Intrductin BCS, THE CHARTERED INSTITUTE FOR IT TRUSTEE BOARD REGULATIONS - SCHEDULE 3 CODE OF CONDUCT FOR BCS MEMBERS As a prfessinal bdy the British Cmputer Sciety (knwn as BCS, the Chartered Institute fr IT), has a respnsibility t set rules and prfessinal standards t direct the behaviur f its members in prfessinal matters. It is expected that these rules and prfessinal standards will be higher than thse established by the general law and that they will be enfrced thrugh disciplinary actin which can result in expulsin frm membership. Members are expected t exercise their wn judgement (which shuld be made in such a way as t be reasnably justified) t meet the requirements f the cde and seek advice if in dubt. Appendix 1 t the cde sets examples f interpretatin f the tenets f prfessinal cnduct and frm part f this Cde f Cnduct. Breaches f the Cde f Cnduct If a member f BCS shuld knw f, r becme aware f, any breach f this Cde f Cnduct by anther member they are under an bligatin t ntify BCS immediately. Breaches f the Cde f Cnduct may als be brught t the attentin f BCS by thers wh are nt members f BCS. Any breach f the Cde f Cnduct brught t the attentin f BCS, r f which BCS becmes aware, will be cnsidered under the Institute s Disciplinary prcedures. Where BCS receives infrmatin that a member has been cnvicted f a criminal ffence, the member, when asked will prvide a Standard Disclsure Certificate, r Certificate f Cnvictin r ther similar ntice prviding evidence f their criminal recrd (if any) within 28 days. Nte that nt all cnvictins are seen as relevant t membership in BCS and each case will be cnsidered individually. Prfessinal Cmpetence and Integrity Yu shall: a. nly undertake t d wrk r prvide a service that is within yur prfessinal cmpetence. b. NOT claim any level f cmpetence that yu d nt pssess. c. develp yur prfessinal knwledge, skills and cmpetence n a cntinuing basis, maintaining awareness f technlgical develpments, prcedures, and standards that are relevant t yur field. d. ensure that yu have the knwledge and understanding f Legislatin * and that yu cmply with such Legislatin, in carrying ut yur prfessinal respnsibilities. e. respect and value alternative viewpints and, seek, accept and ffer hnest criticisms f wrk. f. avid injuring thers, their prperty, reputatin, r emplyment by false r malicius r negligent actin r inactin. g. reject and will nt make any ffer f bribery r unethical inducement. 3. Duty t Relevant Authrity Yu shall: a. carry ut yur prfessinal respnsibilities with due care and diligence in accrdance with the Relevant Authrity s requirements whilst exercising yur prfessinal judgement at all times. b. seek t avid any situatin that may give rise t a cnflict f interest between yu and yur Relevant Authrity. c. accept prfessinal respnsibility fr yur wrk and fr the wrk f clleagues wh are defined in a given cntext as wrking under yur supervisin. Duty t the Prfessin Yu shall: a. accept yur persnal duty t uphld the reputatin f the prfessin and nt take any actin which culd bring the prfessin int disrepute. b. seek t imprve prfessinal standards thrugh participatin in their develpment, use and enfrcement. c. uphld the reputatin and gd standing f BCS, the Chartered Institute fr IT. d. act with integrity and respect in yur prfessinal relatinships with all members f BCS and with members f ther prfessins with whm yu wrk in a prfessinal capacity. e. ntify BCS if cnvicted f a criminal ffence r upn becming bankrupt r disqualified as a Cmpany Directr and in each case give details f the relevant jurisdictin. f. encurage and supprt fellw members in their prfessinal develpment. APPENDIX 1 Interpretatin f the BCS Cde f Cnduct The explanatry ntes belw are ffered fr guidance nly. The examples are nt, and nt intended t be, exhaustive. Definitins: Legislatin The term Legislatin means any applicable laws, statutes and regulatins. Third Parties The term Third Parties includes any persn r rganisatin that might be affected by yur activities in yur prfessinal capacity, irrespective f whether they are directly aware r invlved in thse activities. Relevant Authrity The term Relevant Authrity in this dcument is used t identify the persn(s) r rganisatin(s) which has/have authrity ver the activity f individuals in their prfessinal capacity. Fr practising BCS members this is nrmally an emplyer r client. Fr student members, this is nrmally an academic institutin. Public Interest Acting in the public interest may be gverned by Legislatin. Legitimate rights f third parties include prtecting persnal identifiable data t prevent unlawful disclsure and identity theft, and als respect fr cpyright, patents and ther intellectual prperty. Prfessinal Cmpetence and Integrity All members are required t undertake prfessinal develpment activities as a cnditin f membership. Cntinuing prfessinal develpment activities shuld braden yur knwledge f the IT prfessin and maintain yur cmpetence in yur area f specialism. Yu shuld seek ut and bserve gd practice exemplified by rules, standards, cnventins r prtcls that are relevant in yur area f specialism Yu shuld nly claim current cmpetence where yu can demnstrate yu have the required expertise e.g. thrugh recgnised cmpetencies, qualificatins r experience. Legislatin that may apply in carrying ut yur prfessinal respnsibilities might include that applicable t: yur Relevant Authrity. the gegraphic area in which yu are carrying ut yur prfessinal respnsibilities. the gegraphic area in which yur respnsibilities will be discharged. Yu may need t seek guidance frm yur Relevant Authrity. Where yu are leading a first f kind prject yu will ensure that yu make use f peer review and supprt where apprpriate. Duty t Relevant Authrity Exercising f yur prfessinal judgement: Where there is cnflict between full and cmmitted cmpliance with the Relevant Authrity s instructins and the independent and cnsidered exercise f yur prfessinal judgement, yu will indicate the likely risks and cnsequences. If any cnflict is likely t ccur r be seen by a third party as likely t ccur yu will make full and immediate disclsure t yur Relevant Authrity. If fr any reasn yu are unable t cmplete any assigned tasks in accrdance with their requirements (e.g. n time r within budget) yu will advise the Relevant Authrity as sn as practicable. Duty t the Prfessin As a member f BCS yu have a respnsibility t: share knwledge and understanding f IT and supprt inclusin f every sectr f sciety. encurage and supprt fellw members in their prfessinal develpment.
