3 OJJDP FY 2012 Enfrcing Underage Drinking Laws Discretinary Prgram: Initiative T Reduce Underage Drinking in the Military (CFDA #16.727) Overview This prgram seeks t reduce the availability f alchlic beverages t and the cnsumptin f alchlic beverages by persns serving in the U.S. Air Frce and/r the U.S. Marine Crps wh are yunger than 21 years ld. The initiative will prvide funds t lcal civilian cmmunities t implement research-based and prmising practices t enfrce underage drinking laws and prevent underage service persnnel frm cnsuming alchl in cllabratin with active duty bases. This prgram is authrized by the Juvenile Justice and Delinquency Preventin Act f 1974, as amended, 42 U.S.C , and by the Department f Justice Apprpriatins Act, 2012, Public Law Deadlines: Registratin and Applicatin Applicants must register with Grants.gv prir t submitting an applicatin. OJP encurages applicants t register several weeks befre the applicatin submissin deadline. Prgram-Specific Infrmatin Respnding t preliminary evidence suggesting that cmmunity and base cperatin can reduce underage drinking and the accmpanying negative effects n the cmmunity, OJJDP entered int a partnership with the U.S. Air Frce in That partnership resulted in demnstratin effrts in Arizna, Califrnia, Hawaii, and Mntana. 4 partnership with the Air Frce in 2009 resulted in demnstratin effrts that are nging in Missuri and Wyming. OJJDP seeks t establish new partnerships between civilian cmmunities and the Air Frce t implement and evaluate research-based and prmising practices t reduce underage drinking. This prgram cnstitutes a third expansin f the riginal partnership between OJJDP and the Air Frce. In additin, this prgram intrduces a partnership between OJJDP and the U.S. Marine Crps t establish partnerships between civilian cmmunities and Marine Crps bases, where pssible, using the evidence-based apprach tested with the U.S. Air Frce. OJJDP will als evaluate prgram wrk n Marine Crps bases. Each state must prvide sub-grants t a minimum f ne and a maximum f three civilian cmmunities fr prgram implementatin. Grantees may use as much as 5 percent f the grant award fr n-base activities that are a critical element f the verall prject and use best practice r research-based preventin activities that supprt envirnmental strategies t change the physical, scial, legal, and ecnmic envirnment assciated with the use f alchl by underage persns. Such strategies include the simultaneus implementatin f enfrcement f underage drinking laws (hlding bth adults and yuth accuntable), plicy develpment, and educatin/awareness-building effrts. Purpse The prgram will supprt the reductin f the availability f alchlic beverages t and the cnsumptin f alchlic beverages by enlisted persnnel serving in the U.S Air Frce and/r U.S. Marine Crps wh are yunger than 21 years ld. Gals, Objectives, and Deliverables As a result f this initiative, it is intended that selected civilian cmmunities and U.S. Air Frce and/r U.S. Marine Crps bases will: decrease the number f first-time alchl-related incidents amng underage persns. decrease incidence f unintentinal injuries related t alchl cnsumptin amng underage persns. reduce alchl-related traffic injuries r fatalities amng underage persns. OJJDP will assign majr tasks and deliverables under this guidance based upn a review f the applicatin. At a minimum, grantees will submit semi-annual prgress reprts thrugh OJP s Grants Management System. Requirements fr Natinal Evaluatin. Grantees must exhibit their ability t supprt the natinal evaluatin by pssessing r prpsing t implement the fllwing capacities: Ability t distinguish between military persnnel (yunger than and lder than 21 years ld) and civilians wh have cmmitted alchl-related ffenses within the lcal cmmunity and n-base. The state applicant will: Ensure the engagement f qualified civilian cmmunity crdinatrs wh will cllect and share apprpriate cmmunity data with the evaluatr, plan and execute jint civilian cmmunity/air Frce r Marine Crps activities, and maintain cnsistent, cllabrative cmmunicatin with the Air Frce r Marine Crps base. OJJDP recmmends that the cmmunity crdinatr have experience in wrking with lcal law enfrcement and Air Frce r Marine Crps persnnel t maximize cllabratin. Ensure crdinatin with ther prgrams that address underage drinking in the jurisdictins selected t participate in this initiative. Crdinate training and technical assistance that reflect cllabratin between Air Frce r Marine Crps bases and the selected civilian cmmunities. Wrk with the civilian cmmunities t ensure that they base their wrk plans n researchbased and prmising practices. 6 Use training and technical assistance that the EUDL state-level agency and OJJDP prvide. At a minimum, OJJDP will require the state EUDL crdinatr and lcal crdinatrs t attend the annual natinal leadership training that the OJJDP training and technical assistance prvider cnducts. Enhance plicies and prcedures related t underage drinking. Implement innvative ways t educate the civilian cmmunity abut underage drinking issues in cllabratin with Air Frce r Marine Crps bases. In cllabratin with the Air Frce r Marine Crps bases, assess and imprve law enfrcement respnses t underage drinking ffenses, implementing best practices that include: Cmpliance checks. Strategies t reduce the scial availability f alchl t underage persns. Plicy changes related t underage drinking. Driving while intxicated enfrcement fcused n underage persns. Other envirnmental strategies fr reducing underage alchl cnsumptin. Evidence-based Prgrams r Practices OJP cnsiders prgrams and practices t be evidence-based when their effectiveness has been demnstrated by causal evidence (generally btained thrugh ne r mre utcme evaluatins). Causal evidence dcuments a relatinship between an activity r interventin (including technlgy) and its intended utcme, including measuring the directin and size f a change, and the extent t which a change may be attributed t the activity r interventin. Causal evidence depends n the use f scientific methds t rule ut, t the extent pssible, alternative explanatins fr the dcumented change. The strength f causal evidence, based n the factrs described abve, will influence the degree t which OJP cnsiders a prgram r practice t be evidence-based. OJP s CrimeSlutins.gv and OJJDP s Mdel Prgram Guide Web sites are tw resurces that applicants may use t find infrmatin abut evidence-based prgrams in criminal justice, juvenile justice, and crime victim services. Fr this specific prgram, OJJDP is expanding its wrk with the U. S. Air Frce and implementing the prgram in partnership with U.S. Marine Crps bases in respnse t preliminary evaluatin evidence suggesting that cmmunity and base cperatin can reduce underage drinking and its accmpanying negative effects n the cmmunity. The findings cme frm an independent evaluatin that the Natinal Institute n Alchl Abuse (NIAAA) and OJJDP funded. Amunt and Length f Awards OJJDP expects t make as many as three awards f as much as $900,000 per award fr a 36- mnth prject perid. The amunt per award is fr the entire award perid. OJJDP will make n additinal awards t successful applicants in subsequent years. 7 All awards are subject t the availability f apprpriated funds and t any mdificatins r additinal requirements that may be impsed by law. OJJDP will enter int a cperative agreement with the successful applicant. In furtherance f the gals and bjectives described abve, OJJDP's rle will include the fllwing tasks: Reviewing and apprving majr wrk plans, including changes t such plans, and key decisins pertaining t prject peratins. Reviewing and apprving majr prject-generated dcuments and materials used in the prvisin f prject services. Prviding guidance in significant prject planning meetings and participating in prject spnsred training events r cnferences. Budget Infrmatin Limitatin n Use f Award Funds fr Emplyee Cmpensatin; Waiver: With respect t any award f mre than $250,000 made under this slicitatin, federal funds may nt be used t pay ttal cash cmpensatin (salary plus bnuses) t any emplyee f the award recipient at a rate that exceeds 110% f the maximum annual salary payable t a member f the Federal Gvernment s Senir Executive Service (SES) at an agency with a Certified SES Perfrmance Appraisal System fr that year. The 2012 salary table fr SES emplyees is available at Nte: A recipient may cmpensate an emplyee at a higher rate, prvided the amunt in excess f this cmpensatin limitatin is paid with nnfederal funds. (Any such additinal cmpensatin will nt be cnsidered matching funds where match requirements apply.) The limitatin n cmpensatin rates allwable under an award may be waived n an individual basis at the discretin f the Assistant Attrney General fr OJP. An applicant requesting a waiver shuld include a detailed justificatin in the budget narrative f its applicatin. Unless the applicant submits a waiver request and justificatin with the applicatin, the applicant shuld anticipate that OJP will request the applicant t adjust and resubmit its budget. The justificatin shuld include the particular qualificatins and expertise f the individual, the uniqueness f the service being prvided, the individual s specific knwledge f the prgram r prject being undertaken with award funds, and a statement explaining that the individual s salary is cmmensurate with the regular and custmary rate fr an individual with his/her qualificatins and expertise, and fr the wrk t be dne. Minimizatin f Cnference Csts. N OJP funding can be used t purchase fd and/r beverages fr any meeting, cnference, training, r ther event. Exceptins t this restrictin may be made nly in cases where such sustenance is nt therwise available (i.e., extremely remte areas), r where a special presentatin at a cnference requires a plenary address where there is n ther time fr sustenance t be btained. Such an exceptin wuld require prir apprval frm OJP. This restrictin des nt apply t water prvided at n cst, but des apply t any and all ther refreshments, regardless f the size r nature f the meeting. Additinally, this restrictin des nt impact direct payment f per diem amunts t individuals in a travel status under yur rganizatin s travel plicy. 8 Updated Department f Justice and OJP guidance n cnference planning, minimizatin f csts, and cnference cst reprting will be frthcming and will be accessible n the OJP Web site at Csts Assciated with Language Assistance (if applicable). If an applicant prpses a prgram r activity that wuld deliver services r benefits t individuals, the csts f taking reasnable steps t prvide meaningful access t thse services r benefits by individuals with limited English prficiency may be allwable csts. Reasnable steps t prvide meaningful access t services r benefits may include interpretatin r translatin services where apprpriate. Perfrmance Measures T assist the Department in fulfilling its respnsibilities under the Gvernment Perfrmance and Results Act (GPRA) f 1993, Public Law , and the GPRA Mdernizatin Act f 2010, Public Law , applicants that receive funding under this slicitatin must prvide data that measure the results f their wrk dne under this slicitatin. Any award recipient will be required, pst award, t prvide the data requested in the Data Grantee Prvides clumn s that OJP can calculate values fr the Perfrmance Measures clumn. Perfrmance measures fr this slicitatin are as fllws: Objective Perfrmance Measure(s) Data Grantee Prvides The prgram s gal is t reduce underage drinking in selected cmmunities by systematically implementing best r prmising practices that attain the bjectives f increasing the enfrcement f underage drinking laws and enhancing researchbased preventin planning and prgramming. The perfrmance measures will differ, depending n the specific prgram gals and bjectives. Examples are belw: Reductin in alchl-related traffic injuries r fatalities where an underage persn s use f alchl may have been a factr. Reductin in the number f alchlrelated ffenses invlving underage persns. The fllwing data must be submitted t the evaluatr, as directed by OJJDP: Number f DUIs/DWIs amng underage persns. Instead, applicants shuld discuss in their applicatin their prpsed methds fr cllecting data fr perfrmance measures. Prject Evaluatins Applicants that prpse t use funds awarded thrugh this slicitatin t cnduct prject evaluatins r statistical data cllectins shuld be aware that these activities (such as systematic investigatins designed t develp r cntribute t generalizable knwledge) may cnstitute research, which is defined as fllws: Research means a systematic investigatin, including research develpment, testing, and evaluatin, designed t develp r cntribute t generalizable knwledge. Activities that meet this definitin cnstitute research fr the purpses f this plicy, whether r nt they are cnducted r supprted under a prgram that is cnsidered research fr ther purpses. Fr example, sme demnstratin and service prgrams may include research activities. 28 C.F.R (d). The fllwing infrmatin pertains t applicatins that prpse t cnduct research and invlves human subjects: DOJ regulatins (28 C.F.R. Part 46) prtect the human subjects f federally funded research. In brief, 28 C.F.R. Part 46 requires that mst research invlving human subjects that is cnducted r supprted by a federal department r agency be reviewed and apprved by an Institutinal Review Bard (IRB), in accrdance with the regulatins, befre federal funds are expended fr that research. As a rule, persns wh participate in federally funded research must prvide their "infrmed cnsent" and must be permitted t terminate their participatin at any time. 10 human subjects, must submit apprpriate dcumentatin t OJP shwing cmpliance with 28 C.F.R. Part 46 requirements, as requested by OJP. DOJ regulatins (28 C.F.R. Part 22) require recipients f OJP funding t submit a Privacy Certificate as a cnditin f apprval f any grant applicatin r cntract prpsal that cntains a research r statistical cmpnent under which "infrmatin identifiable t a private persn" will be cllected, analyzed, used, r disclsed. The funding recipient's Privacy Certificate includes a descriptin f its plicies and prcedures t be fllwed t prtect the cnfidentiality f identifiable data. 28 C.F.R The Department's regulatins prvide, amng ther matters, that: "Research r statistical infrmatin identifiable t a private persn may be used nly fr research r statistical purpses." 28 C.F.R Mrever, any private persn frm whm infrmatin identifiable t a private persn is cllected r btained (either rally r by means f written questinnaire r ther dcument) must be advised that the infrmatin will nly be used r disclsed fr research r statistical purpses and that cmpliance with the request fr infrmatin is vluntary and may be terminated at any time. 28 C.F.R OJP has develped a decisin tree t assist applicants in assessing whether an activity they plan t undertake with OJP funds may cnstitute research invlving human subjects. Applicants shuld review this decisin tree and include a specific statement in their applicatin narrative that clarifies if they intend t use any infrmatin frm a prject evaluatin r data cllectin t cntribute t generalizeable knwledge r if they intend t use the infrmatin slely fr the purpse f internal imprvements and/r t meet OJP s perfrmance measures data reprting requirements. If an applicatin includes a research, demnstratin evaluatin, r statistical data cllectin cmpnent, OJP will examine that cmpnent t determine whether it meets the definitin f research. Fr additinal infrmatin visit the Research and Prtectin f Human Subjects and the Cnfidentiality sectins f the OJP Other Requirements Web page at Ntice f Pst-Award FFATA Reprting Requirement Applicants shuld anticipate that OJP will require all recipients (ther than individuals) f awards f $25,000 r mre under this slicitatin, cnsistent with the Federal Funding Accuntability and Transparency Act f 2006 (FFATA), t reprt award infrmatin n any first-tier sub-awards ttaling $25,000 r mre, and, in certain cases, t reprt infrmatin n the names and ttal cmpensatin f the five mst highly cmpensated executives f the recipient and first-tier subrecipients. Each applicant entity must ensure that it has the necessary prcesses and systems in place t cmply with the reprting requirements shuld it receive funding. OJP highly recmmends that applicants start the registratin prcess as early as pssible t prevent delays in submitting an applicatin package by the specified applicatin deadline. All applicants are required t cmplete the fllwing steps: 1. Acquire a Data Universal Numbering System (DUNS) number. In general, the Office f Management and Budget requires that all applicants (ther than individuals) fr federal funds include a DUNS number in their applicatins fr a new award r renewal f an existing award. A DUNS number is a unique nine-digit sequence recgnized as the universal standard fr identifying and keeping track f entities receiving federal funds. The identifier is used fr tracking purpses and t validate address and pint f cntact infrmatin fr federal assistance applicants, recipients, and sub-recipients. The DUNS number will be used thrughut the grant life cycle. Obtaining a DUNS number is a free, ne-time activity. 13 What an Applicatin Is Expected T Include Applicants shuld anticipate that failure t submit an applicatin that cntains all f the specified elements may negatively affect the review f the applicatin; and, shuld a decisin be made t make an award, it may result in the inclusin f special cnditins that preclude access t r use f award funds pending satisfactin f the cnditins. Mrever, applicants shuld anticipate that applicatins that are unrespnsive t the scpe f the slicitatin, r that d nt include applicatin elements designated by OJJDP t be critical, will neither prceed t peer review nr receive further cnsideratin. Under this slicitatin, OJJDP has designated the fllwing applicatin elements as critical: Prgram Narrative, Budget Detail Wrksheet, a Budget Narrative, and a letter f cmmitment frm the base cmmander. OJP strngly recmmends use f apprpriately descriptive file names (e.g., Prgram Narrative, Budget Detail Wrksheet and Budget Narrative, Timelines, Memranda f Understanding, Resumes ) fr all attachments. Granting this permissin will nt affect OJJDP s funding recmmendatins, and if the applicatin is nt funded, it will nt guarantee that infrmatin will be shared, nr des it guarantee funding frm any ther surce. b. Statement f the Prblem. Applicants must briefly describe the nature and scpe f the prblem in the jurisdictin that this prject will address. This descriptin shuld include: Data, at least as current as 2009, frm the selected Air Frce r Marine Crps base in regard t the fllwing: Underage Air Frce r Marine Crps persnnel statined at the base. Off-premise utlet cmpliance with underage drinking laws in the selected cmmunities. Air Frce r Marine Crps persnnel issues related t underage drinking (e.g., number f unintentinal injuries related t alchl cnsumptin, number f alchl-related traffic injuries/fatalities, number f first-time alchl-related incidents.) Driving while intxicated incidences in the selected cmmunities. Discussin f plicy issues within the selected cmmunities and between the selected cmmunities and the Air Frce r Marine Crps bases. Discussin f ther underage drinking issues that the selected cmmunities have experienced as they relate t Air Frce r Marine Crps persnnel. c. Gals, Objectives, and Perfrmance Measures. Applicants shuld describe the gals f the prpsed prgram and identify its bjectives. When frmulating the prgram s gals and bjectives, applicants shuld be cgnizant f the perfrmance measures that OJJDP will require successful applicants t prvide. They shuld be clearly linked t the prblem identified in the preceding sectin and measurable. (Examples f measurable bjectives include the fllwing: Cnduct tw annual cmpliance check peratins in 90 percent f ff-premise establishments in Anywhere, USA, with a 100 percent cmpliance rate by year three.) Perfrmance Measures. OJJDP requires award recipients t reprt data in supprt f mandated perfrmance measures fr this slicitatin (see Perfrmance Measures, page 8.) OJJDP des nt require applicants t submit perfrmance measure data with their applicatins. OJJDP requires applicants t prvide infrmatin regarding implementatin f best and mst prmising practices t prevent underage drinking amng military persnnel. The applicant must describe effrts t deter underage drinking t date in the lcal civilian cmmunities that have been nminated t participate in the EUDL discretinary grant prgram. Applicants shuld identify any ther federal, state, r private fundatin grants that serve the same lcal area and target ppulatin. Prgram Cmpnents. OJJDP requires lcal civilian cmmunities t implement the minimum prgram cmpnents annually. Applicants must describe hw they will implement the fllwing: Crdinatin f a lcal calitin with brad civilian cmmunity and military representatin. Develpment and implementatin f a prgram plan that includes the fllwing activities t deter underage drinking by underage military persnnel. Lgic Mdel. Applicants shuld include a lgic mdel that graphically illustrates hw the perfrmance measures are related t the prject s prblems, gals, bjectives, and design. Sample lgic mdels are available at Applicants shuld submit the lgic mdel as a separate attachment, as stipulated in Additinal Attachments, page 18. Timeline. Applicants shuld submit a realistic timeline r milestne chart that indicates majr tasks assciated with the gals and bjectives f the prject, assigns respnsibility fr each, and plts cmpletin f each task by mnth r quarter fr the duratin f the award, using Year 1, Mnth 1, Quarter 1, etc., nt calendar dates (see Sample Prject Timelines at jjdp.gv/grantees/timelines.html). Applicants shuld submit the timeline as a separate attachment, as stipulated in Additinal Attachments, page 18. On receipt f an award, the recipient may revise the timeline, based n training and technical assistance that OJJDP will prvide. e. Capabilities and Cmpetencies. The state will prvide, at a minimum, a half-time prgram manager, wh will mnitr, crdinate, and prvide training and technical supprt t implementatin sites in cllabratin with Air Frce r Marine Crps bases, where apprpriate, with supprt frm the EUDL natinal training and technical assistance prvider. The lcal crdinatr will develp and maintain a lcal calitin r similar bdy t select and implement best and mst prmising practices, maintain a strng wrking relatinship with the Air Frce r Marine Crps, and assist the evaluatr in cllecting data t supprt the evaluatin. Applicants must demnstrate their ability t partner with selected civilian cmmunities and Air Frce r Marine Crps active duty bases and btain a supprt letter between the civilian cmmunity and the base cmmander f a state-based Air Frce r Marine Crps base (See Attachments B fr the apprpriate Air Frce template letter. In additin, applicants must justify their selectin based n the cmmunity s prximity t an Air Frce r Marine Crps active duty base. Applicants may budget as much as 5 percent f the cperative agreement award fr nbase activities that are a critical element f the verall prject and use best practice r research-based preventin activities that supprt envirnmental strategies designed t change the physical, scial, legal, and ecnmic envirnment assciated with the use f alchl by underage persns. Such strategies include the simultaneus implementatin f enfrcement f underage drinking laws (hlding bth adults and yuth accuntable, plicy develpment, and educatin/awareness-building effrts. See Appendix A.) Fr questins pertaining t budget and examples f allwable and unallwable csts, see the OJP Financial Guide at a. Budget Detail Wrksheet. A sample Budget Detail Wrksheet can be fund at Applicants wh submit the budget in a different frmat shuld include the budget categries listed in the sample budget wrksheet. The budget detail wrksheet shuld be mathematically sund. b. Budget Narrative. The Budget Narrative shuld thrughly and clearly describe every categry f expense listed in the Budget Detail Wrksheet. Prpsed budgets are expected t be cmplete; reasnable and allwable; cst-effective; and necessary fr prject activities. The narrative shuld be mathematically sund and crrespnd with the infrmatin and figures the applicant prvides in the Budget Detail Wrksheet. The narrative shuld explain hw the applicant estimated and calculated all csts and hw they are relevant t the cmpletin f the prpsed prject. The narrative may include tables fr clarificatin purpses but need nt be in a spreadsheet frmat. As with the Budget Detail Wrksheet, the Budget Narrative shuld be brken dwn by year. 4. Indirect Cst Rate Agreement (if applicable) Indirect csts are allwed nly if the applicant has a federally apprved indirect cst rate. (This requirement des nt apply t units f lcal gvernment.)
