January 2011 Volume 6, Issue 1 The President s Corner M a n y o f o u r Je s t e r neighbors have become increasingly concerned over the past several years about folks who do not put much effort into maintaining their property. Good maintenance of our properties is important to our enjoyment from living in Jester and to all our property values. T h e J H A B o a r d o f D i r e c t o r s h a s w o r k e d with our attorney and has approved a program t o e n c o u r a g e g o o d m a i n t e n a n c e o f o u r yards and property. The p r o g r a m i n v o l v e s l o t maintenance guidelines and fining members who do not adequately respond to violation notices. The resolutions passed by the Board at a recent meeting are reproduced in this edition of the Warbler. Please read them. The children s Santa on a Firetruck event drew a huge crowd this year. Teresa Gouldie and her volunteers do an incredible job of putting together 4 events a year for our Jester Children. We had a fun night filled with music, laughter and good times. We heard some great music from Joy Luther, Mike Carter and Cat, Lloyd Terry and Bob Sarnataro did a great job facilitating the event. We thank Mark and Linda for agreeing to host this event at My Place. It was such a success they are willing to let us continue on the first Tuesday of each Month. However in January we will do the second Tuesday to give folks a little recovery time from the New Year Eve parties. So get ready!! By Teresa Gouldie, Social Chairman Jester children and grandchildren were treated to a visit from Santa as he arrived in our neighborhood aboard a firetruck on Saturday, Dec. 11th. Each child had an opportunity to visit with Santa personally and share what they hoped to receive under the tree this holiday season. They posed for pictures not only with Santa, but with the firemen as well! The prize walk was a big hit along with the coloring sheets and the holiday tattoos. We would like to extend a heartfelt thank you to the four firemen who took time to come to Jester and create memories for our neighborhood children. Firemen Jeff Ward, Blake Mashburn, James Parker, and Sean Cummings patiently answered questions, posed for pictures, and let the kiddos explore all aspects of the firetruck. Fireman Blake Mashburn even jumped to the rescue with a first aid kit when a child fell and scraped her knee! (see photo on next page). 4 Resolutions Meeting of Board of Directors of Jester Homeowners Association, Inc. - November 3, 2010 RESOLVED, that in accordance with the Jester Homeowners Association, Inc., a Texas nonprofit corporation (the Association ), board of directors duty to enforce the provisions of Correction Second Supplemental Restrictions, Covenants and Conditions (the Restrictions ), the board adopts the following Lot Maintenance Guidelines for lot maintenance. Article V, 8 of the Restrictions requires Members to keep all weeds and grass on their lot cut in a sanitary, healthful and attractive manner and to keep all lots free from accumulation of garbage, trash or rubbish of any kind. The Lot Maintenance Guidelines are: 1. The height of grass or weeds shall not exceed eight inches (8 ). 2. Lots shall be neatly maintained, with grass trimmed and edged at curbs, sidewalks, and driveways. 3. Sidewalks on lots shall be kept free of shrubs and plants. Tree limbs and shrubs extending over sidewalks shall be trimmed to at least seven (7 ) feet vertical distance from the surface of the sidewalk. 4. Lots shall be kept free of garbage, trash, rubbish, auto parts, or debris, including non-drivable automobiles and motorized vehicles. 5. Except for political signs and standard home for sale signs, no lot shall display signs, banners, or other types of displays. No sign may exceed a height of forty-eight inches (48 ) from the ground, or be wider than thirty-six inches (36 ). 6. No statues or ornaments may be displayed in the front or side yards except those customarily designed and used for landscaping. IT IS FURTHER RESOLVED, that in accordance with Article VI, Section 1, the board of directors creates a Maintenance Committee. The Maintenance Committee shall consist of not less than three, nor more than seven, members who are members of the Association and shall be appointed by the board. A majority decision shall be the decision of the Maintenance Committee. The purpose of the Maintenance Committee is to enforce the standards set forth above, send notices to Members in violation of these standards, and implement the fines as described below: Upon violation of a Lot Maintenance Guideline, as determined by a decision of the Maintenance Committee, the Maintenance Committee will take the following actions: (Continued on Page 5) The Brown Paint Company What can BROWN paint for you? 5 Resolutions - (Continued from Page 4) Provide written notice by certified mail, return receipt requested and first class mail to the lot owner. The notice will contain a detailed description of the violation. If it is the first violation within the previous six months, the notice will provide the owner with fourteen (14) days from the date of the notice to cure the violation. The notice shall also inform the owner that he/she is entitled to a hearing in front of the Maintenance Committee or the entire Board of the Association provided the owner requests a hearing in writing and the request is received by the Association within fourteen (14) days of the date of the notice of violation. If the owner requests a hearing with the Maintenance Committee or the Board, one will be held within thirty (30) days of the request. The notice shall notify the owner that if the violation continues after the fourteenth day, the owner may also be liable for any costs, including attorney s fees. At a hearing, the owner shall present information which the owner believes to excuse or mitigate the violation. Provided that the owner cures the violation within a time agreed to by the Committee or Board, such Committee or Board may waive or reduce the fine. Jester Estates informing the owner that a fine is being assessed against it for fifty dollars ($50.00). The notice will provide the owner an additional seven (7) days to cure the violation. If after the seventh day, the owner has not cured the violation, the owner will be subject to a fine of up to twenty-five dollars per day ($25.00) until cured, up to a maximum of $1, per violation. If the violation remains uncured after forty-five (45) days from the date of the original notice and no hearing has been timely requested, then the Association may (1) file suit and seek to recover its damages and costs, including judicial foreclosure of any liens, and/or (2) record a lien against the owner s property to the extent permitted by law. IT IS FURTHER RESOLVED, that the secretary of the Association is directed to include these resolutions in the minutes of this meeting of the Association, and, further, that the officers of the Association are hereby authorized and directed to execute and deliver all documents, to waive all conditions, and to do all things necessary or helpful to carry out the purposes of the foregoing resolutions. All acts of the officers of the Corporation that are consistent with the intent of the above resolutions are hereby ratified and adopted in all respects as the acts of the Corporation. Dr. Michael S. 6 Jester Dinner Club International Potluck A wonderful time was had by all as Jester neighbors sampled international cuisine at the home of Fred & Susie Blount. The attendees each brought a dish to share, and the food was amazing! Some dishes from around the world included Spanokapita, Bratwurst & Potatoes, Chicken Cannelloni, Middle Eastern Rice, Irish Potato Soup, Pierogi Casserole, Sliders, Ramon Salad, Spinach Casserole, Caprese Salad, Seasoned Bread sticks, and an incredible pie for dessert. 8 Jester Networking Group Holiday Happy Hour The Jester Networking Group and their spouses rang in the holiday season with a happy hour at My Place Bar and Grill on December 7th. There was a great turn-out of members, and it was fun getting to meet many of the spouses for the first time. 11 WELCOME COMMITTEE NEWS by JoAnn Welles Thanks to Teresa Gouldie, the Welcome Committee learned of 15 new sales last fall. That s quite a few in such a small neighborhood! We were able to deliver packages to: James and Jenny on Berrycone Cove. They actually closed on their house in the summer, but we had trouble finding them at home. It was good to finally meet them! Rae Anne, Sean and their children on the 6700 block of Winterberry Amit, Radhika and their children Rohan and Rena, right next door to Rae Anne and Sean Cary and Heather on Jancy Dr. Tim and Julie, with their children Liam and Ryan, also on Jancy Dr Ben and Debbie with their 5th grader Sydney on the 6700 block of Jester Blvd. Ben and Debbie are long time Jester residents, moving from Bottlebrush Dr. We also left one package on the doorstep of a resident on the 7800 block of Moonflower Drive. We only leave packages if it s clear the house is inhabited, and there s a safe place to leave it. As you can tell we re behind in our deliveries! That s partially due to several new neighbors who have closed on their new house, but not yet moved in. In one case we tried to deliver a welcome package and discovered that the previous owners were still in the house, renting from the new owners. We are sad that Joan Smith has had to leave the committee due to other more pressing projects. Joan crocheted the most beautiful baby blankets and stroller afghans. Unless we find someone else that crochets or knits, we will have to suspend deliveries to parents of newborns. On a happier note, Debbie Rosenberg has offered to help us out. 13 Green Tips Keep Oak Wilt Out of Jester! It is that time of the year again to trim oak trees. Even though oak wilt is in the area, it has not shown up in Jester Estates yet. If you are new to the area, Oak Wilt is an incurable disease that attacks red oaks and live oaks mainly. Both of these species are in the red oak family. A fungus that is spread by failure to properly clean pruning tools, sap beetles and by interconnected tree roots causes it. Once a tree is infected, it lasts only about three months. The city of Austin has lost over 10,000 trees so far and many more will be lost. What can you do? First of all plant diverse tree species so that the disease won t spread through a monoculture. Yards that have mainly red oaks and live oaks are a prime target for the spread. There are many good oak alternatives that are native and well adapted here. The ones below are all in the white oak family. These oaks are resistant to Oak Wilt. Some good choices are: Monterey Oak or Mexican White Oak Chinquapin Oak Bur Oak Lacey Oak Vacey Oak Winter is not only the time to trim trees but it is also the time to plant trees. This gives them a chance to get their roots established before the heat of summer. If you are planting oaks this year, consider those that are Oak Wilt resistant.
