89 BETAtrans Technical description Halogen free The halogens are the elements of the 7th group in the Periodic Table of Elements: chlorine (Cl), fluorine (F), bromine (Br), iodine (I). Halogen free cables are free of all these elements. They are called halogens because in reaction with bases they build salts. (hals: Greek for salt); chlorine reacts with sodium and builds table salt (NaCl). The halogens are an integrated component of many acids HCl = Salt acid (hydrochloric acid) HF = Hydrogenfluorid HBr = Hydrogenbromid The most popular plastic containing halogens is PVC (polyvinylchloride). In case of fire or at high temperature PVC starts to degradate. Hydrochloric acid and other fission products are generated and leads to extremely aggressive corrosion. Therefore the current trend is to replace the halogen containing plastics with halogen free ones. For instance PVC is currently being replaced at a large scale with polyolefin i.e. polyethylene. Thanks to halogen free cables the formation of corrosive and toxic gases can be prevented. Corrosive gases Corrosive active gases link with humidity and generate aggressive acids which attack metal parts, thus causing great subsequent damages, even if initial fire damage was small. These damages also do not regard directly the area affected by the event of fire. Most endangered are the electric contacts, electronic devices and apparatus, machines and metal constructions. Even the iron of the concrete reinforcement could be attacked by these acids. Toxic gases During combustion small amounts of toxic gases such as CO and CO2 are inevitably emitted. Combustion gases may not contain any halogen hydrogen compounds (HCl, HF, HBr) nor any strong toxic gases (Phosgene, HCN). The same applies to sulphur and nitric oxides. The toxicity of gases is defined by the so called mortality rates L50. The most relevant international standard hereto are: NES Part 3 (Naval Engineering Standard) The sum of all toxic elements in a material based on a mortality rate L50 after 30 min. impact. Rating by means of dimensionless index number (the lower the better). Typical permissible limit values shipbuilding 5 8 SBB < 5 BETAtrans < 1.2 and French standard NF C Burning of a material sample. No biological damage after 30 min. Flame retardant (self-extinguishing) Flame retardant cables are cables which, when installed as a single cable, although ignitable on exposure to flame source, will greatly reduce flame spread and self-extinguish once the flame source is removed. However in a vertical cable bundle, e.g. in vertical risers, fire can spread along the cables (chimney effect). In order to avoid this danger, the so called «non-flame propagating» cables should be used. Non flame propagating Non-flame propagating cables are those cables which can be ignited by a flame source, however they do not allow the fire to spread even if the cable bundle is placed vertically; they are self extinguishing once the fire source is removed. 87

90 BETAtrans Limiting Oxygen Index LOI LOI = Limiting Oxygen Index. According to ISO 4589 the LOI represents the minimum Oxygen concentration expressed in percentage of volume which in combination with azote (nitrogen) could still sustain the burning of the plastic. LOI 23 = combustible LOI = limited flame retardancy LOI = flame retardant LOI > 36 = especially flame retardant LOI ca. 45 = peak value at halogen free materials LOI = BETAtrans Smoke density The formation of combustion gases has several unpleasant consequences. On one hand it considerably lowers the visibility in a fire event, thus impeding the people trapped inside closed rooms to escape and the firemen to carry on their rescue and extinguish actions. On the other hand it produces smoke poisoning because of the carbon monoxide. Regarding the formation of the combustion gases the PVC comes off quite badly. This however, is not because of the PVC itself, as often wrongfully presumed, but because of the additives in its composition. Normally the softening additives in the PVC are the cause of considerable combustion gas formation. Infusible (VDE 0472 part 615) Electron beam cross-linking enable our heat-resistant cables to keep its mechanical properties and remain infusible, even at high temperatures (> 100 C). Cross linked materials do not drip and therefore guarantee a high operating safety and short-circuit security. Thermoplastic insulation materials Thermoplastics consist of filiform macromolecules which can exist in either an unorganised structure (amorphous) or in an organized structure (crystalline). The transition temperature of the amorphous phase (Tg = brittle temperature) limits its use in cold conditions, the transition temperature of the crystalline phase (Tm = melting temperature) limits its use in warm conditions. Above the melting temperature the crystalline phase disappears, the filiform molecules can move freely and the material begins to flow. The polymer can be given a thermoplastic processing. Cross-linked insulating materials Cross-linking binds together the filiform molecules by means of a linking (in the amorphous phase). This leads to a three-dimensional network. The filiform molecules can no longer move freely (irrespective of temperature). Above the melting temperature the material can no longer flow but it goes into a rubber-like elastic state. Advantages of cross-linked insulation materials: _ increased shear and compressive strength _ improved integrity in case of electrical failures (overload, short circuit) _ improved resistance to chemicals _ infusible, soldering iron resistance _ improved impact strength and crack resistance _ better weather- and abrasion-resistance Circuit Integrity The circuit integrity indicates how long a non-protected cable maintains its insulation properties, when exposed to fire under certain predefined conditions, without causing a short circuit. (As per IEC 60331: A cable is laid horizontally over a burner and kept for three hours at ca. 800 C. No short circuit may occur during this time). The circuit integrity is designated with FE (e.g. FE 180 = circuit integrity of 180 min.). Fire load Fire load is the quantity of energy which can be set free through combustion. The fire load of cables is calculated from the heat value and the quantity of inflammable materials used; this value forms a baseline for choosing the security measures to be applied (e.g. the measurement of sprinkler systems and the layout of cable trays). 88

91 BETAtrans Temperature index as per IEC / VDE 0304 part 21 The temperature index describes the long-term performance of plastics. The temperature index defines the ageing temperature (in C), at which the material still has an absolute elongation at break of 50% after hours. A rise in the temperature index of + 10 C results in approximately doubling the life span of the insulation. Requirement The material is considered to be halogen free if no green to blue-green flame discolouration occurs. The chlorine and the bromine would cause such a discolouration, however the existence of fluorine cannot be proven like that. Test standards IEC , EN Corrosivity of combustion gases 1000 mg insulation material is burned in a combustion furnace at 935 C with predefined air supply for over 30 minutes. By means of two gas washing containers, held in the airflow the conductivity and the ph-value are measured. Like that even small quantities of halogen containing substances can be detected and proven. The test is considered to be passed when the ph-value > 4,3 the conductivity < 10 μs/mm Test standards IEC , EN Smoke emission The density of smoke emission can be determined by measuring of the light penetrability. Cable samples are lit with alcohol in a test chamber (cubical with an edge length of 3 m). The so formed smoke is uniformly spread by a ventilator and influences the light measuring section The test is considered to be passed when the following light penetrability is reached level of danger requirement HL 1 HL 2 and HL 3 60% HL 4 70% Test standards IEC 61034, EN

94 BETAtrans Fire performance for single cable (flame retardant) This test procedure describes the minimum requirements for flame retardant cables and it is valid for lead wires or on single cables only. A lead wire or a cable is being aflamed with a propane-air-burner (1- kw- flame). Test duration: Ø 25 = 60 s Ø = 120 s Ø = 20 s Ø >75 = 480 s The burning cable should self-extinguish as soon as the fire source has been removed. The fire damage may not be higher than 60 cm. The test is considered to be passed if: The sample has not burned and the damage (carbonisation) has not reached any of the terminations of the sample (> 50 mm). Test standards IEC , EN Fire performance of a cable bundle (non-flame propagating) This test simulates the chimney effect in vertical cable installations. In a standardized cabinet the cable bundle is kept in a burner fire for minutes (gas burner 75±5 MJ/h). Thereby the temperature is kept constant to 750 C. Depending on the volume of the non-metal (combustible) materials per running meter it can be differentiated in the categories A F/R, A, B, C und D as follows: Category Liter (dm 3 ) of insulation material per 1 m sample aflame time (min) A F/R 7,0 40 A 7,0 40 B 3,5 40 C 1,5 20 D 0,5 20 The cables must self-extinguish after removing the fire source. The sample is fastened at 75 mm above the burner. The conductor is connected to a power source at nominal voltage, via an 2 A fuse. 96 BETAtrans General Terms and Conditions of Sale 1. Subject matter of the contract 1.1 For all orders (or commissioning of goods or services) placed with L&S Transportation Systems GmbH (hereinafter L&S ) only these Terms and Conditions apply. However, these Terms and Conditions are not valid for consumers according to 13 of the German Civil Code. 1.2 All ancillary agreements, reservations, amendments and/or supplements to any order and/or these Terms and Conditions must be made in writing in order to be valid including any such affecting this requirement of written form. 1.3 L&S here with rejects the buyer s Terms and Conditions. These do not apply given if not expressly rejected in any individual case. 1.4 These General Terms and Conditions of Sale also apply to allsubsequent and additional orders. 1.5 Should any contractual provision be or become nil and void for any reason whatsoever this shall not affect the remaining provisions of the contract. 1.6 The buyer may not assign nor pledge contractual rights without L&S s written consent. 2. Delivery 2.1 Call orders must be planned or called off within six months after completion of the contract or order confirmation from L&S unless otherwise agreed. After this period, or in the case that the buyer does not call off the goods and/or services as agreed within six months of ordering, and after a period of grace of two weeks has expired, L&S shall be entitled to either demand immediate acceptance and payment of the goods, or to cancel the contract, or to claim damages for non-performance of the contract. 2.2 Should L&S get to know any circumstances causing doubts about the buyer s creditworthiness after conclusion of the contract, L&S is entitled to either withdraw from the contract,to demand advance payment,or to supply only if a security has been provided. This also applies when debts due have not been paid despite demand for payment. ln the event of cancellation of the contract the buyer shall have no right to make any claims whatsoever for damages due to non-fulfilment of contract. 2.3 Delivery periods given indicate the approximate date of delivery ex works provided that all production requirement are satisfied, unless binding delivery dates have been agreed upon. L&S cannot accept any responsibility for particular transport times. 2.4 Prerequisites for adherence to agreed delivery periods are timely receipt of all documents to be supplied by the buyer, graming of all permits required and particularly release of plans, as well as adherence to payment conditions agreed upon, and compliance with other obligations by the buyer. Should these conditions not be satisfied in time the delivery periods are extended for a reasonable period; this does not apply if L&S is responsible for any such delay. 2.5 Should the buyer neglect to fulfil any contractual duty or obligation or not do so punctually (submission of technical drawings, data, ordering of material, etc.), the delivery period agreed upon originally shall be replaced by a new one L&S informs the buyer of once he has fulfilled his obligations or, if this is omitted, a suitably extended period. 2.6 If the delivery of goods and/or services is im peded by interruptions of L&S operations,or those of L&S s suppliers that could not be prevented although ordinary care was taken,or by industrial disputes, the delivery period is extended appropriately. Should these interruptions make the delivery of goods impossible, L&S s obligation to deliver is cancelled. In this case the buyer cannot claim for damages. 2.7 Should L&S be behind schedule in the fulfilment of contractual duties or obligations L&S is only liable for damages caused directly by default that are customary and foreseeable in this industry. If L&S does not act deliberately or grossly negligent L&S is lia ble only up to the value of the respective individual order. Liability for standstill of assembly lines, lost profit and all indirect damages caused by defaults, as well as all other consequential damages and damages to property is excluded except in the case of intent or gross negligence. 2.8 Should the buyer be in default of acceptance, L&S is entitled to charge the storage costs incurred beginning one month after advice of the goods being ready for dispatch.these costs will be at least 0.5% of the total invoice amount for each month or part thereof up to a maximum of 5% of the price agreed upon for the goods the buyer is in default with.the buyer may, however,submit proof of lesser damage. L&S reserves the right to prove a higher damage. 2.9 All measures necessary to import the products that are the subject matter of the contract into the buyer s country, such as obtaining import licenses and currency authorizations, have to be taken in good time by the buyer. Should the buyer become aware of circumstances impeding the import L&S is to be advised without delay. Should obtaining the required import documents be questionable L&S shall be entitled to withdraw from the contract after a period of grace of another two weeks has expired For shipments to EU nations the buyer is obliged to inform L&S of his/her VAT ID number upon placing the order. Should the buyer fall to do so, or disclose an incorrect number, L&S shall be entitled to claim damages.the same applies if the buyer falls to make the required confirmation on shipment and final destination for deliveries ex works available to L&S. The objection of contributory fault is excluded. In particular, L&S has no obligation to check the accuracy of any VAT ID number disclosed, or have such numbers checked In the case of goods sold by the meter L&S may deviate from the quantity ordered by +/ 10% if this has not been expressly excluded. The buyer has to accept customary standard variations in size. Partial shipments shall be possible any time. 94

97 3. Prices and payment 3.1 All prices are based on the cost situation at the time when the order is placed. Should the goods ordered be supplied within 4 months after the order was placed and should material costs,wages and salaries and/or other costs rise in this period, L&S shall be entitled to demand an appropriate surcharge for this increase in costs based on the original cost calculation. 3.2 Unless otherwise agreed all packaging and shipment costs shall be borne by the buyer. 3.3 Empties such as reels, drums and barrels in particular remain L&S property and are let to the buyer in form of a pledge. The full value of the empties is invoiced as pledge. Upon return of the empties in good, clean and re-useable condition without any material residues the invoiced amount will be reimbursed completely. 3.4 Empties are to be returned to the L&S works that shipped the products at the buyer s risk and expense. In the event of damage to empties for which the buyer is responsible, L&S shall be entitled to set off the sum retained as pledge against the repair cost. The same applies to cleaning costs if cleaning is necessary. lf the empties are unusable due to damage, L&S is entitled to completely reta in the pledged sum. This also applies if according to L&S s discretion repalring the damaged empties is economically no longer efficient. 3.5 Empties have to be returned at the latest within 6 months from date of invoice. When this period and another period of grace of two weeks have expired, L&S is entitled to invoice the value of the empties. L&Sshall then be entitled to set off the pledged sum against the invoiced value of the empties. L&S does not take back non-returnable packages. 3.6 Tooling costs will be invoiced separately without the buyer acquiring any title in or right to these tools. 3.7 Promises to gram cash discounts are made with the reservation that no debts are due. Bills of exchange will only be accepted by L&S by prior agreement and on account of performance. All expenses are borne by the buyer. 3.8 The buyer may only set off or withhold payment on the basis of counterclaims that have been recognised by L&S or by declaratory judgement. 3.9 Unless otherwise agreed in writing credit and reimbursement are made without acknowledgement of fault or legal obligation of performance. 4. Shipment conditions 4.1 Unless otherwise agreed the riskalways passes to the buyer when the products leave the plant or are advised to the buyer as ready for shipment. L&S will take out an insurance policy upon request and at the buyer s expense. 4.2 Choice of means of transport and shipment route is at L&S s discretion without guarantee that means and route chosen are the cheapest possible ones. Should the buyer insist on a different carriage of goods, additional costs will be borne by him. 4.3 Shipments will only be ma de on a CIF or C+F basis if the value of the goods exceeds 5,000 per shipment Shipment will only be insured against shipping damage at the buyer s request and expense except when CIF shipment has been agreed. 4.4 Shipments with an invoiced value of goods below 5,000 will be processed FOB German port This also applies to partial shipments if these are agreed upon with the buyer. Shipments with a weight of less than 50 kgs will be sent only ex works regardless of their invoiced value. 4.5 L&S reserves the right to invoice surcharges on shipment and insurance costs agreed upon in the case of unforeseen events such as e. g. danger of war, outbreak of armed conflicts, closure of shipping routes, and other cases of force majeure. 5. Reservation of title 5.1 The goods remain L&S s property until all current and future claims arising from the mutual commercial relationship have been completelysatisfied. The buyer has the obligation to store the goods separately. Reservation of title includes the accepted balance of account as far as L&S is posting debts of the buyer to current account (current account reservation). 5.2 The buyer will handle or process the goods for L&S without liabilitiesaccruing from this for L&S. Any co-owner s share of the buyer accruing from mixing or combining with other goods is assigned to L&S in advance on acceptance of any goods in which title is retained. The buyer stores the products and/or groups of asset on L&S s behalf. 5.3 The buyer maysell any goods in which title is retained and those resulting from their ha ndling and/or processing only subject to reservation of title and may not impair L&S s retention rights by any disposition as for example assignment as security or pledging. 5.4 L&S must be notified in writing and without delay of any actual or legal attachment by third parties affecting any goods in which title is retained as well as of their damage or loss. 5.5 The buyer assigns all claims from sale or any other legal reason which affect any goods in which title is retained to L&S in advance.should such goods be sold together with others not belonging to L&S or become part of any delivery then said assignment only applies in the amount of the invoice value of the goods subject to retention of title. Upon request the buyer must inform the debtor of such an assignment. 5.6 Should the value of these securities exceed L&S s claims by more than 20%, L&S will release securities at it own choice upon the buyer s request. 6. Default in payment 6.1 The buyer is in default should payment not be effected as agreed within 14 days on receipt of invoice. 6.2 Should the buyer be in default of payment,all existing L&S receivables become due in cash immediately regardless of bills of exchange having been accepted or credit terms having been granted. The buyer may no longer sell any goods which are fully orjointly owned by L&S and is obliged to provide security. The authorization to collect debts assigned to L&S expires. 95

98 6.3 The same a pplies if there is reasonable doubt regarding the buyer s creditworthiness. 6.4 The buyer gram L&S a right of lien affecting all materials assigned to execute the order and the claims superseding these to secure all current and future claims accruing from the mutual commercial relationship. Should the buyer fall to pay on due date or suffer loss of credit L&S is entitled to enforce the pledge by selling it in the open market at the price quoted on the London Metal Exchange or, if not listed there, at the average German market price on the date the buyer fa iled to pay or lost credit. 7. Claims based on defects 7.1 The buyer has to inspect the goods immediately upon receipt. Claims based on an apparent defect may only be asserted by the buyer within 2 weeks and on a latent defect within 3 months of receipt of goods. In the case of deliveries according to sample, claims based on defects are excluded even for latent defects if the goods supplied comply with the sample. Should any defect be caused by material supplied by the buyer, any claim based on defects is cancelled. 7.2 All claims based on defects require that L&S is notified immediately in writing or electronically upon detection of the defect and before processing or handling of the goods in question,and that a sample of the goods objected to is sent to L&S. Shipping damage is to be noted on the bill of lading and delivery note and to be confirmed by the driver with his/her signature. 7.3 Upon existence ofa defect as to quality or title within the Limitation period of the defect as stated below in item 75, L&S can either put the goods into the condition conforming to the contractor supply a substitute at the agreed place of delivery free of charge against return of the defective goods. Property of the replaced goods passes to L&S. After three unsuccessful attempts of rectification ofa defect or substitute delivery, the buyer shall be entitled to claim price reduction or withdraw from the contract. Further claims, in particular for compensation of consequential da ma ges, are excluded unless any act of intent or gross negligence on the part of L&S owners, executive officers or servants applies, someone s life, body or health has been injured, an important contractual duty (cardinal duty) has been violated, imperative lia bility under German Product Liability Act applies, or L&S has given a conditions or durability guarantee as defined by 443 German Civil Code. 7.4 To the extent L&S has given a conditions or durability guarantee ( 443 German Ovil Code) possible damage claims shall be limited to a typical and foreseeable damage and at the most to the value (excluding VAT) of the individual order the defective product forms part of. 7.5 With expiry of the Imitation period of the defect of 12 months from receipt of goods, the buyer s right to make claims based on defects becom es statute-barred. 8. Industrial property rights Should industrial property rights of third parties be violated by deliveries based on technical drawings or other data from the buyer, then the buyer is obligated to exempt L&S from any claim. 9. Places of performance and jurisdiction 9.1 Place of performance for all obligations arising from the mutual commercial relationship is the registered office of L&S 9.2 Place of jurisdiction for all disputes arising from any provisions herein or on the making and validity of this contract including actions arising from bills of exchange or cheques is either the registered office of L&S or the court of the national capital in which the buyer s office is registered. 9.3 L&S is entitled to assert all claims against the buyer not onlyat a normal court of law but also at a competent court of arbitration in the place ofjurisdiction following the ICC Conciliation and Arbitration Rules. 10. Applicable Iaw Only German law is applicable. Application of the UN Convention on the International Sale of Goods (CISG) dated 11 April 1980 is excluded.
