11 ACA EXHIBITOR RULES AND REGULATIONS A. CONTRACT This applicatio, properly executed by applicat (Exhibitor) shall upo writte acceptace ad otificatio of space assiged by Exhibit maagemet costitute a valid ad bidig cotract betwee Exhibitor ad the America Couselig Associatio. Applicatios will ot be accepted without deposit. Processig of paymet does ot costitute acceptace ito the show or guaratee space availability. B. SPACE RENTAL 1. Stadard Booth: This cotract for use of space provides a 8' high flameproof back wall drapery ad 36" high side rails with drapery, a stadard booth sig carryig the exhibitor s ame, a booth umber, a six foot draped table, two side chairs, oe wastebasket, stadard grade carpetig o floor (carpet grade ad color is the choice of ACA), security guard service ad aisle cleaig. 2. Floor Pla: All dimesios ad locatios show o the official floor pla are believed, but ot warrated, to be accurate. The Associatio reserves the right to make modificatios, as ecessary, to meet the eeds of the exhibitors, exhibit program ad the Fire Marshall. 3. Assigmet of Space: (a) Assigmet of space will be based o the order of date of receipt of applicatio as well as size, utility requiremets ad locatio of space requested. Assigmet of space is fial ad shall costitute a acceptace of the exhibitor s offer to occupy space. Space assigmets may be revoked or chaged by exhibit maagemet ay time that the miimum paymet schedule is ot met. Deposit of $600 is due with applicatio. Cacellatio of Show: I the evet that fire, strike or other circumstaces beyod the cotrol of the Associatio cause the exhibit to be cacelled, full refud of exhibit retal fees will be made. 5. Furishigs: Additioal furiture, ad/ or additioal drapig, accessories, sigs, electrical outlets, etc., are the sole resposibility of the exhibitor ad should be ordered i advace from the official show decorator o the forms that will be provided. Table coverigs as well as all booth equipmet must be of o-flammable material. All decorative materials must be fire-resistat ad i accord with the stadards established by the Fire Departmet. 6. Exhibitor Registratios: Each exhibitig compay receives two complimetary full registratios per 10' x 10' full price exhibit booth. No refuds will be give to those exhibitors who have already registered as idividuals for the 2015 coferece. This also applies to ACA Divisio exhibitors. C. CANCELLATION OF EXHIBIT CONTRACT 1. Cacellatio: I the evet that otificatio of itet to cacel is received by the exhibit maagemet i writig by December 15, 2014 all sums paid by the exhibitor, less the deposit of $600 per booth, will be refuded. 2. Late Cacellatio: Cacellatio after December 15, 2014 obligates the exhibitor to full paymet of the booth retal. No refud of ay fees, icludig the deposit fee, will be made if otice of cacellatio is received after December 15, Late Cotracts: Exhibit cotracts received after Jauary 15, 2015 will require paymet i full whe cotract is submitted. 4. Failure to Pay: Failure to remit the balace of booth retal by the date specified o the applicatio form costitutes cacellatio of cotract ad the reserved space will be subject to resale without refud of deposit. 5. Failure to Occupy Space: Space ot occupied by the close of the exhibit istallatio period or 3 p.m. o March 12, 2015 as specified i the accompayig material will be forfeited by the exhibitor ad this space may be resold, reassiged or used by the exhibit maagemet. D. CONSTRUCTION, INSTALLATION, AND USE OF EXHIBITS AND EXHIBIT FACILITIES 1. Acceptability of Exhibits: Associatio will provide space for idividuals, govermetal agecies, as well as profit ad ot-forprofit orgaizatios to exhibit their materials to members ad o-members attedig our Associatio meetigs, especially the aual coferece. Exhibitors must abide by certai rules ad regulatios. Oly exhibitors whose materials are related to the explicit purposes of the Associatio ad of the exhibits will be approved or allowed to maitai displays. These materials must be directly relevat ad be of value to our professio. Exhibit shall be operated i a way that will ot detract from other exhibits, the exhibitio or coferece as a whole. Each exhibitor must agree to abide by the policy of the Associatio o odiscrimiatio. The Associatio reserves the right to bar or relocate ay potetial exhibitor or require the immediate withdrawal of ay exhibit which it believes to be ijurious to the purposes of the Associatio or to the exhibits. 2. Restrictio o Use of Space: No exhibitor shall sublet, assig or share ay part of the space allocated to him without the writte coset of the exhibit maagemet. Solicitatios or demostratios by exhibitors must be cofied withi the bouds of their ow prospective booth(s). Aisle space shall ot be used for exhibit purposes, display sigs, solicitatio, or distributio of promotioal material. Booths must be staffed at all times durig exhibit hours. Exhibits, sigs ad displays are also prohibited i ay of the public space or elsewhere o the premises of the meetig facilities or i the guest rooms or hallways of the hotels. Operatio of soud devices is allowed if the exhibitor complies with restrictios o loud volume. ACA requires the exhibitor to obtai its ow licese for copyrighted music. 3. Costructio of Exhibits: Exhibits shall be costructed ad arraged so that they do ot obstruct the geeral view, or hide the exhibits of others. No side wall higher tha 36" may exted forward from the back wall more tha oe-half the depth of the exhibit space with back walls of booths ot measurig higher tha 8', except those booths located o the side ad rear perimeter walls. Exhibitors desirig to use other tha stadard booth equipmet, ay sigs, or material coflictig i ay way with the above regulatios should submit two copies of a detailed sketch of proposed layout at least 50 days before the meetig or before costructio is ordered ad receive writte approval from the exhibit maagemet. 4. Appearace of Exhibits: Ay part of the exhibit that does ot led itself to a attractive appearace, such as ufiished side or ed paels, must be draped at the exhibitor s expese. Maagemet reserves the right to have such fiishig doe, billig the exhibitor for charges icurred. 5. Istallatio ad Dismatlig of Exhibits: All istallatio ad dismatlig of exhibits must be carried out durig the time idicated i the accompayig exhibit iformatio or set-up o later tha 3 p.m. o March 12, No exhibit may be erected after the exhibitio opes or be dismatled before the official closig date ad time of 5:30 p.m. o March 14, It is the resposibility of the exhibitor to see that all materials are delivered to the expo hall ad removed from the expo hall by the specified deadlie. Should exhibitor fail to remove exhibit, this removal will be arraged by the exhibit maagemet at the expese of the exhibitor. 6. Drayage: All shipmets of exhibit material must be made to the official drayage compay as idicated i the exhibitor s service kit. 7. Labor: Exhibitors shall employ oly accredited labor persoel for all work other tha that properly hadled by their ow persoel i accordace with local labor regulatios. Iformatio regardig specific regulatios may be obtaied from the official decorator. Display persos, paiters, carpeters, electricias, ad other skilled labor ca be arraged through the official decorator at established rates. 8. Fire ad Safety Regulatios: The exhibitor hereby agrees to be boud by (i) all applicable fire, utility ad buildig codes ad regulatios; (ii) ay rules or regulatios of the facility where the exhibitio is held; (iii) the terms of all leases ad agreemets betwee ACA ad the maagers or owers of said facility; ad (iv) the terms of all leases ad agreemets betwee ACA ad ay other party relatig to the exhibitio. All decoratios ad booth equipmet must be fireproofed ad electrical wirig must meet the safety requiremets of the official service cotractor. Affidavits attestig to flameproof compliace with fire departmet regulatios must be submitted whe requested. No combustible materials shall be stored i or aroud exhibit booths. 9. Damage to Exhibit Facilities: The exhibitor must surreder space occupied i the same coditio it was at commecemet of occupatio. The exhibitor or its agets shall ot ijure or deface facilities, the booths or the equipmet or furiture of the booth. Whe such damage appears, the exhibitor shall be liable to the owers of the property so damaged. E. LIABILITY 1. Security: The Associatio will provide security guards o a 24-hour basis but the furishig of such service shall ot be costructed to ay assumptio of obligatio or duty with respect to the protectio of the property of exhibitors, which shall at all times remai i the sole possessio ad custody of each exhibitor ad shall be the sole resposibility of each exhibitor. 2. Resposibility of ACA ad the Exhibit Facility: Isurace ad liability are the full ad sole resposibility of the exhibitor. The exhibitor agrees to comply strictly with applicable terms ad coditios cotaied i the agreemet betwee ACA ad its agets ad the Covetio Ceter regardig the exhibitio premises. The exhibitor further agrees to assume complete resposibility for ay damage arisig uder this cotract by the exhibitor, its agets, employees ad busiess ivitees ad to idemify ad hold ACA, its officers, directors, employees, aget ad busiess ivitees harmless from ad agaist ay ad all actios, proceedigs, claims, damages, attorey s fees ad expeses of whatsoever kid, arisig out of or relatig to this cotract, icludig ay actio icidet to or arisig from exhibitor s occupatio of or use of booth space or exhibit premises ad ay actios brought by the Covetio Ceter or its agets agaist ACA.
