TERMS OF PAYMENT Advertiser and Agency are liable jointly, and severally, for payments of all advertising services, production and related expenses incurred, ordered and provided on behalf of the Advertiser by the Publisher. Agency is deemed to be acting as both principal and as authorized agent for the Advertiser. For accounts with established credit, payment for all such advertising or related services shall be due and payable within thirty (30) days from the date of invoice. Balances not paid in 30 days are subject to a delinquent charge of 1 1/2% per month. Accounts without approved credit must pay for advertising when order is placed. Going Out of Business, Political, Work Wanted, and all Private Party ads must be paid in advance. B. changes to terms The publisher reserves the right to change the terms, conditions and rates upon 30 days notice. If changes are not acceptable, the advertiser may terminate the contract effective the date of change without penalty, provided all other conditions are fully met. C. local and national rates General advertising originating out of the newspaper s trade area is subject to national rates. A 15% agency commission is granted to established, accredited advertising agencies billed at the national gross rate. D. COPY ACCEPTANCE Any advertising offered by a person to an employee or agent of the newspaper is subject to final acceptance by the publisher at any time prior to distribution of the newspaper. The publisher reserves the right to refund any money paid and to reject any offer to advertise. The publisher reserves the right to cancel or edit any ad at any time. All advertising is accepted with the understanding that all rates and regulations herein are acceptable to the advertiser. Advertising simulating news style must carry the words Paid Advertisement at the top of the ad. Political advertising must include disclaimers as required by state law. Brokered advertising is not accepted. E. POSITION Position of an advertisement cannot be guaranteed. Requests for position will be honored when possible and convenient but no advertisement is accepted predicated on exact page or page position. F. PROOFS AND COPY CHANGES Original copy and layout furnished to our representatives will be considered final at time of material closing deadline. Copy and layout changes made after material closing deadline will be charged for remake expenses at $30 per hour with one hour minimum. No changes can be made day of publication. Advertising canceled past the published deadline will be charged at half rate. Special sections and supplements, as well as the Sunday Lifestyle and Sunday Classified Section, are frequently printed in advance of publication. No changes can be made on day of printing. G. INDEMNIFICATION The Advertiser and Advertising Agency assume liability, jointly and severally, for all content (including text, representations and illustrations) of advertisements. Advertiser and Agency hereby agree to hold the Defiance Publishing Company harmless from all costs, expenses, liabilities and damages resulting from publication of any advertisement. H. ERRORS The liability of for any material error caused by The Crescent-News in an advertisement is limited to the cost of the portion of the advertisement containing the error. This liability is limited to the first incorrect insertion of any order. There shall be no liability for noninsertion of any advertisement beyond the amount paid for such advertisement. No republication will be made because of slight changes or typographical errors which do not lessen the value of the ad. I. PROPERTY RIGHTS All property rights, including any copyright interest to any advertisement produced by using artwork and/or typography furnished or arranged by, shall remain its property.
