The San Dieg Adult Prgrams, due t recent funding limitatins, are limiting the enrllment t felns nly at this time. The prgram includes frequent randm drug testing, judicial supervisin, drug treatment cunseling, educatinal and vcatinal training pprtunities, and the use f curtimpsed sanctins and incentives. The Judge is actively invlved in supervising drug curt participants, rather than placing defendants in unsupervised prbatin r diversin prgrams. Upn successful cmpletin f the criminal drug curt prgram, which is a minimum f 18 mnths, prbatin may be terminated, r in rare instances, based n the recmmendatin f the prsecutr, the drug charge may be dismissed. Accrding t the Natinal Assciatin f Drug Curt Prfessinals, as f Octber 2004, there were ver 1,600 Drug Curts thrughut the Cuntry in peratin r in the planning stages (includes Adult, Juvenile and Family Drug Curts). Each f the prgrams in San Dieg Cunty were designed using the guidelines f the Federal Office f Drug Curt Plicy. San Dieg Cunty Drug Curts include: Nrth Cunty Divisin Adult Drug Curt - implemented January, 1997; Central Divisin Adult Drug Curt - implemented March, 1997; East Cunty Divisin Adult Drug Curt - implemented August, 1997; Suth Cunty Divisin Adult Drug Curt - implemented Octber, 1997; and

The missin f the Adult Drug Curt Prgram is twfld: t imprve lives that have been impacted by drug addictin, and t increase public safety by reducing the amunt and frequency f drug related crimes. These gals are accmplished by assisting the participants in leading clean, sber, independent and prductive lives. The tls used t prvide this assistance are mandated treatment, rigrus curt supervisin, sanctins and the dedicatin f caring and knwledgeable cllabrative team members. 5. Hw is the Adult Drug Curt funded? San Dieg Superir Curt Adult Drug Curts perate with Federal and State grant mney. In additin, lcal law enfrcement agencies have cntributed drug asset frfeiture mney and Lcal Law Enfrcement Blck Grant funds. The effrts t btain federal, state and lcal funding are nw reginal in apprach. The Cunty, in cllabratin with the San Dieg Superir Curt, has applied fr and received funding fr Drug Curts including federal funding fr a cuntywide drug curt evaluatin and state funding thrugh the Califrnia Drug Curt Partnership Act and Cmprehensive Drug Curt Implementatin Act. Participants in the Adult Drug Curt prgrams must pay a minimal $20 fee each week t the prvider t aid in the therapeutic aspect as well as t help ff-set csts. 6. Wh is invlved in the Adult Drug Curt? The Drug Curt Team cnsists f the fllwing representatives: Superir Curt - Judge and supprt staff; District Attrney; Public Defender; State and lcal law enfrcement agencies; Case Management and Treatment Prviders. 7. Hw d Drug Curt Teams receive training? 3 Many f the grants that are available thrugh the federal gvernment require that the applicant allcate a prtin f their budget t training. This helps t ensure that the grantee is well infrmed n all f the current issues invlving Drug Curt, willing t attend technical assistance cnferences and is able t include the entire Drug Curt Team in the training prcess. 8. Why d we need Drug Curt? The cnnectin between drug addictin and crime has been well dcumented. The cycle f drug use and criminality cannt be brken under the traditinal criminal justice system, where thse arrested fr drugs remain either unexpsed t treatment r receive little supervisin r mnitring fr cmpliance while in treatment. This system is extremely expensive fr taxpayers and has been shwn t have a questinable impact n recidivism rates. 9. Are Vilent and/r Serius Offenders Eligible fr Drug Curt? San Dieg Superir Curt Adult Drug Curts exclude ffenders charged with vilent ffenses, sex crimes, manufacturing illegal substances and ther serius ffenses. Funding under the Crime Bill excludes participatin by any ffender that has been charged with a vilent ffense r wh has a prir cnvictin fr a vilent crime. 10. Are Drug Curts cst effective? While studies are n-ging, the Califrnia Drug and Alchl Treatment Assessment (CALDATA) estimated a cst f less than $8 per day fr utpatient treatment which cmpares t estimates f $86 per day assciated with jail time. The utpatient treatment prgrams utilized by Drug Curt are relatively inexpensive when cmpared t incarceratin csts. In additin, the savings t the cmmunity frm a reductin f prperty crime and reduced public health csts can be immense. Results f a study cnducted by the Administrative Office f the Curts and NPC Research cncluded that fr many agencies in San Dieg, their investment in drug curt is actually less than their investment in nn-drug curt prcesses. The mst recent results are frm a reprt f the Califrnia's Cmprehensive Drug Curt Implementatin Act (CDCI), which shwed that Adult Drug Curt participants wh cmpleted the CDCI Prgram averted a ttal f ver $34 millin in prisn days csts and the rati f prisn csts averted by participants, t the amunt invested was 1.53 t Are Drug Curts Anther "Sft-n-Crime" Preventin Prgram? Drug Curts acrss the cuntry rely n sanctins, including terms f incarceratin and increased drug testing and supervisin, t respnd t prgram failure. They prvide cmprehensive hands-n supervisin and mnitring and require far mre cntact with the judicial system than any ther case management apprach. In additin, the prgrams require participatin in drug testing, educatinal and rehabilitatin classes. Drug Curts are tugher n ffenders than traditinal prceedings; it is hard wrk getting and staying clean and sber. In cntrast t the limitatins impsed by Califrnia's Prpsitin 36, Drug Curt Judges have the discretin t rder shrt terms f incarceratin upn participants that are ut f cmpliance with the prgram. Successful Drug Curt Participants are quick t admit that these "wake up calls" in the jail have prven t be very effective in their verall recvery. 12. Are Drug Curts Effective in Reducing Recidivism?

4 A recent federally funded natinal study cnducted by the Urban Institute cncluded that 16% f drug curt participants were rearrested and charged with a serius ffense within 1 year f graduatin. The San Dieg Cunty District Attrney's Office researched San Dieg Cunty Adult Drug Curt recidivism and fund that: 14% have a new cnvictin within 1 year f cmpletin; 25% have a new cnvictin within 2 years f cmpletin and 29% have a new cnvictin within 3 years f cmpletin. 13. Hw ften des Drug Curt cnvene? Curt status hearings with the Drug Curt Team are held weekly. Participants appear befre the judge weekly, bi-weekly r mnthly, depending n which phase f the prgram they are in. A reprt f each participant's prgress is prepared and given t the judge prir t the hearing. The judge is ntified f psitive and negative urinalysis tests, and attendance at cunseling and educatinal classes. Any special circumstances cncerning the participant are included in the prgress reprt. The Curt may increase the frequency f drug testing, rder increased attendance r participatin in a residential prgram as a requirement t stay in the prgram, and may rder jail time as a sanctin. Terminating the defendant frm Drug Curt and sentencing them, is the final sanctin. 14. What is the Treatment Prgram? All fur Divisins f the Adult Drug Curt Prgrams utilize a single case manager/ treatment prvider, wh is under cntract t San Dieg Cunty Health and Human Services Agency. The Drug Curt Teams and treatment prviders have tgether designed drug interventin prgrams intended t prvide an early pprtunity fr treatment and a cst effective alternative t traditinal criminal case prcessing. The criteria fr prgram participatin has been established cperatively by the Curt, the Public Defender's Office, the District Attrney's Office, Cunty HHSA/Alchl & Drug Services and lcal law enfrcement agencies. Lcal law enfrcement fficers participate as Drug Curt Liaisn Officers t help supervise the prgram participants in the cmmunity. 15. What des Treatment entail? Treatment services may include: Grup therapy; Individual therapy; Case Management; Urinalysis drug testing (quantitative and immediate results); and Placement in detx, residential treatment, sber living and mental health prgrams as deemed apprpriate by the Drug Curt Teams and availability f resurces. Ancillary services may include: Jb training and Emplyment assistance; Educatin, such as G.E.D.; and Health referrals. Clients are respnsible fr their develpment and participatin in the treatment prcess. Regular status hearings are held with the Judge and Drug Curt Team. Status hearings

5 ffer the client encuragement fr cntinuing grwth. Sanctins are impsed fr relapses, use incidents, failures t attend treatment r testing and ther nn-cmpliant events. Clients successfully cmpleting the prgram will have brken the addictin cycle, fund and maintained emplyment, and becme active, prductive members f sciety. Chemical dependency is treated as a primary, chrnic, lifelng disease. Grup therapy, educatin, individual cunseling, and a cmmunity-based apprach are the basic tls ffered fr behaviral changes. Invlvement and participatin in 12-step self-help meetings such as Alchlics and/r Narctics Annymus, is stressed as a fundamental tl f lifelng recvery. 16. What happens at graduatin? Upn cmpletin f the minimum 18-mnth intensive prgram, the participant and their families and friends are invited t participate in a graduatin ceremny. The graduatin ceremny is a recgnitin f the participant's accmplishments. Each participant's arresting fficer is als invited t the graduatin. Depending n the legal status f the curt case, prbatin may be terminated r, in rare instances, based n the recmmendatin f the prsecutr, the criminal case may be dismissed upn cmpletin f this last phase; thereby aviding jail and/r prisn terms. Pst prgram activities include an alumni assciatin, aftercare plans and mentring prjects. 17.
