PART-A TERMS AND CONDITIONS 1. Complete sealed tenders should be submitted along with price list and discount offer in your printed letter head with authorization certificate from the firm. Tender documents that do not provide complete information and that are received after the specified date and time will not be considered and will be summarily

3 rejected. University will not be responsible for any postal delay. The tender has to be submitted in two sealed envelopes, Envelop marked as Tender for Chemicals, Glass wares and Consumable Items enclosing demand draft. 2. THE RATES QUOTED SHOULD BE FOR HNBGU, Srinagar (Garhwal) inclusive of all charges viz. price list, certificate of authorization, discount, packing, forwarding, local taxes, freight, transit insurance etc. and free delivery at department. Taxes and duties should be quoted separately. 3. Quotations without specifying the make and other particulars may be rejected. The payment will be made after the goods have been received. In case the goods are rejected these have to be removed and replaced by the supplier at his own cost. Losses or damages in transit will be the responsibility of the supplier. 4. The minimum average annual turnover of the firm should be Rs Lacs or more in each year during the last three financial years ( , , ). 5. Firm should have good experience in supplying of lab consumable items to the Govt. Organizations/Universities/PSU/Autonomous bodies under Govt. of India. Firm should have supplied lab consumable items worth Rs Lacs against one order during last 7 years Or Firm should have supplied lab consumable items worth Rs. 1.5 Lacs each against two orders during last 7 years Or Firm should have supplied lab consumable items worth Rs. One Lac each against three orders during last 7 years 6. Rates should be valid for six months from the last date of receipt of quotations. 7. The University is not bound to accept the lowest tender and may reject any tender or any part of the tender without assigning any reason thereof. 8. In case of failure to supply the goods within the prescribed time and in accordance with the specifications given in the quotations, the University shall be free to cancel the order and make purchases from the next higher tendered or from the open market as the case may be. In that case the loss sustained by the University shall be recovered from the defaulting supplier. The University will be at liberty to recover the loss from the payment of earnest money/preference guarantee or any other pending claims of the supplier without prejudice to its general right to affect recovery from the supplier. 9. The University has the right to select vendor(s) on the basis of the prices quoted for individual items separately, instead of the total prices offered for more than

4 one item. 10. No payment will be made in advance for any supplies under this tender. The valid documentary proof of Sales Tax, VAT/Service Tax Registration No. & details of Income Tax registration (PAN) should be submitted along with the quotation. The taxes must be quoted clearly and separately. If the taxes are not quoted separately, it will be presumed that the rates quoted are inclusive of all taxes. 11. The University reserves the right to accept or reject any/all tenders or a part thereof, without assigning any reason. 12. The University reserves the right to verify/seek confirmation of all original documentary evidence submitted by the vender in support of the tenders, specifications for eligible criteria. In case any information furnished by vendor is found false/incorrect, the tender will be summarily rejected. 13. The tender document must be submitted along with a tender fee of DD for Rs. 100/- (non refundable) in favour of Finance Officer, H.N.B. Garhwal University payable at Srinagar (Garhwal) Earnest Money: Rs. 7000/-, in favor of FINANCE OFFICER, HNBGU, Srinagar Garhwal in form of DD only. Suppliers registered with this university need not to deposit Earnest money (EMD). However, if they compete to get order, they have to deposit performance security of the ordered value. 15. Performance Guarantee Amount: All the vendor (whether registered with University or not) need to provide Performance Guarantee amount, in the form of DD, when demanded by the University which shall be 10% of the total ordered value before order is placed to them. Performance Guarantee amount shall be returned without interest after satisfactory receipt of the item/equipment by the University. 16. Vendor has to quote price on his printed letter head separately for each items. 17. The Court of Pauri Garhwal, Uttarakhand alone will have the jurisdiction to try any matter of dispute or reference between the parties arising of this agreement/contract. Penalty: EMD/ Performance Guarantee amount or both amount of such vendor shall be forfeited who withdraw his bid during the period of bid validity specified by the bidder in the bid form or who do not supply the items as per the order or refuse to supply the items after order is given to them. Such vendor may also be blacklisted for further period to

5 supply the item to the university as deems fit to the competent authority of the university. Apart from this, extra penalty for the late supply shall 0.1% of the order value or Rs. 500 per day (whichever is higher) which shall be calculated from the next day of the last date of supplying as mentioned in the purchase order for supply of the item. This extra amount towards late fee shall be paid by the vendor along with the ordered item/s else shall be deducted from the total bill/emd/performance Guarantee of the vendor. Please note that the university reserves the right to accept or reject any bid and to annul the bidding process and reject all bids at any time prior to the award of contract, without thereby incurring any liability to the affected Bidder or bidders.
