General a) All trainees are the legal emplyees f the client rganisatin named abve. b) Smart Emplyment Slutins Ltd t/as Hassle Free Apprentice Management (HFAM) agrees that it will nt attempt t directly r indirectly emply a cntracted Trainee withut the permissin f the client rganisatin named abve, during the term f their traineeship with the client. 2. Term f cntract The client agrees t a minimum management term f 12 mnths at the current rate as utlined in item 4A, 4B r bth. This agreement will be enfrced as lng as the trainee is wrking with the client. If the trainee terminates his r her emplyment with the client, r if the client intends t terminate the trainee, Hassle Free Apprentice Management requires immediate written ntificatin. Respnsibility fr Wages Under Optin 4A trainees are permanent emplyees f the client during the term f their traineeship. Under Optin 4B trainees are permanent emplyees f the client during the term f their traineeship. Upn receipt f a prperly authrised time sheet HFAM will prcess the payrll with wages being drawn frm the client s bank accunt. 4. Invicing Optin A HFAM will invice the client nce the client has received the cmmencement incentive frm the Federal Gvernment ttalling $2000 fr a Certificate 2 level qualificatin, r $2250 fr a Certificate 3 level qualificatin. The amunt inviced will be $1500 plus GST per trainee prviding the services specified belw. This service will include: The recruitment f yur trainee (if nt already emplyed), including cnducting literacy and numeracy testing and interviewing t shrtlist thse individuals wh will meet yur businesses specific needs. Ensuring yu get all Gvernment new apprentice emplyment incentives t which yu are eligible. Initial cnsultatin and nging supprt t ffer guidance that will help t prtect yur business frm breaches f the Fair Wrk Act in relatin t yur trainee. Hassle free management f yur trainee: We d all the paperwrk assciated with registering and managing yur trainee. We handle all Registered Training Organisatin matters. We relieve yu f the hassle f rganising yur trainees cllege time, ensuring that their training recrds are up t date and that they are cmpleting this part f their traineeship at the apprpriate time. Help with mentring yur trainee. We knw and understand the cncerns and issues that they may have and are ready t ffer guidance and supprt t help them. Help with reslving prblems. We ffer cunselling services t yur trainee, giving them a frum t explain their prblems and yu the pprtunity t set ut yur cncerns in a calm and impartial envirnment. A tailred service t suit yur needs: Every business and every trainee is different. By maintaining an apprpriate case lad fr ur Traineeship Crdinatrs, we can ensure that they give yu a bespke service t meet yur unique needs. The wages will be drawn frm the client s bank accunt by HFAM plus an amunt f $0.75 plus GST per hur, per trainee based n a legal minimum f 7.6hrs per week. Please nte that in the event the trainee des nt wrk a given week fr any reasn whatsever, HFAM will cntinue t invice fr their csts at $0.75 per hur fr a minimum f 7.6 hurs fr that week. Service includes all aspects utlined in ptin A. Additinal services available at extra cst include, Payrll services Taxatin, Superannuatin, PAYG statements, and separatin certificates if required. Amendments r additins t cntract Upn receipt f a timesheet, signed by the trainee as well as the client, HFAM will pay wages (less taxatin) t the trainee tgether with any allwances and penalties accrding t the relevant industrial instrument and issue a grup certificate annually. HFAM will direct debit the clients accunt fr the legal minimum f 38 hurs per week nly, and depsit the trainees wage directly t the trainees bank accunt. 5. Wrkers Cmpensatin The client will cver Wrkers Cmpensatin fr all trainees. HFAM can als prvide yu with WPH&S advice n a fee fr service arrangement. 6. Terminatin f Emplyment HFAM is able t advise n serius cncerns and any cunselling required invlving trainees, in rder that the Industrial Relatins criteria be met. Other services are available with regards t the Fair Wrk Act n a fee fr service arrangement. 7. Gds and Services Tax The ttal cst f prvisin f services shall attract GST at the legislated rate. 8. Respnsibilities f the Client Organisatin a) The client will be liable fr and will indemnify and hld harmless Hassle Free Apprentice Management, its servants and agents, frm and against any and all liability, damage, lss, csts, charges r expense f whatsever kind and hwsever ccurring, whether under statute r at cmmn law, impsed upn r claimed against Hassle Free Apprentice Management, its servants r agents, due t any act r missin by the emplyee/s in cnnectin with r arising ut f the perfrmance by the emplyee/s f any duties required by them by the client, its servants r agents, r by any act r missin f the client, its servants r agents. 9. Other Services (Nt Under Scpe f this Agreement) Other services can be prvided n a fee fr service basis.
