3 Fee Refund Plicy as Prescribed under s. 25 t 33 f O.Reg. 415/06 Full refunds 25. (1) A private career cllege shall refund all f the fees paid by a student under a cntract fr the prvisin f a vcatinal prgram in the fllwing circumstances: 1. The cntract is rescinded by a persn within tw days f receiving a cpy f the cntract in accrdance with sectin 36 f the Act. 2. The private career cllege discntinues the vcatinal prgram befre the student cmpletes the prgram, subject t subsectin (2). 3. The private career cllege charges r cllects the fees, i. befre the registratin was issued fr the cllege under the Act r befre the vcatinal prgram was apprved by the Superintendent, r ii. befre entering int a cntract fr the prvisin f the vcatinal prgram with the student, unless the fee is cllected under subsectin 44 (3). 4. The private career cllege expels the student frm the cllege in a manner r fr reasns that are cntrary t the cllege s expulsin plicy. 5. The private career cllege emplys an instructr wh is nt qualified t teach all r part f the prgram under sectin The cntract is rendered vid under subsectin 18 (2) r under sectin If a private career cllege fails t, r des nt accurately, prvide in the itemized list prvided t the Superintendent under sectin 43 a fee item crrespnding t a fee paid by a student fr the prvisin f a vcatinal prgram, the cllege shall pay the student, i. in the case f an item nt prvided by the cllege, the full amunt f the fee fr the item, and ii. in the case f a fee in excess f the amunt f the fee prvided fr the item, the difference between the amunt f the fee fr the item prvided t the Superintendent and the fee cllected. (2) A full refund is nt payable in the circumstances described in paragraph 2 f subsectin (1) if the discntinuance f the vcatinal prgram cincides with the private career cllege ceasing t perate. (3) A refund is nt payable under paragraphs 1 t 6 f subsectin (1) unless the student gives the private career cllege a written demand fr the refund. (4) A refund under subsectin (1) is payable by the private career cllege within 30 days f the day the student delivers t the cllege, (a) in the case f a rescissin under sectin 36 f the Act, ntice f the rescissin; r (b) in the case f a refund under paragraphs 2 t 6 f subsectin (1), a written demand fr the refund. Partial refund where student des nt cmmence prgram 26. (1) If a student is admitted t a vcatinal prgram, pays fees t the private career cllege in respect f the prgram and subsequently des nt cmmence the prgram, the cllege shall refund part f the fees paid by the student in the fllwing circumstances:

4 1. The student gives the cllege ntice that he r she is withdrawing frm the prgram befre the day the vcatinal prgram cmmences. 2. In the case f a student wh is admitted t a vcatinal prgram n the cnditin that the student meet specified admissin requirements befre the day the prgram cmmences, the student fails t meet the requirements befre that day. 3. The student des nt attend the prgram during the first 14 days that fllw the day the prgram cmmenced and the cllege gives written ntice t the student that it is cancelling the cntract n later than 45 days after the day the prgram has cmmenced. (2) The amunt f a refund under subsectin (1) shall be an amunt that is equal t the full amunt paid by the student fr the vcatinal prgram, less an amunt equal t the lesser f 20 per cent f the full amunt f the fee and $500. (3) A refund under subsectin (1) is payable, (a) in the case f a refund under paragraph 1 f subsectin (1), within 30 days f the day the student gives ntice f withdrawing frm the prgram; (b) in the case f a refund under paragraph 2 f subsectin (1), within 30 days f the day the vcatinal prgram cmmences; and (c) in the case f a refund under paragraph 3 f subsectin (1), within 45 days f the day the vcatinal prgram cmmences. (4) Fr the purpses f paragraph 3 f subsectin (1), it is a cnditin f a cntract fr the prvisin f a vcatinal prgram that the private career cllege may cancel the cntract within 45 days f the day the vcatinal prgram cmmences if the persn wh entered the cntract with the cllege fails t attend the prgram during the 14 days that fllw the day the vcatinal prgram cmmences. (5) A private career cllege that wishes t cancel a cntract in accrdance with subsectin (4) shall give written ntice f the cancellatin t the ther party t the cntract within 45 days f the day the vcatinal prgram cmmences. Partial refunds: withdrawals and expulsins after prgram cmmenced 27. (1) A private career cllege shall give a student wh cmmences a vcatinal prgram a refund f part f the fees paid in respect f the prgram if, at a time during the prgram determined under subsectin (3), (a) the student withdraws frm the prgram after the prgram has cmmenced; r (b) the student is expelled frm the prgram in circumstances where the expulsin is permitted under the private career cllege s expulsin plicy. (2) This sectin des nt apply t vcatinal prgrams described in sectins 28 and 29. (3) A private career cllege shall pay a partial refund under this sectin nly if the withdrawal r expulsin frm the vcatinal prgram ccurs at a time during the prgram determined in accrdance with the fllwing rules: 1. In the case f a vcatinal prgram that is less than 12 mnths in duratin, the withdrawal r expulsin ccurs during the first half f the prgram. 2. In the case f a vcatinal prgram that is 12 mnths r mre in duratin,

5 i. fr the first 12 mnths in the duratin f the prgram and fr every subsequent full 12 mnths in the prgram, the withdrawal r expulsin ccurs during the first six mnths f that 12-mnth perid, and ii. fr any perid in the duratin f the vcatinal prgram remaining after the last 12-mnth perid referred t in subparagraph i has elapsed, the withdrawal r expulsin ccurs in the first half f the perid. (4) If the student withdraws r is expelled frm a vcatinal prgram within the first half f a perid referred t in subsectin (3), the amunt f the refund that the private career cllege shall pay the student shall be equal t the full amunt f the fees paid in respect f the prgram less, (a) an amunt that is equal t the lesser f 20 per cent f the full amunt f the fees in respect f the prgram and $500; and (b) the prtin f the fees in respect f the prtin f the perid that had elapsed at the time f the withdrawal r expulsin. (5) If the student withdraws r is expelled frm a vcatinal prgram during the secnd half f a perid referred t in subsectin (3), the private career cllege is nt required t pay the student any refund in respect f that perid. (6) A private career cllege shall refund the full amunt f fees paid in respect f a perid that had nt yet cmmenced at the time f the withdrawal r expulsin. Partial refunds: distance educatin prgrams 28. (1) This sectin applies t a vcatinal prgram that is ffered by mail, n the internet r by ther similar means. (2) A private career cllege shall give a student wh cmmences a vcatinal prgram referred t in subsectin (1) a refund f part f the fees paid in respect f the prgram if, (a) the student withdraws frm the prgram r the student is expelled frm the prgram in circumstances where the expulsin is permitted under the private career cllege s expulsin plicy; and (b) at the time f the withdrawal r expulsin, the student has nt submitted t the private career cllege all examinatins that are required in rder t cmplete the prgram. (3) The amunt f the refund that a private career cllege shall give a student under subsectin (1) shall be determined in accrdance with the fllwing rules: 1. Determine the ttal number f segments in the vcatinal prgram fr which an evaluatin is required. 2. Of the ttal number f prgram segments determined under paragraph 1, determine the number f segments in respect f which an evaluatin has been returned t the student. 3. The amunt f the refund that the private career cllege shall pay the student shall be equal t the full amunt f the fees paid in respect f the prgram less, i. an amunt that is equal t the lesser f 20 per cent f the full amunt f the fees in respect f the prgram and $500, and ii. the prtin f the fees in respect f the number f segments determined under paragraph 2. (4) A private career cllege is nt required t give a student any refund if the student, at the time f withdrawal r expulsin, has been evaluated in respect f mre than half f the ttal number f segments in the prgram.

6 Partial refunds: nn-cntinuus prgrams 29. (1) This sectin applies t a vcatinal prgram apprved by the Superintendent t be prvided thrugh a fixed number f hurs f instructin ver an indeterminate perid f time. (2) A private career cllege shall give a student wh cmmences a vcatinal prgram referred t in subsectin (1) a refund f part f the fees paid in respect f the prgram if, befre cmpleting the required number f hurs f instructin, (a) the student has given the cllege ntice that he r she is withdrawing frm the prgram; r (b) the student is expelled frm the prgram in circumstances where the expulsin is permitted under the private career cllege s expulsin plicy. (3) The amunt f the refund that a private career cllege shall give a student under subsectin (1) shall be equal t the full amunt f the fees paid in respect f the prgram less, (a) an amunt that is equal t the lesser f 20 per cent f the full amunt f the fees in respect f the prgram and $500; and (b) a prtin f the fees in respect f the prgram that is prprtinal t the number f hurs f instructin that have elapsed at the time f the withdrawal r expulsin. (4) A private career cllege is nt required t give a student any refund if the student, at the time f withdrawal r expulsin, has cmpleted mre than half f the required number f hurs f instructin in a prgram. N retentin f refund 30. A private career cllege shall nt retain, by way f deductin r set-ff, any refund f fees payable t a student under sectins 25 t 29 in rder t recver an amunt wed by the student in respect f any service r prgram ther than a vcatinal prgram ffered by the private career cllege. Treatment f bks and equipment 31. In calculating a refund under sectins 25 t 29, a private career cllege may retain the retail cst f bks r equipment that the private career cllege supplied t the student if the student, (a) fails t return the bks r equipment t the private career cllege within 10 days f the student s withdrawal r expulsin frm the prgram, r (b) returns the bks r equipment t the private career cllege within the 10-day perid referred t clause (a), but fails t return it unpened r in the same state it was in when supplied. Refund fr internatinal students 32. A ntice t a private career cllege that is prvided by r n behalf f an internatinal student r f a prspective internatinal student and that states that the student has nt been issued a temprary resident visa as a member f the student class under the Immigratin and Refugee Prtectin Act (Canada) is deemed t be, (a) ntice f a rescissin f the cntract fr the purpses f sectin 36 f the Act if the ntice is given within tw days f receiving a cpy f the cntract; and (b) ntice that the student is withdrawing frm the prgram fr the purpses f paragraph 1 f subsectin 26 (1) r clause 29 (2) (a) if the ntice is received n r befre half f the duratin f the prgram has elapsed. Currency 33. Any refund f fees that a private career cllege is required t pay under the Act shall be paid in Canadian dllars.
