INTERNATIONAL CODEVELOPMENT INCENTIVE WITH SPCINE (SAO PAULO, BRAZIL) GUIDELINES 2016-2017
The Internatinal Cdevelpment Incentive with Spcine The Canada Media Fund s mandate includes encuraging the develpment (and eventual prductin) by Canadian prducers with internatinal cprducers f televisin r digital media cntent. As such, the CMF is renewing its Internatinal Cdevelpment Incentive with Spcine (the Incentive ) fr the 2016-2017 fiscal year. The current budget fr the Incentive is set at apprximately CDN$172,000 ($100,000 frm the CMF and $72,000 frm Spcine). Eligibility t the Incentive des nt guarantee the Applicant eligibility fr further CMF funding in develpment r in prductin. Fr the Canadian side f a prject, the Incentive will take the frm f a nn-repayable cntributin f up t 75% f the Canadian prtin f a prject s Eligible Csts 1, up t a per-prject maximum f CDN$50,000 if the prject is a Televisin Cmpnent and up t a per-prject maximum f CDN$25,000 if the prject is a Digital Media Cmpnent (web-based prjects r games). Fr the Brazilian side f a prject, the Incentive will take the frm f a repayable cntributin 2 up t 100% f the Brazilian prtin f a prject s Eligible Csts, up t a per-prject maximum f CDN$36,000 if the prject is a Televisin Cmpnent and up t a per-prject maximum f CDN$18,000 if the prject is a Digital Media Cmpnent (webbased prjects r games). Prjects will be evaluated and chsen by a cmmittee cmprised f representatives f the CMF and Spcine thrugh a selective prcess (using the Evaluatin Criteria listed belw). A reciprcity apprach will be adpted t ensure a fair balance between majrity and minrity prjects fr each cuntry. The Incentive may be cmbined with funding frm ther CMF funding Prgrams; it will be awarded separately and in additin t any amunts cntributed t the prject thrugh ther CMF Prgrams, and withut regard t Maximum Cntributin amunts applicable t thse Prgrams. In n case, hwever, will the CMF cntribute mre than 84% f the Canadian prtin f the financing f a prject frm any cmbinatin f CMF prgrams. Eligibility a) The prject must invlve at least ne Brazilian prducer eligible under Spcine criteria and ne Canadian prducer eligible under CMF criteria. b) The prject culd be assciated with either the CMF s Develpment Prgram in the Cnvergent Stream r develpment activity in the Experimental Stream. c) If the prject is defined as Cnvergent prject, it must be develped in ne f the fllwing eligible genres: dcumentary, children and yuth, drama (including animatin) and variety and perfrming arts (see sectin 3.2.TV.2 f the CMF s 2016-2017 Develpment Prgram Guidelines). There is n such requirement fr the prject defined as Experimental. d) If the prject is a televisin prject, it must cmply with the rules f Brazil-Canada Audivisual C-Prductin Agreement, signed n January 27, 1995. 1 Fr the definitin f Eligible Csts fr a Cnvergent prject, see sectin 2.3 and all f its subsectins in the 2016-2017 Develpment Prgram Guidelines. 2 The Brazilian cntributin will be a repayable cntributin ver the Brazilian share f the prject. Spcine will have the right, if the prject cmes t be perfrmed, in the initial way it was planned r in any ther audivisual frmat, t equitable interests f the prducer equity recupment (the PEC ) frm the date f the clsing f the applicatins t the public ntice until the end f the perid f 7 (seven) years, start cunting after the first exhibitin f the prject. 1
e) The prject includes an applicable develpment fee prvided by an eligible Canadian bradcaster fr the Canadian prtin f financing f the Televisin cmpnent. Requirement fr a Canadian bradcaster des nt apply t Digital Media Cmpnents unless these Cmpnents are part f a multiplatfrm apprach that includes a Televisin Cmpnent. The CMF requires a minimum develpment fee f 10% f the Canadian prtin f a Televisin Cmpnent s (and related Digital Media Cmpnents) Eligible Csts. f) Fr televisin prject, nly Canadian csts are allcated t the Canadian share f the budget. Fr digital media prject, 75% f the Canadian eligible csts are Canadian csts. g) The financing prvided by each cuntry is at least 20% f the glbal budget unless financing is prvided by a third cuntry, in which case the minimum and maximum financing amunts frm this third cuntry range frm 10% t 20% f the ttal budget. h) The wnership, financial cntrl and creative cntributins (based n key creative psitins) are t be determined in the c-develpment agreement between prducers. Hwever, the CMF and Spcine encurage that these elements be prprtinal t each party s funding cntributins. i) The Canadian Applicant meets all f the requirements f sectin 3.1 f the CMF s 2016-2017 Develpment Prgram Guidelines r applicable Develpment requirements in the Experimental Stream Guidelines. j) The prject meets all f the applicable requirements f sectin 3.2, and its subsectins, f the CMF s 2016-2017 Develpment Prgram Guidelines, with exceptins and amendments, if any, set in these Guidelines r applicable Develpment requirements in the Experimental Stream. k) The prject has nt received develpment funding frm the CMF in a prir CMF fiscal year. l) The prject is 100% financed at applicatin (including the Incentive and any ther CMF financing). m) The prducers must have entered int a cdevelpment agreement. In-huse prgramming (see sectin 2.1.1 f the CMF s 2016-2017 Develpment Prgram Guidelines) are ineligible t the Incentive. Bradcasters will have a windw f tw years after the cmpletin f the prject s develpment t enter int a licence agreement fr the prductin f the prject with the Applicants. Once this time perid has expired, the Applicants will be released frm their bligatins with the bradcasters. Prjects with bth Televisin and Digital Media Cmpnents must submit a cmbined applicatin in which Eligible Csts are presented in ne single budget. As applicable, sectin 1 f the CMF s 2016-2017 Develpment Prgram Guidelines and Experimental Stream Guidelines apply t applicatins fr the Incentive. 2
