3 CUIRK CLARK WARRANTY CLARK warrants each new Construction Machinery Group product, including attachments and accessories thereto, sold by it to be merchantable and free from defects in material and workmanship. CLARK will cause any part of a CLARK product covered by this warranty (except as excluded below) which proves to be defective in material or workmanship during six (6) months immediately following the delivery of said product to the person who first puts it into use, to be replaced without charge with a new or repaired part (whichever CLARK elects). CLARK also will cause the labor to remove any such defective part and to install the new or repaired part to be provided without charge to the owner of said CLARK product. The parts and labor to meet this warranty will be furnished by a CLARK distributor designated by CLARK. CLARK also warrants each replacement part for the products covered by this warranty sold by it to be merchantable and free from defects in material and workmanship. CLARK will cause any such replacement part which proves to be defective during the first six (6) months following its installation in a CLARK product to be replaced, without charge, with a new or repaired part (whichever CLARK elects). CLARK'S warranty does not cover: (i) the replacement of parts found to have been damaged by abuse, accident or a failure to maintain or use the CLARK product or part according to the instructions applicable to it, (ii) the labor to remove and reinstall a defective replacement part after the expiration of the warranty period applicable to the product in which such part is located, (iii) overtime labor premiums, (iv) transportation of the CLARK product to the distributor's service facility or transportation of the distributor's service men to the product's location, (v) the engine or the tires of any CLARK product, nor does it cover the carrier on any truck mounted hydraulic cranes. The warranty of the respective manufacturers of these components shall apply to said items unless said manufacturers make no warranty with respect to said items, in which event CLARK'S warranty shall apply. The Buyer accepts this warranty and the limitations of liability and disclaimers set forth herein as part of the purchase of the CLARK product or part to which this warranty applies. THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES EX- PRESSED OR IMPLIED AND THERE IS NO IMPLIED WARRANTY OF MERCHANTABIL- ITY OR FITNESS FOR A PARTICULAR PURPOSE. Remedies available to any person claiming under this warranty are exclusive and expressly limited to obtaining the parts and the labor, where applicable, in accordance with terms of this warranty. CLARK'S liability for losses, damages or expenses of any kind arising from its design, manufacture or sale of the products or parts covered by this warranty, whether based on contract, tort or otherwise, including liability arising from a breach of this warranty, is limited, unless otherwise prohibited by law, to an amount not exceeding the cost of performing the obligations contained in this warranty according to its terms, and in no event shall CLARK'S liability exceed the value of the CLARK product giving rise to such liability. CLARK disclaims all liability for loss, damage or expense attributable to a loss of use of the CLARK product, a loss or damage to property other than the CLARK product, a loss of profits or other commercial loss, or any special or consequential damages (except liability for consequential damages which by law may not be disclaimed). The term CLARK means Clark Equipment Company or one of its subsidiaries, whichever last sold the product to which this warranty applies. The term Construction Machinery Group products refers to machines of the following types: Tractor shovels (loaders), wheel dozers, scrapers, log skidders, log loaders, motor graders, hydraulic cranes, cable cranes, excavators, and power shovels. (Not included are: lift trucks, straddle carriers, skid steer loaders, agricultural products or other products sold by CLARK'S Material Handling Group or the General Products Group). IMPROVEMENTS It is CLARK'S policy to constantly strive to improve its products. The right therefore is reserved to make changes in design and improvements whenever it is believed the efficiency of the product will be improved thereby, but without incurring any obligation to incorporate such improvements in any product which has been shipped or is in service. Cada grupo foi montado separadamente corn o numero da pegina prefixado pela letra designada para aquele grupo. Ex: Al, B2, C3, etc... Em seguida a designacdo alfabetica e o numero da pegina, e separado destas por urn hifen ( vem o numero da versio da pegina. Ex: Al - 1, B1-2, C3-3. Esta designacdo indica os nomeros de revisoes sofridas pela referida pagina, em razdo de alteracties introduzidas no produto por meihoria de qualidade ou alteracoes de niimeros de pecas. Os grupos de A a G incluem todos os itens fornecidos como equipamento padrdo na data desta publicacdo. Todos os itens opcionais e acessorios estdo listados no grupo H. 5 PARTS MANUAL ARRANGEMENT TO DISTRIBUTOR: The various parts groups involved in this equipment are arranged in this manual in alphabetical order. Each alphabetical parts group is page numbered separately with the page numbers prefixed by the alphabetical letter designated for that group, i. e., Al, B2, C3, etc. Following the alphabetical and page number designation, and separated therefrom by a hyphen ( - ), is the page version number, i. e., Al - 1, 81-2, C3-3, etc. This designation indicates the revision numbers to incorporate design changes in the equipment covered by that page. Groups "A" thru "G" include all items furnished as standard equipment at date of this publication. All optional and accessory items are listed under group "H". The page numbers are on right upper corner of pages with parts lists (R.H. pages) and the serail numbers of machines covered by this page are on right below corner. The last machine serial number covered by page must be noted by the distributor, as soon as a new page is received indicating the first machine serial number changed. The illustration numbers are in the upper center of pages (L.H. pages). These numbers will be only modified when changes be incorporated on illustration i. e., PC - A02 This illustration will receive the number PC-A02-1 at this first change. TO OWNER To assure the best results and to maintain the original quality built into the machine it is important that only Clark - Approved Parts be used when new parts are required. Parts orders must be made through your nearest Clark distributor. Always furnish the distributor with the machine serial number and model, parts manual number, item number and the part description. 6 ESTRUCTURA DEL MANUAL DE REPUESTOS AL DISTRIBUIDOR Los varios grupos de piezas incluidos en este manual han sido dispuestos en orden alfabetica. Cada grupo correspondiente a una letra este compaginado en una pagina independiente y el numero de pagina este precedido por la tetra que corresponde a esse grupo. Por ejemplo: Al, B2, C3, etc. Siguiendo Ia designacion alfabetica y el orden numerico, y separado Por un gui6n ( - ), esta el numero de pagina de la version; por ejemplo: Al - 1, B1-2, C3-3, etc. Esta designacion indica los numeros de las revisions para los cambios incorporados a los disenos del equipo, y numeros de piezas. Los grupos de piezas desde la letra "A" a la "G" incluyem todos los items considerados como equipo standard a Ia fecha de esta publicacion. Todos los items opcionales y accesorios estan enumerados en el grupo "H".
