SUPDT OF POST OFFICES, MUMBAI NORTH WEST DN KANDIVALI (E), MUMBAI No: G2/L.B.Clearance/Contract/Tender/NW/2014 dated at Mumbai , TENDER NOTICE On behalf of President of India, sealed tenders are hereby invited for clearance of mails from letter boxes (once in a day) using three wheeler on regular basis on all working days except Sundays and Post Office Holidays for a period of one year which can be extended on a month to month basis depending upon the performance of the contractor, which will be specified in the letter communicating the acceptance of the tender/award of work. The Auto Rickshaw vehicle will be used for clearance of letters from Letter Boxes and its conveyance Post Offices within the jurisdiction as per the specification in Annexure II in Mumbai North West Dn. area in the vicinity of the following post offices under the Division. Deshmukh Sr. Supdt. of Post Offices, Mumbai North West Dn, Kandivali (E), Mumbai ) The sealed tenders should be super-scribed as "Tender for mechanized Letter Box Clearance". Tenders should reach this office on or before upto hrs & will be opened on the same day i.e at hrs, in the presence of those contractors who may wish to remain present at their own expenses. In case the opening date i.e happens to be holiday due to unforeseen reasons, the tender will be open on next working day at the same time. The tenders received after the scheduled date and time will be rejected outright. 3) a) Three wheeler auto rickshaw that have run not more than 75,000 km and which is in excellent condition, not more than 6 years old, have a load carrying capacity of not less than 450 kg. The vehicle should have a closed top with a floor area of not less than 1.3 sq. meters, internal height above floor not less than 1.25 sq. meter and should have door with locking arrangement. Auto rickshaw will have arrangement of sitting of two postal officials whenever required.

2 b) The successful tenderer should be able to supply/provide stand by vehicle in case of breakdown of the vehicle provided for the purpose. 4) (i)the tenderer will have to credit Rs /- as Earnest Money Deposit in any Post office and credit receipt should be enclosed with Technical bid. 4)(ii) The successful tenderer will be required to execute an agreement with Government of India for a period of one year from the date of signing the agreement with the application of provision of clause 16 of the Agreement and security deposit of Rs.50000/- or 10% of accepted tender value work whichever is more. 5) The tender must be submitted in two separate sealed covers, one containing the technical Bid and the EMD receipt (Annexure-A) & the other containing the Price Bid (Annexure-B). Both the bids should be kept in separate wax sealed cover addressed to the undersigned. The forms of tender and a copy of the schedules showing the number, timings and other details of the service required with particulars regarding other terms and conditions of the contract and the form in which the contractor will be required to execute an agreement (Annexure-C), may be obtained on application from the undersigned from to during office hours on production of ACG-67 receipt of Rs.200/- (Rupees Two Hundred Only) obtainable after depositing the said amount in any post office towards cost of Tender form(s) for Letter Box Clearance contract for mail conveyance for above noted offices which will not be refunded in any case.the amount of tender would be Rs /- 6) The tenderer should sign & stamp all the pages of tender document including Annexure A, B C & D that he has read all the terms & conditions & agree with it. 7) The competent authority reserves the right to reject any or all tender(s) without assigning any reason thereof. 5 ANNEXURE C AGREEMENT I, Shri adult, Indian Inhabitant of Mumbai residing at, do hereby state on solemn affirmation as under:- I have been awarded contract by the Sr. Superintendent of Post, Mumbai North West Division, Kandivali East, Samta Nagar, Mumbai vide letter No. Mumbai for the letter box clearance for the area of In the view of my above contract I hereby undertake as under:- a) The vehicles used for clearance of Letter Box will have a permanent body structure, free rain/sunshine during day/night. b) Alternate mode of conveyance should be provided by the contractor if his designated vehicle do not turn up or they are off road at the prescribed time. c) If I fails to carry on the work on any day, a penalty of Rs.200/- will be levied from in addition to approved at daily rate. d) The brand name and brand of vehicles, registration No. of vehicles is required to be mentioned by me. e) That I shall make own arrangement in case the vehicles meant for the said work fails, failing which the Deptt will make its own arrangement for conveyance of the mail/clearance of the letter boxes, then I shall be liable for cancellation in cases of such failures on five occasions and security deposit will be forfeited. f) has been engaged as Auto Rickshaw Driver for the Letter Box Clearance work at , whose copy of license along with other relevant documents is attached herewith. g) I will Rs. per K.M. for further year. h) I will not carry any external passenger or any other goods except Group D official of Post office deputed for the Letter Box Clearance job in the rickshaw while performing the Letter Box Clearance work.

6 -: 2 :- i) The time and route of L.B.Clearance prescribed can be changed, by the Sr. Supdt Post North West Dn. j) I will maintain a daily chart, showing the arrival time, Letter Boxes Cleared, work completed and obtain counter signature of Post Master/Sr. Post Master concerned. I hereby undertake to abide by above terms and conditions and I shall not commit any breach of the conditions mentioned herein above. Whatever stated hereinabove is true and correct to the best of my knowledge and belief. 7 General Terms And Conditions Note : The employees of Department of Posts and their near relatives are not entitled to participate in this tender. Sub: Notice Inviting Tender for mechanized letter box clearance. Parties: Parties to the contracts are the Contractors ( The tenderer to whom the work shall be awarded) and the Govt. Of India through the department of posts for and on behalf of the President Of India. 1. Addresses: For all purposes the contracts including arbitration there under, the address of the contractor mentioned in the tender shall be final unless the contractor notifies a change of address by a separate letter sent by registered post with acknowledgement due to the Sr. Supdt. Of Post Offices, Mumbai North West Dn. The Contractor shall be solely responsible for the consequences of any omission or error to notify the change of address in the aforesaid matter. 2. Earnest Money: Earnest money of Rs must be deposited in concerned Head Post Office and original receipt in form ACG-67 provided by Post Office in token of having received the amount should be submitted along with their tenders. Tenderer shall not be permitted to withdrew his offer or modify the terms and conditions thereof. In case the tenderer fails to observe and comply with the stipulations made herein or back out after quoting the rates, the aforesaid amount of earnest money will be forfeited to the Government. Tenders without EMD will be summarily rejected. 3. Preparation and Submission of Tender: The tender should be submitted in two parts viz; Technical Bid along with proof of EMD and Commercial Bid and each should be kept in separate sealed cover. Both the bids should be kept in another sealed cover addressed to Department Of Posts. The Outer envelope containing the sealed cover should bear the address, tender number and date, subject of tender, date and time of opening the same. Inner envelopes should be superscribed with Tender No., subject of tender and whether the envelopes in containing Technical Bid or Commercial Bid. 4. The tenderer should sign and affix his/her firm s stamp at each page of the tender and all its Annexures as the acceptance of the offer. No page should be removed/detached from the Notice Inviting Tender. 5. Validity of the Bids: The bids shall be valid for a period of 1 year from the date of opening of the tenders. 6. Opening of Tender: The tenderer is at liberty to either present himself or to authorize not more than one representative to be present at the opening of the tender. On the date and time indicated, bid will be opened and read out in the presence of the tenderer/ tender s representative. 7. Criterian for evaluation of tenders:

8 The evaluation of tenders will be made on the basis of information furnished in Technical Bid and then on the basis of Commercial Bid by Tender Evaluation Committee constituted by the Competent Authority. The commercial Bid of such firms found valid on the basis of Technical Parameters will be opened on the date, time and venue to be announced after opening of Technical Bid. The reason for selection or rejection of a particular tender will not be disclosed. 8. Right Of Acceptance: The department of posts reserve all the rights to reject any tender including of those renderers who fail to comply with the instruction without assigning any reason whatsoever and does not bind itself to accept the lowest or any specific tender. 9. Communication of acceptance: Successful tenderer will be informed of the acceptance of his tender. Necessary instruction regarding the amount and time provided for Security Deposit will be communicated. 10. Security Deposit: The successful tender will have to deposit in cash in any post office under unclassified Receipt a sum of Rs. 6000/- or 10% of the accepted tendered value work as security deposit whichever is more in favour of President of India towards Security Deposits within 7 days from the date of acceptance of the tender and produce receipt in original to this office. The successful tenderer shall tender an irrevocable Bank Guarantee of any Scheduled Bank or State Bank of India in accordance with the form prescribed for an amount equal to 10% as performance guarantee for the period extending at least six months beyond the completion of work within 7 days from the date of acceptance of the tender. The Security Deposit will be forfeited in the event of any brreach or negligence or for non-acceptance of any condition of contract or unsatisfactory performance or for non execution of work. 11. Penalty: In the event of contractor failing to carry on the work on any day, a penalty of Rs. 200/- will be levied from in addition to approved at daily rate. 12. Breach of Terms and Conditions: In case of breach of any terms and conditions mentioned above, the Competent Authority will have right to cancel the tender without assigning any reason thereof and nothing will be payable by this Department in that event and the security deposit shall also stand forfeited. 13. Subletting of work: The contactor shall not assign or sublet the work or subcontract or any part of it to any other person or party. 14. Terms of Payment: No payment shall be made in advance. The contractor shall submit

9 the bill at each stage/ in the first week of the following month on completion of each stage of work for sanction of the amount of bill and passing the bill for payment. All payment shall be made by cheque subject to recovery of amount of Income Tax and other recovery towards penalty if any. 15. Compliance: During the period of contract, the contactor shall at his own cost and initiative fully comply will all applicable law of the land. 16. Arbitration: If any differences arise concerning this Agreement its interpretation or the payment to be made there under, the same shall be settled under mutual considerations. If attempts for conciliation do not yield any results within a period of 30days, either of the parties may make a request to other party for submission of the disputes for decision by an arbitral tribunal containing a sole arbitrator to be appointed by the Chief Postmaster Maharashtra Circle. Such request shall be accompanied with a panel of names of three persons to act as the sole arbitrator. In case of such arbitrator refusing, unwilling or becoming incapable to act or his mandate having been terminated under law, another arbitrator shall be appointed in the same manner from among the panel of three persons to be submitted by the claimant. The arbitration proceeding shall take place at Mumbai and shall be conducted in English. The provision of Arbitration and Conciliation Act, 1996 and rules framed there under and in force shall be applicable to such proceedings. 17. Other: a) The vehicle used for clearance of Letter Box will have a permanent body, structure, free rain/ sunshine during day/ night. b) Alternate mode of conveyance should be provided by the contractor if his designated vehicle do not turn up or they are off road at the prescribed time. c) The brand name and brand vehicle, registration no. of vehicle is required to be mentioned by the contractor. d) The contractor shall make own arrangement in case the vehicle meant for the said work fails, failing which the Department will make its own arrangement for conveyance of the mail/ clearance of the letter boxes, the contractor shall be liable for cancellation of contract in case of such failure on five occasions and security deposits will be forfeited. e) The rate should be quoted per km. No extra amount will be paid toward maintenance and other expenditure. f) He will not carry external passenger or any other goods except postal official, official deputed or LB Clearance job in the rickshaw, while performing the Letter Box Clearance work.
