2 Notice Inviting Tender Sub: Tender for Installation, Commissioning and Maintenance of 10 Mbps ILL for Bihar Public Service Commission offices for a period of 3 years. 1. BSEDC Ltd. invites commercial bids from ISP agency Authorized under Unified License, DOT(GoI),for providing Internet service of 10 Mbps ILL for Bihar Public Service Commission offices for a period of three year. A self declaration shall be submitted with the proposal. 2. The agency shall provide the 10 Mbps Internet bandwidth (Last mile on Fiber Ring Topology) at the BPSC for a period of initially three (3) years and will be further extended, based on the requirement of commission on yearly basis, unless it will stand cancel on expiry of the contract or on written notice within 30 days. 3. Bidder needs to submit the refundable EMD of Rs. 15,000/- (fifteen thousand only) and a non-refundable Tender Fee of Rs. 1,000/- (One Thousand Only) in the form of a DD (Demand Draft) issued in favour of Managing Director, Bihar State Electronics Development Corporation Ltd, Payable at Patna, from any Nationalised Bank, must be enclosed in the envelope containing the financial bid. 4. Offer of financial bid should be written in English and price should be written clearly in both figures and words. In case of any discrepancy the value written in words will be considered as the final financial bid value. The offer should be typed or written in ink or ball pen; use of pencil will not be acceptable. 5. The bidders shall keep their bid valid for 60 days from the date of opening of the financial bid. 6. The successful bidder shall submit performance bank guarantee (PBG) within the 10 working days from the issuance of the LoI. The value of the PBG will be the 10% of the agreement value. 7. 3 2.0 INTRUCTIONS TO BIDDERS 2.1 Bid Submission: The Response (Bid Documents) to this tender document is to be submitted to:- Managing Director, BSEDC,Beltron Bhwan Shastri Nagar, Bailey Road, Patna,Bihar 2.2 Submission of Bid The Bidder needs to submit the Financial Bid document (Financial Proposal) in the given format in a sealed envelope, super scribing the Tender No & subject along with Financial Bid on the top of the envelop. 2.3 Bid Preparation cost: BSEDC will not be liable for any costs or expenses (directly or indirectly) incurred by bidders in connection with the preparation/ delivery/ submission of bids. 2.4 Acceptance of bids: BSEDC reserves the right to reject any bid and/ or to terminate the tendering process without giving any reason to anyone whatsoever at any point of time. 2.5 Implementation Period The bidder shall complete the installation and commissioning of the Internet Leased Line (ILL) at the BPSC offices within 1 Month of issuance of LoI. 2.6 Bid Evaluation The financial bid of bidders will be opened on the scheduled date and the tender will be awarded to the L1 (Lowest Price) Bidder 3. TERMS AND CONDITIONS 3.1 Contract Period This contract between BSEDC and Vendor shall be valid for a period of three (3) years from the date of issuance of commissioning. 4 3.2 Service The agency shall provide 98.5% (Minimum) uptime for Hub location on 24 x 7 x 365 basis. If the downtime is beyond committed uptime, on quarterly basis deduction shall be made as per below detail: Parameter Availability Penalty i.e. Deduction Availability of Internet Connection Within SLA i.e. 98.5% Between 96% to <98.5% Between 94% to <96% Between 92% to<94% Less than 92% Nil 1 % of the QGR 2% of the QGR 3 % of the QGR No Payment 3.3 Payments The ILL charges will be paid on quarterly basis(qgr), on receipt of invoice in triplet copy. Payments shall be made subject to deductions of any amount for which vendor is liable and deduction under late delivery and SLA monitoring. All payments shall be made subject to deduction of TDS (Tax deduction at Source) as per the Income-Tax Act, 1961 and any other taxes. Tax rates are not firm and shall be applicable at the time of billing. 3.4 Trouble Shooting Bidder shall respond with a solution within one working hour of reporting of a problem and restore satisfactory operation within four working hours. 3.5 Service Review Reports & S/W The bidder shall provide following reports on the WEB for reviewing service parameters for location a) Actual Bandwidth utilization b) Summary of usage weekly, monthly c) Monthly network bandwidth availability Bihar State Electronics Development Co.Ltd.,Patna Tender No. BSEDC/592/16 Dt Page 4 of 5

5 4. Commercial Format:- Sl. Description of Product & services 1 10 Mbps (1:1 last mile fiber ring topology) Internet leased line Connectivity for 3 Years on rental basis with router and all allied devices and accessories One Time Cost (OTC) Annual Recurring Cost of (1:1) 10Mbps Internet link in fiber ring (ARC) Service Tax Amount as applicable (@14.5%) Total (INR) Total Cost of Ownership for Three years (OTC + ARC) Amount In Word Force Majeure Neither party shall be responsible to the other for any delay or failure in performance of its obligations due to any occurrence commonly known as Force Majeure which is beyond the control of any of the parties, including, but without limited to, fire, flood, explosion, acts of God or any Governmental body, public disorder, riots, embargoes, or strikes, acts of military authority, epidemics, strikes, lockouts or other labour disputes, insurrections, civil commotion, war, enemy actions. If a Force Majeure arises, the Bidder shall promptly notify BSEDC in writing of such condition and the cause thereof. Unless otherwise directed by BSEDC, the Bidder shall continue to perform its obligations under this Agreement as far as is reasonably practical, and shall seek all reasonable alternative means for performance not prevented by the Force Majeure event 6. Aribtration Any and all disputes, controversies and conflicts ( Disputes ) arising out of this Agreement between the Parties or arising out of or relating to or in connection with this Agreement or the performance or non-performance of the rights and obligations set forth herein or the breach, termination, invalidity or interpretation shall resolve or settle amicable through mutual negotiation and discussions, if the dispute/disputes is not settled amicable then in that case it shall be finally decided by reference to Bihar Arbitration Tribunal in accordance with Bihar Public Works Contracts Dispute Arbitration Tribunal Act, 2008, Rules framed there under or procedure prescribed by the Bihar Arbitral Tribunal.
