2 DfT Dangerus Gds Guidance Nte #4 - Lad threshlds Octber The exemptins allwed by ADR are ften referred t as limited quantities exemptins a term that, strictly, shuld be applied nly t the exemptins allwed by ADR 3.4 ( Exemptins related t dangerus gds in limited quantities ) which uses LQ r limited quantity cdes. There is n relatinship between exemptins (where the key quantity is amunt carried n the transprt unit), and 3.4 exemptins (where the key quantity is net quantity per inner packaging r package) 2.2 It culd be pssible fr a cnsignment t be exempt under but nt 3.4 and vice versa. 2.3 This guidance will use the phrase lad threshld(s). 3. Cnditins and calculatins 3.1 Fr the lad threshld exemptins allwed by ADR [see Annex 1] t apply, cnditins have t be met: primarily, the quantity f dangerus gds carried n the transprt unit must be less than (r equal t) the maximum quantities specified (as apprpriate) in either ADR r Als, the gds must be packaged; and, the gds must be carried n a single transprt unit (a transprt unit is a mtr vehicle withut an attached trailer, r a cmbinatin f a mtr vehicle and an attached trailer. ) Als, (a) apprpriate entries must be made in the transprt dcument; and, (b) there is a requirement fr basic fire extinguisher prvisin, as fllws: (a) [see Sectin 5.4 f this guidance, especially 5.4.2] In the case f intended applicatin f , the ttal quantity f dangerus gds fr each transprt categry shall be indicated in the transprt dcument in accrdance with [Nte t ADR (f)] In the case f exemptins prvided fr in , the transprt dcument shall bear the fllwing inscriptin: "Lad nt exceeding the exemptin limits prescribed in ". [ADR ] Where cnsignments frm mre than ne cnsignr are carried in the same transprt unit, the transprt dcuments accmpanying these cnsignments need nt bear the inscriptin mentined in [ADR ] (b) Transprt units carrying dangerus gds in accrdance with shall be equipped with ne prtable fire extinguisher fr the Page 2 f 18 pages

3 DfT Dangerus Gds Guidance Nte #4 - Lad threshlds Octber 2006 inflammability classes A, B and C, with a minimum capacity f 2 kg dry pwder (r an equivalent capacity fr any ther suitable extinguishing agent). 2 [ADR ; Fr the definitin f the inflammability classes, see Standard EN 2:1992 Classificatin f fires.] 3.2 Maximum quantities depend n transprt categry (TC) effectively, therefre, n Class + UN number. 3.3 If the dangerus gds being carried n the transprt unit all belng t ne TC: the quantity carried must be less than (r equal t) the apprpriate value indicated in clumn (3) f the table in fr the TC in questin - e.g., a lad f 21kg f UN 0101 [1.3G, TC 1] wuld nt attract the lad threshld exemptins since the maximum quantity specified in clumn (3) fr TC 1 is 20kg. 3.4 If the dangerus gds being carried n the transprt unit belng t mre than ne TC: a calculatin has t be carried ut, as fllws: firstly the quantity f gds in each TC is multiplied by the multiplier fr each TC as indicated in ; these are 50 (in sme cases, 20), 3 and 1 respectively fr TCs 1, 2 and 3; - secndly, the results f all multiplicatins are added tgether, and if the resulting ttal is greater than 1,000 the lad threshld exemptins d nt apply. Fr example, take the fllwing (hypthetical) lad: UN 0101 [1.3G, TC 1 multiplier= 50 ] : UN 0336 [1.4G, TC 2 multiplier = 3] : UN 0430 [1.3G, TC 1 multiplier = 50] : 5 kg 120 kg 3 kg (50 x 5) + (3 x 120) + (50 x 3) = = 760 [NB that units are ignred s litres and kg can be added tgether] Since 760 is less than 1,000, the lad threshld exemptins wuld apply t this (hypthetical) lad. 3.5 NB that (a) fr TC 0 (zer) the maximum ttal quantity is zer, and there is n multiplier; in ther wrds, a lad slely f TC 0 dangerus gds cannt attract the lad threshld exemptins, and n TC 0 dangerus gds can cunt twards pssible lad threshld exemptin fr a lad cnsisting f mre than ne TC; als, (b) fr TC 3, the multiplier is 1; and, (c) fr TC 4 the maximum ttal quantity is unlimited, and there is n multiplier; in ther wrds, a lad cnsisting slely f any quantity f TC 4 dangerus gds will attract the lad threshld exemptins, and TC 4 dangerus gds are nt cunted twards pssible lad threshld exemptin fr a lad cnsisting f mre than ne TC, 2 NB that (ADR ) that a transitinal measure cmes int play here, meaning that the requirements f ADR apply until 31 December Page 3 f 18 pages

4 DfT Dangerus Gds Guidance Nte #4 - Lad threshlds Octber NB als that, fr dmestic transprt nly, the Carriage Regulatins make changes t the clumn (3) maximum quantities and multipliers specified in ADR fr mre details, see Sectin 5, Variatin by the Carriage Regulatins fr Class Scpe 4.1 Nt a ttal exemptin: The lad threshld exemptins are smetimes assumed t be an exemptin frm all the requirements f ADR. This is incrrect nly sme f the requirements f ADR are exempted. Thse requirements that remain may (r may nt) still apply depending n the nature f the cnsignment. 4.2 Only sme f the requirements are exempted: the bulleted / indented list in ADR , f exempted requirements, i.e. thse requirements which d nt apply if the cnditins are met, switches between listing chapters &c f ADR, and (t save space) chapters, parts &c qualified by with the exceptin f.... This can be cnfusing if nt read clsely. 4.3 Annex 1 simply lists all thse requirements f ADR that are exempted if the lad threshld cnditins are met; fr detailed infrmatin n Chapter 1.10 (Security prvisins), Chapter 7.2 (Prvisins cncerning carriage in packages) and Part 8 (Requirements fr vehicle crews, equipment, peratin and dcumentatin) 4.5 NB that reference shuld be made t the electrnic r (when available) printed text f ADR the ancillary carriage exemptin in ADR (c) als refers t the maximum ttal quantities per transprt unit specified in ADR The applicatin f this exemptin t Class 1 is varied by the Carriage Regulatins see Sectin 5.3; and, The requirements f ADR t appint ne r mre safety advisers d nt apply t undertakings the activities f which cncern quantities in each transprt unit smaller than thse referred t in , and in Chapters 3.3 and 3.4;. [see Carriage Regulatins Reg 12(3)(b)] 5. Variatin by the Carriage Regulatins fr Class Fr the purpse f dmestic (GB) carriage f principally Class 1 dangerus gds, Regulatins 3(7) and 3(8) f the Carriage Regulatins make changes t the requirements f ADR, which are detailed in Sectins 5.2, 5.3 and 5.4, with a specific example regarding firewrks and related pyrtechnic articles in Sectin New maximum ttal quantities and multipliers fr Class 1: Regulatin 3(7)(b): mves the Class 1 UN Numbers frm TC 1 and 2, t (respectively) new TCs designated 1A and 2A; remves the Class 1 UN Numbers frm ftnte (a); creates maximum ttal quantities, fr the new TCs 1A and 2A, f 50 and 500 respectively; and, Page 4 f 18 pages
