17 2. Colombia s Infrastructure

18 The development of infrastructure The development of road infrastructure in Colombia linking private participation began in the mid 90s with the first generation of road concessions. Since then, private participation in road infrastructure has remained through programs of second and third generation of road concessions which sought to improve the execution of contracts. First Generation road concession contracts, primarily focused on road rehabilitation and expansion of road corridors (1,649 km).

19 The development of infrastructure Second Generation Improve issues related to financial aspects, responsibility and risks schemes. The second generation of road concessions involved 470 km of roads (construction and rehabilitation of new roads, seconds driveways entrances to major cities). Third Generation olicy adjustments: extensions and additions to the concession contracts legislation was improved. 3,557 km included, highlighting the Ruta del Sol project which incorporated changes on risk allocation between the public and private counterparts and a new scheme of contract award criteria.

27 Main Characteristics All Sectors Capacity & Commitment s Legal and Regulatory Framework - Law 1508 / 2012 The law applies to all sectors in which the provision of infrastructure and its related services are needed. Seeks to attract long term investors with enough financial capacity, who will not only construct the infrastructure but also operate and maintain it. The law reinforces the proper structuring of projects with regard to studies, risk analysis and includes the concept of value for money. The law contains changes in the budgetary treatment regarding: future reserves for national and territorial projects. The law clarifies the roles and functions of the entities participating in the project cycle. A data base to register the rojects is created. (Managed by the ND). The infrastructure reverts to the public sector at the end of the concession period. (30 years max)
