STATEMENT OF SALE CONDITIONS Unless otherwise agreed (in writing), these sale conditions shall be applied to each FERPORT Electronic Sas contract of sale. Submitting an order will imply the completely acceptance of such conditions. Order confirmation The contract of sale shall be considered valid as soon as the Order Confirmation is received. Should the ordered goods be immediately available, the issue of the relevant invoice will completely replace such Order Confirmation. Carriage The delivery term shall be EX WORKS Monza (Italy) (Incoterms 2000 CCI) and unless otherwiseby Buyer, its shipping will be carried out by means of a carrier operating with FERPORT Electronic Sas. The relevant freight shall be debited into the invoice. Delivery date The delivery date indicated on the Order Confirmation shall be condidered purely as estimated; in case of delay with date, FERPORT Electronic Sas will not be liable for any kind of damage. In order to quickly meet the Buyer s requirements, FERPORT Electronic Sas reserves to split the orde fi lling. In the case, each shipment shall be separately invoiced according to the terms and conditions agreed for whole order. FERPORT Electronic Sas shall not be liable for any partial execution of an order and any lack of items does not allow he Buyer to carry out any payment deduction or stoppage. Claims and returns No Buyer s claim shall be accepted after eight days from the delivery of the goods. The replaced material shall be of FERPORT Electronic Sas own. The Buyer shall pay the labour costs. The Buyer shall not be entitled in any compensation for any plant outage. The repair/replacement time shall not extend the warranty period. It is understood that the warranty shall depend on the specifications of the products, being duly shown into their operating manuals. Warranty does not cover as follows Any carriage damage or average: any damage caused by any electric plant failures o negligence, a different use of the system as to its original purpose and any improper use as well. Any damage caused by a staff s tampering or any use nonoriginal spare parts. Any defect caused by chemical agents or atmospheric phenomenon. Any consumption material. Any call for supposed failures or convenient surveys.
