4 ANTAQ s Institucional Aspects Created by the Law nº 10,233, of June 5th, Special Autarchy linked to Secretariat of Ports Law nº 12,815/13 Responsible for regulation, supervision and harmonization of ports and waterways transport activities.
5 Art. 27. ANTAQ, in it sphere of activity, should: IV prepare and publish rules and regulations to the provision of transport services and the operation of the waterway and port infrastructure, ensuring equality in access and use, ensuring the rights of users and fostering competition between operators. V celebrate grant s acts of permission or authorization for the provision of transport by inland waterway shipping companies, lakeside, crossing, maritime support, port support, cabotage and long course, respecting the provisions of the art. 13 and 14, managing the related contracts and other administrative instruments. X represent Brazil at international navigation bodies and conventions, agreements and treaties on waterway transport, subject to the directives of the Ministry of Transports and the duties of other federal agencies. XXIV authorize Brazilian companies of long course navigation, cabotage, maritime support, port support, river and lakeside, the charter of foreign vessels to cargo transportation, as provided by Law nº 9,432 of January 8th, 1997.

13 Aspects of Law nº 9,432/97 Art. 7 The foreign vessels may only participate in cargo transportation in cabotage and inland navigation, as well as in port and maritime support navigation when chartered by Brazilian shipping companies, subject to the provisions of art.9 and 10. Sole Paragraph. The Brazilian government could celebrate international agreements that allow the participation of foreign vessels in navigation referred to this article, even when it is not chartered by Brazilian shipping companies, since the same privilege is provided to Brazilian flag in others contracting States.
