The Councl may consder an tem not lsted on the agenda only f t s determned by a two-thrds (10) vote that the need for acton arose after the postng of an Agenda. Some tems on the agenda may be approved wthout any dscusson, however, any tem may be called "specal" by a Counclmember. If an tem s called "specal" t wll be "held" untl the remander of the tems on the Councl agenda have been acted on by the Councl. COUNCIL DISCUSSION AND TIME LIMITS - Counclmembers requestng to address the Councl wll be recognzed by the Councl Presdent n the order requested. For any tem, the Charperson of the Commttee, or the maker of the orgnal moton, or the member callng a matter "specal" shall have up to sx (6) mnutes to dscuss the tem. All other Counclmembers may speak up to three (3) mnutes each on the matter. After all members desrng to speak on a queston have had an opportunty to be heard once, the tme for each Member desrng to speak agan shall be lmted to a maxmum of three (3) mnutes. A moton callng the "prevous queston" may be ntroduced by any member durng a Councl debate. If adopted, ths moton wll termnate debate on a matter and the Char wll nstruct the Clerk to call the roll on the matter. VOTING AND DISPOSITION OF ITEMS - Most tems requre a majorty vote of the entre membershp of the Councl (8 members). Items whch have not been dscussed n a Councl Commttee and have been placed drectly on the agenda wll requre 10 votes to consder. Once consdered, these tems wll normally requre eght (8) affrmatve votes to be adopted. Ordnances requre a unanmous vote (at least 12 members must be present) n order to be adopted on frst consderaton. If an ordnance does not receve the necessary unanmous vote, t s lad over one calendar week. The votes requred for approval on second consderaton vary and depend upon the type of ordnance, but a typcal ordnance requres eght (8) affrmatve votes upon second consderaton. When debate on an tem s completed, the Char wll nstruct the Clerk to "call the roll". Every member present must vote for or aganst each tem; abstentons are not permtted. The Clerk wll announce the votes on each tem. Summary of Fndngs After revewng all of the responses to the vendor questonnare, three themes emerged, asde from typcal hardware and software mprovements: 1) cloud storage offerngs; 2) smartphones as body cameras; and 3) auto-actvaton. Frst, most vendors have ether mproved or ntroduced a cloud storage opton. The LAPD has requred cloud storage for ts dgtal evdence from the body cameras snce late 2014. Second, some vendors ntroduced new body cameras nto the marketplace after October 2015. The trend for these cameras s to utlze an exstng smartphone, upon whch software s added n order to turn the devce nto a "body camera." Ths s a relatvely new approach and has not been wdely adopted by most law enforcement agences. At ths tme, ths approach provdes no mprovement over the recommended Taser Internatonal, Inc. (Taser) soluton, and n fact, rases several concerns. Uchda, Ph.D. June 2016 Recent research on the use of body-worn cameras shows that wearng the cameras reduces the number of uses of force and the number of complants made by ctzens aganst the polce. Table 1 shows fndngs from the three most recent studes n the Unted States. Table 1. By reducng the number of uses of force and complants, there wll be a reducton n the amount of tme that t takes for nvestgators, supervsors, and command staff to nvestgate and conduct revews of these ncdents. In addton, for non-categorcal uses of force and for some cvlan complants, footage from the cameras wll enable supervsors to make decsons more quckly about stuatons and reduce the tme an nvestgaton s pendng. Anecdotally, n Newton and Msson Dvsons where cameras are currently beng used, the Captans and sergeants ndcated that n at least three nstances where cvlans made complants, they were able to revew the footage quckly and determne that the complants were unfounded. Rather than take a week to conduct an nvestgaton (ncludng ntervews, wrte-ups, and tme away from the street), the Captans were able to make decsons wthn a day. More mportantly, they were able to reach a frm decson n the adjudcaton of the complant ( unfounded or C demonstrably false ) rather than one that was undetermned ( not resolved ). Ths secton brefly examnes cost and tme savngs for complants, lawsuts, and uses of force. Complants Currently, about 2,200 personnel complants are fled aganst LAPD offcers annually. Usng conservatve estmates based on the research fndngs above, we assume that LAPD wll see a reducton n complants of 30% annually or about n=660. Based on an estmate of 40 hours for an nvestgaton, ths would equate to about 26,400 hours saved n sworn staff tme (660 X 40 = 26,400). The average fully-loaded-offcer-hourly rate s about $83. Thus, we antcpate a savngs of about $2,191,200 ($83 X 26,400) annually or about 12-15 offcers back on the street per year. Lawsuts Snce 2011 the cty and LAPD have pad out $65 M n settlements and jury verdcts for Cvl Rghts volatons and excessve/unlawful uses of force. Two major cases were recently settled, one case for $8 M and another for $15 M. In both nstances, vdeo footage may have asssted the Department n exoneratng the offcer or mtgatng the crcumstances of the cases. Lawsuts fled aganst the LAPD have ncreased each year snce 2014. To defend the cty and the Department, we estmate that t costs about $100,000 to $200,000 per case. Table 2 shows the year, number of lawsuts and estmated costs to defend the cases each year. Table 2. Second, f the evdence shows that the offcer acted napproprately, then the case could be settled earler and not nvolve extensve ltgaton. If 25 cases occur that exonerate the polce, then $2.5 M to $5 M wll be saved n defense costs alone. Uses of Force Table 3, below, shows the number of uses of force per year for 2000-2014. Usng the same logc and fgures from the cvlan complants, we calculate the number of hours saved and the dollars saved for a reducton of use of force. Based on a very conservatve estmate of 40 hours for a use of force nvestgaton, ths would equate to about 7,600 hours saved n sworn staff tme (190 X 40 = 7,600). The average fully-loaded-offcer-hourly rate s about $83. Ths equates to about $630,800 ($83 X 7,600) annually or 4-5 offcers dong other nvestgatons per year. Table 3.
