2 Foreword Contents At any time, maintaining and creating jobs is a priority. Against the backdrop of the current economic cimate, now more than ever it is absoutey vita. As the nationa housing and regeneration agency, we have an important roe to pay in maximising empoyment opportunities, as we as heping to ensure that industry has the necessary skis to buid the homes and communities the country needs. We beieve that homes and jobs shoud go hand in hand and we re working hard to safeguard and create empoyment and skis opportunities through our investment in housing and regeneration. That is why we are embedding empoyment and skis initiatives in our operations and encouraging our partners to do the same. We re committed to providing practica advice to support this work. So in partnership with ega and procurement experts, we ve deveoped this empoyment and skis guidance and a tookit for deveopers and contractors. This guidance wi hep our partners to deveop and impement robust empoyment and skis strategies and buid requirements into their procurement processes of construction projects. It provides a framework for deveopers, contractors and their suppy chains and incudes tender documentation; tempates for procurement and contract causes; benchmarks that set outputs required per scheme; and best practice exampes of successfu empoyment and skis initiatives sourced from across the country. This guidance buids on government and oca authority guidance previousy commissioned by ConstructionSkis. 3 Introduction Deveopers and contractors have ong been at the forefront of creating and impementing empoyment and skis opportunities across a range of construction trades and support services, which in turn, has provided significant opportunities for the communities that they work in. Housing and regeneration pay a huge roe in the country s economy, not ony as a catayst for regeneration and renewa, but as a major empoyer and contributor to our gross domestic product. As a nationa housing and regeneration agency with a 17.3 biion of investment between , we beieve that we have an important roe in heping to deiver not ony affordabe homes but aso the empoyment and skis opportunities to enabe communities to prosper and thrive ong term. We ca this the empoyment and skis dividend (or added vaue) of our work of providing new affordabe homes and creating strong and thriving communities. The guidance and tookit is based on essons earned from the Nationa Skis Academy for Construction (NSAfC) programme, which integrates skis deveopment with major construction projects, incuding a number of housing projects. The programme has been estabished since 2007 and invoves 40 major construction projects throughout the UK. It incudes the deivery of an empoyment and skis pan (ESP), which is deveoped to refect the profie of the individua construction projects. Athough, the guidance and tookit is based on a construction mode, the principes can aso be appied to the procurement of non-construction works and services. The HCA understands that given their ead in this area of work, many deveopers and contractors wi aready have deveoped very successfu empoyment and skis strategies. To this extent, we are not making the adoption of the approach within this guidance and tookit mandatory. However, since the Agency wi be drawing on the approach set out in this guidance and tookit in informing its own empoyment and skis strategy and requirements for data coection and coation, partners may find it hepfu to check their approach against the advice contained within this guidance and tookit. The HCA is preparing a separate document which wi set out the empoyment and skis requirements that we expect a our investment partners to compy with. This document wi outine what we wi need our investment partners to commit, deiver, monitor and report on empoyment and skis if they receive funding incuding the sae or use of HCA and. As part of our commitment to the empoyment and skis agenda, we have now made it a condition of our capita investment, incuding the sae or use of and, for a deivery partners to provide apprenticeships, empoyment and skis opportunities. By prioritising our roe in creating opportunities for empoyment, skis and training, we firmy beieve we wi hep communities to prosper and thrive ong term. It wi aso hep to grow and keep a skied workforce to meet the chaenges of the modern word and future industries. 4 Background The HCA has appointed Trowers and Hamins LLP soicitors, working with ConstructionSkis Limited and The Skis Project Limited, as ead consutants to provide this guidance to assist deveopers and contractors to deveop and impement cient-ed empoyment and skis strategies on construction projects. Separate guidance has been commissioned by the HCA for registered providers. Equivaent guidance has been created by the same team of consutants for the deveopment and impementation of cient-ed empoyment and skis strategies by oca authorities and centra government departments and agencies and a summary of these is avaiabe at Deveoping an empoyment and skis strategy Whether in response to a project initiated by a third party or when formuating proposas for a project that it is initiating itsef, the deveoper/contractor firsty needs to identify the empoyment and skis areas which they woud ike to support. If working with a oca authority in reation to a particuar scheme, the deveoper/contractor shoud aso (on a vountary basis) seek to incorporate the priorities of that oca authority s Sustainabe Communities Pan but within the 12 empoyment and skis areas. In the Nationa Skis Academy for Construction framework, which is based on the Sector Skis agreement (deveoped by ConstructionSkis and the industry) and is becoming the industry adopted approach, empoyment and skis areas come under three headings: i) new entrants ii) existing workforce iii) skis cuture See appendix B for exampes of the empoyment and skis areas. An exampe of an outine empoyment and skis strategy workbook has been incuded at appendix F to highight a number of the considerations to be taken into account by a deveoper/contractor when deveoping its own empoyment and skis strategy. The minimum benchmarks provided in appendix E for new buid and refurbishment schemes have been taken from experience gained from existing Nationa Skis Academy for Construction schemes and an anaysis of abour patterns within the industry. The benchmarks have been prepared across a range of different construction vaue bands refecting the differing eve of potentia in terms of outputs and scope of empoyment and skis areas that they can support. In practice, the potentia outputs from the impementation of the ESP wi vary between schemes of a simiar size due to differences in the form of construction and nature of the construction process. Another key variabe wi be the capabiity and effectiveness of suppy chain members in contributing to the empoyment and skis strategy. This can be best managed by the deveoper/contractor through procurement and contract monitoring processes. Tabe 1 iustrates the degree to which schemes may be abe to support certain empoyment and skis areas depending on their size. Gauging the impact of the strategy In order to understand the eve of empoyment and skis outputs that can be achieved for given eves of construction activity, benchmarks can be incorporated into the empoyment and skis strategy, which hep to gauge the potentia impact of the strategy. 6 Guidance and tookit for deveopers and contractors Guidance and tookit for deveopers and contractors 7

Deivery issues for the empoyment and skis pan The ESP sets out the output figures for each of the empoyment and skis areas for the duration of the scheme. It is recognised that the impementation and management of the agreed ESP can be compex and it wi need input from the deveoper/contractor and its suppy chain. The successfu impementation of an ESP wi require the foowing: i) deveopment of the method statement ii) provision of guidance on deivery issues iii) review of suppy chain order detais iv) monitoring and support from the deveoper/contractor incuding the provision of standard documentation v) in cases where there is more than one deveoper/ contractor, individua ESPs that contribute to the overarching scheme ESP. Deveopment of the method statement A method statement for the impementation of the ESP wi be a requirement during the tender process (the method statement). Prior to entering into a scheme-specific contract or framework agreement, the deveoper/contractor shoud confirm or produce a more detaied method statement setting out how each of the areas in the ESP wi be impemented. When using a framework agreement, a scheme-specific ESP and method statement shoud be produced for each individua scheme, which wi be derived from a generic method statement deveoped for the entire framework programme. Provision of guidance on deivery issues Deivery of the ESP wi require considerabe coaboration between a number of agencies and organisations. Many sector skis councis such as ConstructionSkis, Asset Skis, Summit Skis and LANTRA (the sector skis counci for the environment and and based services) and others such as the Nationa Apprenticeship Service, through their network of advisors, may be abe to support main contractors and their suppy chain partners with deivery matters. An outine of key issues reating to the deivery of a number of major empoyment and skis areas is set out in appendix D. Review of suppy chain order detais Suppy chain partners working on ESP schemes and frameworks shoud be invoved with the deveopment of the ESP at the eariest opportunity. An appendix in the suppy chain order shoud set out the eve of invovement which wi be required from suppy chain partners. This shoud aso be reviewed by the deveoper/contractor with its suppy chain partners during any pre-commencement meeting. Monitoring and support from the deveoper/contractor The deveoper/contractor ESP shoud set out on a monthy basis the anticipated outputs against each of the empoyment and skis areas. Pease see appendix A for a tempate ESP. A tempate monitoring form has been provided at appendix G, which woud set out the ESP forecast figures against what has been achieved within that month or quarter. This coud be compemented by a quaitative report expaining the outputs and setting out other achievements within that period. The deveoper/contractor shoud acknowedge the amount of work and effort that wi have been provided by its suppy chain in the successfu deivery of a chaenging ESP. Site-based faciities and setting up a skis centre Some site-based faciities wi be required for impementing an ESP. These woud be used for accommodating schoo visits, on site assessment inductions, skis audits, etc. On sma and medium sized schemes an existing meeting room coud be used for these purposes. A dedicated skis centre coud be appropriate for arge schemes of. This coud be a site cabin fitted out with tabes and chairs, a white board and computer. Some regeneration schemes may aready have simiar faciities and deveopers/contractors shoud be encouraged to make use of these faciities rather than dupicate effort and to work coaborativey across projects. Personne responsibe for deivery The method statement wi set out how the deveoper/ contractor intends to manage the impementation of the ESP. On sma and medium sized schemes this coud be the responsibiity of the site manager with head-office support. For arger schemes or framework programmes of over 50m, there coud be a case for having a dedicated project skis coordinator. Their roe woud be to coordinate and faciitate the range of empoyment and skis areas. This woud invove iaising with the site team, trade contractors, schoos, coeges and training agencies. Costings The deivery of an ESP does have certain costs associated with it. However, best practice demonstrated on a number of Nationa Skis Academy for Construction schemes shows that costs, as a proportion of construction vaue, can be reativey ow. The main cost is that associated with the management and deivery of the ESP. For the arger schemes this coud incude the roe of a dedicated project skis coordinator together with a site based skis centre. On smaer schemes, which do not justify a dedicated skis coordinator, this management roe may be undertaken by a part-time skis coordinator, the cost of which wi form part of the deveoper/contractor overheads for the scheme. As deveopers/contractors become more practiced at deivering ESPs, it is ikey that they wi increasingy empoy speciaist staff to assist with this requirement. Other costs such as wages of apprentices are often abe to be absorbed by the suppy chain companies who empoy them. Wage costs can often be significanty off-set against the productivity of the apprentice together with grants, which may be drawn down by the company empoying them. 10 Guidance and tookit for deveopers and contractors Guidance and tookit for deveopers and contractors 11
7 Guide to the incusion of empoyment and skis requirements into the procurement process Appendices: Tempate tender documentation To provide guidance to deveopers/contractors, appendix C incudes expanatory paragraphs which coud be incuded into suppy chain tender documentation to describe the empoyment and skis requirements for tenderers. Contract causes Appendix C incudes tempate contract causes, which can be incorporated at each stage of the suppy chain procurement process and in standard construction contracts such as the ACA Standard Form of Contract for Project Partnering, PPC2000, NEC3 Engineering and Construction Contract 2005, JCT Design and Buid Contract 2005 and a bespoke framework agreement and project contract. It is appreciated that in many cases deveopers/contractors wi not be appointing separate main contractors and, in such circumstances, it is envisaged that deveopers/contractors can adapt the tempate wording as appropriate for use in their other suppy chain contracts. Deveopers/contractors shoud seek their own ega advice on procurement processes and contracts. 16 Appendix D Issues reating to the deivery of the empoyment and skis areas The purpose of this section is to provide an outine of the issues reating to the deivery of the empoyment and skis areas. It covers three specific areas: A) new entrants, B) existing workforce and C) deveopment of a skis cuture. Each empoyment and skis area incudes a definition and a key issues section. A. New entrants: peope wishing to enter the industry from education or as a change in career. 1. Schoo/coege/university site visits visits by students to the site to support their earning. Key issues: coordination with the site team; risk assessment and method statement; and site safety induction. Coordination with the site team a review shoud be carried out covering the objective of the visit and identification of key earning points, timing of the site visit, ocation for assemby and induction, route of the visit and identification of person with responsibiity for eading the visit. Risk assessment and method statement these shoud be carried out by a competent person and the risk assessment shoud take into account trips and fas; contact with chemicas; contact with moving vehices; noise; and dust. The method statement shoud cover assemby, inductions, routes incuding a diagram, standards of behaviour, process for deaing with an accident and evacuation arrangements. Site safety induction this shoud incude introduction to the scheme; supervision and assemby; requirements for PPE; wefare faciities eg. toiet and refreshments; routes for site visit; procedure for deaing with moving pant and vehices; rues of conduct; hazards and contro measures; reporting accidents; and fire and evacuation procedures. 2. Schoo workshops educationa workshop activities that are deivered by the contractor or their suppy chain within the schoo or coege, or on site in a meeting room or suitabe open area. Key issues: preparation of engaging materia; deivery of workshops: supporting the Construction and Buit Environment Dipoma. Preparation of engaging materia the schoo shoud be asked to indicate what aspect of the curricuum they woud ike to be covered by the workshop. The contractor shoud then provide suitabe materia to cover this aspect and making it appropriate for the age group. The materia coud incude a workbook setting out chaenges and exercises, or a project for the students to work on incuding appropriate supporting materia. Deivery of the workshop ideay this woud incude invovement by a member of the site team, and perhaps aso a trade contractor. Supporting the Construction and Buit Environment Dipoma the new dipoma supports students in gaining a comprehensive understanding of construction as preparation for entry into the industry. Support for this dipoma through the provision of workshops addressing key eements of the curricuum wi be of considerabe benefit for the students and for the industry. 3. Research projects Key issues: research topic. Research topic universities, coeges and schoos are generay keen to work with contractors to undertake research reated to a scheme. The research coud either be to support an ongoing research project being undertaken by the university, schoo or coege, or aternativey to research an area that the contractor has an interest in. 4. Work experience years work experience pacements with the site team or trade contractors. This can incude bock pacements on site of one week or more, or weeky pacements of one or two days. An induction session with the supervisor and the young person shoud incude a review of chid protection measures that need to be observed. Parenta consent wi need to be obtained for the work experience pacement. This shoud incude a copy of the risk assessment and method statement. In addition, a medica consent form shoud aso be incuded which identifies any medica conditions and aso incudes consent for the young person to be offered treatment in an emergency. A trade-specific risk assessment wi need to be prepared for each pacement. This shoud take into account any particuar issues reating to the type of work that wi be undertaken and aso any specific issues reating to the individua. Method statement this wi ist particuar actions to minimise risk, taking into account the age and experience of young person. Supervision a competent person wi be required to provide one-to-one continuous supervision of the young person throughout their time in the work pace. Arrangements need to be agreed with parents and guardians about drop-off and pick-up. Appropriate guidance shoud be obtained from them on how to ensure that the work experience pacement conforms to best practice for deaing with chidren and young peope. 5. Work experience 16+ years individuas who are engaged in fu-time further education and aso incudes entry to empoyment and university student pacements. Apprentices individuas who are empoyed by a company and enroed on a reevant apprenticeship framework. Key issues: types of apprenticeships Apprenticeships apprenticeships can incude i) traditiona apprentices, ii) programme-ed apprentices and iii) adut apprentices. Further information on apprenticeships, incuding the grants avaiabe can be found on need to make arrangements to provide foow-on work where necessary, which coud be through a group training association (GTA). GTAs are often deveoped within arge organisations or between a number of organisations. They provide the opportunity, once an apprentice finishes a contract, for other teams or organisations with the GTA to offer further work opportunities, so that the apprentice can continue their apprenticeship. Range of experience not a schemes wi be abe to offer the fu range of experience that an apprentice wi need to compete their apprenticeship. In these situations the contractor or trade contractor shoud seek to identify opportunities esewhere for the necessary experience to be obtained. B. Existing workforce this section reviews skis deveopment opportunities for those aready working in the industry. 8. Heath and safety training workers trained in some aspect of heath and safety and deivered by a recognised heath and safety trainer. Key issues: duration of test, type of training. The duration shoud be a minimum of haf a day. Grant funding funding to cover the cost of the on-site assessment may be avaiabe through Train to Gain, subject to the status of the candidate. In addition, grants may be avaiabe from ConstructionSkis ( subject to the status of the company. 10. Construction Skis Certification Scheme (CSCS) Skis Cards - skis cards demonstrate that the hoder is competent in their respective roe. Detais can be found on Key issues: requirements for a CSCS Skis card. Workers wi need to have the appropriate NVQ or equivaent quaification and have passed the appropriate heath and safety test. C. Deveopment of a skis cuture and infrastructure 11. Short courses courses on a range of subjects reated to supervision; heath and safety; new methods and technoogy and operationa issues. Key issues accreditation, supporting eadership and management training. Accreditation courses that are accredited means that they are recognised by an awarding body. It is not a requirement that a courses deivered are accredited. However, in this instance the course shoud have a cear set of earning objectives and be capabe of assessment. Supporting eadership and management training - eadership and management training is seen as a crucia eement in raising standards in the industry. This training can be directed at a eves of the workforce. 12. Progression into empoyment - peope who have been registered unempoyed and are offered and accept empoyment opportunities, which are expected to ast 13 weeks or more. Key issues supporting progression into empoyment. Supporting progression into empoyment this incudes a range of JobCentre Pus and Connexions initiatives incuding Entry to Empoyment, Pre-empoyment Training and Pathways to Work. This initiative invoves work trias, guaranteed interviews and potentiay subsidised empoyment. Further information can be found on and 7. Project initiated apprenticeships (created) individuas who are taken on as apprentices specificay as part of the scheme, which can incude traditiona, programme ed and adut apprentices. Vocationa quaifications assessments of competence that provide the primary evidence for a CSCS Skis Card. Empoyment - this may invove the main contractor empoying the apprentices as a host cient and pacing them with their trade contractors for the duration of the works on the scheme. Key issues: NVQ eves, form of assessment, grant funding. NVQ eves - Nationa Vocationa Quaifications range from eves 2 craft, eve 3 advanced craft or supervisor eve 4 manager and eve 5 senior manager. Progression not a schemes can provide continuous empoyment sufficient for an apprentice to compete his or her apprenticeship. A programme-ed apprenticeship typicay requires ess time e.g. one year compared to a traditiona apprenticeship which is generay two years. Assessment is generay through an on-site assessment where an approved assessor visits the candidate at the pace of work to carry out the competency assessment. Some assessments aso require a portfoio of evidence to be provided by the candidate. 20 Appendix E Part 5 Benchmarks for decent homes Benchmarks for refurbishment schemes 10m- 60m+ per year construction spend The benchmark figures are based on the mid-point figure for each of the vaue bands Refurbishment programmes invove the upgrading of existing properties, which often incudes working with residents in occupation. The work typicay incudes interna improvements covering new kitchens and bathrooms, upgrading to heating systems and eectrica rewiring. Externa improvement works cover items such as roof repacement/repairs, new windows and repairs to brick and concrete eevations. Such schemes offer significant opportunities for incuding empoyment and skis requirements as part of the project. The scope of these opportunities wi be determined by the profie of the work and the size of the construction spend. The key factors reating to the profie of the works wi be: i) the number of trades that are invoved, ii) the nature of the work being undertaken and iii) the abiity of the scheme to accommodate visits and other forms of engagement with schoos and coege groups. i) Number of trades - a typica refurbishment scheme might invove three to five traditiona trades such as eectrica; pumbing; carpentry; painting and decorating; and roofing. A significant eement of the works is ikey to be carried out by muti-trade gangs or speciaists such as kitchen fitters, window fitters and brickwork/concrete repairers. ii) The nature of the works the works are generay imited in their nature to improvement works and do not incude the range of works that woud typicay be found on a new buid project of a comparabe vaue. iii) Abiity of the scheme to accommodate visits and other forms of engagement due to the restricted nature of the works and the fact that these are generay undertaken within occupied properties there are ikey to be restrictions on the abiity to arrange a wide range of educationa engagement activities. iv) Size and continuity these schemes tend to be very arge in terms of capita spend e.g. in the order of 10m to 50m per year. They aso tend to run for between two and 10 years, which provides significant continuity of work, which in turn supports apprenticeships and skis deveopment. It shoud be noted that there can be considerabe variation in construction spend between years and this woud need to be taken into account when setting empoyment and skis targets. The benchmarks beow have been deveoped to assist with this process of setting target outputs. Overview of the benchmarks The benchmark figures have been based on the profie of works typicay found in a decent homes programme. They have been designed to generate a profie of potentia empoyment and skis outputs for the ife of the scheme based on the ife of the scheme. The foowing issues have been taken into account when setting the benchmarks: The eve of outputs for educationa engagement are generay quite ow refecting the ogistica restrictions of conducting site visits and workshops on an occupied site. The age group for work experience starts at 16 rather than 14 years od, as woud be expected on new buid schemes. This refects the sensitive nature of working in occupied areas and heath and safety impications associated with refurbishment type works. Opportunities for apprenticeships are ikey to be more restricted than in a new buid scheme due to the imited number of trades that are generay engaged on this type of work. Work experience opportunities and progression into empoyment opportunities wi be higher than on new buid schemes refecting the opportunities that are avaiabe from the greater presence of non-traditiona trades, which do not generay support apprenticeships. Skis deveopment for the existing workforce such as heath and safety training, and CSCS achievements wi be broady simiar to comparabe new buid projects. fewer NVQs woud be expected, given the greater continuity of work that is norma on these schemes, eading to fewer workers being engaged on the project overa. 26 Appendix H Best practice exampes Stanhope Regeneration Ashford, Kent The empoyment and skis pan (ESP) at Stanhope has been entered into on a vountary basis as part of the regeneration programme on a major housing estate in Ashford. It is deivered through a site-based skis centre estabished and run by the main contractor, Denne. This is the first Nationa Skis Academy for Construction accredited skis centre in the UK to receive funding by ConstructionSkis, as we as being the first of its type on a housing project. Profie of the Stanhope deveopment project Profie of the Stanhope deveopment project. The construction eement of the project is vaued at 65m and invoves the deveopment of 450 new dweings and the improvement of 332 existing properties. The scheme is a Private Finance Initiative project and commenced in the Spring of It is due for competion in The cient is Ashford Borough Counci and the deivery partners are Moat, Geeson Capita Soutions and Denne, part of the Leadbitter Group. Deivery arrangements The skis programme is managed by a dedicated project training coordinator. This roe incudes coordinating activities, deivering heath and safety tests, and iaising with the site team, the trade contractors, coeges, schoos, accredited training providers/assessors and the trainees. The centre is run from a site-based cabin fitted-out with desks, a white board and a tea-point. It aso operates as an accredited CSCS heath and safety testing centre. Contractua arrangements The contract for the scheme is bespoke and deveoped for the PFI deivery mode. There is no contractua requirement to deiver the ESP. However, the contractor has incuded a requirement to deiver the empoyment and skis outputs in a its sub-contract orders. The other approach has been through direct recruitment as an apprentice. This has incuded schoo eavers at sixteen and aso individuas who have been ong-term unempoyed. Three residents from the area were recenty taken on by the groundwork contractor and scaffoder under a Construction Skis managing agency. Another oca resident was permitted by the further education coege to start an eectrica course without the required quaifications because a trade contractor from the scheme agreed to empoy him. Additiona assistance was given with numeracy and iteracy training to bring him up to the required standard. In addition to these project initiated apprentices, a number of trade contractors aso have existing apprentices who have worked on the project. These figures reate to the period from the estabishment of the skis centre in November 2007 to February Other activities incude supervisor training, heath trainer visits, activities for young unempoyed peope, and a Young Buiders Cub. Engish for Speakers of Other Languages courses have been deivered on the scheme, which has heped some of the migrant workers with obtaining a CSCS card. Arrangements for apprenticeships Two routes into apprenticeships have been successfuy used on this scheme. The first starts with work experience pacements for fu-time coege students. This is initiay for two weeks but they have generay been extended for the duration of the trainee s first year at coege. Subject to performance, the trainee is then taken on as an apprentice, which enabes them to start and compete their vocationa quaification. 27 Registered provider housing scheme Simmonds Court, Tonbridge, Kent The scheme is a 3.6m deveopment consisting of 33 fats contained in one bock. The contract duration is 50 weeks and the project commenced with site cearance taking pace in January The scheme incorporates a biomass boier and one of the areas that the cient is particuary interested in exporing is the deveopment of skis in renewabe energy instaation. Set out in the side box are the target outputs that were agreed with the contractor. The approach to deivering the ESP adopted by the contractor is as foows: Assign a skis coordinator empoyed within the company to visit site one day per week to coordinate the empoyment and skis activities Incude a requirement for apprenticeships, CSCS cards, the provision of work experience pacements etc within a sub-contractor orders Equip the existing site-based meeting room as a skis centre. Tabes and chairs, a computer and tea-point were aready provided within the meeting room. The ony additiona items that were added were a white board and two extra computer stations Set up an accredited heath and safety testing centre. This was again based in the meeting room and required a ockabe storage cabinet and various administrative systems to be put in pace to satisfy the accreditation process. This enabes the contractor to run heath and safety testing from the site. Using ocay based trade contractors and ones which are used on a reguar basis by the main contractor ensures the necessary commitment on their part. The other eement of the approach is to recruit students who were aready studying on a recognised coege-based course.
