SECTION - I Request for Proposal (RFP) for Supply of Oracle e-business Suite Application User Software Licenses and Annual Technical Support. JSEB has already procured partial licenses details of the Oracle E-Business suite modules that JSEB is licensed for under the R-APDRP contract. JSEB is in the process of procuring additional Oracle e-business Suite Application User Software Licenses and Annual Technical Support as detailed in Annexure II. Proposals along with the following documents as mentioned below must be submitted in a non window sealed envelope super scribing "Proposal for Oracle e-business Suite Application User Software Licenses and Annual Technical Support. 1. The bidder should be an authorized partner of Oracle for supply of Oracle product Licenses - Certification from company s authorized signatory or relevant certificate copy from Oracle. 2. The bidder should be incorporated in India and operating for the past 3 years. - Copy of the Letter of Incorporation to be submitted. 3. The Bidder should have a positive net worth over the last three years Copy of Annual Report / balance sheet / supporting document. 4. Bidder must not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Govt. of India/ State Govt. Certification from company s authorized signatory 5. The Bidder must not have any record of poor performance, abandoned work, having been black listed by any state government or government of India, having inordinately delayed completion and having faced Commercial failures etc. Certification from company s authorized signatory 6. The Proposals submitted after due date and time will not be accepted. Please note that JSEB reserves the right to consider/reject any or all applications without assigning any reason thereof. 10. Annexure II Deliverables and Scope of work JSEB has already procured few oracle for R-APDRP applications licenses details of the Oracle E-Business suite modules that JSEB is licensed for under the R-APDRP contract: Oracle Asset Management Maintenance Management Along with the above modules, JSEB owns a shared install of the below ERP modules: Oracle Financial Management Oracle Inventory Management Oracle Purchasing JSEB wishes to extend the functionalities of the already procured Oracle E-Business suite modules to incorporate the functional scope mentioned like finance, HR, Inventory etc. The additional modules should be under the same Oracle E-Business suite platform or latest one. JSEB Intends to procure additional Oracle e-business suite modules licenses on top of the existing Oracle e-business suite licenses which it already owns. It is also required that the Oracle License supplying agency shall also have to provide the annual technical support for the supplied licenses. 1. Details of Oracle Product Licenses: The Oracle License as required is given below for ERP implementation in JSEB: Oracle e-business Suite Module Description Quantity Oracle Financials 150 Oracle Inventory 150 Oracle Human Resources 5000 Oracle Self-Service Human Resources 5000 Oracle Payroll 5000 2. Deliverables under Oracle License. a. Updates Subscription Services: The Updates Subscription Services should be provided to JSEB with rights to Oracle product upgrades, maintenance releases and patches released during the subscription period and distributed on CD Packs. b. Product Support: Oracle Product Support services to be offered to JSEB for direct access via both the telephone and the web to Oracle skilled staff of technical analysts for problem Page 6 of 14

resolution, bug reporting, and technical guidance on a 24 x 7 basis. This service should be provided through telephone, fax, e-mail and Oracle s Web Interface Metal ink directly. c. Standard tools for MIS must be including in supply, free of cost along with above modules licenses. d. All database, tools, complementary software s required for ERP solution modules. 3. JSEB should be provided with a 10 digit Customer Support Identifier (CSI) number from Oracle directly. JSEB should be in a position to access Oracle global support infrastructure for problem resolutions directly using CSI number. 4. JSEB should also be in a position to access Oracle Support Portal METALINK at http://metalink.oracle.com and log a Technical Assistance Request (TAR) or search the help index for known problem resolutions and bug fixes directly. 5. JSEB should get Latest versions by sending a mail to oracle.com email ids by mentioning the CSI number of JSEB and delivery address. The latest versions should be shipped to JSEB within 4 weeks of receiving JSEB s request. Vendor would be required to coordinate and provide the latest versions. However it is decision of JSEB to renew the licenses after one year based on successful performance. 6. Vendor should submit Oracle s licensing policy in detail for the renewal of Licensing after the completion of the license period. The vendor must indicate license renewal fees, if any in details. The financial evaluation shall be decided considering renewal fees also. 7. Transfer of licenses from one platform to other during License period as and when required by JSEB shall be acceptable to vendor without any financial implication. 8. Technical support manpower is to be provided by the vendor at the time of electronic downloading of the licenses from Oracle website. The resource provided should be able to install the licensed software as per BOM mentioned in this tender in the designated environment at. Data Centre, Ranchi, Deptt. Of Information Technology, JSEB, Ranchi within seven days of electronic downloading of the software. After installation, two man months of support shall be required to provide the overview and first level of training of the licensed software modules. Infrastructure required for training shall be organized by JSEB. Page 7 of 14

Annexure - III General Terms and Conditions 1. Period of License: The Oracle e business suite license offered by the bidder shall be on perpetual basis. JSEB shall not pay anything additional for the renewal of these licenses. Only technical ATS support shall be renewed by JSEB after the expiry of the one year ATS support, if so desired by JSEB. 2. Cost Details: The quoted Rate/Cost should be inclusive of all levies/ taxes like Service tax, Sales Tax, Transportation, Customs, Excise, VAT, traveling charges etc, if any. However all taxes shall be indicative separately in commercial bid format (Annexure-V) for financial evaluation. 3. Payment Terms: 90% payment after submitting the license certificate or getting a license delivery confirmation (through electronic download) from Oracle and rest 10% shall be released after the completion of manpower services as mentioned explicitly in this tender document. 4. Bid Validity: The bid should be valid for 90 days or finalization of bidder whichever is earlier. 5. JSEB Rights: JSEB reserve the right to accept or reject any quotation in full or part, and to suspend this process and reject all quotations or part at any time prior to the award of contract, without thereby incurring any liability to the affected vendors on the grounds of the purchaser s inaction. 6. Contact Person of Oracle India Ltd.: Vendor should provide Name, Address, E-mail address, dedicated telephone/ mobile/ FAX number of technical support tram at Oracle India Pvt. Ltd. Further, Vendor should also provide contact numbers of Oracle call center and Call escalation procedure and contact details. 7. Earnest Money Deposit (EMD): EMD of Rs. sixteen lakhs (16 lakh) in the form of DD/Pay Order/BG should be submitted with technical bid. 8. Penalty for Default in Services: If the vendor fails to deliver the items within stipulated time, JSEB will impose a penalty of 2% of the order value for the late delivered items for each weeks delay or part thereof, subject to maximum of 10% of value of the late delivered items. In case the delay exceeds five weeks, JSEB reserves the right to cancel the order and in such a case the earnest money deposit (EMD) received from the vendor shall be forfeited. Page 8 of 14

9. Licensing Policy Vendor is required to submit Oracle Licensing policy for the products, if any. 10. Indemnity: The vendor will indemnify JSEB against any claims due to vendor s violation of any patents and copy rights, in such a form as prescribed by JSEB. 11. Force Majeure: If the performance as specified in this order is prevented, restricted, delayed or interfered by reason of Fire, explosion, cyclone,floods, War, revolution, acts of public enemies, blockage or embargo, Any law, order, proclamation, ordinance, demand or requirements of any Government or authority or representative of any such Government including restrict trade practices or regulations, Strikes, shutdowns or labor disputes which are not instigated for the purpose of avoiding obligations herein, or Any other circumstances beyond the control of the party affected, then not withstanding anything here before contained, the party affected shall be excused from its performance to the extent such performance relates to prevention, restriction, delay or interference and provided the party so affected uses its best efforts to remove such cause of non performance and when removed the party shall continue performance with utmost dispatch. 11. Jurisdiction in court: This tender shall be construed and interpreted in accordance with and governed by the laws of India and the Courts at Ranchi, India shall have jurisdiction over all matters arising out of or relating to this Agreement. 13. Confidentiality: The Vendor shall keep information related to JSEB confidential and will not divulge to outside agencies without written consent from JSEB. 14. Contract performance guarantee (CPG)/performance security: As a Contract Performance Guarantee (CPG), the successful bidder is required to furnish Contract Performance Security (10 percent of the ATS portion of the order value) in favour of the JSEB within 15 days from the date of issue of Letter of Award in the form of a Bank Guarantee denominated in the currency of the contract as per specified Performa issued by any Nationalized Bank. The original bank guarantee against the CPG should be sent to JSEB directly under Regd. Post (A.D.) by the issuing bank. Where the original bank guarantee against CPG is handed over to the bidder by issuing bank, the bidder shall ensure sending of a duplicate copy of the bank guarantee by the issuing bank /branch under Regd. Post (A.D.) directly to the JSEB at the address mentioned in the Bid Document. This shall be valid till the end of ATS period. 15. Quantity variation: The quantity (nos.) of licenses for different modules is tentative and the number of Page 9 of 14

licenses shall be finalized with implementing agency. The numbers of licenses are indicative in tender document. The bidder cannot claim towards reduction in number of licenses in any module. Any additional number of licenses shall be delivered at the rate indicated in commercial bid (Annexure-V). 16. Evaluation Criteria: A) Minimum-qualification criteria are mandatory requirements to be met by the implementer / bidder to qualify for the opening of their Technical Bid. The pre-qualification evaluation of the bidder shall be done based on the information asked in Section I. In case the bidder does not adhere to even one of the pre qualification criteria mentioned in Section I, the bidder s bid will be rejected and will not be considered for further evaluation. Only those Bidders who qualify the Stage-I evaluation shall be considered for Stage-II evaluation. B) Technical Bid of the Bidder shall be opened and evaluated for acceptability of technofunctional requirements. The Technical evaluation criteria of the Bidder will be primarily done on the basis of information asked in Annexure 1-VII except V. C) Total Cost to Company (TCC) will be calculated based on response provided in Price Bid (refer Annexure -V). Price Bid evaluation will be done on total prices all inclusive of taxes, duties and levies. D) Proposals would be ranked according to their Bid price from lowest to highest. Company having lowest total bid price will be considered as a successful bidder However these scores are not binding on JSEB and its decision in selection of successful bidder is final and binding on all bidders.
