3 I. INTRODUCTION DUI curts are cnstructed upn a partnership between the criminal justice system and the treatment cmmunity. This cllabratin results in a DUI curt team that structures treatment, supervisin, and interventin in rder t break the cycle f abuse and related criminal activity. DUI curt participants experience lng-term treatment and cunseling, sanctins, incentives, and frequent curt appearances. Althugh DUI curts vary smewhat frm ne jurisdictin t anther in terms f structure, scpe, and target ppulatins, they all usually share three primary gals: (1) t reduce recidivism, (2) t decrease substance abuse amng participants, and (3) t rehabilitate participants. DUI curt prgrams must therefre recgnize: Substance abusers are mst vulnerable t successful interventin when they are in the crisis f initial arrest and incarceratin, s interventin must be immediate. Preventing breaches in cmmunicatin and ensuring ffender accuntability are f critical imprtance, s curt supervisin must be crdinated and cmprehensive. Substance abuse seldm exists in islatin frm ther serius prblems, which undermine rehabilitatin, s interventin must include ther available services and resurces such as dual diagnsis interventin, educatinal assessments and jb assistance. Relapse and intermittent prgress are part f the recvery prcess, s sanctins and incentives must be integral t the DUI curt interventin strategy. A. MISSION STATEMENT The Putnam Cunty DUI curt is a prgram designed t reduce substance abuse, criminal recidivism and increase rehabilitatin thrugh intense judicial interventin and substance abuse treatment. Frequent drug testing, substance abuse treatment, scial service referrals, sanctins and rewards are used t prmte lng-term sbriety, accuntability and prductive lifestyles. B. GOALS The Putnam Cunty DUI curt has the fllwing primary gals: 1. Reduce drug use and related criminal activity. 2. Reduce recidivism rates. 3. Hld drug-dependent ffenders accuntable fr their criminal cnduct. 4. Prvide real and effective rehabilitatin fr criminal ffenders. C. METHODS FOR ACHIEVING GOALS Gal 1 - Reduce drug use and related criminal activity Mandate intensive substance abuse treatment and clse judicial supervisin and mentring f all participants, with apprpriate sanctins and rewards based n perfrmance. Clse judicial supervisin is premised upn a stable and cnsistent relatinship between the participant and the designated DUI curt Judge. Require cntinued educatin, jb training, and/r emplyment fr graduatin. II. DUI COURT TEAM PHILOSOPHY AND STATEMENT OF VALUES The missin statement cmmunicates what we d as a DUI curt and why. Examining ur values can assist us with rientatin f new members and cntinued mbilizatin f the cmmunity fr funding, referrals, and resurce develpment. Adhering t ur values is essential t the success f the team and participants. A. CORE VALUES Our team is successful and effective in that we have: 1. Respect fr each ther s rles, ethical cncerns, bundaries, ideas and perspectives. 2. Shared expectatins fr prgrams and understanding fr each ther s rles. 3. A high level f cmmitment frm all team members. The cmmunity benefits frm the wrk f ur team because f: 1. Reduced scietal csts thrugh reduced crime. 2. Increased awareness f drug and alchl issues in the cmmunity as well as increased cmmunicatin and increased cllabratin between services. 3. Prviding skills t DUI curt participants that may prevent future drug use. 4. Prviding better access t services fr DUI curt participants and their families. 5. 5 The DUI curt helps imprve family stability and identifies and addresses a range f underlying needs. The team cntributes a framewrk fr addressing these needs and prviding access t necessary services. Cmmunity values reflected in ur team s decisins. The DUI curt team perates with values cngruent t ur cmmunity, such as accuntability, prmting individual dignity, using treatment rather than incarceratin whenever apprpriate and decreasing csts f criminal justice. B. ORIENTING NEW MEMBERS New team member rientatin. We will familiarize new team members by requiring training n the 10 Key Cmpnents f Drug Curt, prviding ur plicy and prcedures manual, and encuraging new team members t participate in the prcess alngside ther team members. As previusly stated, each team member will be encuraged t respect the rles, ethical cncerns, bundaries, ideas and perspectives f ther team members, including a new team member. New team members have input and wnership in the DUI curt Team plans and peratins. We have rganized a cnsensus prcess that encurages new members t prpse mdificatins t the prgram after they have been with the team fr a perid f time. Annual Training fr Team Members Team members sputnam attend at least ne Natinal r State level training per year as funding allws. III. DUI COURT ORGANIZATION A. DUI COURT COMMITTEE A DUI curt Cmmittee was established t discuss the feasibility and sustainability f a prpsed Putnam Cunty DUI curt fr DUI defendants. The cmmittee determined the curt was practicable and culd be cntinual with available resurces and a ppulatin f defendants wh wuld benefit frm it. The cmmittee undertk the task f defining the functin, prcedures, and plicies f the DUI curt. The cmmittee was cmprised f the Putnam Cunty Public Defender, the Putnam Cunty Slicitr, the Putnam Cunty State Curt Judge, the Putnam Cunty Office f the Curt Administratr, the lcal treatment cmmunity, the Putnam Cunty Sheriff s Office, Eatntn Plice Department and Judicial Alternatives f Gergia. This manual is the tangible result f their wrk. The cmmitment and devtin f the DUI curt team members t induct and perate the Putnam Cunty DUI curt is the instrumental result f their wrk. B. TEAM MEMBERS AND ROLES It is essential fr each team member t make a cmmitment t participate cnsistently and dependably in all prceedings during their DUI curt tenures. 1. DUI curt Judge The DUI curt Judge will prvide leadership t the DUI curt prgram and make final prgrammatic/participant decisins and participate fully as a DUI curt team member. The judge will: Lead pre-hearing staffing meeting and make final decisins based n cllabrative team input. Assume nt nly the rle f judge, but als f mentr and encurager t each DUI curt participant. 6 Establish a rehabilitative relatinship with each participant thrugh intensive interactin during curt appearances. 2. DUI curt Crdinatr The DUI curt Crdinatr will prvide versight fr the day t day peratins f the DUI curt prgram. He r she will als mnitr whether it is meeting its shrt and lng term bjectives n the participants, cmmunity and the lcal criminal justice system. The DUI curt Crdinatr will: Plan, rganize, crdinate and mnitr the activities f the DUI curt prgram. Schedule and meet with participants t discuss prgram details. Attend pre-hearing staffing and hearings in rder t evaluate and direct DUI curt peratins, case management, media inquiries and DUI curt team chesiveness and understanding f DUI curt cncepts. Gather and prepare DUI curt data fr grant reprting mandates and btain future funding. Cllabrate with gvernment and cmmunity agencies in rder t meet prgrammatic gals and prvide effective prgramming. Mnitr cnditins f the DUI curt cntract, including treatment cmpliance, abstinence, husing arrangements, emplyment, traveling, and legal/ financial bligatins 3. DUI curt Slicitr The DUI curt Slicitr will ensure cmmunity safety cncerns are met and will participate fully as a DUI curt team member. The DUI curt Slicitr will: Make eligibility determinatins and cntact cllabrative agencies such as law enfrcement and prbatin ffice fr input. Make determinatins fr terminatin and new charges, such as bail jumping, that balance cmmunity needs and therapeutic utcmes. In status hearings will perate in a nn-adversarial manner, prmting a sense f a unified team presence. 4. DUI curt Public Defender The DUI curt Public Defender will ensure his r her clients legal rights are prtected and will participate fully as a DUI curt team member. When assigned the defense will: Meet with ptential DUI curt participants t evaluate their interest and acceptability int the prgram (as needed). Advise the clients n their legal rights, legal ptins, prgram cnditins and ptential sentencing utcmes. Participate in a nn-adversarial manner at status hearings, thus prmting a unified DUI curt team presence. 5. DUI curt Treatment Prvider Putnam Cunty DUI Curt Plicy Manual 6 f 13

7 The DUI curt Treatment Prvider and will participate fully as a DUI curt team member. The Treatment Prvider will be respnsible fr all individual and grup sessins thrughut the duratin f the prgram. Cnduct intake interviews with clients and review all relevant treatment and demgraphic infrmatin. Prvide referrals and assistance in btaining ut-patient substance abuse treatment services, and in-patient beds, as directed by the case plan. Input demgraphic and ther relevant data fr each participant and maintain a database, which will be used t evaluate the prgram at the end f each year. Prvide referrals t ther necessary scial and health services fr participants. 6. JAG Prbatin Officer The DUI curt Prbatin Officer will prvide case management services fr all DUI curt participants: Mnitr all necessary requirements f DUI curt prgram (i.e. AA). Crdinate all drug screens fr all participants. Prvide eligibility feedback during initial screening prcess. Participate in weekly staffing and curt hearings and prvide weekly input f treatment and drug testing data int DUI curt database. Apprise the ther team members f the participants cmpliance with curt rders. 7. DUI curt Law Enfrcement Liaisn The DUI curt Law Enfrcement Liaisns will prvide law enfrcement supprt fr DUI curt activities and participate fully as a DUI curt team members. The Putnam Cunty Sheriff s Office and the Eatntn Plice Department will bth serve as cntributing team members. These liaisn fficers will: Serve warrants and transprt t residential treatment as needed. Prvide eligibility feedback during initial screening prcess. C. DUI COURT FACILITIES AND OPERATIONS The Putnam Cunty DUI curt will be cnvened every week, r when scheduled by the Judge, in the curtrms assigned t sitting Judge. Prir t each curt hearing, at which all team members and participants must be present, the DUI curt Team will staff all cases that will be befre the curt. Staffing cases includes review f each participant s prgress and cmpliance, and making recmmendatins and decisins regarding any actins that shuld be taken n each case. Administrative supprt and management will be prvided by the DUI curt Crdinatr. IV. ENTRY AND ASSESSMENT A. CAPACITY The DUI curt will have a maximum capacity f 100 participants in each Curt. B. 8 Participatin in DUI curt sputnam be permitted in the exclusive discretin f the Accuntability Curt Team, upn request f a charged defendant. The slicitr will give great weight t the wishes f victims and cnsider input frm law enfrcement. The DUI curt strives t assist in the rehabilitatin f ffenders wh psses high risk as well as high needs. In rder t be eligible t participate in DUI curt, the defendant must meet the fllwing criteria: The defendant suffers frm a substance abuse prblem r addictin needing treatment The defendant admits t having a substance abuse prblem r addictin, and wants treatment There is a cnnectin between the defendant s substance abuse and the current charges The defendant wuld likely re-ffend if nt treated fr substance abuse prblem C. REFERRAL AND APPLICATION PROCESS Referrals t the Accuntability Curt Prgram may cme frm several surces, including, Slicitr General, Putnam Cunty Sheriff s Office, Eatntn Plice Department r Prbatin. All Defendants referred t the Accuntability Curt Prgram will cmplete an Accuntability Curt Evaluatin and Assessment as directed with the Treatment Prvider. If the Defendant meets the basic criteria fr entry the case must then be apprved by the Slicitr General s Office. Befre apprval, the Defendant must cmplete a Clinical Evaluatin t determine apprpriateness fr treatment. If all team members apprve, the case is scheduled fr a plea and/r prbatin revcatin befre the Accuntability Curt Judge fr entry int the Accuntability Curt Prgram at the next available curt calendar. D. PROGRAM ENTRY After apprval f entry the Defendant will be scheduled fr a plea befre the assigned Accuntability Curt Judge at the next available Curt calendar. The Defendant alng with cunsel will sign the Acuntability Curt cntract and all waivers. A plea int the prgram cnstitutes a stipulatin t facts sufficient t supprt a cnvictin f the charges. The stipulatin als includes a waiver f his r her right t a speedy trial, his r her right t present evidence and cnfrnt witnesses, and his r her right t a jury trial. The participant will waive his/her right t cnfidentiality in relevant treatment recrds. The participant will begin treatment services immediately and attend grup sessins within 7 days upn entry int the prgram (r release frm custdy). The participant will be required t pay $110 per mnth fr drug screens and prbatin supervisin. V. PROGRAM COMPONENTS A. OVERVIEW The Accuntability Curt Prgram cnsists f intensive treatment, supervisin, drug testing, curt reprting and accuntability. All participants attend regularly scheduled treatment, supprt meetings and curt hearings. Additinally, participants underg regular drug testing. As participants remain prgrammatically cmpliant they prgress thrugh the phases f DUI curt. Vilatins (i.e. drug use, missed appintment) are immediately addressed with a sanctin. As participants prgress they are given incentives (certificates, less frequent curt/drug testing) t publicly recgnize and encurage their cntinued cmpliance. Successful cmpletin f all phases f the DUI curt leads t graduatin r a pssible reductin in fines and cmmunity service wrk. Chrnic vilatins, r majr vilatins may result in terminatin frm DUI curt, a cnvictin and sentencing n the underlying charges r revcatin f the prbated sentence. TREATMENT PHASES Outpatient treatment will usually cnsist f the fllwing phases, all f which must be cmpleted in rder t graduate: PHASE I: ACTIVE TREATMENT & EARLY RECOVERY (24 AA SESSIONS) Attend bi-weekly curt sessins Attend a minimum f tw (2) AA meetings and prvide verifiable dcumentatin Prvide a minimum f tw (2) randm drug screens per week Obtain an AA spnsr within days f entering the prgram Maintain an nging relatinship with a spnsr All fees kept current N sanctins within 30 days Cmplete and present a 2 page paper explaining yur struggles with addictin Cmplete the fllwing: Risk Reductin Prgram Alchl & Drug Evaluatin PHASE II: RELAPSE PREVENTION (64 AA SESSIONS & 60 SA HOURS) Cntinue all requirements f Phase I excluding drug screening, with the additin f: Prvide drug screens as recmmended by DUI curt team Cmplete Curt-rdered cmmunity service Cmplete Curt-rdered jail time Cmplete and present the fllwing nce apprved: Prmtinal Interview with Treatment Prvider in the presence f a persnal supprt grup (spuse, rmmate, etc ) PHASE III: CONTINUANCE OF AFTERCARE PROGRAM & GRADUATION (16 AA SESSIONS) DUI Curt attendance nce per mnth. Attend ne-and-a-half (1.5) hurs f weekly grup meetings Attend a minimum f tw (2) AA meetings and prvide verifiable dcumentatin Prvide at least ne (1) randm drug screen per week Cmplete and present the fllwing nce apprved: Final Presentatin Family / Exit Sessin with treatment prvider r prgram crdinatr Exit interview, as prvided by DUI curt Yu must be clean and sber fr a minimum f six mnths prir t graduatin. 10 Treatment may deviate frm utlined schedule based n participant s prgress, ASAM recmmendatins, and DUI curt mandates. Duratin f phases are nt mandated, time spent in each phase may alter based n the defendant s riginal sentence, participatin and cmpliance. Graduatin frm DUI curt will be determined when all treatment plan gals and legal requirements are met. C. REQUIRED ACTS DUI curt participants must cmply with all f the fllwing cnditins. Attend all treatment grups as directed and n time. Attend all Curt sessins as directed and n time. Attend and prvide verificatin f required AA/NA/CA meetings. And submit n time. Cmply with Treatment Plan. Submit t all drug screens as directed. Cmplete all written wrk in a timely manner. Participate apprpriately in all grup sessins. Remain law abiding. Remain drug and alchl free. Pay fees timely. D. PROHIBITED ACTS DUI curt participants will refrain frm cmmitting any f the fllwing acts. The participant will nt pssess, use, distribute, sell, r have under his r her cntrl any drug r drug paraphernalia, except as authrized by a lawful prescriptin and upn apprval by the DUI Curt Crdinatr. The participant will nt pssess r cnsume alchl. The participant will nt knwingly assciate with persns using r pssessing cntrlled substances except in the cntext f treatment. The participant will nt vilate any law, and understands that if he/she engages in any criminal act, he/she may be prsecuted fr any new charge and the new charge may be the basis fr his/her exclusin r expulsin frm the DUI curt Prgram. E. SANCTIONS AND REWARDS Sanctins will be impsed fr vilatins f the terms and cnditins f the DUI curt rder, and may include: Verbal Reprimand Written Assignment Cmmunity Service Bench Duty Additinal Jail time Revcatin f prbatin Terminatin Rewards may be given at the discretin f the DUI curt Judge t recgnize and encurage prgress f the participant. 11 F. DRUG SCREENING DUI curt participants are randmly tested fr drugs/alchl at a frequency determined by their Phase level. Drug testing is perfrmed by Judicial Alternatives f Gergia with the assistance f Redwd Txiclgy r any ther labratry designated by Judicial Alternatives f Gergia. 1. Sample Cllectin Prcedures The DUI curt will emply several techniques t minimize tampering and adulteratin. When a DUI curt participant is abut t submit a sample fr urinalysis, he/she must empty all pckets and shw the tester all pssible areas f hiding. The DUI curt participant must leave all bags in the custdy f the tester befre entering the bathrm. The bathrm has been cleared f all pssible cntaminates and tampering devices. A same-gender staff member will supervise drpping f specimens. The tester will enter the bathrm area with the DUI curt participant t ensure n tampering is evident. The bathrm is checked again fr pssible tampering. The specimen is then sealed by the tester and Defendant and set fr transprt. All prcedures are within view f the DUI curt participant s that accusatins f tampering cannt be charged t the tester. 2. Ntice f Randm Cllectin Randm Urinalysis Drug Testing is required f all participants. DUI curt participants submit t an bserved chain f custdy urinalysis test between the assigned testing hurs and lcatins. Judicial Alternatives f Gergia utilizes ne r mre f the fllwing - specific gravity, ph and creatinine values t check fr adulterants. Breathalyzer Tests may be administered in cnjunctin with drug screens. Results are btained within 72 hurs f prcessing. 3. Screening Test Results Urinalysis results and results f ther mnitring techniques will be dcumented and prvided t the DUI curt Team. Any psitive urine screens, tampered samples r refusal t prvide a sample can be grunds fr sanctins. Participants will be warned that certain substances can give false psitive tests, hwever, the participant is respnsible fr substances ingested. The participant handbk will cntain a list f substances t avid, hwever, the list is nt expected t be all inclusive and it will be the participant s respnsibility t verify substances with the Curt prir t ingestin. 4. Prescriptin Medicatins Participants in DUI curt are expected t be drug free, including the use f md-altering, ptentially addictive, prescriptin medicatins. Participants with chrnic pain requiring repeated use f prescriptin pain medicatin (piate, narctic r benzdiazepine medicatins) are nt gd candidates fr the prgram. Participants must discntinue all addictive medicatins. Participants wh have pted int DUI curt and have an acute pain episde must have apprval frm the DUI curt Team befre they take any pain medicatin. 5. Creatinine Every urine specimen is tested at the labratry fr creatinine level. Creatinine levels determine whether a participant has diluted a sample by, fr example, cnsuming large amunts f water. If the creatinine level is t lw t permit an accurate analysis, the sample will be treated as being psitive fr presence f prhibited substances. G. 12 The DUI curt DUI curt Treatment Prvider and Prbatin Officer are respnsible fr prviding primary case management and treatment services fr each participant while in DUI curt. Case management is a crdinated, cllabrative effrt t prvide linkages between the curt system and service prviders and/r agencies in an effrt t assist the participant and/r family with their needs and cmplete the prgram. DUI curt DUI curt Treatment Prvider and Curt Prbatin Officer prvide: Mnitring and reprting prgress f the participant in regards t treatment and ther prgram mandates t the curt Planning fr interventin services and the fulfillment f criminal justice bligatins Assisting the participant in identifying and wrking thrugh barriers t successful participatin in treatment Supprting the participant by advcating fr the participant with curt, treatment, scial service, medical and mental health systems H. STAFFINGS AND STATUS HEARINGS 1. Status Hearings Hearings will be held every ther Thursday fr DUI Curt as scheduled. Clients prgress will be reviewed by the judge. The judge administers apprpriate sanctins and rewards and prvides encuragement and supprt. Unexcused failure t appear at curt hearings may result in the issuance f a bench warrant. Effective January 1, 2015, DUI Pre-hearing staffing s will be held at 11 AM n Wednesday s biweekly. 2. Pre-Hearing Staffing The DUI curt team meets prir t each status hearing t review prgress f each participant, utside the presence f the participants. The Prbatin Officer and Treatment Prvider will prvide the Team prgress reprts n each participant wh will be present at that week s hearing. The prgress reprt infrms the team f the participants cmpliance in all DUI curt areas since the last hearing. Based n this reprt and any additinal infrmatin brught t the meeting, team members assess a participant s prgress and discuss ptential treatment r prgrammatic interventins. It is during these meetings that team members discuss, debate, and ptentially disagree with the directin f interventin and team decisins but during the curt sessin the team presents a unified psitin. Team discussins will be cnducted with a gal f reaching cnsensus n actin t be taken fr each participant. In the event that cnsensus f all team members cannt be achieved, the DUI curt Judge has discretin t determine what actin will be taken. Effective January 1, 2015, DUI Curt will be held at 1 PM n Wednesday s bi-weekly. I. FEES The Participant will be respnsible fr paying Accuntability Curt fees f $110 per mnth. The participant will als be respnsible fr paying all assessment/clinical fees, $95. J. GRADUATION REQUIREMENTS In rder t graduate, the DUI curt Team must authrize the participant s graduatin, and the participant must have met each f the fllwing criteria: 1. 13 2. The participant will have had n medium/majr vilatins fr the thirty (30) days prir t his r her scheduled graduatin date 3. The participants must be have maintained abstinence frm all drugs and alchl fr a dcumented minimum f six (6) cnsecutive mnths prir t graduatin 4. The participants must have cmpleted all sanctins invlving affirmative cnduct frm previus vilatins 5. The participants must be emplyed and have all DUI curt fees, and restitutin paid in full as directed by curt. K. TERMINATION PROCEDURES 1. Terminatin Terminatin results when the prgram can n lnger serve the needs f the client. Due t many factrs there are instances when cntinuatin is unprductive fr the client, the prgram, r bth. A participant may be invluntarily remved frm the DUI curt prgram if he/she repeatedly vilates the DUI curt rders, including psitive drug and/r alchl screens. A participant may be invluntarily remved frm the DUI curt prgram if there is prbable cause t believe he r she has cmmitted any felny ffense. A participant may be remved frm the DUI curt prgram if he/she cmmits a new ffense f any kind, and if, under the circumstances, it appears t the DUI curt team that the participant wuld nt benefit frm the services f the DUI curt prgram. Terminatin decisins are based n many factrs including, but nt limited t: current situatin/vilatin, length f time in prgram, number and level f treatment episdes, living situatins, attitude etc. If terminated, the participant s prbated sentence will be mdified r have a prbatin revcatin. Any DUI curt prbatin/treatment fees paid are frfeited, and nt credited twards any additinal legal financial bligatins impsed by the cnvictin. 2. Terminatin Hearing Prcedures The DUI curt Judge sputnam cnduct a prbatin revcatin hearing at the earliest pssible DUI curt hearing fllwing a decisin t remve a participant frm the DUI curt prgram. VI. REPORTING The DUI curt Crdinatr will prvide an annual reprt t the DUI curt team. The reprt shuld include DUI curt statistics, and a reprt n recidivism f all current and frmer DUI curt participants. VII. TRANSFER CASES Any DUI curt case frm any cunty can be transferred t and frm and ther DUI curt in the state f Gergia. With regard t accepting transfer cases, the evaluatin prcess will be the standard perating prcedure t ur wn cases. Attached is the 3 page transfer prcess that the accuntabilities curts in Gergia must fllw. When transferring a case t anther cunty, the crdinatr is respnsible fr sending bth transfer frms t aide establishing a chesive line f cmmunicatin with the participating cunty. All transfer prcesses will be at the respnsibility f the crdinatr t handle. All transfers must be cmplete with full jurisdictin t the receiving cunty. In the spirit f transferring cases, if a case seems t be a mre apprpriate fit fr a specialized accuntability curt utside f urs, it will be at the respnsibility f the crdinatr and the slicitr general t frmally assist in making said referral t the ptential receiving accuntability curt prgram.
