4 4 P a g e A BRIEF HISTORY OF HAZARDOUS WASTE MANAGEMENT REGULATIONS In 1976, Cngress passed the Resurce Cnservatin and Recvery Act (RCRA), which directed the U.S. Envirnmental Prtectin Agency (EPA) t develp and implement a prgram t prtect human health and the envirnment frm imprper hazardus waste management practices. The prgram is designed t cntrl the management f hazardus waste frm its generatin t its ultimate dispsal (in ther wrds, frm "cradle-t-grave ). EPA first fcused n large cmpanies, which generate the greatest prtin f hazardus waste. Business establishments prducing less than 1000 kilgrams (2,200 punds) f hazardus waste in a calendar mnth (knwn as small quantity generatrs) were exempted frm mst f the hazardus waste management regulatin published by EPA in May In recent years, hwever, public attentin has been fcused n the ptential fr envirnmental and health prblems that may result frm mismanaging even small quantities f hazardus waste. Fr example, small amunts f hazardus waste dispsed n the land may seep int the earth and cntaminate undergrund water used as a surce f ptable water. In Nvember 1984, the federal Hazardus and Slid Waste Amendments t RCRA were signed int law. With these amendments, Cngress directed EPA t establish new requirements that wuld bring small quantity generatrs wh generate between 100 and 1000 kilgrams (kg) f hazardus waste in a calendar mnth int the hazardus waste regulatry system. EPA issued final regulatin fr these 100 t 1000 kg/m generatrs n March 24, Mst f the requirements became effective n September 22, The EPA has authrized Alabama t administer its wn hazardus waste prgram. Alabama administers its prgram under the Alabama Hazardus Waste Management and Minimizatin Act f 1987(AHWMMA). The state regulatins generally parallel the federal prgram and perate in lieu f the federal scheme t the extent f the EPA s authrizatin. ADEM has adpted state regulatins (Divisin 14 f ADEM Administrative Cde) t include bligatins impsed by the federal Hazardus and Slid Waste Amendments f Federal regulatins: 40 Cde f Federal Regulatins (C.F.R.), Parts 260 thrugh 280. Almst any business entity, be it an ffice r a factry, generates sme waste frm discarded sandwich wrappers in the break rm t spilled paint in the stck rm. Part f yur task is t determine if the wastes yur facility generates are hazardus and hw best t manage them. Regardless f the amunt f hazardus waste generated, state and federal envirnmental regulatins require every facility t test r use knwledge f its materials and prcesses t determine if its waste is a listed hazardus waste r exhibits ne f the fur hazardus characteristics (i.e., ignitability, crrsivity, reactivity, txicity). This prcess is called making a hazardus waste determinatin. T determine whether a material is a hazardus waste, a facility must answer 4 questins abut each waste stream: First, is the material a slid waste, as defined by the AHWMMA regulatins? The regulatry framewrk fr distinguishing slid and hazardus waste can be fund at ADEM Admin. Cde rs (2) and (3). Secnd, des it fit ne f the exclusins frm the definitin f slid r hazardus waste? Materials that have been excluded are listed in ADEM Admin. Cde r (4). Third, is it listed r characteristic hazardus waste? Listed and characteristic wastes are defined in ADEM Admin. Cde rs , , and Furth, has the waste been delisted? Fllw the Hazardus Waste Identificatin Flwchart belw t determine if yu have a hazardus waste: # 1 - Is Yur Material a Slid Waste? Step 1 The first step is t determine if the material in questin is classified as a slid waste. If the material is NOT a slid waste, it cannt be a hazardus waste. The statutry definitin f a slid waste is cmpletely irrespective f the physical frm f the waste. A "slid" waste can be a liquid r a cntained gas. A material is cnsidered a slid waste if it: Is a slid, semi-slid, liquid, r cntained gaseus material which is discarded r has served its intended purpse Is abandned Is being recycled by being placed n the grund (and that is nt the nrmal use), burned fr energy recvery, reclaimed, r accumulated mre than ne year. Is inherently waste-like (e.g., dixin wastes) If the material in questin meets any f the prvisins abve, yu may have a slid waste. If yu answered NO t all f the abve prvisins, yu d nt have a slid waste. D yu have a slid waste? YES - g t Step #2 belw. NO - the material des nt qualify as a slid waste, and therefre cannt be regulated under

8 8 P a g e the Alabama Hazardus Wastes Management and Minimizatin Act (AHWMMA). Step 2 # 2 - Is Yur Slid Waste Excluded frm Hazardus Waste Regulatins? After yu have determined that yu have a slid waste n hand, the next step is t determine if that slid waste is excluded frm AHWMMA regulatin. ADEM grants specific exclusins frm sme hazardus waste regulatins if certain cnditins are met. Sme materials are excluded frm the definitin f slid waste, while sme slid wastes are excluded frm the definitin f hazardus waste. Knwing these exclusins can be helpful in waste management prgrams. Sme materials that are excluded frm the definitin f slid waste (and therefre are NOT hazardus) include: Dmestic sewage Industrial wastewater discharges Radiactive waste Spent wd preserving slutins that are reclaimed and reused in the wd preserving prcess Prcessed scrap metal Irrigatin return flw In situ mining waste Secndary materials that are reclaimed and returned t the riginal prcess, if the reclamatin and return prcess is ttally enclsed. These wastes are nt hazardus because they are nt cnsidered slid waste. Sme slid wastes are excluded frm the definitin f hazardus wastes: Husehld waste (pesticides, cleaners) Sme agricultural wastes that are returned t the sils as fertilizers Fssil fuel cmbustin wastes Cement kiln dust (unless the facility burns hazardus waste as fuel) Arsenically treated wd wastes generated frm a persn using wd fr its intended purpse Petrleum-cntaminated media that is subject t the Undergrund Strage Tank (UST) crrective actin prgram Used il filters that have been ht drained Used chlrflurcarbn refrigerants that are being reclaimed fr further use. These slid wastes are excluded frm the definitin f hazardus waste by ADEM. In additin, sme recycled materials are nt classified as slid waste. Materials are nt slid wastes IF: They are being used as substitutes fr cmmercial prducts

9 9 P a g e Returned back t the riginal prcess withut first being reclaimed r land dispsed. NOE: This exemptin is nt valid if the materials are burned fr energy recvery r used t make a prduct that will be applied t the land. Samples cllected fr lab analysis are exempt frm AHWMMA regulatin until it is determined that they are t be dispsed f. Used il that exhibits hazardus characteristics can be excluded if recycled. It is regulated under Standards fr the Management f Used Oil (ADEM Admin Cde r ). Universal wastes (including batteries, pesticides, mercury-cntaining thermstats, switches, and thermmeters, and electric lamps) may als qualify fr reduced regulatin. The list abve is NOT cmprehensive. If yur waste is nt n the list abve, it may still be excluded frm AHWMMA regulatin. See ADEM Admin Cde r (4) fr a cmplete list f thse wastes exempt frm hazardus waste regulatin. Furthermre, if yur waste IS listed abve, that des nt mean yu are autmatically exempt. Each exemptin abve is cnditinal and facility managers shuld review applicable sectins f ADEM Admin Cde r and cntact the State's hazardus waste prgram fr clarificatin n exemptins. Is the slid waste excluded frm hazardus waste regulatin? YES - the waste is exempt (nt regulated) under the AHWMMA. NO - g t Step #3 belw. #3 - Is Yur Slid Waste a Listed Waste? Step 3 Once yu have determined that yur slid waste is nt excluded frm AHWMMA requirements, the next step is t determine if the material is a "listed waste". ADEM "lists" hazardus wastes that fall int fur categries; F-listed wastes: The F list includes wastes frm cmmn industrial prcesses. Because they are nt specific t ne type f industry, they are called wastes frm nn-specific surces. This list includes fr example many types f spent (r used) slvents. See ADEM Admin Cde r (2) t see if yur waste is F-listed. K-listed wastes: The K list includes wastes frm specific industrial prcesses, such as wd preservatin, rganic chemical prductin, and pesticide manufacturing. See ADEM Admin Cde r (3) fr the cmplete list f manufacturing prcess wastes t see if yur facility might have a K-listed waste. P- and U-listed wastes: These tw lists designate certain cmmercial chemical prducts as hazardus when dispsed f unused. These unused chemicals may becme wastes in a number f ways. Sme can be spilled while in use while thers can be intentinally discarded if ut f specificatin. Fr a waste t qualify as a P- r U-listed waste, it must meet all three f the fllwing criteria: The frmulatin must cntain at least ne chemical n the P r U list The chemical in the waste must be unused The chemical in the waste must be in the frm f a CCP. *A CCP is a chemical that is f technical (cmmercial) grade, 100% pure, and the nly active ingredient in the frmulatin. There are hundreds f P- and U-listed wastes. Facility managers shuld lk in 40 CFR t see if chemicals present n-site are hazardus if dispsed f unused. Please nte that the chemicals with the "P" cde are acutely hazardus. Generatrs with acutely hazardus waste are subject t different

10 10 P a g e accumulatin limits fr thse wastes. Is the slid waste a listed waste (F, K, P, U)? YES - the waste is a listed waste and is therefre regulated under the AHWMMA. NO - g t Step #4 belw. #4 - Is Yur Slid Waste a Characteristic Waste? Step 4 If yur waste is nt listed in ADEM Admin Cde r , it may still be a hazardus waste. The next step is t see if yur waste is a characteristic hazardus waste. Slid wastes that are nt directly listed in ADEM Admin Cde r may still be hazardus. ADEM uses a classificatin system based n the fur prperties f slid wastes. If a material exhibits at least ne f these characteristics, it is classified as a hazardus waste. The fur prperties are: IGNITABILITY A substance is ignitable if it displays any f the fllwing prperties. A liquid with a flashpint f less than 60 C (140 F); A nn-liquid that is capable, under standard temperature and pressure, f causing fire thrugh frictin, absrptin f misture, r spntaneus chemical changes, and when ignited, burns s vigrusly and persistently that it creates a hazard; An ignitable cmpressed gas; An xidizer (such as a chlrate r perxide). Details n the ignitability characteristic are included in ADEM Admin Cde r (2). CORROSIVITY A substance is crrsive if it displays any f the fllwing prperties: An aqueus material with a ph less than r equal t 2 r greater than r equal t 12.5; A liquid that crrdes steel at a rate f at least 0.25 inches per year at 55 C (130 F); NOTE: A waste that is nt aqueus and cntains n liquid falls utside the definitin f ADEM crrsivity. Details n the crrsivity characteristic are included in ADEM Admin Cde r (3). REACTIVITY A substance is reactive if it displays any f the fllwing prperties. Nrmally unstable and readily underges vilent change withut detnating; Reacts vilently with water; Frms ptentially explsive mixtures with water; A cyanide r sulfide bearing waste which can generate fumes in a quantity sufficient t present a danger t human health. Capable f detnatin A frbidden explsive, r a Class A r Class B explsive, as defined in Department f Transprtatin regulatins in 49 CFR Part 173. Details n the reactivity characteristic are included in ADEM Admin Cde r (4). TOXICITY A substance is txic if it exceeds the cncentratins fr cntaminants listed in the

11 11 P a g e "Maximum Cncentratin f Cntaminants fr the Txicity Characteristic" table, presented in ADEM Admin Cde r (5). A specific test, the Txicity Characteristic Leaching Prcedure (TCLP) must be cnducted t determine if the waste is classified as txic. Details n the txicity characteristic are included in ADEM Admin Cde r (5). ADEM designates specific, standardized test methds that are t be used when determining the characteristics f a waste. These techniques are listed in the abve mentined sectins. Is the slid waste a characteristic hazardus waste? YES - the waste is a characteristic waste and is therefre regulated under the AHWMMA. NO - g t Step #5 belw. Step 5 #5 - Is Yur Slid Waste Subject t the Mixture Rule? Even thugh yur slid waste is nt a listed r characteristic waste, it culd becme a hazardus waste if mixed with materials classified as hazardus. The next step is t determine if yur waste is a mixture f a slid waste and a hazardus waste. The "Mixture Rule" states that mixtures f slid waste and listed hazardus waste must be regulated as hazardus waste. There are tw ways t determine if a material is regulated under the mixture rule: If the material is a mixture f a slid waste and a hazardus waste, and the mixture exhibits ne r mre f the characteristics f hazardus waste; If the material is a mixture f a slid waste and a listed waste. The mixture rule is intended t discurage generatrs frm mixing wastestreams. Mre infrmatin can be reviewed at ADEM Admin Cde r and ADEM Admin Cde r (3)(a)2(iv). Is the slid waste subject t the mixture rule? YES - the waste is subject t the mixture rule and is therefre regulated under the AHWMMA. NO - g t Step #6 belw. Step 6 #6 - Is Yur Slid Waste Subject t the Derived-Frm Rule? Yur material is nt a listed r characteristic waste, nr is it classified as hazardus due t the mixture rule. Yet the material might still be a hazardus waste. Hazardus waste treatment, strage, and dispsal prcesses ften generate residues that may cntain high cncentratins f hazardus cnstituents. The derived-frm rule gverns the regulatry status f such waste residues. Accrding t the Rule, any slid waste derived frm the treatment, strage, r dispsal f a hazardus waste is cnsidered hazardus. "Derived frm" wastes include sludges, spill residue, ash, emissin cntrl dust, and leachate. Sme examples are drums that have been used fr strage f a hazardus waste, r ash frm the incineratin f hazardus waste. This principle applies regardless f the actual risk t human r envirnmental health. Mre details abut the "derived-frm" rule and exemptins t the rule are included in ADEM Admin Cde r (3)c and d. Is the slid waste subject t the derived-frm rule? YES - the waste is subject t the derived-frm rule and is therefre regulated under AHWMMA. NO - the waste is nt classified as hazardus under AHWMMA.

12 12 P a g e Waste Analysis A slid waste is a hazardus waste if it is a listed hazardus waste (defined at ADEM Admin. Cde r ) r if it exhibits any f the characteristics defined in ADEM Admin. Cde r T determine whether the waste exhibits any f the characteristics, the generatr generally must use analytical methds capable f quantitatively identifying the cntaminants in questin. Unlike characteristic wastes, listed wastes are generally determined based n the generatr s knwledge f its manufacturing prcess r the chemicals used. Example A: a facility generates a sludge frm wastewater treatment f spent electrplating slutin and spent acetne frm cleaning and degreasing parts in a maintenance shp. In bth cases, knwledge f the prcess that prduces the waste is enugh t identify the material as a hazardus waste. Spent slvent and wastewater treatment sludge frm an electrplating prcess are bth listed hazardus wastes. Example B: a facility generates a spent sandblasting media that cntains lead. Generatr knwledge f the prcess is nt enugh t make a hazardus waste determinatin; analytical testing is needed t dcument hw much lead is present. If lead is present at levels belw 5 parts per millin (ppm; als expressed as milligrams per liter r mg/l), the waste is nt hazardus fr lead; if the level is 5 parts per millin r higher, the waste is a txicity characteristic hazardus waste. Yu can meet waste analysis requirements using several methds r cmbinatins f methds. Wherever feasible, the preferred methd is t cnduct sampling and labratry analysis because it is mre accurate than ther ptins. Hwever, generatrs can als apply acceptable knwledge, which includes (1) prcess knwledge; (2) waste analysis data btained frm facilities with a similar prcess that send their waste ff-site fr treatment, strage, r dispsal; r (3) recrds f analysis perfrmed n the waste befre the effective date f AHWMMA regulatins, assuming the waste stream has nt changed. Prcess knwledge invlves btaining detailed infrmatin n a waste frm existing published r dcumented waste analysis data r studies cnducted n hazardus waste generated by prcesses similar t that which generated the waste. The waste shuld be retested if the prcess generating it changes. When using prcess descriptins and existing data, yu must carefully scrutinize whether (1) there are any differences between the prcesses dcumented and yur current prcesses and (2) the data used are accurate and current, including (a) whether any wastes are newly regulated as hazardus wastes, (b) whether existing data are sufficient t identify any new cnstituent cncentratin limits, and (c) the infrmatin is based n currently valid analytical techniques.

Under Alabama and federal regulatins, there are three classificatins f hazardus waste generatrs. Yur generatr status is based n the amunt f hazardus waste yu generate in ne calendar mnth; in turn, that determines which regulatins apply t yur business. Facility persnnel invlved in the management f hazardus waste, r the dcumentatin f hazardus waste activities, must have training which is specific t their jb duties. It is expected that the jb-specific training necessary will be as varied as the jb duties present in yur facility. The training prgram shuld cntain basic hazardus waste management prcedures fr select individuals as necessary. Fr example, waste identificatin and determinatins, manifest requirements, accumulatin time limits, prper cntainer and tank management, and hw t prperly label hazardus waste cntainers and tanks shuld all be tpics included in the hazardus waste training prgram.

All facility persnnel, n matter their psitin, shuld have emergency respnse training s they can respnd effectively in an emergency invlving hazardus waste. These cntainers must be under the cntrl f the emplyees wh generate the waste placed in them; they must remain clsed at all times, except when waste is being added r remved, and they must be marked with the wrds Hazardus Waste r ther wrds that describe their cntents. When a cntainer is filled, it must be dated at nce and mved t yur hazardus waste accumulatin area within three days. (2) Cntainer and Tank Labels: While being accumulated n-site, hazardus waste must be stred in cntainers r tanks that are labeled r marked clearly with the wrds "Hazardus Waste" and the apprpriate EPA hazardus waste numbers. (3) Cnditin f cntainers. If a cntainer hlding hazardus waste is nt in gd cnditin, r if it begins t leak, the generatr must transfer the hazardus waste frm this cntainer t a cntainer that is in gd cnditin, r manage the waste in sme ther way that cmplies with the requirements f Chapter 6 f Divisin 14.

(b) Uncvered tanks must be perated t ensure at least 60 centimeters (2 feet) f freebard, unless the tank is equipped with a cntainment structure (e.g., dike r trench), a drainage cntrl system, r a diversin structure (e.g., standby tank) with a capacity that equals r exceeds the vlume f the tp 60 centimeters (2 feet) f the tank. (2) If yu accumulate hazardus waste in tanks, yu must inspect, where present:

27 27 P a g e (6) If yu generate incmpatible wastes, yu must cmply with the fllwing special requirements: (a) Incmpatible wastes and/r materials must nt be placed in the same tank. (b) Hazardus waste must nt be placed in an unwashed tank which previusly held an incmpatible waste r material. Emergency Respnse The Emergency Crdinatr. At all times there must be at least ne emplyee, either n the premises r n call (i.e., Available t respnd t an emergency by reaching the facility within a shrt perid f time), with the respnsibility fr crdinating all emergency respnse measures specified in ADEM Admin Cde r (5)(d)6.(iv). This persn is yur emergency crdinatr; yu may als designate ther emplyees t take n thse respnsibilities if the emergency crdinatr is nt available t d s. The emergency crdinatr r designee must be trained and prepared t respnd t any emergencies that arise. The applicable respnses are as fllws: (1) In the event f a fire, call the fire department r attempt t extinguish it using a fire extinguisher. (2) If there are injuries, call the fire department; (3) In the event f a spill, cntain the flw f hazardus waste t the extent pssible, and as sn as practicable, clean up the hazardus waste and any cntaminated materials r sil; (4) In the event f a fire, explsin, r ther release which culd threaten human health utside yur facility r when if yu have knwledge that a spill has reached surface water, yu must immediately ntify the Natinal Respnse Center (using their 24-hur tll free number 800/ ). Yur reprt must include the fllwing infrmatin: (a) The name, address, and U.S. EPA Identificatin Number f yur facility; (b) Date, time, and type f incident (e.g. spill r fire); (c) Quantity and type f hazardus waste invlved in the incident; (d) Extent f injuries, if any; and (e) Estimated quantity and dispsitin f recvered materials, if any. All facilities must be equipped with the fllwing, unless nne f the hazards psed by waste handled at the facility culd require a particular kind f equipment specified belw: (a) An internal cmmunicatins r alarm system capable f prviding immediate emergency instructin (vice r signal) t facility persnnel; (b) A device, such as a telephne (immediately available at the scene f peratins) r a hand-held tw-way radi, capable f summning emergency assistance frm lcal plice departments, fire departments, r State r lcal emergency respnse teams; (c) Prtable fire extinguishers, fire cntrl equipment (including special extinguishing equipment, such as that using fam, inert gas, r dry chemicals), spill cntrl equipment, and decntaminatin equipment; and (d) Water at adequate vlume and pressure t supply water hse streams, r fam prducing equipment, r autmatic sprinklers, r water spray systems. (3) Testing and maintenance f equipment. All cmmunicatins r alarm systems, fire prtectin equipment, spill cntrl equipment, and decntaminatin equipment, where required, must be tested and maintained as necessary t assure that they will wrk during an emergency. (4) Access t cmmunicatins r alarm system. (a) Whenever hazardus waste is being pured, mixed, spread, r therwise handled, all persnnel invlved in the peratin must have immediate access t an internal alarm r emergency cmmunicatin device, either directly r thrugh visual r vice cntact with anther emplyee, unless such a device is nt required under ADEM Admin. Cde r (3). These limits were established s that a small business culd accumulate enugh waste t make shipping and dispsal ecnmical. ** As an SQG, yu must nt ffer yur hazardus waste t transprters that have nt received an EPA identificatin number and an Alabama Hazardus Waste Transprt Permit. Carefully chse yur Hazardus Waste Transprter and Treatment, Strage, r Dispsal facility. Under Federal Law, yu are always respnsible fr the hazardus waste generated at yur facility even after the waste leaves yur facility. This is knwn as Cradle t Grave respnsibility. Preparing Yur Hazardus Waste fr Shipment. When yu prepare hazardus wastes fr shipment, yu must put the wastes in cntainers acceptable fr transprtatin and make sure the cntainers are prperly labeled and packaged accrding t the cntainer manufacturer s packaging specificatins. It became effective in Alabama in March f Universal Waste regulatins are fund in Chapter 17 f ADEM s hazardus waste regulatins (ADEM Administrative Cde 335, Divisin 14). Criteria fr waste t be included in the Universal Waste Rule are: The waste is generated in a wide variety f settings The waste is generated by a vast cmmunity The waste may be present in significant vlumes in nn-hazardus management systems What Wastes are Cvered by This Rule? Batteries, such as nickel-cadmium (Ni-Cd) and sealed lead-acid batteries which are fund in many cmmn items in the hme r business including electrnic equipment, mbile telephnes, prtable cmputers, and emergency back-up lighting. All hazardus waste batteries are cvered by this Rule including wet, dry, Ni-Cd, lead-acid, and caustic mercury. Pesticides that have been recalled r banned frm use, are bslete, have becme damaged, r are n lnger needed due t changes in crpping patterns r ther factrs. These wastes are ften stred in sheds r barns fr lng perids f time. Only thse pesticides which are suspended r canceled as part f a recall and unused pesticides cllected as part f a waste pesticide cllectin prgram are cvered by this Rule. Mercury-cntaining Equipment is a device r part f a device (including thermstats but excluding batteries and lamps) that cntains elemental mercury integral t its functin. Thermstats can cntain as much as three (3) grams f liquid mercury and are lcated in almst any building. Mercury-cntaining thermstats, switches, and ther equipment (as well as vials r ampules f mercury remved frm such equipment) are cvered by this Rule. Lamps (including high intensity discharge lamps, flurescent lamps, and cmpact flurescent lamps), which cntain small amunts f mercury, lead, and smetimes cadmium. Large Quantity Handlers f universal wastes must cmply with the same requirements as Small Quantity Handlers with the fllwing exceptins: Must prvide written ntificatin t State/EPA and btain an EPA identificatin number. Ntificatin must include cmpany name, mailing address, name and phne number f cntact persn, physical address, type f waste being handled, and a statement indicating the handler is accumulating mre than 5,000 kilgrams f universal waste; Must ensure that all emplyees are thrughly familiar with prper waste handling and emergency prcedures; and Must keep a recrd f universal waste received and shipped at the facility, t include: name, quantity and type, date shipped r date received. These recrds must be retained fr at least three years.

Wh may cmply with the universal waste rule? All hazardus waste generatrs are allwed t manage applicable wastes under the universal waste regulatins. Husehlds are exempted frm cmplying with these regulatins. Am I required t manage these items as a universal waste? A generatr has the ptin f handling applicable wastes as universal wastes r perfrming a slid/hazardus waste determinatin. If the materials are nt listed and d nt display a characteristic f hazardus waste, they are nt hazardus waste. 37 37 P a g e CHAPTER 6 USED OIL MANAGEMENT STANDARDS In additin t hazardus waste, many small businesses in Alabama als generate used il, used il filters, and materials that are cntaminated with used il (such as srbents used t clean up the small leaks and spills f used il). While used il is typically nt as dangerus t the wrkers wh handle it as mst hazardus wastes, spilled r imprperly dispsed used il can still have a devastating impact n the envirnment. Because f its ptential fr envirnmental harm, used il is regulated under a special set f rules cntained in Chapter 17 f ADEM s hazardus waste regulatins (ADEM Administrative Cde 335, Divisin 14). This chapter will deal with the management f used il and the differences between the hazardus waste regulatins and the used il regulatins. What is used il? Chapter defines used il as any il that has been refined frm crude il, r any synthetic il, that has been used and as a result f such use is cntaminated by physical r chemical impurities. In additin t the autmbile crankcase il that is traditinally referred t as used il, this definitin includes nearly any f the petrleumbased r synthetic substances that are used fr lubricatin, heat transfer, r hydraulic fluid. The facility must prvide adequate aisle space in all areas, including the hazardus waste accumulatin area: the cntainers must be arranged s emergency equipment can be maneuvered int the area and can reach any cntainer. Hazardus Waste Determinatins: Yu must make a Hazardus Waste Determinatin n any slid waste that is generated at yur facility. Hazardus waste determinatins can be cnducted by labratry analysis r generatr knwledge. If yu find unidentified cntainers during yur weekly inspectins, yu must make a hazardus waste determinatin n the cntents yu have t knw what the material is befre yu can figure ut what t d with it. Keep dcumentatin fr the hazardus waste determinatins n all yur facility s waste streams, hazardus r nt. Used Oil Management: Used Oil cntainers must be clsed, labeled with the wrds Used Oil, and in gd cnditin. All releases f used il t the envirnment must be cleaned up prmptly. Weekly Inspectins: Yu must cnduct an inspectin f yur hazardus waste strage area every week. Thse inspectins must be dcumented in an inspectin lg; that lg must include the name f the persn cnducting the inspectin, the date and time f the inspectin, the number and vlume f cntainers in the strage area, the bservatins made during the inspectin and the date and nature f any repairs. Recrdkeeping Requirements: Yu must maintain dcuments related t training, emergency preparedness, emergency respnse activities, and hazardus waste ntificatins, shipments, and inspectins. In mst cases, yu will need t keep these recrds fr three years.

43 43 P a g e CHAPTER 8 MANAGING NON-HAZARDOUS SOLID WASTE In this handbk, we ve talked abut the prper management f hazardus wastes generated by small businesses in Alabama. Hwever, yur business als generates ther wastes that need prper management. This chapter will deal with the management f nnhazardus slid waste and its effect n the municipal slid waste (MSW) stream. What is MSW? Municipal slid waste includes wastes such as durable gds, nndurable gds, cntainers and packaging, fd wastes, yard wastes, and miscellaneus inrganic wastes frm residential, cmmercial, institutinal, and industrial surces. Examples f waste frm these categries include appliances, newspapers, clthing, fd scraps, bxes, dispsable tableware, ffice and classrm paper, wd pallets, and cafeteria wastes. As f 2010 (the mst recent statistics available), the United States generates apprximately 249 millin tns f MSW annually. The U.S. Envirnmental Prtectin Agency (EPA) estimates that 34% f the MSW is being recycled, 12% is managed by cmbustin, while the remaining 54% is buried in landfills. New state and federal landfill regulatins will make the dispsal f waste in landfills increasingly expensive. Cmmunities shuld cnsider ther alternatives t landfilling, including waste reductin, recycling and cmpsting. Small business can play a key rle in helping its cmmunity meet its waste reductin and recycling gals. A typical MSW stream is cmpsed f the fllwing majr elements: Materials in MSW Weight * Paper and Paperbard 28.5% * Fd 13.9% * Yard Waste 13.4% * Plastics 12.4% * Metals 9.0% Rubber, Leather, Textiles 8.4% * Wd 6.4% * Glass 4.6% Other 3.4% 100% (Items with an asterisk can be recycled r cmpsted in mst cmmunities) In years past, cmmercial firms and small businesses recycled cardbard bxes and scrap metals n a limited basis. Tday, recycling has greatly expanded t include

44 44 P a g e materials such as: glass, aluminum cans, wd, ffice and cmputer paper, newspaper, plastics, used mtr il, cnstructin and demlitin waste, kitchen grease, steel, and autmtive batteries. When it cmes t recycling at yur facility, the first step is t find ut what markets and services are available lcally t handle the types and quantities f materials generated at yur business. Fr example, yur business may generate enugh paper (cardbard, ffice paper, cmputer paper, newspaper etc.) that a lcal waste hauler may cme and pick up these materials n a regular basis. Other, smaller vlume, items may have t be taken t a recycling drp site r recycling center. Once yu have identified the lcal markets fr recyclables, then it is time t establish yur prgram using the fllwing steps as a guide: 1. Get management's supprt. Have the Directr, Chief Executive Officer, President, r "The Bss", send a mem r letter t all emplyees explaining the prgram, its benefits, hw the revenue will be used, etc. 2. Set up an emplyee cmmittee t guide the recycling prgram and assign ne individual as the primary cntact persn t crdinate the prgram between management, the emplyees, and the waste hauler/cllectrs. 3. Organize a cllectin system fr each material in yur recycling prgram. This will include psitining and labeling cntainers and wrking with janitrial staff. 4. Establish an educatin and mnitring prgram t insure that new emplyees are infrmed abut the recycling prgram, uncntaminated recyclables are supplied t the hauler/cllectrs, and the prgram is meeting the cmmunity's waste reductin/recycling gals. 5. Prvide psitive feedback t emplyees s that they feel invlved in and cmmitted t the recycling prgram. As stated befre, yard waste makes up abut 13.4% f the MSW stream, and in Alabama during the grwing seasn this culd easily increase t 20-25%. With restrictins n the pen burning f leaves and increases in tipping fees at landfills, mre and mre cmmunities are turning t cmpsting. A variety f materials can be cmpsted including, but nt limited t: grass clippings and dead plants frm garden areas; leaves, twigs and branches frm tree pruning; vegetable scraps and cffee grunds frm cafeterias and kitchens; and saw dust frm untreated wd. Cmpst is a valuable sil cnditiner and rganic amendment that prvides imprved sil texture and sil aeratin, increased water hlding capacity, decreased ersin, and imprved regulatin f sil temperature. A n-fuss way t recycle grass clippings and leaves is t put a mulching blade n the lawn mwer; the leaves and clippings are pulverized and disappear int the grass, where they decmpse and prvide nutrients back t the lawn. In additin t recycling and cmpsting, there are a variety f ther techniques yu can use in yur daily business peratins that can help reduce the amunt f waste dispsed in landfills.
