1 DRUG, ALCOHOL AND SUBSTANCE MISUSE POLICY FOR THE WORKPLACE Intrductin Write yur business name here recgnises that drug, alchl and substance misuse are grwing scial and medical prblems, which can lead t accidents at wrk, reduced efficiency, pr decisin making and lst prductivity. In rder t address these issues the Cmpany is cmmitted t having prcedures which: Minimise drugs, alchl and substance misuse related prblems in the wrkplace, thrugh prmting a sensible attitude t alchl and a greater awareness f the risks f taking ther drugs; Offer supprt and advice fr emplyees experiencing difficulties related t alchl r drug use. This plicy relates t instances where individuals have becme dependent upn alchl r drugs. It des nt apply t islated instances f miscnduct r absence frm wrk caused by the effects f excessive alchl r drugs. In this instance, miscnduct will be dealt with under the nrmal disciplinary rules. The bjective f this Plicy is t: Cmply with ur legal respnsibilities; Assist managers and supervisrs in dealing with substance misuse-related incidents in the wrkplace; Establish clear, easily-understd guidelines fr dealing with miscnduct, arising frm substance misuse; Demnstrate the rganisatin s cmmitment t staff health and safety; and Raise awareness amngst staff f the effects f drugs and alchl and the impact n themselves and the wrkplace f inapprpriate use. Hw t recgnise the prblem In mst cases it is the behaviur assciated with drug, alchl and substance misuse that will be evident t bth managers and clleagues. Listed belw are a number f indicatrs. It is essential t nte that these indicatrs culd equally apply t ther illnesses r stress. It is imprtant t thrughly examine each situatin befre acting. Pssible indicatrs f misuse Patterns f depressin r fatigue (ften after the weekend) Absenteeism shrt term / frequent patterns Pr timekeeping Erratic perfrmance Lack f discipline Unusual irritability r aggressin culminating in harassment Over-cnfidence Sudden md swings Inapprpriate behaviur Reduced respnse times Becming easily cnfused Reduced prductivity Deteriratin in relatinships with clleagues, custmers r management Financial irregularities Dishnesty and theft Remember: These are nly signs they can all be caused by ther factrs. The crnerstne f this plicy is the cmmitment t regard drug, alchl and substance misuse as a health and scial prblem, which may affect wrk perfrmance. The guidance aims t enable the individual t seek help in rder t maintain his/her perfrmance at wrk. The success f this guidance depends upn a jint cmmitment frm management and emplyees. 1

2 This plicy seeks t ensure that supprt and assistance is practively ffered t emplyees as apprpriate and available t thse seeking help. It is als recgnised that the alchl/drug prblems f a family member may impact upn emplyees wrk efficiency. This guidance prvides a backgrund f advice and assistance which managers shuld cnsider in any disciplinary hearings where alchl and/r drugs might be a cntributry factr t pr perfrmance r miscnduct. What shuld I d if I suspect an emplyee s wrk is being affected by drug, alchl r substance misuse? The fllwing pints will help by prviding a prcess fr dealing with the matter in an effective way: Deteriratin in perfrmance / cnduct identified: substance misuse suspected Manager must gather facts / evidence in preparatin fr a meeting with the emplyee and discuss with Persnnel Manager meets with the emplyee t discuss facts, dates, issues At the meeting manager determines whether the emplyee admits t having a prblem with substance misuse After the meeting, manager decides if he/she cntinues t believe that the emplyee s perfrmance / cnduct is being affected by substance misuse When pr wrk perfrmance is identified as being related t substance misuse it is imprtant t: Identify the prblem within its wrk cntext; Clearly explain the actin required f the emplyee t vercme this prblem; Offer supprt and, where apprpriate, access t cunselling r treatment; Emphasise that disciplinary prcedures may be suspended (depending n the seriusness f the incident) while the emplyee seeks assistance fr a prblem. Realistic timescales and utcmes will need t be agreed; Clearly explain that failure t fllw the agreed supprtive prgramme is likely t see a resumptin f disciplinary prcedure; Emphasise the cnsequences f nt fllwing the agreed supprtive prgramme and the likelihd f resumptin f the disciplinary prcedure. Emplyee referred t Occupatinal Health t determine any pssible underlying medical cnditin and t identify apprpriate supprt mechanisms. Persnnel / Occupatinal Health in cnjunctin with the emplyee / manager agree an actin plan, mnitring mechanisms and timeframe fr supprt. Infrm the emplyee that there is the expectatin that they will cmmit t a supprt prgramme where ne has been put in place. Make the individual aware that relapse culd result in disciplinary actin If n medical prblem identified r the emplyee des nt agree t a referral t Occupatinal Health, the Manager in cnsultatin with Persnnel will, cnsider the use f ther cmpany prcedures. If the emplyee is cmmitting an act f miscnduct, the frmal prcedures will apply. Where an emplyee s capability is in questin the cmpany s nrmal prcedures will be applied. N.B: as the Manager has been invlved in investigating the matter, it is likely any disciplinary / capability hearing will need t be heard by a mre senir Manager. Flw chart (appendix A) will help by prviding a framewrk / prcess fr dealing with the matter in an effective way. At all times it is vital t ensure that the matter is dealt with in a ttally cnfidential way. It shuld be handled in the same way as any ther health related cnditin. This kind f infrmatin is sensitive persnal data under the Data Prtectin Act and Human Rights Act and culd be retained n an individual s persnnel recrds etc. Als, cnjecture r gssip must be excluded frm fficial mems r individual persnnel recrds. If staff lack faith in the rganisatin s ability t mnitr cnfidentially the plicy will nt functin effectively. What are disciplinary issues? Disciplinary What cnstitutes a disciplinary issue? Sme examples are: 2

3 1. The use f drugs as defined by the Misuse f Drugs Act 1971 during the wrking day (except thse prescribed and ver-the-cunter medicatin. Many prescribed and ver-the-cunter medicatins can impair perfrmance. All staff have a respnsibility fr reading medicine advice given / supplied with their medicines and seeking medical advice where apprpriate); 2. Wrking under the influence f drugs, alchl r ther substance; 3. Being in pssessin f an illegal substance in the wrk place. Terminlgy Fr the purpses f this plicy, the term drug includes prescribed medicines, ver-the-cunter medicines, slvents and substances cntrlled under the Misuse f Drugs Act Rles and Respnsibilities The fllwing rles and respnsibilities will ensure that the guidance is implemented and applied equally t all staff. 1. Managers - T be familiar with this guidance, lcal resurces and services - T set a gd example thrugh their wn respnsible use f alchl - T be aware f the effects f drug, alchl and substance misuse and be alert t and mnitr changes in wrk perfrmance and attendance, sickness and accident patterns - T take apprpriate and early interventin where ptential alchl r drug misuse has been identified - T identify any aspects f the wrk situatin which culd cntribute t alchl r drug misuse and take actin t change them - T bserve strictest cnfidentiality as far as is practicable - T c-perate with evaluatin f this guidance - When rganising wrk r scial events, t pursue gd practice by ensuring that ample supplies f nn-alchlic drinks are available 2. Emplyees - T urge clleagues t seek help if they have a drug, alchl r ther substance misuse related prblem - T avid cvering up r clluding with clleagues - T seek help frm managers, Persnnel r an utside agency, if they are wrried abut their wn alchl r drug use - T use alchl respnsibly - T be aware that the cnsumptin f alchl r any substance prir t entering the wrkplace puts him/her at greater risk f accidents and a lss f efficiency - T ensure they are cnversant with disciplinary rules and this guidance - T avid the use f illegal substances r any substance which may affect their wrk r which might place them at risk f accidents, lss f efficiency r effectiveness Appendix A - A Framewrk fr dealing with an emplyee wh is suspected f substance misuse Appendix B- Backgrund infrmatin abut drugs and legislatin and als guidelines fr sensible drinking. 3
