2 SECTION - I INVITATION OF BIDS Sealed tenders are invited from ORACLE OEM/ Authorized Partner of ORACLE for Renewal of ORACLE-ATS ( Software Update-1 Year & Product Support-1 Year ) for Odisha State Data Centre, Bhubaneswar. Tender paper can be downloaded from the Internet at and and the bids should be submitted at OCAC by dt , 15:00 hrs along with a DD of non-refundable fee of Rs.1000/- (Rupees one thousand only) drawn in favour of Odisha Computer Application Centre, Bhubaneswar. 3 SECTION II SCOPE OF WORK Renewal of Oracle ATS (Software Update -1Year & Product Support 1 Year) to be Purchased for Odisha State Data Centre as mentioned below. Oracle Database Enterise Edition-CPU- Nos Oracle RAC-CPU- Nos Tuning Pack-CPU- Nos Diagnostic Pack-CPU- Nos. The supplier shall be responsible for renewal of Oracle ATS products as per PO through mail link to Project Manager, OSDC/documents/ updation in SR site Delivery and installation of Renewal of Oracle ATS must be completed within 2-3weeks at Odisha State Data Centre(OSDC) from the receipt of the PO. Warranty - Software Update (1Year) & Product Support (1 Year)

4 SECTION III GENERAL TERMS & CONDITIONS 1. Location of the Project: Odisha State Data Centre, Bhubaneswar. 2. Eligibility Criteria a) The bidder must submit copy of the following documents along with the tender failing which, the tender will be treated as non-responsive and will not be accepted. i. Up to date VAT Certificate ii. iii. iv. from the OEM Up to date Authorization Certificate PAN Card Service tax registration no. v. Financial schedule as per format vi. (Section-IV) documents for executing the similar types of Order. Bidders should have submitted the b) The firm should have a local office in Bhubaneswar. 3. Payment: (i) 90% of the contract price shall be paid on successful delivery of mail link for renewal of Oracle ATS/Documents/updation in SR site of ORACLE products as per PO against submission of invoice within 7 days (ii) No claim towards interest can be made by the bidder for some unforeseen delay in payment. (iii) 10% Payment will made after Successful running of one month. 4. Delay in Service: If the item as mentioned not renewed within 3 weeks time, 0.5 % penalty will be charged per week or part thereof, after expiry of the period. The maximum penalty will not exceed 5% of the purchase value. 5. Validity:

5 The price and conditions of the offer should be valid for at least a period of 10 days from the date of tender opening. 6. Award of Work: Award of the contract shall be made to the bidder with the lowest (L1) commercial quotation. 7. Legal Jurisdiction: All legal disputes are subject to the jurisdiction of Bhubaneswar courts only.. Renewal of Oracle-ATS Period: The period of Renewal of Oracle-ATS Period from 1 st June 2015 to 31 st May 9. Final Authority: The final authority for payments will be the consignee except otherwise specifically stated and if the vendor/supplier desires to appeal against any matter, she/he shall appeal to Chairman-cum-CEO, Odisha Computer Application Centre, N-1/7-D, Nayapalli, near Planetarium, Acharya Vihar square, Bhubaneswar whose decision in consultation with the IT department, Govt. of Odisha on such matters shall be final and conclusive.
