1 TORONTO AREA CHIEF BUILDING OFFICIALS COMMITTEE TACBOC CHARTER April 30, 2012 ARTICLE I MISSION STATEMENT 1.1 TACBOC s missin is as fllws: T serve the public interest by advancing and imprving building regulatins and their applicatin within the Greater Trnt Area (GTA). ARTICLE II - ORGANIZATION AND AFFILIATIONS 2.1 This rganizatin is the Greater Trnt Area Chief Building Officials Cmmittee, als knwn as TACBOC. It is an assciatin f Chief Building Officials frm Ontari municipalities within the gegraphic area knwn as the Greater Trnt Area (GTA) cmprised f the fllwing regins: Durham Regin, Yrk Regin, Peel Regin, Haltn Regin and the City f Trnt. Municipal Chief Building Official representatin n TACBOC is vluntary. 2.2 TACBOC cllabrates in a number f bjective areas with the Building and Develpment Branch f the Ministry f Municipal Affairs and Husing (MMAH), the Ontari Building Officials Assciatin (OBOA) and the Large Municipalities Chief Building Officials (LMCBO) and Engineer Architect & Building Official cmmittee (EABO), and has a distinct purpse as utlined in Article III. TACBOC was established t supprt Chief Building Officials in verseeing cmprehensive enfrcement f the Building Cde Act and related respnsibilities in the municipalities f the GTA. TACBOC is independent, perating under its wn rules, plicies and practices. ARTICLE III - PURPOSE The purpse f TACBOC is as fllws: 3.1 T prmte member s cllabratin by facilitating the exchange f ideas, infrmatin, knwledge, practices and experiences thrugh a cmmunicatin netwrk fr Chief Building Officials f member municipalities and with the LMCBO and ther stakehlders as necessary. 3.2 T prmte unifrmity f Ontari Building Cde (OBC) interpretatin and applicatin. 2 3.3 T cnduct member meetings with a structured frum fr discussin, pprtunity t advance netwrking, infrmatin sharing, prfessinal develpment and t identify/reslve emerging issues. 3.4 T share, prmte and develp best practice standards fr member municipalities. 3.5 T cmmunicate with the prvincial gvernment as necessary n matters which relate t technical cde develpment and the applicatin f the OBC and the Building Cde Act (BCA). ARTICLE IV GENERAL MEMBERSHIP f TACBOC 4.1 Cmmittee membership is cmprised f the Chief Building Officials frm municipalities within the fur regins f the GTA, the CBO and Deputy CBOs frm the City f Trnt and, the Directr, Building and Develpment Branch, MMAH. Applicatin fr membership by a GTA municipality shall be in writing t TACBOC s Executive Cmmittee. 4.2 The Directr, Building and Develpment Branch, MMAH is an ex-ffici member f TACBOC but shall nt be a vting member nr pay membership fees. 4.3 N alternates (r substitutes) are permitted t represent a member CBO r Deputy CBO n TACBOC. TACBOC relies n cntinuity f participatin by its members t assure its effectiveness. Anther persn appinted t perfrm the duties f the CBO may be designated the municipality s interim TACBOC member in the event f prtracted absence r ther special circumstances. The member must ntify the Executive Cmmittee t cnfirm their designatin. 4.4 Member municipalities shall pay an annual membership fee as determined by the Executive Cmmittee and are required t maintain and update their cntact infrmatin with TACBOC s Secretary. 4.5 Members are expected t make their best effrts t participate n matters f interest, t act t build cnsensus and t respnd in a timely manner t requests fr infrmatin. 4.6 Nn-payment f annual membership fees r lack f participatin shall be reviewed by the Executive Cmmittee t determine apprpriate actin. ARTICLE V EXECUTIVE COMMITTEE 5.1 TACBOC shall have an Executive Cmmittee that meets n a regular basis and perfrms the fllwing: TACBOC Charter 2

3 Prvides versight, administrative directin and identifies issues/cncerns fr TACBOC, Cmmunicates with its Advisry Cmmittees and stakehlder rganizatins, Cmmunicates with the membership, Sets agenda fr the Annual General Meeting (AGM), Calls membership meetings as required (minimum ne annually plus AGM), and Serves as a resurce fr member municipalities. 5.2 The Executive Cmmittee shall cnsist f five (5) TACBOC Chief Building Officials representing the five (five) regins f the GTA ne Rep frm Yrk Regin, ne Rep frm Durham Regin, ne Rep frm Haltn Regin, ne Rep frm Peel Regin and ne Rep frm the City f Trnt. 5.3 Executive Cmmittee appintments are as determined by the respective reginal membership and shall be fr a tw (2) year term with ptin fr an additinal tw (2) year term. The Chair sits n the Executive Cmmittee as Past Chair fr ne (1) additinal year t supprt cntinuity f Executive peratins when pssible. 5.4 The Executive Cmmittee selects and appints the Chair, Secretary and Treasurer. 5.5 The Chair shall direct the activities f the Executive Cmmittee, prvide leadership and directin t Advisry Cmmittees, as required, and cmmunicate with the membership. An unplanned vacancy in the Executive Cmmittee may be filled by appintment by the Chair, in cnsultatin with the apprpriate Reginal CBOs. 5.6 In the absence f the Chair, the Secretary shall be respnsible fr executin f Executive Cmmittee business. 5.7 The Secretary shall make and issue a recrd f all Executive Cmmittee, membership and, AGM meetings. The Secretary maintains all member cntact data and issues such ther crrespndence and infrmatin as may be required r is directed by the Chair. 5.8 The Treasurer shall crdinate all financial matters, including recmmending annual fees, extrardinary assessments, cllect fees and assessments, issue payments, maintain apprpriate recrds and prepare an annual financial statement. The Treasurer shall als versee financial matters related t the Advisry Cmmittees. 5.9 The Directr f the Building and Develpment Branch, MMAH, participates in the Executive Cmmittee frm time t time fr the purpse f sharing infrmatin related t technical cde develpment and the applicatin f the OBC and BCA. 4 ARTICLE VI OPERATING PRINCIPLES 6.1 TACBOC s Operating Principles: T perate with integrity, cmmitment and purpse, T engage and share infrmatin, and, T prvide supprt t each ther. 6.2 The Executive Cmmittee prmtes active engagement and participatin by members in develping and issuing cmmunicatins. Where apprpriate, members shall be prvided with the pprtunity fr input int TACBOC cmmunicatins. The final frm f cmmunicatins shall be authrized by the Executive Cmmittee and issued by the Chair. 6.3 Cmmunicatins t gvernment and ther utside stakehlders are intended t reflect the breadth f member knwledge and experience with respect t technical cde develpment and the applicatin f the OBC and BCA. 6.4 Cmmunicatins frm the Executive Cmmittee shall be bjective. Cmmunicatins n matters where there is significant absence f verall cnsensus amngst pinins expressed t r by the Executive Cmmittee shall indicate the diversity f views, but the Executive Cmmittee may express a recmmendatin r cnclusin. 6.5 Chief Building Officials exercise independent executive authrity ver the administratin f building regulatins in their municipal jurisdictin. Decisins, recmmendatins and pinins expressed by TACBOC n behalf f members are nt binding n any member in respect f executin f their respnsibilities as a Chief Building Official. Hwever, members are encuraged t prmte, within their respective municipalities, the use and applicatin f TACBOC decisins, recmmendatins and pinins, as well as, the bulletins, plicy decisins, details, etc. f TACBOC Advisry Cmmittees when endrsed by the Executive Cmmittee. ARTICLE VII ADVISORY COMMITTEES 7.1 Advisry Cmmittees under TACBOC are established t prvide supprt t TACBOC members in specific cde related disciplines in matters related t OBC review, OBC interpretatin, and unifrm applicatin f cde requirements and ther issues/cncerns identified by TACBOC members, Advisry Cmmittee members and/r ther stakehlder grups. 7.2 TACBOC has established five (5) permanent Advisry Cmmittees t address the majr disciplines f cnstructin and regulatry review/ inspectin requirements as fllws: Cde Interpretatin Advisry Cmmittee (CIAC) Structural Advisry Cmmittee (SAC) Building Inspectin Advisry Cmmittee (BIAC) Mechanical Services Advisry Cmmittee (MSAC) Plumbing Advisry Cmmittee (PAC) TACBOC Charter 4

5 Other advisry cmmittees and special task grups may be established by the Executive Cmmittee as deemed necessary t address specific issues and/r prvide additinal supprt t the TACBOC membership. 7.3 Advisry Cmmittees are cnstituted with their wn specific Terms f Reference develped and apprved by TACBOC. The Terms f Reference shall be the basis fr cnduct f business, decisin-making, recmmendatins and cmmunicatin. 7.4 Advisry Cmmittee membership is limited t municipal staff, appinted by the respective TACBOC CBO member, t serve fr a tw (2) year term. T encurage municipal staff participatin, diversity f pinin, learning and leadership member CBOs are encuraged t rtate their Advisry Cmmittee appintee, if feasible. 7.5 Advisry Cmmittees may include a Cnsultative Grup cnsisting f representatives frm a gvernmental, prfessinal r industry-related agency r assciatin may be identified by the Advisry Cmmittee members in accrdance with the prvisins related t Cnsultative Grups set ut in the Advisry Cmmittee s Terms f Reference. A member f the Cnsultative Grup shall nt be a vting member nr pay membership fees. 7.6 MMAH representatin n Advisry Cmmittees is encuraged as ex-ffici members f the Advisry Cmmittee but shall nt be a vting member nr pay membership fees. 7.7 T assist Advisry Cmmittee deliberatins, the invlvement f subject matter expertise frm academia, industry, design cmmunity and any ther valid stakehlder grup is encuraged. Guest attendance shall be limited t the issue under discussin and shall be fr infrmatinal and decisin-making purpses nly. 7.8 Recmmendatins frm all Advisry Cmmittees shall be frwarded t the Executive Cmmittee fr review and endrsement by the Executive Cmmittee and further cmmunicatin t the membership thrugh established cmmunicatin channels (i.e., TACBOC Website). TACBOC shall establish the apprpriate frms fr the Advisry Cmmittees submissins and/r recmmendatins. 7.9 Advisry Cmmittees shall prvide t TACBOC, annually at the AGM the fllwing: A full accunt f the meetings held during the past reprting perid, The matters that were cnsidered, All recmmendatins made and, Any issues and cncerns that require the attentin f the TACBOC membership TACBOC s purpse shall be achieved thrugh Advisry Cmmittee member cnsensus and vluntary acceptance f majrity decisins. Hwever, the Advisry Cmmittee and TACBOC as a whle has n regulatry mandate and the manner in which its actins are given effect within a participating municipality shall lie slely with the Chief Building Official. 6 ARTICLE VIII ANNUAL DUES 8.1 The Executive Cmmittee shall cnsider annual membership fees as prpsed by the Treasurer fr TACBOC membership and fr membership f the Advisry Cmmittees. Prpsed fees shall be presented, annually at the AGM, fr apprval by the membership. Upn apprval, the agreed upn amunts shall be inviced by the Treasurer f TACBOC and the appinted Advisry Cmmittee Treasurers. ARTICLE IX AMENDMENT OF CHARTER 9.1 This Charter Statement takes effect n April 30, 2012 and may be amended frm time t time. Amendments are recmmended by the Executive Cmmittee and adpted by a tw-thirds majrity apprval f all members. TACBOC Charter 6
