1 HERNANDO COUNTY APPLICATION PACKET RESIDENTIAL ROOFING PERMIT Intrductin This is an applicatin fr a building permit t replace a rf (Re-rf) r re-cver (re-shingle) a rf. All items listed in the Checklist must be submitted with yur cmpleted applicatin. Yur applicatin cannt be prcessed if any ne f the items listed is incmplete r missing. An applicatin fr any prpsed wrk becmes vid if nt picked up within 180 days. There is a nn-refundable administrative review fee t be paid at the time yur applicatin is submitted. This fee will be credited tward the cst f yur permit, if the applicatin is apprved. Many f the frms required t be submitted with this permit applicatin are required t be ntarized. Ntary services are available in ur ffice. Ntice f Cmmencement If the valuatin f the jb is greater than $2,500, a NOTICE OF COMMENCEMENT (NOC) must be recrded at the Hernand Cunty Recrding Office and psted n the jb site. A certified cpy f the recrded NOC must be submitted t the Building Services befre yur permit can be issued. Please read the imprtant infrmatin n the Cnstructin Lien Law included with this packet. Inspectins A list f required inspectins will be given t yu when yur permit is issued. It is the cntractr s (wner/builder s) respnsibility t ensure that all required inspectins are made prir t prceeding with wrk n prjects. Yu must call fr a final inspectin within ten (10) days f cmpletin f yur prject. Final inspectins that have been red tagged must be re-inspected within seven (7) days. All red tag fees must be paid prir t final inspectin. Upn issuance f yur permit, wrk must begin within 180 days. If wrk is nt begun within 180 days frm permit issuance, r wrk is suspended r abandned fr a perid f 180 days, yur permit will becme inactive and will be vid. Be advised that lack f apprved inspectin activity fr a 180-day perid is cnsidered suspensin r abandnment f the permitted wrk. Additinally, it is the cntractr r wner/builder=s respnsibility t ensure crrectins are made t items that have been red tagged, the red tags paid, and re-inspectins perfrmed and apprved prir t prceeding with wrk. Failure f the cntractrs r wner/builders t request and receive re-inspectins befre prceeding with additinal wrk may result in disciplinary actin r a fine against the cntractr r wner/builder. Permit Expiratin A valid permit may be extended past the 180 day time frame if an extensin is requested in writing and justifiable cause has been demnstrated. Additinal fees apply fr an extensin f the permit. Inactive permits must be reactivated befre wrk may cntinue under the permit. Additinal fees apply fr reactivating a permit. A building permit is nly valid fr a perid f 2 years frm date f issuance. Any permit nt finaled r vided within 2 years is expired. Cnstructin wrk nt cmpleted pursuant t an expired permit shall be re-permitted, and additinal fees will apply. 1

3 Flrida's Cnstructin Lien Law Prtect Yurself and Yur Investment Accrding t Flrida law, thse wh wrk n yur prperty r prvide materials, and are nt paid-in-full, have a right t enfrce their claim fr payment against yur prperty. This claim is knwn as a cnstructin lien. If yur cntractr fails t pay subcntractrs r material suppliers, the peple wh are wed mney may lk t yur prperty fr payment, even if yu have paid yur cntractr in full. This means that if a lien is filed against yur prperty, yur prperty culd be sld against yur will t pay fr labr, materials, r ther services which yur cntractr may have failed t pay. This dcument prvides infrmatin regarding Flrida Statute 713, Part 1, as it pertains t hme cnstructin and remdeling, and prvides tips n hw yu can avid cnstructin liens n yur prperty. Prtecting Yurself If yu hire a cntractr and the imprvements cst mre than $2,500, yu shuld knw the fllwing: Yu may be liable if yu pay yur cntractr and he then fails t pay his suppliers r cntractrs. There is a way t prtect yurself. A Release f Lien is a written statement that remves yur prperty frm the threat f lien. Befre yu make any payment, be sure yu receive this waiver frm suppliers and subcntractrs cvering the materials used and wrk perfrmed n yur prperty. Request frm the cntractr, via certified r registered mail, a list f all subcntractrs and suppliers wh have a cntract with the cntractr t prvide services r materials t yur prperty. If yur cntract calls fr partial payments befre the wrk is cmpleted, get a Partial Release f Lien cvering all wrkers and materials used t that pint. Befre yu make the last payment t yur cntractr, btain an affidavit frm yur cntractr that specifies all unpaid parties wh perfrmed labr, services r prvided services r materials t yur prperty. Make sure that yur cntractr prvides yu with final releases frm these parties befre yu make the final payment. Always file a Ntice f Cmmencement befre beginning a hme cnstructin r remdeling prject. The lcal authrity that issues building permits is required t prvide this frm. Yu must recrd the frm with the Clerk f the Circuit Curt in the cunty where the prperty being imprved is lcated. Als pst a certified cpy at the jb site. (In lieu f a certified cpy, yu may pst an affidavit stating that a Ntice f Cmmencement has been recrded. Attach a cpy f the Ntice f Cmmencement t the affidavit.) In additin, the building department is prhibited frm perfrming the first inspectin if the Ntice f Cmmencement is nt als filed with the building department. Yu can als supply a ntarized statement that the Ntice has been filed, with a cpy attached. The Ntice f Cmmencement ntes the intent t begin imprvements, the lcatin f the prperty, descriptin f the wrk and the amunt f bnd (if any). It als identifies the prperty wner, cntractr, surety, lender and ther pertinent infrmatin. Failure t recrd a Ntice f Cmmencement r incrrect infrmatin n the Ntice culd cntribute t yur having t pay twice fr the same wrk r materials. 3

4 Ntice T Owner Prir t filing a lien, a lienr wh des nt have a direct cntract with the wner, must serve the wner with a Ntice t Owner. The Ntice t Owner must state the lienr's name and address, and a descriptin f the real prperty and the nature f the services r materials being furnished. The Ntice t Owner must be served befre cmmencing, r within 45 days f cmmencing, t furnish the services r materials (but befre wner's final payment t the cntractr). A lien cannt be enfrced unless the lienr has served the Ntice t Owner as described abve. Whse Respnsibility is it T Get These Releases? Yu can stipulate in the agreement with yur cntractr that he must prvide all releases f lien. If it is nt a part f the cntract, hwever, r yu act as yur wn cntractr, YOU must get the releases. If yu brrw mney t pay fr the imprvements and the lender pays the cntractr(s) directly withut btaining releases, the lending institutin may be respnsible t yu fr any lss. What Can Happen If I Dn't Get Releases Of Lien? Yu will nt be able t sell yur prperty unless all utstanding liens are paid. Smetimes a landwner can even be frced t sell his prperty t satisfy a lien. Wh Can Claim A Lien On My Prperty? Cntractrs, labrers, materials suppliers, subcntractrs and prfessinals such as architects, landscape architects, interir designers, engineers r land surveyrs all have the right t file a claim f lien fr wrk r materials. Always require a release f lien frm anyne wh des wrk n yur hme. Cntesting A Lien A lien is valid fr ne year, unless a lienr files a lawsuit t enfrce the lien prir t the expiratin f the year. An wner has a right t file a Ntice f Cntest f Lien during the ne-year perid. Upn the filing f a Ntice f Cntest f Lien, a lienr must file a lawsuit t enfrce the lien within 60 days. Failure f the lienr t timely file a lawsuit renders the lien invalid. THE CONSTRUCTION LIEN LAW IS COMPLEX AND CANNOT BE COVERED COMPLETELY IN THIS DOCUMENT. If yu sell r lease a building yu have built yurself r substantially imprved yurself within ne (1) year after the cnstructin is cmplete, the law will presume that yu built, r substantially imprved it fr sale r lease, which is a vilatin f this exemptin. 11 PERMIT CARD INSTRUCTIONS The permit card must be displayed n street side f lt facing the street in a permanent, substantial shelter accessible t the inspectr. The permit card must remain displayed until all final Inspectins are cmpleted. N inspectins will be made unless an apprved set f plans is available at j b site fr the inspectins. Yur first inspectin must be made within 180 days f permit issuance date.
