General Statute Cyberbullying penalty Except as therwise made unlawful by this Article, it shall be unlawful fr any persn t use a cmputer r cmputer netwrk t d any f the fllwing: (1) With the intent t intimidate r trment a minr: a. Build a fake prfile r Web site; b. Pse as a minr in: 1. An Internet chat rm; 2. An electrnic mail message; r 3. An instant message; c. Fllw a minr nline r int an Internet chat rm; r d. Pst r encurage thers t pst n the Internet private, persnal, r sexual infrmatin pertaining t a minr. (2) With the intent t intimidate r trment a minr r the minr's parent r guardian: a. Pst a real r dctred image f a minr n the Internet; b. Access, alter, r erase any cmputer netwrk, cmputer data, cmputer prgram, r cmputer sftware, including breaking int a passwrd prtected accunt r stealing r therwise accessing passwrds; r c. Use a cmputer system fr repeated, cntinuing, r sustained electrnic cmmunicatins, including electrnic mail r ther transmissins, t a minr.

(4) Cpy and disseminate, r cause t be made, an unauthrized cpy f any data pertaining t a minr fr the purpse f intimidating r trmenting that minr (in any frm, including, but nt limited t, any printed r electrnic frm f cmputer data, cmputer prgrams, r cmputer sftware residing in, cmmunicated by, r prduced by a cmputer r cmputer netwrk). (5) Sign up a minr fr a prngraphic Internet site with the intent t intimidate r trment the minr. (6) Withut authrizatin f the minr r the minr's parent r guardian, sign up a minr fr electrnic mailing lists r t receive junk electrnic messages and instant messages, with the intent t intimidate r trment the minr. (b) Any persn wh vilates this sectin shall be guilty f cyber-bullying, which ffense shall be punishable as a Class 1 misdemeanr if the defendant is 18 years f age r lder at the time the ffense is cmmitted. If the defendant is under the age f 18 at the time the ffense is cmmitted, the ffense shall be punishable as a Class 2 misdemeanr.
