Center, Dr Ambedkar veedhi, Bangalore phone no : TENDER FOR ALLOTMENT OF 9 PLOTS (No.2,3 and 6 to 12) FOR TAKING UP ORNAMENTAL FISHERIES ACTIVITIES AT AQUAPARK, HESARAGHATTA Aquapark a centarlised production center for the production of ornamental fish is being established at Government Fish Seed Production Farm, Hesaraghatta, Bengaluru North taluk with all the advanced common facilities such as road, electricity, laboratory, quarantine facility, etc. required for the purpose. Sealed tenders are invited under Two Cover Bid System i.e. Technical Bid and Financial Bid from interested entrepreneurs (professional aquarists/hobbyists, self help groups fisher co-operative societies, unemployed fisheries graduates and other individuals having experience in the field of production and marketing of ornamental fishes) to undertake production and marketing of ornamental fish using the common facilities created. Twelve individual plots of approximately ½ acre each dimension have been developed for the purpose. It is proposed to lease out 9 plots (No.2,3 and 6 to 12) for a period of 15 years. 2. Tender document containing Eligibility criteria and Terms and Conditions can be either downloaded from website or may be obtained from this office by paying Rs. 2,000/- Interested entrepreneurs may submit sealed tenders to the undersigned latest by 30 / 0 1 / PM along with E.M.D. amount of Rs.25,000/- through Demand Draft in favour of DIRECTOR OF FISHERIES payable at Bangalore. Last date for receipt of tender 30 /01/2016 before 4.00 PM Date of opening of technical bids :02/02/2016 at AM If the last day of receipt of tender is declared as Holiday, then the next working day should be construed as last day for the receipt of the Tender. Time of receipt and opening of the tender remains the same or the date and time of the opening of the technical bid shall be intimated to all the tenders / bidders. 3.1 Submission of Bids: - Tenderer is requested to submit two separate bids, super scribing Technical Bid and Financial Bid in separate/ individual sealed cover as in Annexure 1 & 3 respectively. Both these envelopes and D.D of Rs. 25,000/- towards EMD are to be kept in a third bigger cover which should also be sealed and super scribed as TENDER FOR ALLOTMENT OF PLOT No. FOR TAKING UP OF ORNAMENTAL FISHERIES ACTIVITIES AT AQUAPARK, HESARAGHATTA. This third envelope should be dropped in the tender box placed in the DIRECTORATE OF FISHERIES, BANGALORE - 01, latest by 30/01/ PM. Only technical bids shall be opened first. All the envelops should bear the tenderers name and address and plot no Separate tenders shall be submitted for each Plot with separate EMD as mentioned in Annexure The Financial Bid of only those tenderers whose technical bid is accepted by the Technical Evaluation Committee shall be opened, on any subsequent day under intimation to the technically qualified tenderers. Each and every page of the tender must be serially numbered and duly signed by the tenderers. Please note that without EMD, Technical Bid shall not be opened/ considered. 4. 2 01.OBJECTIVES OF THE PROJECT: GOVERNMENT OF KARNATAKA Directorate of Fisheries 3rd Floor, Podium block, V.V. Center, Dr Ambedkar veedhi, Bangalore phone no : AQUAPARK is an initiative of the Department of Fisheries, Government of Karnataka with an aim to promote commercial production of freshwater ornamental fish, plants, inputs and other related activities under one roof concept. The initiative is broad based in terms of its specificity of activities and intends to harness the state s positional advantages of climatic conditions, abundant availability of several unexplored local fish varieties of ornamental values and growing markets in Bangalore and surrounding areas. The main objectives of establishing AQUAPARK are 1. To facilitate infrastructure development for the ornamental fish production 2. To encourage private entrepreneurs/professionals to take up ornamental fish production activities on commercial scale. 3. To complement investors by mainstreaming them to Government schemes/initiatives 4. To develop supportive guidelines/policies for ornamental aquaculture 2. LOCATION AND FEATURES OF THE PROJECT: The site is located at Hesaragatta which is at a distance of 24 kms from Bangalore city and 20 kms from Bangalore International Airport. Department of fisheries owns a functional fish seed production center at Hesaraghatta which is spread over an area of 13 acres, out of which 6 acres of vacant land is developed with all the basic infrastructure facilities such as Roads, supply of water, power, laboratory and quarantine facilities. AQUAPARK consists of 12 individual plots of approximate area of ½ acre each and out of these it is proposed to lease out 9 plots to the interested entrepreneurs on a long term lease through tender for a period of 15 years to take up ornamental fish production activities on commercial scale. 3. SCOPE OF THE PROJECT: It is now intended to select 9 private entrepreneurs who are interested in pursuing the production and marketing of ornamental fishes through a tender process. Selected entrepreneurs will be provided ready to use space of approximately ½ acre to set up units for production of ornamental fish and related inputs. Common facilities such as water, electricity, quarantine facilities, and conditioning and packing facilities will be available on user fee/service charge basis. Selected entrepreneurs can also utilize/obtain institutional support under ongoing NFDB, MPEDA and Government of Karnataka and Government of India schemes for establishment of units. Department of Fisheries, Government of Karnataka will facilitate entrepreneurs interested to establish satellite farms with the participation of fish farmers, self-help groups and fisher co-operative societies etc. 4. SELECTION CRITERIA: Entrepreneurs will be short listed based on assessment by Technical Evaluation Committee in accordance with the following criteria. The technical evaluation commits shall consist of Director of Fisheres, Joint Director of Fisheries(INL), Deputy Director of Fisheries Bangalore zone and senior asst Director of Fisheres, Aqua park, Hesaraghatta. 1. Experience in the field of ornamental fish production/marketing: The entrepreneur shall submit a certificate of experience if any in the field of ornamental fish production/breeding and marketing either from the Curators of Government Aquariums or from District Fisheries Officers. 2. Qualification: Unemployed fisheries graduates seeking allotment of plots in AQUAPARK shall have to submit an attested copy of B.F.Sc degree and an undertaking stating that they are unemployed fisheries graduates. Others shall submit a documentary proof of their qualification. 3

3 3. Entrepreneur s turnover/financial position: Registered firms/individuals may submit average annual turnover statement for the last 3 financial years duly attested by an auditor. Last three years IT returns duly attested by the Auditor to be enclosed. 4. Establishment of satellite farms: Entrepreneurs interested in establishing a satellite farm with the local farmers shall submit the details in the form of an undertaking. 5. Activities chart: Entrepreneurs shall invariably submit a detailed action plan of proposed activities to be taken up at AQUAPARK EVALUATION OF TECHNICAL BID: Every technical bid shall be evaluated according to the criteria hereinafter disclosed EVALUATION CRITERIA Sl No Particulars of the item of evaluation Description of evaluated item 1 Experience in the field of ornamental Fisheries Max. marks For every one year of experience in the field - 5 marks 20 2 Qualification Fisheries graduate -10 marks Non Fisheries graduates -5 marks Non graduates -3 marks 10 3 Average annual turnover/ Annual turnover - 5 marks (one lakh 1 mark) Financial position of applicant Financial arrangements 5 marks (for every 1 lakh bank balance /bank credit 1 mark) 10 4 Establishment of satellite farm For every one satellite farm proposed to be established with minimum participation of 5 farmers formed as a group - 5 marks 10 5 Activity chart a) Training undergone by applicant in the field of ornamental fisheries 10 marks b) Employment of trained personnel - 5 marks (One mark for each person) c) Adoption of Novel/improved methods of seed production/brood stock management -5 marks. d) Submission of Action plan document marks. e) Marketing network 10 marks. f) Production of inputs related to ornamental aquaculture: aquarium plants/tanks 5 marks. g) Aquarium fish feed 5 marks TOTAL 100 Qualifying marks shall be 30. Technical bids receiving 30 marks and above shall be eligible for opening the financial bid (Cover no. 2). The date and time for opening the financial bid of the technically qualified bidders will be intimated to the qualifying bidders only. 6.0 FIXATION OF ANNUAL RENT AND SECURITY DEPOSIT AMOUNT: The minimum lease amount for each plot is fixed at 6.5% per annum of the guidance value of the land prevailing in the area, where the land is situated with annual escalation of (10%) on the above lease rent. The guidance value taken into account is as determined by the 4

4 Government. Any subsequent change in the guidance value of the land will have no bearing on the agreement already signed. In addition to this the lessee will also have to pay 6.5% per annum of the investment made by the Government in developing the aqua park (land leveling and fencing of each plot). These two will form minimum lease amount fixed for each plot. The minimum lease amount thus calculated per sqmtr. and given in the Annexure 1.for the information of the bidders. 7.0 Norms for scrutinizing the Proposals The following norms will be adopted for scrutinizing the proposals: 1. The background including the technical and financial background and present networth of the entrepreneur. 2. Past experience in executing / managing / developing similar projects and size. 3. Highest offer of lease amount: In case of such situation, where only one bid has been received for a particular Plot, the minimum fixed lease amount as worked out has to be quoted. In the event of lesser amount being bid, the bid for the particular plot is treated as cancelled. 4. Earliest completion period - The civil works in the plots should be shown through a PERT chart. Generally the work should be completed within one year of the possession of the plot. 8.0 Bid Validity Period The approval for setting up of farm in the designated plot is valid for one year only. On expiry of one year it automatically stands cancelled, if not extended within the validity period. Extension would be considered only if effective steps for implementation were taken within this period. 9.0 Security Deposit : Bidder has to enter into separate MOU / Agreement with Department of Fisheries and have to provide Security Deposit (upfront) in the form of Bank guarantee/crossed DD favouring Director of Fisheries, Department of Fisheries Bangalore Drawn on any Nationalised / Scheduled bank for Rs lakh towards performance coverage on receipt of the confirmation of bid at the time of issuing the MOU / Agreement PRINCIPLES OF LEASE AGREEMENT 1. The Role of Department of Fisheries The role of Dept. of Fisheries would be limited to that of periodic inspection and access to relevant information to ensure compliance with the terms of the Agreement. The selected Bidder shall extend all cooperation to Dept. of Fisheries in this regard. 2. License to Develop, Operate and Transfer to Selected Bidder. Dept. of Fisheries would extend a License to Develop, Operate and Transfer the facility to the selected Bidder/ Entrepreneur for a period of 15 years (fifteen years) at an annual lease amount as stipulated in the Tender document and embedded in the License Agreement. Dept. of Fisheries at its option may extend the lease period beyond the period specified or renew the lease after specified lease period on fresh terms and conditions including lease amount payable to Dept. of Fisheries. 3. Sub-Contract Agreements The Selected Bidder / Enterpreneur would have no right to sublease the Plot, but will have complete flexibility in structuring the sub-contract arrangements for the development of the Plots and undertaking of civil works. 4. Approval of Uses The selected Bidder shall indicate the proposed uses of the facility in the approved Action Plan Document. The selected bidder shall adhere to these specified uses. 5

5 11. Selection Criteria: The Financial bid of the technically qualified bidders will be evaluated on the following terms. 1. Once the bidders are technically qualified against the plots, for which they have quoted, they are treated on an equal platform for that particular plot and the financial bid prevails. No weightage will be considered for a higher marked bidder under the technical qualification evaluation. The highest financial bidder among the qualified bidders for a plot will prevail over the other bidder. 2. The bidders attaining the qualifying criteria will be viewed in a single platform, except under the following conditions : i. The marks obtained above the qualifying marks stipulated by the bidder in the technical evaluation will have bearing on the financial bid if there is a tie ii. In the event of tie of a financial bid, between the qualified bidders then preference will be given to iii. the bidder, who has scored higher marks in the evaluation made under the technical bid. In the event of two or more bidders evaluated at the same marks under the technical evaluation and also a tie in the financial bid occurs then that particular plot s tender would be treated as cancelled for further process. 3. Each bidder is eligible to quote for one plot or more. In the event of a bidder quoting for more than one plot, the evaluation of such bidders will be carried out as under : The aim is to allocate the 9 plots to different bidders. If less than 9 participants were to bid then the participants will be evaluated primarily for one plot per bidder. However, as it is permitted for the bidders to quote for one or more plots, in the event of not getting 9 or more independent bidders, then the bidders who have quoted for more than one plot would be evaluated. If 9 plots put to tender does not receive different bidders, then the bidders who have been already evaluated and awarded with a plot and if they have participated for other plots, the bid would be evaluated as mentioned in the clause 11 (1) above 4. The financial bid quoted by the bidders should satisfy the minimum annual rent fixed for each of the plots. If the minimum annual rent is not satisfied then the bidder who have quoted lesser than the annual rent for each of the plot will be treated as null and void. 5. In line with the accepted principle of one plot for one bidder, it is found prudent to consider one bidder against one plot who has been qualified and has quoted the highest financial bid. In the eventuality, if the same bidder has quoted for another plot as per the accepted norms above, and has also quoted the highest financial bid for the other plot, his second bid would be treated as null if there is a primary bidder for the second plot quoted by the above bidder whose financial bid is above the minimum annual rent stipulated and below the quote of the second bidder, who has already been awarded with a plot. In such eventuality the primary bidder would be awarded with the plot, provided he agrees to pay the highest bid amount to the plot GENERAL CONDITIONS: 01.The plots shall normally be awarded to the highest evaluated tenderer fulfilling all the terms/ conditions of the tender. 02. Successful tenderer after receiving a allotment letter from Director of Fisheries, Bangalore,shall 1. Pay the quoted annual rent for the first year along with the security deposit amount of Rs 1.00 Lakh to the Director of Fisheries, Bangalore within one month from the date of receiving allotment letter. 2. Enter into an agreement with the Department of Fisheries on a stamp paper of Rs. 200 value purchased by him at his own cost and take possession of plot. 6

6 03. Failure to pay the security deposit and first year s rent amount will lead to cancellation of allotment order and forfeiture of EMD. In such a situation next highest tenderer in the process shall be considered for allotment of the plot, subject to the condition that the next highest tenderer agrees to pay the first tnederers bid amount. 04. The lessee shall pay the rent for subsequent years within the closure of the 1 st month of the next year, as specified by the Department of Fisheries. Failure to pay the rent shall lead to cancellation of lease agreement and forfeiture of security deposit. 05 Subletting/sublease of plots is not permitted. In case the subletting is observed, the lease agreement shall be canceled and security deposit forfeited. 06. The lessee under no circumstances shall become an owner of the land or plot allotted to him. He will remain as lessee only, till the completion of lease period. 07. The lessee shall complete the construction of civil works as per the plan approved by the Director of Fisheries within one years from the date of taking possession of plot, failing which lease agreement shall be canceled and security deposit forfeited. 08.The Department of Fisheries will ensure supply of water and electricity. The lessee shall regularly pay water and electricity usage charges to Department of Fisheries /BESCOM. 09. In course of time if Department of Fisheries requires the leased plots, a 6 months notice shall be served to the lessee and the land shall be reclaimed. In such an event the lease agreement shall be terminated and security deposit shall be refunded after adjusting towards damages if any. Similarly, the lessee can also discontinue with the project, by giving a six months notice to the Government and security deposit shall be refunded after adjusting towards damages if any. 10. After the completion of lease period or during the period of lease if the lessee wants to vacate the plot he is entitled to take away only the movable items which he has created or developed for the purpose during the course of lease period. The other immovable items/properties shall be transferred to the Department of Fisheries. 11. The Director of Fisheries shall not compensate the lessee for any loss of life or injury to the personnel or damage or loss of equipment or for any natural calamities. The lessee is expected to sufficiently insure all his belongings including personnel for any exigencies. 12. The Director of fisheries shall not accept any obligation on account of medical care, provident fund, pension or DCRG in respect of personnel appointed by the lessee on this project. 13. The responsibility of conforming to all acts, rules and executive orders made under the labour act, minimum wages act etc applicable to the place of work shall rest with the lessee. 14. Cartels/canvassing in any form at any stage up to the issuance of allotment letter shall disqualify the tenderer. 15. The lessee shall not carry out activities of breeding, propagation, transport and marketing of banned fish species in the allotted plots. 16. The Senior Assistant Director of Fisheries, Aqua park and Hesaraghatta Fish Seed Farm or his subordinate staff or any other person authorized by the Director of Fisheries is empowered to inspect the premises of lessee at any time. 7

7 17. The lessee shall ensure the cleanliness of premises and maintain the structures in good condition. He should also ensure that the water and surrounding environment do not get polluted and should take sufficient precautionary measures to prevent environmental pollution. 18. The lessee shall not carry any unlawful activities in the allotted plot other than the permitted activities. 19. The lessee shall obtain all statutory licenses required for construction and operation of unit from the concerned authorities at his own cost. 20. In the event of breach of any of the terms and conditions of the agreement the lease shall be canceled and the security deposit forfeited. 21. All correspondence between the tenderer and Department of Fisheries should take place through acknowledgeable means i.e., RPAD, Certificate of Posting by hand and branded/registered courier services. 22. All disputes arising out of allotment of plots and such matters including those related to interpretation of conditions shall be referred to a sole arbitrator. The Sole arbitrator is the Principal Secretary/Secretary of the Department of Animal Husbandry and Fisheries. The arbitrator's decisioon is final and binding on both parties. 23. The tender forms shall be filled in neatly and legibly in English/Kannada with a uniform single writing. Each page should be signed by the tenderer. All erasures or corrections shall be attested by the tenderer. Not doing so may render the tender liable for rejection. Supporting copies of any document if enclosed shall be self-attested by the tenderer. The Department of Fisheries may require the tenderer to produce all the supporting documents in original for verification at any specified date. 24. Conditional/incomplete tenders will not be accepted and will be summarily rejected without assigning any reason. 25. The Director of Fisheries reserves the right of accepting or rejecting a particular or all the tenders without assigning any reasons. 26. The tender is liable for rejection if any false or misleading information is furnished. If such falsification is detected after signing of the agreement it shall be liable to be terminated and security deposit forfeited. The tenderer shall be blacklisted and disqualified from participating in future tenders floated by the Department of Fisheries. 27. The tender documents will not be sent by post, and queries and correspondence through will not be entertained. 28. The successful bidder should be agreeable to be a member of the Ornamental Fish growing and marketing society to be formed for the proper functioning of the aqua park. 29. The lessee shall pay the stipulated lease rent within stipulated time, failing which 3 months notice shall be served and lease agreement canceled. Sd/- Director of Fisheries Bangalore 8
