3 City f Newburgh City Hall 83 Bradway Newburgh, New Yrk Eligible Wrk This prgram is aimed t address health and safety cncerns in eligible City f Newburgh husehlds which are wner-ccupied and the wner qualifies as lw incme n the HUD scale. Eligible wrk includes: Water and Sewer laterals Rf repairs Heating system repair and replacement Water heating repair and replacement Electrical system repair and replacement Handicap accessibility Other emergency repairs (fr which a city vilatin has been issued, including sidewalks) Prgram Terms There is a maximum lan amunt f $20,000 fr the wner s unit and a maximum f $15,000 fr rental units in the hme. The actual lan amunt will be determined by the scpe f wrk apprved fr the prject. If there is a rental unit, it must be ccupied by a tenant earning less than 80% f the AMI. The City requires dcumentatin cnfirming the incme f the tenants. The lan will be recrded as a lien n the prperty. Fr Very Lw Incme Applicants (less than 50% f the AMI): The lan is prvided fr a five (5) year term and will be reduced by 10% fr each year the applicant remains in ccupancy f the prperty. N repayment is required during this perid. At the cmpletin f the sixth (6th) year, the lan will cnvert int a grant and n payment will be required. If the prperty is sld r transferred during the six (6) year perid the prrated amunt f the lan due will be due t the City and will be depsited back t the CDBG fund. The lien will be released at the end f the six (6) year perid. Fr Lw Incme Applicants (earning less than 80% f AMI but nt less than 50% AMI): The lan is prvided fr a ten (10) year term at a rate f 0% interest. Mnthly lan payments will be due thrughut this term. If the wner-ccupant sells r refinances the prperty prir t the ten ten (10) year perid, the prrated amunt will be due back t the CDBG fund. The lien will be released at the end f the ten (10) year perid. Page 3 f 9 06/01/2016

4 City f Newburgh City Hall 83 Bradway Newburgh, New Yrk APPLICATION PROCESS 1. Once the applicatin is submitted, it will be checked fr cmpleteness. If the applicatin is nt cmplete r there are missing dcuments the applicant will be infrmed f the missins and the applicatin will nt be reviewed until cmpleted. 2. Cmpleted applicatins will be reviewed fr incme eligibility and underwriting criteria. Credit reprts will be btained and reviewed. 3. A building cde fficer (r his/her equivalent) will inspect the prperty and cmplete a Husing Quality Survey t determine the scpe f the wrk required t address the emergency. 4. A secnd inspectin at the prperty will be scheduled fr cntractrs, t prcure three estimates fr the jb. 5. When all dcumentatin is received in the Planning and Develpment Office it will be packaged and presented t an independent lan cmmittee fr review and apprval. The applicatin and the cnstructin estimates will determine if the prject is eligible t prceed. A ntificatin letter will be sent t the hmewner advising them f the cmmittee s decisin. 6. Cntracts, bnd and mrtgage are then prepared and signed by the City and the prperty wner. 7. A pre-cnstructin meeting (including representatives f the City, the selected cntractr, and the hme-wner) will be held t review the wrk schedule. After this meeting, wrk can begin. 8. Once the wrk has been cmpleted and inspected, the wner and inspectr will sign ff that the wrk was cmpleted in a satisfactry manner in accrdance with the prgram. 9.
