Copies of the inspection reports are enclosed for your records. Please refer to the Summary of Findings sections of the attached inspection reports and provide a written response for each violation that was noted. This response should be mailed to the attention of the Water Division Inspection Branch at the address at the bottom of this letter or e- mailed to Water-Inspection-Report@adeq.state.ar.us. This response should contain documentation describing the course of action taken to correct each item noted. Sediment had left the construction site and was deposited on the street (Photos 1-5). This violates the Arkansas Water and Air Pollution Control Act - A.C.A (a)(2) which states, It shall be unlawful for any person to place or cause to be placed any sewage, industrial waste, or other wastes in a location where it is likely to cause pollution of any waters of this state. 2. The Stormwater Pollution Prevention Plan (SWPPP) did not match actual site conditions as required by Part II, Section A:3. of the permit. The SWPPP indicates a stabilized construction entrance will be used; however, a stabilized entrance has not been installed. This has resulted in the offsite tracking of sediment in violation of Part II, Section A:4.H.2. of the permit (Photos 1-6). 3. Site inspections were not being performed by the permittee every 7 days as indicated in the SWPPP. The last inspection by the permittee at the time of the March 28 th visit was from 17 days earlier on March 11 th. This violates Part II Section A.4.L. of the permit. Additionally, the inspections that had been performed by the permittee failed to indicate the need for a stabilized construction entrance. GENERAL COMMENTS Small <1 acre site located in Wildwood Phase III (ARR153885). Adjacent to 4852 Wildwood Ln. which is also operated by GSB Builders, LLC. and was inspected on these dates. I have met with the foundation sub, sewer sub, and material supplier. The foundation sub, Ronnie Hammett was instructed to ALWAYS put in a stabilized entrance. The sewer sub, Loren Hurst was instructed to clean up the street debris as it occurs. I believe the majority of the sediment was caused by lack of stabilized entrance coupled with a tremendous amount of rainfall. Not to mention delivery drivers that chose the easiest method of dropping materials to suit them. It was impossible to remove all of the debris due to the muddy lot. Both lots have been cleaned of any floatables, trash, and debris. At this point, a driveway should be installed within 2 weeks. I am afraid that installing a stabilized entrance will make the street sediment even worse. Over the past several weeks, my inspections have been frequent and on time.
