1 CLEARANCE REVIEWS FOR STUDENT RESTRICTION ISSUES OTHER THAN ACADEMIC PROGRESS Only the Ministry f Training, Clleges & Universities can cnsider clearance reviews fr mst ther student restrictin issues. These ther student restrictin issues include: federal restrictins nly; prvincial restrictins nly; federal and prvincial restrictins; breach f cntract; and significant incme variances. A student s request fr a review hwever, must be submitted thrugh the Student Awards & Financial Aid Office and frwarded t the Ministry n the student s behalf. The fllwing infrmatin utlines the prcedural issues and dcumentatin requirements fr reviews f this nature. Nte: Student restrictins prevent the student frm applying fr OSAP thrugh the nline web applicatin, hwever, the web will display infrmatin t the student that utlines the nature f the restrictin and the applicable remedy. Students may elect t cmplete and submit a paper applicatin thrugh the Student Awards and Financial Aid Office while they wait t determine if clearance will be prvided. Student restrictins apply t future eligibility fr further OSAP assistance, (i.e., lans, grants, bursaries and schlarships). Despite a student restrictin, students wh have nt defaulted n their student lan(s) may remain eligible fr OSAP repayment assistance prgrams such as: Revisin f Repayment Terms; Interest Relief; Debt Reductin in Repayment; Medical Lan Frgiveness (Ontari); Permanent Disability Benefit (Canada). Students shuld be directed t the Natinal Student Lans Service Centre r the financial institutin hlding their lans t discuss eligibility fr repayment assistance. A) Federal Restrictins Students wh have failed t maintain their bligatins with respect t federal student assistance debts must seek clearance thrugh the Gvernment f Canada (Human Resurces and Scial Develpment Canada (HRSDC) Canada Student Lans Prgram (CSLP)). 2 Telephne: Nte: Students must clearly itemize the purpse f their inquiry t the NSLSC representative t ensure that they are directed t the apprpriate department. If the student receives federal clearance and is apprved fr additinal federal funding, then HRSDC-CSLP will prvide the student with a written clearance decisin, knwn as a Clearance Letter. Students wh have been issued a Clearance Letter can request a review f their situatin t determine whether their eligibility fr further federal funding can be cnsidered by OSAP. A letter frm the student requesting a review f their current situatin; A cpy f the Clearance Letter, as issued by HRSDC-CSLP. Ntes: 1. A cpy f the Clearance Letter must be received by the ministry within ne year f its date f issue. 2. A letter frm a lender (e.g., a bank, financial institutin r the NSLSC) indicating the student s federal assistance is in gd standing will nt be accepted in lieu f the Clearance Letter frm HRSDC-CSLP. If the student nly has a federal restrictin, federal clearance will allw the OSAP applicatin t prcess fr full funding, depending upn all ther eligibility factrs. If the student nly has a prvincial restrictin, then federal clearance is nt required. Hwever, the student must make a written request t the Student Awards & Financial Aid Office t have their OSAP applicatin prcessed fr federal funding nly. B) Prvincial restrictins Generally, students wh have prvincial student assistance debts and wh have a prvincial restrictin n their file are nt eligible fr further prvincial assistance until the prvincial debt has been repaid in full. Student may cntact the fllwing prvincial agency t determine the current status f their prvincial debt and which private cllectin agency currently has the debt: Ontari Shared Services Cllectin Management Unit 40 Elm Street Suite 41A Sudbury, ON P3C 1S8 Telephne: Tll free within area cdes 905, 705, 613, 519, 807 & 416: Fax: Once the prvincial debt has been paid in full, students can request a review f their situatin t determine whether they are eligible fr further funding. A letter frm the student requesting a review f their eligibility fr further prvincial funding, including infrmatin n the current status f their prvincial debt; and Prf that the prvincial debt has been repaid in full (e.g. mst recent statement f accunt frm the agency hlding the debt). 2

3 If the student nly has a prvincial restrictin, then federal clearance is nt required. Hwever, the student must make a written request t the FAA t have their OSAP applicatin prcessed fr federal funding nly. C) Prvincial and Federal Restrictins If the student has a federal and a prvincial restrictin issue, then upn receipt f prf f federal clearance frm the student, the ministry will release the current OSAP applicatin fr prcessing fr federal funding nly. Additinal prvincial funding will be prvided nce tw cnditins have been met: prf f federal clearance (abve); cmpletin f a successful review t remve the prvincial restrictin. D) Breach f Cntract (Cde 61 full restrictin, Cde 62, Cde 63, Cde 64) Verificatin and Cmpliance Unit Students wh have been restricted based upn an audit f their individual files are issued a detailed letter by the ministry utlining the nature f the restrictin and the applicable remedy. Reinstatement f eligibility after receipt f a cde 61 restrictin cannt ccur until: The end f the restrictin perid identified in the letter; and The day the student repays all interest and principal wing n the utstanding Ontari prtin f any Canada-Ontari Integrated Student Lans (issued n r after August 1, 2001) and Ontari Student Lans (issued prir t August 1, 2001, if applicable). E) Significant Incme Variances Student Incme Verificatin The ministry verifies student incme as reprted n the OSAP applicatin against incme infrmatin prvided t Canada Revenue Agency (CRA) by the student. If the ministry determines a significant variance between these incme amunts, then the student is ntified, in writing, f the results f the verificatin and f the available review ptin. Reinstatement f eligibility after receipt f a Cde 67 restrictin cannt ccur until: The end f the perid identified in the letter; and The day the student repays all interest and principal wing n the utstanding Ontari prtin f any Canada-Ontari Integrated Student Lans (issued n r after August 1, 2001) and Ontari Student Lans (issued prir t August 1, 2001, if applicable). 3

Allwable reviews: 1. Revised Incme Tax Infrmatin A student may ntify the Student Awards & Financial Aid Office that the incme infrmatin prvided t the ministry by CRA has been reassessed if the reassessment by CRA ccurred after the date that the Ministry verified the incme. A letter frm the student requesting a review f their current situatin, including an explanatin f the reasn fr the reassessment by CRA. A cpy f the student s mst recent Ntice f Reassessment as issued by CRA t the ministry. Once this infrmatin has been reviewed by the ministry, the student will be issued a decisin regarding his/her eligibility status fr further funding. 2. Cnflicting Incme Amunts Prcess fr Verificatin f Incme In the case f cnflicting incme amunts reprted t OSAP and CRA, a student will be issued a letter frm the ministry at the time that incme verificatin is cmpleted. The letter will include a Verificatin f Incme frm that the student must cmplete prviding mre detailed infrmatin and dcumentatin regarding the timing and amunts f incme received. This frm must be submitted t the ministry in rder t have the student s situatin reviewed The Verificatin f Incme frm includes specific instructins n the supprting dcumentatin that must be prvided t supprt the student s review request. If the student has lst r misplaced the Verificatin f Incme frm, the student may cntact the Ministry directly t request a duplicate frm r the Student Awards & Financial Aid Office may the Ministry. 4
