl. The schl must make all effrts t acquire the evidence f identity but must nt stp a child attending because it has nt been presented. If there is any dubt abut the parent's guardianship r care and cntrl f the child the principal must ask fr evidence f their status in this regard, including any curt rders (Sectin 4 (5), Educatin Act 1994). The schl must ensure that the required evidence f identity and residency status infrmatin is prvided by the parent befre the enrlment is accepted. Once the enrlment has been accepted, the schl must enter the data prvided n the Enrlment Frms A, B and C (if apprpriate) int EduPint and retain a cpy f the evidence f the student s identity, as part f the student s permanent recrds. Schls must request that parents validate each student s enrlment details n an annual basis. 4 The Validatin Prcess must be fllwed. Student Administratin Training Resurces website Validatin f Infrmatin. If the principal believes that the schl is unable t prvide apprpriate and safe supprt fr a student with health care needs including thse n the Severe Disability Register r under a Guardianship and Custdy Order, the principal must cnsult the Learning Services General Manager. 4.3 Hme area enrlment prcedures A principal must ensure that all schl-aged children are able t enrl at his r her hme area schl. If a principal believes they are at capacity fr any reasn the principal must cntact Learning Service. 4.4 Hme educatin registratin prcedures Registratin fr hme educatin is the respnsibility f parents. If a child fr whm hme educatin registratin is being sught is already at schl, the child must remain at schl until the Tasmanian Hme Educatin Advisry Cuncil (THEAC) issues the parents with Prvisinal Registratin status. Part-time schl enrlment and part-time registratin with THEAC is nt an available ptin. The age fr hme educatin crrespnds t the age fr schl enrlment. A yung persn may cntinue t be hme educated after the end f the year in which they turn 16, fr a perid nt exceeding the equivalent f tw years full-time study, if they are already in an nging hme educatin prgram. T register fr hme educatin, parents must cntact THEAC n (03) fr Infrmatin n Hme Educatin Registratin. Parents must prvide t THEAC an Applicatin fr Hme Educatin; a certified cpy f the child s full Recrd f Birth/Birth Certificate shwing parent/guardian; and an utline f the prpsed prgram. The minimum registratin perid is the equivalent f ne schl term. 5 identified strategies fr keeping a recrd f each student s prgram and educatinal prgress ntify Learning Services if a student is n lnger enrlled. 4.5 Early entry enrlment prcedures Giftedness T be cnsidered fr early entry t Kindergarten/Preparatry (Prep) a child must: be assessed in the Very Superir range f cgnitive functin, thrugh frmal testing by a registered psychlgist be aged at least three years and six mnths n r befre January 1 fr Kindergarten, and fur years and six mnths n r befre January 1 fr Prep f the year in which entry is requested. The child s parents must infrm the principal f the intentin t apply fr early entry by the last Friday in August f the year prir t enrlment. A principal must: check the age f the child fr whm early entry is t be cnsidered make cntact with the Curriculum Officer (Extended Learning), thrugh the Learning Services General Manager prvide the parents with the relevant dcumentatin make arrangements fr the frmal assessment frward the cmpleted applicatin and assessment reprt t the Curriculum Officer (Extended Learning) thrugh the Learning Services General Manager. The Curriculum Officer (Extended Learning) must frward the applicatin t the Crss-Sectral Placement Cmmittee which will make the final decisin. The Curriculum Officer (Extended Learning) will send a summary f the cmmittee s decisins t each Learning Services General Manager Mbile categry (enrlment f a child frm interstate r verseas) In April 2007, Educatin Ministers agreed that state and territry plicies and practices wuld ensure n child mving interstate wuld be disadvantaged in his/her prgress thrugh the schl system by different state and territry schl starting ages. 6 Fr children seeking early entry r enrlment frm interstate r verseas under the mbile categry the fllwing prcedures apply: Parents must prvide: the child s birth certificate a cpy f the child s enrlment frm frm the previus schl r a dated letter f cnfirmatin f enrlment frm the previus schl a cpy f the child s mst recent schl reprt evidence f a change in residential address fr the child s parents frm interstate t Tasmania. The principal must: accept the mbile categry enrlment nce he/she has authenticated the required dcumentatin and in cnsultatin with the parents, is satisfied that it is in the best interest f the child place the student in an age apprpriate year level unless the parents specifically request that the they be placed in a year level equivalent t their previus enrlment ensure cpies f the required dcumentatin are kept n the student s file. Abut early entry Under Tasmania s Admissin Plicy and Guidelines fr all Tasmanian schls, children begin Kindergarten if they are fur years ld n r befre January 1. The Early Entry Guidelines fr gifted students r students under the mbile categry frm part f these guidelines. See Dc ID TASED Admissin Guidelines fr Kindergarten and Preparatry (Prep). 4.6 Delayed entry t enrlment prcedures There are sme circumstances where delaying entry int Prep may be beneficial. These include where a child has special educatinal needs r delayed develpment. Parents f a child may apply t delay entry int Prep if there is a sund educatinal reasn. Parents must in the first instance seek endrsement fr delayed entry frm the principal f the primary schl that the child will be attending. Parents must then apply by letter directly t the Secretary r their delegate (Learning Services General Manager) with details f their reasn; the name f the primary schl; and evidence f endrsement by the schl principal. 7 Parents must receive cnfirmatin frm the Secretary, r delegate, that an exemptin allwing a delayed entry int full-time schl has been apprved. If granted an exemptin allwing a delayed entry int full-time schl it is hped that the child will enter r remain in Kindergarten in the year that they wuld nrmally have entered Prep. If at any time parents decide t reverse the decisin t delay entry int full-time schl they are able t d s and, in such a circumstance, must make direct cntact with the schl principal. 4.7 Enrlment prcedures in the Tasmanian eschl Enrlment prcedures at the Tasmanian eschl vary accrding t the criterin under which the student is enrlling. The tw enrlment criteria and their enrlment prcedures are: Islatin This applies t students living at distances frm the nearest schl which fall within state and Cmmnwealth criteria. Enrlment prcedure: referral frm the schl where the student is currently enrlled r direct applicatin frm parents Schl Initiated Registratins: Schl Principals are able t register students in the eschl when it is believed that it is likely t imprve the student s access t schling r participatin and/r educatinal utcmes. This wuld include medical, psychlgical, travel and pregnancy criteria. A Memrandum f Understanding (MU) detailing respnsibilities f all parties is signed at the time the student cmmences at the Tasmanian eschl. NOTE: Enrlment Prcedure: Schls are respnsible fr paying fr a Registratin. This equates t $8000 per year fr a full -time registratin and a pr-rata amunt fr part time/part f the year. 8 4.8 Exemptin frm enrlment general infrmatin A schl-age child r class f children may be granted exemptin frm enrlment t enable them t leave schl befre they turn 16 if it is in the best interests f the child s/class f children s educatin fr this t happen. Exemptin frm enrlment may be apprpriate when: it is a cnditin fr enrlment in an educatinal r vcatinal prgram being ffered utside the Department f Educatin a student has lng-term prspects f stable emplyment the student s health prevents their participatin in schling exceptinal circumstances dictate that the student is unable t participate in schling circumstances dictate that the student wuld benefit frm delayed entry int full time schl (Prep - See Sectin 4.6). Exemptin frm enrlment must nt be used: as a disciplinary actin fr family reasns such as the need fr the student t lk after family members, help in a family business r maintain the family hme because a student is pregnant r parenting. Exemptin frm enrlment is granted by the Secretary r delegate at his r her wn initiative r n applicatin (Educatin Act 1994, Sectin 5). The Secretary may impse any cnditins n an exemptin which he r she deems apprpriate. Fr example: the exemptin might be cnditinal n the student having full-time emplyment. If the emplyment were terminated, the student wuld be bliged t return t schl r t an apprved alternative educatinal facility the exemptin might be cnditinal n regular receipt f medical certificates r regular reviews f the child s circumstances. Exemptins frm enrlment can be revked, r ther cnditins can be added, at any time. Until a Certificate f Exemptin frm enrlment has been issued, students must nt be advised that they have received an exemptin. 9 the peple invlved in making decisins affecting the child (e.g. carers, scial wrkers, psychlgists, natural parents, yuth justice wrkers, Children and Family Services, and advcates). Exemptin frm enrlment fr students wh are independent, living away frm hme and withut the care f a parent with care and cntrl must nly be granted after very careful cnsideratin f the child s circumstances. It is apprpriate t expect the student t accept the legislative requirements f cmpulsry educatin. Students in these circumstances may sign their wn applicatin fr exemptin frm enrlment. 4.9 Prcedures fr applying fr exemptin frm enrlment When a parent applies t exempt a child frm enrlment Parents must cmplete an Applicatin fr Exemptin frm Enrlment, which must be submitted t the schl principal. The schl principal must investigate the applicatin. The investigatin may include: cnsultatin with the student (where student has capacity) and the student s parents a wider discussin with all stakehlders additinal infrmatin frm Learning Services supprt staff. Feasible alternatives must be explred prir t applicatin. A schl scial wrker must prvide a reprt as part f the applicatin and liaise with gvernment agencies as required. The principal must prvide the Learning Services General Manager with: The parent s applicatin fr the child s exemptin, his r her reprt and recmmendatin fr either acceptance r rejectin f the applicatin. The Secretary r delegate may make any further investigatin that he r she cnsiders apprpriate and must then either: grant the exemptin, subject t any cnditins refuse the applicatin fr exemptin with reasn. When an exemptin is granted, the Learning Services General Manager must prvide the child s parents with a Certificate f Exemptin frm enrlment which must state the perid f exemptin and any cnditins. A cpy f the certificate must be sent t the principal and the relevant senir scial wrker. 10 Learning Services must ensure the exemptin is reviewed n a regular basis (at least twice per year) by the Learning Services Operatins Manager. The Learning Services General Manager must include the student s exemptin details n the Learning Services exemptins database When the schl r Learning Services initiate an applicatin fr exemptin frm enrlment A principal r member f the Learning Services supprt staff must apply t the Learning Services General Manager using an Applicatin fr Exemptin frm Enrlment. The applicatin must be signed by the student s parents and must dcument reasns fr the request. The reprt may include evidence frm: the student s parents, btained thrugh cnsultatin members f the supprt staff. A schl scial wrker must prvide a reprt as part f the applicatin and liaise with gvernment agencies as required. Feasible alternatives must be explred prir t applicatin. The Learning Services General Manager may make any further investigatin that he r she believes t be apprpriate and will then either: grant the exemptin subject t any cnditins refuse the applicatin fr exemptin. The Learning Services General Manager must ensure the exemptin is reviewed n a regular basis (at least twice per year). The Learning Services General Manager will include the student s exemptin details n the Learning Services exemptins database Class exemptin frm enrlment fr schl-age students enrlling in TasTAFE r senir secndary schl A current class exemptin frm enrlment exists fr all children wh have cmpleted Year 10 but are still schl-aged, within the meaning f the Educatin Act 1994, in the year fllwing Year 10, and are enrlling full-time in TasTAFE r senir secndary schl. These students must be able t prvide evidence f cmpletin f Year 10 by way f either a certificate f cmpletin r f an end-f-year schl reprt Dual enrlment Dual enrlments fr children wh live in mre than ne lcatin can nly ccur in exceptinal circumstances and when the principals f bth schls invlved agree that a dual enrlment is in the best interests f the child. Principals must seek apprval fr dual enrlments frm their Learning Services General Manager. 12 Dual enrlments between the senir secndary schl, TasTAFE and a schl are essential fr nn-australian students attending senir secndary schls r TasTAFE t ensure they can access their entitlement t English language classes Enrlment at a special schl Enrlment at a special schl will be cnsidered when it is requested by a parent and when: the child has significant, identifiable disability which includes a mderate t prfund intellectual disability the child is eligible fr placement n the Register fr Students with Severe Disability. The enrlment must be cnsidered educatinally apprpriate and is available fr students wh live within the identified Learning Services bundary. A parent must initiate a frmal enquiry regarding enrlment, directed thrugh the apprpriate principal/nminee r Early Childhd Interventin Service (ECIS) Officer in Charge in the first instance. The parent must undertake schl visits with relevant Learning Services staff t ensure any decisin is well infrmed. A team meeting invlving the child s parent (and advcate if desired), principal r nminee frm the special schl, relevant Learning Services staff, principal r nminee frm the current educatinal placement (if apprpriate) must be held. Cnsideratin f the student s nminatin fr enrlment in the special schl by the apprpriate Placement Cmmittee is required. A determinatin abut the apprpriateness f the prpsed enrlment will be made by the cmmittee. In the case f interstate enrlments these steps must be matched as clsely as pssible, with telecnference facilities used t assist the prcess where pssible. Access t a special schl n a part-time basis while maintaining their enrlment in their neighburhd schl is an ptin available t students n the Register fr Students with Severe Disability. Parents may appeal a decisin nt t enrl their child in a special schl thrugh the state mbudsman. Further detail n these prcedures is fund in the Special Schls Guidelines. 13 4.13 Families wh are nt Australian residents A Birth Certificate fr students and their parents must be prvided fr families wh are nt Australian residents. Parents must prvide prf f Australian citizenship r permanent residency. If the parents are nt Australian citizens then the schl must cntact Gvernment Educatin and Training Internatinal (GETI), the department s internatinal educatin unit. Temprary migrants must have an Authrity t Enrl which can be applied fr thrugh GETI. This is necessary fr enrlment purpses as sme students are required t pay fees. If the visa is nt in the list f visa sub-classes eligible fr funding under the English as a Secnd Language-New Arrivals prgram then the principal must cntact GETI t determine eligibility. Children wh have an Australian birth certificate, but whse parents are nt Australian, must have an Authrity t Enrl, which can be applied fr thrugh GETI Participatin f Year 10 students in TasTAFE Secndary schl students, aged 15 r 16 years, wh have nt yet cmpleted Year 10 may participate in curses at TasTAFE as part f a persnalised learning prgram r a schl-endrsed prgram. In such cases the enrlment f the student must remain with the schl until the end f the year in which the student turns 16, r until the student has cmpleted Year 10. The relevant General Manager (Learning Services) must apprve the student s participatin. An exemptin frm schl enrlment is nt required fr these students as they remain enrlled in their schl. If a student r parent cntacts TasTAFE directly abut participatin in a curse, the relevant TasTAFE persnnel team must direct the student/parent back t the schl and infrm the principal f the student s intentin. Year 10 students may be allwed t participate in a small number f VETiS curses if representatin frm the industry bdy is made t the Learning Services General Manager. 14 4.15 Duty f care A principal, r his nminee, has a duty f care t all students enrlled at the schl during schl hurs n matter where the students are attending. Bth the schl and TasTAFE share the duty f care fr Year 10 students wh are attending TasTAFE. Fr students attending a curse at TasTAFE, the principal s duty f care therefre cnsists f exercising due diligence in relatin t the students attendance ff the schl site. This includes prviding pastral care, ensuring TasTAFE is aware f the times the students are attending, and ensuring that the curse being undertaken is apprpriate and safe fr the students. Fr TasTAFE staff, their duty f care includes ensuring that the students are in a safe and apprpriate learning envirnment while at TasTAFE Enrlment f children frm interstate r verseas Nte: see als Mbile categry (enrlment f a child frm interstate r verseas) When a parent is enrlling a schl aged child frm interstate r verseas the principal must discuss the age, previus schl reprts and schl wrk f the child, in rder t decide which year level the child is placed in Flexible/alternate educatin prvisin Students accessing a flexible, alternate r accelerated prgram as identified in their Persnalised Learning Plan (PLP) must remain enrlled with their lcal schl r a schl identified by Learning Services. This includes schl-aged students wh are participating in an accelerated prgram at a senir secndary schl. 15 5. Rles and respnsibilities The Department f Educatin is accuntable t the cmmunity, thrugh the Minister fr Educatin and Skills, fr ensuring apprpriate schl enrlment practices. Tasmanian law requires that schl aged children and yung peple are enrlled, attend and/r participate as defined within these prcedures. Review any applicatins fr review frm parents fr enrlments in an ut f hme area schl. adhere t the Enrlment, Attendance and Participatin Plicy and assciated prcedures and guidelines.
