Supplement in at severlere güzel bir armağan olduğunu düşünüyorum yılında doğan tayları, faaliyeti olan 1584 baş kısrak ile 111 baş ithal kısrak, 1 baş ithal aygır, 42 baş ithal tay, 2 baş ihraç edilen atları sizlere sunmaktan mutluluk ve gurur duyuyorum. Bundan böyle doğan taylar her yıl yayınlanacak olan supplementlerde yer alacaktır. Türk İngiliz atlarının soy kütüğü hazırlanmasında emeği geçenlere teşekkür ediyor, atçılığımıza hayırlı ve uğurlu olmasını diliyorum. I am proud of bestowing the 1584 active broodmares in 2009 season 1 stallion, 111 broodmares and 42 foals imported, 2 exported horses. I wish success for your horses. 8 SAFKAN İNGİLİZ ATLARININ SOY KÜTÜĞÜNE KAYITLARINA DAİR KURALLAR SAFKAN İNGİLİZ ATININ TANIMI Bir İngiliz atı doğduğunda Uluslararası Stud Book Komitesi tarafından onaylanmış İngiliz Atı Stud Book una resmi olarak kaydedilmesi gerekir. Madde 1-Nitelik a) Bir atın onaylanmış İngiliz Atı Stud Book una kaydedilmesi için aşağıdaki şartlara uyması zorunludur. Bir tay onaylı Stud Book ta kayıtlı ana ve babanın çiftleşmesi sonucu olmalı veya safkan İngiliz olmayan bir atın soyundan geliyorsa Uluslararası Soy Kütüğü Komitesi tarafından İngiliz atı olduğuna oy birliği ile karar verilen bir at olmalıdır. Türk Stud Book u I.A.B.R.W nin 12. maddesinin imzacısıdır. Uygun Tay Üretimi için Servis b) İngiliz atı, aygır ile kısrağın doğal aşımı sonucu, şöyle ki aygırın penisinin kısrağın genital sistemine girerek salgılanan semeni fiziksel aktivite ile vermesi şeklinde olmak zorundadır. Ya da doğal aşım sonucu üretilen ejekulatın bir kısmının damızlıkta kullanılacak kısrağın genital sistemine aygır tarafından bırakılmasıdır. Uygun Tay Üretimi için Gebelik c) Doğal gebelik sonucu tayın, aynı kısraktan doğmuş olması gerekmektedir. Embriyo transferi ya da nakli, suni tohumlama, klonlama, veya diğer genetik müdahaleler sonucunda üretilen taylar Uluslararası Stud Book Komitesi tarafından onaylanmış İngiliz Atı Stud Book una kaydedilemez. Tanımlar ve Hukuki Dayanak Madde 2- Aşağıda yazılı terimlerin anlamları karşılarında yer almaktadır. a) Bakanlık : Tarım ve Köyişleri Bakanlığını, b) İl At Islah Komisyonu : İl Müdürlüğü Hayvan Sağlığı Şube Müdürü ile iki Veteriner Hekimden oluşan komisyonu, c) Üye Olunan Uluslararası Kuruluşlar: Ülkemizin de üyesi olduğu at yetiştiriciliği ve yarışçılığı ile ilgili uluslararası kuruluşlar; IFHA International Federation of Horseracing Authorities, ISAG International Society for Animal Genetics, ve ilerde üye olunabilecek kuruluşları, d) At Eşkal ve Muayene Raporu : Tanımlanacak tayın, Stud Book Otoritesinin izin verdiği birisi tarafından doldurulması gerekli olan, İngiliz Atı Otoritesi tarafından onaylı, atın donu, eşkali, ırkı, anababası, anasının aşım tarihi, tayın doğum tarihi, cinsiyeti, doğduğu ülke, tayın sürekli tanım detayları ve kimlik nişaneleri ki bunlar tüm ayak nişaneleri, yüz nişaneleri, servi, yara, dövme, dağlama, varsa mikroçip numarası, renkli fotoğrafı, fiziki (eşkal) muayenesi ve yetiştiricisinin adı gibi bilgileri içeren resmi form ya da elektronik sistemdeki bilgiler, e) Yetiştirici : Tayın doğduğu tarihte anasına sahip olan yasal kişiler, f) Sahip Değiştirme Belgesi : Satış, hibe, veraset gibi sebeplerle atın sahip değişikliğine esas teşkil eden belgeyi, g) Damızlık Belgesi: Damızlık atlara verilen ve Bakanlıkça onaylanan belgeyi, h) Uzman Heyet : At Yetiştiriciliği konusunda Uzmanlık Belgesi veya akademik çalışması bulunan veya at yetiştiriciliği konusunda en az 5 yıl kamu ya da özel kurumlarda çalışmış en az üç Veteriner Hekimden oluşan komisyonu, ifade eder. 9 Kuruluş ve Denetim Madde 3- Bu kurallar aşağıdaki yasalar temel alınarak hazırlanmıştır. Bu kurallar, 28/2/2001 tarihli ve 4631 sayılı Hayvan Islahı Kanunu, 8/5/1986 tarihli ve 3285 sayılı Hayvan Sağlığı ve Zabıtası Kanunu ve 9/3/1954 tarihli ve 6343 sayılı Veteriner Hekimliği Mesleğinin İcrasına, Türk Veteriner Hekimleri Birliği ile Odalarının Teşekkül Tarzına ve Göreceği İşlere Dair Kanuna, 10/7/1953 tarihli ve 6132 Sayılı At Yarışları Hakkındaki Kanuna dayanılarak hazırlanmıştır. Bu kuralların amacı; safkan İngiliz atlarının soy kütüğü kayıtlarının tutulması, pasaport ve damızlık belgelerinin verilmesi, tescili, aşım izni ve ilgili işlemleri, stud book hazırlanması ve yayını, sahip değişiklikleri ile ilgili esasları belirlemek, bunların yetiştirme yönünden sağlık kontrolleri, yetiştirme kayıtları, cetvelleri ve denetimlerine ait hükümler ile ülkemizin de üyesi olduğu Atçılık ve Yarışçılıkla ilgili uluslararası organizasyonların kayıt kurallarına uyumunu sağlamaktır. Bu kurallar soy kütüğüne kayıtlı ve kayıt edilecek safkan İngiliz atlarını kapsar. İngiliz atlarının kayıtları ile ilgili çalışmaların belirli esas ve usullere göre yapılmasını denetlemekle Bakanlık yetkilidir. Türkiye sınırları içerisinde İngiliz atlarının kayıtları ile ilgili tüm işlerden Bakanlık soy kütüğü ofisi sorumludur. Soy kütüğü otoritesi, at yetiştiricileri ve derneklerinden tamamen bağımsız çalışmaktadır. Bakanlık tescil kurallarını kendisi tespit etmekte ve uygulamaktadır. Soy kütüğü ofisi çalışanları gerekli eğitim çalışmalarına katılmakta olup, gerektiğinde diğer soy kütüğü ofisi çalışanlarının deneyim ve uzmanlığından yararlanacaktır. Türk Stud Book una Kayıt Kuralları Madde 4- İllerde tescil ile ilgili işlemler Tarım İl Müdürlüğü Hayvan Sağlığı Şube Müdürlüğü tarafından yapılır. Tescil ile ilgili işlemler için gerekli olan belgeler, at sahipleri ve İl At Islah Komisyonu tarafından düzenlenir. Tescili yapılacak atların muayeneleri, İl Müdürlüğünün uygun gördüğü yerlerde veya İl At Islah Komisyonunun, 6245 sayılı Harcırah Kanunu esasları dahilinde belirlenecek yolluk ve zaruri masraflarının (yevmiye, yol, ibade masrafı...vb.) at sahibi tarafından İllerde Muhasebe Müdürlüğü, İlçelerde Mal Müdürlüğü hesabına yatırılması kaydı ile at sahibinin istediği yerde yapılır. Türkiye de doğan ve ithal edilen safkan İngiliz atların soy kütüğüne kaydı için, at sahibi veya yetkili vekilinin; dilekçe, Aşım Belgesi, kan muayenesi için yatırılması gereken laboratuar ücretinin yatırıldığına dair belge, İl At Islah Komisyon Kararı ile pasaporta yapıştırılacak damga pulu ve tayın usulüne uygun çekilmiş üç adet fotoğrafı ile birlikte, atların bulunduğu Tarım İl veya İlçe Müdürlüklerine yasal süresi içinde müracaat etmesi şarttır. Türkiye soy kütüğüne kayıtlı ve pasaportlu safkan İngiliz ana ve babanın Türkiye de doğmuş ve uluslararası soy kütüğü komitesince kabul görmüş ülkelerin soy kütüğüne kayıtlı ve stud book larında yayınlanmış ithal atlar ile bunların yavruları kayıt edilir. Soy kütüklerine kayıt edilmemiş ana ve babaların tayları, kan ve/veya DNA analizi ile şecere kontrolünde ana babaya uygunluğu tespit edilemeyen taylar, soy kütüklerine kaydedilmez. Muayeneler sonucu düzenlenen İl At Islah Komisyonu Kararı, İl Müdürü tarafından onaylandıktan sonra diğer evraklarla birlikte Bakanlığa gönderilir. Türkiye de doğan taylar veya ithal edilen atların sahipleri, bu atların soy kütüğüne kayıtları için gerekli yasal süre içerisinde İl veya İlçe Müdürlüğüne başvurarak atların kan ve/veya DNA raporu için gerekli numuneyi İl At Islah Komisyonuna aldırmaya mecburdur.il Müdürlüklerince gönderilen numuneler ISAG tarafından tanınan Bakanlığa bağlı Kan Grupları ve Genetiği Laboratuarınca tahlil edilerek ana baba doğrulanması için yapılan Kan ve/veya DNA raporu düzenlenir. Kan Grupları ve Genetiği Laboratuarı kan ve/veya DNA Netice Raporunu Bakanlık ve İl Müdürlüğüne, kan tipi ve DNA Analiz Raporunu ise Bakanlığa gönderir. Atların Stud Book a kayıtları için gerekli belgeler; Atlar kayıtlı safkan İngiliz ana ve babalardan olmalı ve bunların pasaportları olmak zorundadır. İthal edilen atlar ve tayları Uluslararası Stud Book Komitesi tarafından onaylanmış ülkelerin Stud IV

10 Book una kaydedilmek zorundadır. Ana babası kayıtlı olmayan veya kan ve/veya DNA tipi doğrulanmayan taylar Stud Book a kaydedilemez. Türkiye de doğan tayların Soy Kütüğü Kayıtları için gerekli belgeler; 1) At sahibinin resmi tebligat yapılacak adresini de içeren dilekçesi, 2) Resmi kimlik belge fotokopisi ve Türkiye Cumhuriyeti kimlik numarası, 3) Anasının aşım belgesi, 4) Kan ve/veya DNA netice raporu, 5) Atın 3 adet 9x12 cm ebadında fotoğrafı, 6) At Eşkal ve Muayene Raporu, 7) İl At Islahı Komisyon Kararı ile bu karara ve pasaporta yapıştırılacak damga pulu, Aygır ve Kısrakların Kayıt Sistemleri Madde 5- Soy kütüğüne kayıtlı ve DNA/kan tipi analizi yapılmış olan safkan İngiliz atlardan Damızlık Belgesi verilecek aygır ve kısrakların, damızlık belgeleri İl Müdürlüklerince hazırlanarak, pasaportları ile birlikte tasdik edilmek üzere soy kütüğü otoritesine gönderilir. İllerden gelen soy kütüğüne kayıtlı atların damızlık belgeleri, Bakanlıkça oluşturulacak uzman heyet tarafından, damızlık özellikler, kalıtsal kusurlar, esas alınarak yapılan incelemeler sonucu uygun görülenler tasdik edilir. Damızlık Belgesi verilecek aygır ve kısrakların, Bakanlıkça belirlenen, usul ve esasları ilan edilen hastalıklardan salim olduğuna dair rapor almaları gerekir. Damızlık Belgesi almış olan aygır ve kısrakların damızlık olarak kullanıldıkları müddetçe her yıl Bakanlıkça belirlenen, usul ve esasları ilan edilen hastalıklardan salim olduğuna dair rapor almaları halinde vizeleri, Tarım İl Müdürlükleri tarafından yapılır ve At Kayıt Defterlerine işlenerek, bunların listeleri, her yıl Aralık ayı içinde Bakanlığa gönderilir. Bakanlıkça belirlenen hastalıklar nedeniyle vizesi yapılmayan atlar, derhal Bakanlığa bildirilir. Vize alamayan atlar damızlıkta kullanılamaz ve bu durum at sahibine hemen tebliğ edilir. Yurt dışından sıfat için gelen yabancı menşeli aygırların sıfatta kullanılabilmesi için, at ithalatında aranan şartlara uygun olması ve sıfat için Bakanlıktan önceden izin alınma şartı aranır. Aşım belgeleri, aşım istasyonunda görevli Veteriner Hekim veya aygır sahibi tarafından üç nüsha olarak düzenlenerek imzalanır. Aşım Belgesinde çiftleşen kısrağın; adı, doğum tarihi, donu, pasaportu, sahibi, ilk ve son çiftleşme tarihi, suni dölleme ve embiriyo nakli yönteminin kullanılmadığı ve pasaportu ile kimlik kontrolünün yapıldığı belirtilecektir. Türkiye ye gebe olarak ithal edilen safkan İngiliz kısraklarından Türkiye ye geldikten sonra doğan tayların soy kütüklerine kayıt edilebilmeleri için kısrağın kendi ırkı aygırdan aşım yapılmış olduğunu gösterir Aşım Belgesinin ibrazı gerekir. Sahip Değiştirme İşlemleri Sahip değişikliklerinde; a) Soy kütüklerine kayıtlı safkan İngiliz atın satılması, hibe edilmesi veya veraset yoluyla intikali durumunda, sahip değişikliğinin soy kütüğüne ve pasaporta en geç 1 ay içinde işletilmesi için müracaatı gerekmektedir. Sahip değişikliği için; atın pasaportu ile birlikte İllerde Valiliğe, İlçelerde Kaymakamlığa veya Yarış Müessesesine yeni sahibi tarafından müracaatı gerekmektedir. b) Soy kütüğüne kayıtlı veya soy kütüğüne yeni kayıt yapılacak olan atın tescil işlemleri esnasında sahibi ölmüş ise noterden tasdikli veraset ilamı suretinin de gönderilmesi şarttır. c) Sahip değiştirmede bir aylık süre; satış tarihinden ve veraset ilam tarihinden itibaren başlar. Sahip değişikliğinde istenecek belgeler; a) Alan ve satanın, hediye eden veya varisin resmi tebligat yapılacak açık adreslerini içeren ve TC. kimlik numarası yazılı resmi kimlik fotokopisinin eklendiği, fatura, müstahsil makbuzu, veraset ilamı ve benzeri satış evrakları veya resmi makamlar veya yarış müessesesi yetkilileri huzurunda alan ve satanın, alıp-sattığına dair onaylanmış sahip değiştirme belgesi, V

11 b) Atın pasaportu. Aşım Sonuçları Madde 6- a) Aşım detayları aygırın sahibi ya da Stud Book Otoritesinin izin verdiği birisi tarafından İngiliz Atı Otoritesi tarafından onaylı ve aygırın adı, kısrağın adı, aygırın ilk ve son aşım tarihi aygır sahibinin ya da Otorite yetkilisinin, doğal aşım olduğunu ve suni dölleme, embriyo transferi veya nakli, klonlama ya da diğer genetik müdahalelerin yapılmadığına dair imza gibi bilgileri içeren resmi form ya da elektronik sistemi doldurmak zorundadır. b) Kısrak sahibi ya da Stud Book Otoritesinin izin verdiği birisi, sıfat alan kısrağın canlı tay doğurması halinde İngiliz Atı Otoritesi tarafından onaylı ve aygırın adı, kısrağın adı, tayın doğum tarihi, tayın donu, tayın cinsiyeti, tayın yetiştiricisinin adı (tay doğduğunda bu kişi kısrağın sahibidir), tayın doğduğu ülke, kısrak sahibinin ya da otorite yetkilisinin doğal aşımla olduğunu ve suni dölleme, embriyo transferi veya nakli, klonlama ya da diğer genetik müdahalelerin yapılmadığına dair imza gibi bilgileri içeren resmi form ya da elektronik sistemi doldurmak zorundadır. Kısrak sahibi embriyonik ölüm, düşük, ölü doğum, doğumdan sonra ölüm, safkan olmayan attan çekim, boş gibi durumları sütten kesmeden önce bildirmek zorundadır. c) Kır ve al donlu atların genetik don kalıtımı kurallarına uygunluğu zorunludur. Kimlik Saptaması Madde 7- a) Müracaat tarihinden itibaren İl Müdürlükleri tarafından, At Eşkal ve Muayene Raporu ve İl At Islahı Komisyonu kararı Veteriner Hekimlere düzenlettirilerek at sahibinin müracaat tarihinden itibaren en geç dokuz ay içerisinde diğer tescil evrakları ile birlikte noksansız olarak Bakanlığa gönderilmesi şarttır. b) Tayların eşkal tespitinin sütten kesilmeden önce yapılması zorunludur. c) DNA profilleri ve kan grupları soy kütüğü otoritesinin dosyalarında saklanacaktır. Bu dosyalar üçüncü şahıslara gösterilmeyecektir. d) DNA profilleri ve kan grupları raporları ancak ISBC tarafından tanınan soy kütüğü otoritelerine gönderilecektir. e) Ana baba doğrulama testleri yalnızca yeni doğan taylar için istenecektir. Geçmişe ait ana babalık doğrulama testi istenmez. Pasaportlar Madde 8- a) Tescil evrakları tamamlanarak gönderilen taylar soy kütüğüne kayıt edildikten sonra düzenlenen pasaport at sahibine verilecektir. Verilen bu pasaport atın hayatı boyunca yanında bulundurulacaktır. b) Türkçe ve İngilizce olarak düzenlenen pasaportlar, soy kütüğü, kayıt ayrıntıları, nişaneler, yapılan aşılamalar, sahip değişikliklerinin kaydı için bölüm, ihracat ve muayene ayrıntıları ile bazı kuralları ve aile doğrulama testini içermektedir. c) Soy kütüğüne kayıtlı atların pasaportları kaybolduğunda atın sahibi İllerde Valiliğe, İlçelerde Kaymakamlığa yeni pasaport çıkarılması için müracaat eder. Aşağıdaki evraklar bir ay içerisinde tamamlanarak Bakanlığa gönderilir. 1) At sahibinin resmi tebligat yapılacak adresini de içeren dilekçesi, 2) At Eşkal ve Muayene Raporu, 3) İl At Islah Komisyon Kararı ile bu karara ve pasaporta yapıştırılacak damga pulu, 4) Atın yeni çekilmiş 2 adet 9x12 cm ebadında fotoğrafı, 5) Gerektiğinde kan ve/veya DNA raporu, d) At sahibi don değişikliğini yaptırmak için İllerde Valiliğe, İlçelerde Kaymakamlığa müracaat etmek zorundadır. 12 Don değişikliği yapılacak atlarda istenecek belgeler; 1) At sahibinin resmi tebligat yapılacak adresini de içeren dilekçesi, 2) At Eşkal ve Muayene Raporu, 3) İl At Islah Komisyon Kararı ile damga pulu, 4) Atın yeni çekilmiş 3 adet 9x12 cm ebadında fotoğrafı, 5) Atın Pasaportu, 6) Gerektiğinde kan ve/veya DNA raporu. e) Soy kütüğüne kayıtlı atın ölmesi durumunda, atın sahibi tarafından atın ölüm tarihinden itibaren iki ay içinde, ata ait pasaport ve varsa damızlık belgesi İllerde Valiliğe, İlçelerde Kaymakamlığa teslim edilir. İthal Atların Kaydı Madde 9- a) Soy kütüğü otoritesince damızlık olarak ithal atlar ile ilgili bir kayıt tutulmaktadır. b) İthal atların kaydı için istenilen belgeler : 1) At sahibinin resmi tebligat yapılacak adresini de içeren dilekçesi, 2) Resmi kimlik belge fotokopisi ve Türkiye Cumhuriyeti kimlik numarası, 3) Atın safkan İngiliz olduğunu gösteren pasaportu, 4) Kan ve/veya DNA netice raporu, 5) Atın yeni çekilmiş 3 adet 9x12 cm ebadında fotoğrafı, 6) At Eşkal ve Muayene Raporu, 7) İl At Islahı Komisyon Kararı ile bu karara ve pasaporta yapıştırılacak damga pulu, 8) İthal edilen ülkenin direk Türk Stud Book una gönderdiği eksport sertifikası (Export certificate), 9) Gümrük Giriş Beyannamesi, 10) Gümrük İdarelerince satılan atlar için Gümrük satış belgesi, c) Pasaport vermeyen ülkelerden ithal edilen atların eşkali İl Müdürlüklerince tespit ettirilecek ve tayın doğduğu ülkece verilen kimlik sertifikası ile karşılaştırıldıktan sonra pasaport düzenlenecektir. İhracat Madde 10- Soy kütüğüne kayıtlı atların ihracından önce, eşkal muayenesinin mevcut pasaportuyla karşılaştırmalı olarak yetkili birimlerce görevlendirilecek Veteriner Hekime yaptırılması ve export sertifikası düzenlenirken kullanılmak ve onaylanmak üzere pasaport ile Eşkal Muayene Raporunun Bakanlığa gönderilmesi gerekir. İhracat Sertifikası doğrudan ithalat yapan ülkenin soy kütüğü otoritesine gönderilecektir. Soy Kütüklerine Kaydedilecek Atlara İsim Verilmesi Madde 11- Soy kütüğüne kaydedilecek İngiliz tayların, ana ve baba isimleri esas alınarak soy kütüğüne isimsiz olarak kayıtları yapılabilir. Ancak, tayın iki yaşını doldurduğu yılın son gününe kadar, at sahipleri tarafından tayın isminin tescil ettirilmesi gerekir. Verilecek isimler, boşluklar dahil 18 harfi geçemez. Tescil ettirilen isim değiştirilemez. İsim vermede dikkat edilecek hususlar; a) Kullanılması korumaya alınmış ve yasaklanmış isimler, uluslararası korunmuş isimler listesinde görülen isimler, b) Kullanılma hakkı mahfuz olan isimler, c) Karışıklığa sebep olabilecek veya dini ve sosyal nedenlerle kullanılması kabule şayan olmayan isimler, d) Ticari ve reklam maksadı ile kullanılmak istenen isimler, e) Kendisi ya da yakınlarınca izin verilmedikçe kişilerin isimleri, VII

13 f) Yaşayan atların tescil edilmiş isimleri, bu isimlere yazılış ve okunuş yönünden benzerlik gösteren isimler ve aygır isimleri ölümlerini takip eden 15 yıldan önce, kısrak isimleri ölümlerini takip eden 10 yıldan önce, diğer atların isimleri ise ölümlerini takip eden 5 yıldan önce kullanılamaz. g) İsimlerin başına ve sonuna rakam konulamaz. h) İthal atların isimleri, yukarıda belirtilen hususlara aykırılık teşkil etmesi durumunda, kayıtlı olduğu ülke soy kütüğü otoritesi ile mutabakata varılarak, Bakanlıkça değiştirilebilir. Türk Stud Book u I.A.B.R.W nin 14. maddesini imzalamıştır. Stud Book Yayınlanması Madde 12- a) Türkiye de doğan veya yurt dışından getirilen safkan İngiliz atlarının soy kütüğü kayıtları 4631 sayılı Hayvan Islahı Kanununun 7 nci maddesi gereğince Tarım ve Köyişleri Bakanlığınca tutulur. Stud book, üye olunan uluslararası kuruluşların kuralları gereği en geç her dört yılda bir hazırlanarak yayınlanır. Stud book un yayınlanmadığı yıllarda, ithal edilmiş ve o yıl doğan tayların ana ve babası, doğum tarihi, donu ve yetiştiricisini içeren ekler Supplement yayınlanır. Bu hizmetlerin giderleri yetiştiricilerinden karşılanır. Üyesi olduğumuz uluslararası kuruluşlar tarafından kural ve kaideleri belirlenen stud book lar, Bakanlık tarafından yayınlanır. Türk stud book larında yayınlanıp register (kayıt) numarası almış ve üye olunan uluslararası kuruluşların kabul ettiği stud book larda yayınlanmış atların yavruları stud book larda yayınlanır. b) Yayınlanan Stud book ve supplementlerde, kurallarda ve kayıtlarda olabilecek değişikliklerle ilgili bilgiler eklenir. c) Stud book a kayıt edilecek ithal atların ülke kodları isimlerin yanına yazılır. d) Safkan İngiliz olmayan atlar stud book a kayıt edilmez. Ceza Hükümleri Madde 13- a) Veteriner Hekime Muayene Ettirmeme ve Belgesiz Damızlıkta Kullanma; yasal olmayan yetiştiricilik Tabii aşımda kullanılan ve damızlık belgesi bulunan aygırları, Bakanlık taşra teşkilatına tamimlerle bildirilen hastalıklar yönünden ve damızlık özellikleri bakımından bu kurallar gereğince muayene ettirmeyenler ile belgesiz veya yıllık vizesi yapılmadan damızlıkta kullananlar, 4631 sayılı Hayvan Islahı Kanunun 16 ncı maddesi gereği ağır para cezası ile cezalandırılır. b) Evrakta Tahrifat; Düzenlenen evraklardan; 1) Safkan İngiliz atlarının soy kütüğüne kayıt edilmesi için yönetmeliğe göre verilmesi gereken evrakı tahrif edenler, sahte evrak tanzim edenler, sahte ve tahrif edilmiş evrakı bilerek kullananlar hakkında 765 sayılı Türk Ceza Kanununun 2 nci kitabının 6 ncı babındaki hükümler uygulanır. 2) Soy kütüğüne kayıtlı safkan İngiliz atları hakkında gerçeğe uymayan evrak tanzim edenler veya başka bir ata ait belgeleri kullananlar veya bu belgelerde ve atın eşkali üzerinde değişiklik yapanlar, 4631 sayılı Hayvan Islahı Kanunun 17 nci maddesi gereği bir aydan altı aya kadar hapis ve ağır para cezası ile cezalandırılır. Mahkumiyet halinde söz konusu atların soy kütüğünden kayıtları silinir, pasaportları iptal edilerek geri alınır. c) Amaç Dışı Kullanma, Don ve Sahip Değişikliğini Bildirmeme; 4631 sayılı Hayvan Islahı Kanunu nun 6 ncı maddesine aykırı hareket edenler ile soy kütüğüne kayıtlı safkan İngiliz atlarının ölmeleri halinde pasaportlarını aynı Kanunu nun 7 nci maddesindeki süreler içinde geri vermeyen veya sahip ve don değişikliğini bildirmeyen ve pasaportuna işletmeyen at sahipleri hakkında, aynı Kanunu nun 18 inci maddesi hükümleri uygulanır. Sahip değiştirme işleminden önce don değişikliğinin belgelere işletilmemesinden kaynaklanan para cezalarını sahip değişikliği belgesinde aksi belirtilmedikçe yeni sahibi ödemeyi kabul etmiş sayılır. d) Kaybolduğu Bildirilen Pasaportunun Kullanılması; VIII

14 Kaybından dolayı düzenlenen pasaport verildikten sonra orijinal pasaport bulunacak olursa bu pasaport geçersiz ve hükümsüz sayılır. Bu pasaport gerekli işlemlerin yapılması için Bakanlığa gönderilir. Kayıp pasaport kullananlar hakkında, 4631 sayılı Hayvan Islahı Kanunu nun 17 nci maddesi ile Türk Ceza Kanunu nun ilgili madde hükümleri uygulanır. IX

15 DEFINITION OF A THOROUGHBRED RULES OF ENTRY A Thoroughbred is a horse which is recorded at birth in a Thoroughbred Stud Book approved by the International Stud Book Committee at the time of its official recording. Article 1- Qualification a) For a horse to be eligible to be recorded in an approved Thoroughbred Stud Book all of the following requirements must be satisfied: The horse must be the product of a mating between a sire and a dam, both of which are recorded in an approved Thoroughbred Stud Book or either or both must have been promoted from a Non- Thoroughbred, the promotion approved by the unanimous agreement of the international Stud-Book committee. The Turkish Stud Book is a signatory of article 12 of I.A.B.R.W. Service to produce an eligible foal being b) The Thoroughbred must be the result of a Stallion s mating with a Mare which is the physical mounting of a Mare by a Stallion with intromission of the penis and ejaculation of semen into the reproductive tract. As an aid to the mating, a portion of the ejaculate produced by the Stallion during such mating may immediately be placed in the reproductive tract of the Mare being bred. Gestation to produce an eligible foal c) A natural gestation must take place in, and delivery must be from, the body of the same Mare in which the Foal was conceived. Any Foal resulting from or produced by the processes of Artificial Insemination, Embryo Transfer or Transplant, Cloning or any other from of genetic manipulation not herein specified, shall not be eligible for recording in a Thoroughbred Stud Book approved by the International Stud Book Committee. Definitions and Legal basis Article 2- The following terms shall mean what is written opposite of them here below, a) Ministry: Shall mean Ministry of Agriculture and Rural Affairs of Turkey b) Provincial committee of horse amelioration: Shall mean the committee comprising the director of provincial directorate animal health department and two veterinarians. c) The international associations which we are member: Shall mean the international associations which are involved in horse breeding to which our country is a member such as; IFHA International Federation of Horseracing Authorities, ISAG International Society for Animal Genetics, and other associations that our country may be a member to in the future. d) Identification & description; The description of the Foal must be recorded by a person authorized by the Stud Book Authority on an official form or electronic system provided by the Authority certifying the Thoroughbred which should include: name of the Stallion, name of the Mare, exact date of foaling, colour of the Foal, gender of the Foal, name of the Breeder, country of foaling, a detailed description of permanent and acquired identifying markings of the Foal which should include all leg markings, face markings, hair whorls, scars, tattoos, brands and a microchip number, should be substantiated by either colour photographs or physical inspection. e) Breeder: Shall mean the legal persons who own the broodmare on the day where the foal is born. f) Certificate of change of ownership: Shall mean the certificate that is issued for the change of ownership for the reasons such as; sales, donation, succession etc. g) Breeding certificate: Shall mean the certificate granted to Breeding horses and approved by the ministry. 16 h) Expert committee team : Shall mean the committee comprising minimum three veterinarians who are holding certificate of specialist in horse breeding matters, or having an academic study carried out in the same subject or employed with public or private companies for at least 5 years time in a post related to horse breeding. Organization and Control Article 3- These rules are prepared based on according to laws below; The Turkish Law about Animal Amelioration with the date and reference no. 28/2/2001 and 4631 respectively, the Turkish Law about Animal Health and Animal Security Law with the date and reference no 8/5/1986 and 3285 the Turkish Law about the Form of Establishment and Charges of the Turkish Association of the Veterinarians and Their Chambers Including the Execution of the Veterinarian s Profession. with the date and reference no. 9/3/1954 and 6343 the Turkish code about the Horse Races Law with the date and reference no.10/7/1953 and 6312 respectively The objective of these rules is to provide the terms and rules for keeping the stud book for the thoroughbred horses, granting their passport and the breeding certificates, the procedures regarding registration, covering, preparation and publication of stud book and, while specifying the rules and terms with respect to the change of ownership, and to provide due compliance and harmonization with the registration terms and rules of the international organizations related to horsemanship and racing which our country is a member to, with their health control, breeding records, tables and the provisions of their controls These rules concern the thoroughbreds registered or which will be registered into the Stud Book. The Ministry is the authority to control the procedures used in the process of recording the thoroughbreds into the Stud Book. In Turkey, The Stud Book Office of the Ministry is responsible of all the activities concerning the recording of thoroughbreds into the Stud Book. The Authority of Stud Book works completely independent of all the horse breeders and associations. The Ministry determines and applies the entry rules. Stud Book Office Staff participates in necessary training studies and also benefits from the expertise and experience of other Stud Book Offices Staff. Rules for Registering into the Turkish Stud Book Article 4- The procedures regarding the registrations that will take place in provinces, will be performed by the provincial directorate of agriculture department of animal health, The horse owners and the provincial committee of horse amelioration will establish the documents that are required for registration process. The examination of the horses for which registrations are to be made in the places that the provincial directorate may deem fit, or in the places that the horse owner may select on his/her own option provided the daily allowances (including transportation costs, accommodation costs etc.) to be determined by the provincial committee of horse amelioration in accordance with the provisions of the Turkish code about the allowances no will be deposited to the account of the accounting management in the provinces, to the account of district revenue directorate by the horse owner. For the registration of the Thoroughbred horses born in Turkey and the ones imported with the stud book the horse owner or his/her authorized agent must apply to the provincial and district agricultural directorates where the horses are, together with the application, the stamp duty to be affixed on the decree of provincial committee of horse amelioration and the passport and three photos made appropriately and the receipt showing that the fees of laboratory where the required blood test will be carried out, must be attached with the application and certificate of covering accordingly. Thoroughbred horses that are born in Turkey by thoroughbred parents registered into the thoroughbred stud book and the imported horses which are registered with stud books approved by international stud book committee and published in the stud book and their progeny are registered in the stud book. 17 The foals of parents, which are not registered with the stud books, the foals of which parents are failed to determine their conformity to their parents under the passport control carried out through blood and/or DNA test, will not be registered with the stud books. In order to register them into the stud book, owners of the foals born in Turkey or imported horses should apply to districts or provincial directorships within the legal period of time to make them take the blood sample necessary for bloodtyping and DNA testing. Samples sent by the districts will be tested by the bloodtyping and Genetics Laboratory of the Ministry accredited by ISAG and Bloodtype and/or DNA reports are prepared for parentage validation. Bloodtyping and Genetics Laboratory sends the blood and/or DNA results report to the Ministry and District, and sends the Bloodtype and DNA analysis report to the Ministry. Requirements needed for registering the horses into the Stud Book are; For the horses that are born in Turkey, they must have Thoroughbred sire and dam registered in Turkish Stud Book and they must have passports. For the imported horses and their foals, they must be registered in the stud books of the countries approved by the International Stud Book Committee. Foals whose sire and dam are not registered, or whose relations to them cannot be verified with blood and/or DNA typing, are not registered in the stud books. Documents required to register the foals born in Turkey a) The application of the horse owner including the legal notice address b) Official identification card and Turkey Republic identification number c) The covering certificate of the broodmare d) The blood and/or DNA test report e) 3 photo of the horse in dims by 9x12 cm, f) The report of horse identification & description, g) The decree of Provincial committee of horse amelioration and the duty stamp to be affixed on such decree and the passport Registering the Stallions and Broodmares Article 5- The breeding certificates for thoroughbred broodmares and stallions, which are Registered and Blood/ DNA typed already, are issued by the Provincial Directorships and, together with the horse passports, sent to The Stud Book Authority for approval. The Breeding Certificates sent by the provincial directorships, are evaluated according to the horses' breeding characteristics and genetic deficiencies by an expert committee established by the Ministry. The Stallions and Broodmares are to be given Breeding Certificates, must have a health certificate showing that they are free from the infectious and contagious diseases established and announced by The Ministry. As Long as they are used for breeding purposes, the stallions and broodmares with Breeding Certificates must prove with a health certificate that they are free of the infectious and contagious diseases announced by the Ministry annually, to obtain visa. The visas are given by the Provincial Directorships and the names of the horses are registered into the Horse Registry Books. The lists of such horses are sent to the Ministry in each December. Those horses, which could not obtain visa due to the announced diseases, are immediately denounced to the Ministry. These horses cannot be used for breeding purposes and the situation is communicated to the owner. The Stallions must coming from abroad for breeding purposes must have a authorization for covering from the Ministry. The Covering Certificates are produced and signed in three copies by a veterinary surgeon in charge at the stallion station, or by the stallion owner. The name of the Broodmare, date of Birth, colour, passport, name of the owner, the first and the last dates of cover, the fact that the artificial insemination was not used and the passport checked, the identity verified, must be stated on the Covering Certificate. 18 In order to register a foal, which came in uterus of an imported broodmare and was foaled in Turkey, it is obligatory to present a Covering Certificate showing that the Broodmare was covered by a Stallion registered at birth in an approved stud book. Procedures for change of ownership Procedures for change of ownership; a) In case of sales, donation or otherwise transfer of Thoroughbred horse that is registered with the stud book through succession, the application must be submitted in order to enter the change of ownership in the stud book and in the passport within 1 month time. For the purpose of change of ownership the governor s office in the provinces, the district governor s office in the districts, or the racing body must be applied to respectively by the new owner. b) If the horse owner is deceased during the registration procedures for any horse that is already registered with the stud book or the one to be newly registered into the stud book, a notarized copy of determination of heirship must also be sent. c) The one-month time in change of ownership will begin as of the date of sales and the date of determination of heirship correspondingly. The documentation required in change of ownership a) The invoice, receipt of producer, determination of heir ship, and similar sales documents, or the document for change of ownership which is approved by the government bodies, or the racing body authorities in front of which the sales action is realized between the seller and buyer accompanied with the photocopy of official identification card bearing the legal notice address of the seller and buyer, the donator, or the successor to whom the notice will be made including the Turkey Republic identification number. b) The passport of horse Return of Mares Article 6- a) The details of the mating must be recorded by the Stallion owner or authorised agent on an official form or electronic system provided by the Stud Book Authority certifying the Thoroughbred which should include: Name of the Stallion, Name of the Mare, The first and last dates of mating to the Stallion, a statement signed by the Stallion owner or authorised agent that the mating was natural and did not involve the processes of Artificial Insemination, Embryo Transfer or Transplant, Cloning or any other form of genetic manipulation. b) The details of the Foal at the time of foaling must be recorded by the Mare owner or authorised agent on an official form or electronic system provided by the Stud Book Authority certifying the Thoroughbred which should include: name of the Stallion, name of the Mare, exact date of foaling, colour of the Foal, gender of the Foal, name of the Breeder of the Foal who is the Owner(s) of the Mare at the time of foaling, country of foaling, a statement signed by the Mare owner or authorised agent that the Foal was not the result of Artificial Insemination, Embryo Transfer or Transplant, Cloning or any other form of genetic manipulation. Non productive results must be reported by the mare owner such as barren, slipped, aborted early, dead at birth, died since birth, covered by N.T.B. horse, not covered, These details have to be recorded before the ending of suckling period. c) Established genetic rules concerning coat colour heritability for greys and chestnuts must be observed. Identification Article 7- a) Horse description, Examination report and amelioration commission decision are going to be arranged by Provincial directorate onwards application date and these documents should be sent to the XIV

19 Ministry with other Registry documents and without any missing the application date of the horse owner to at most nine months. b) It is mandatory to make description of foals before weaning. c) DNA profiles and blood groups are going to be kept in the Stud Book authority files. These files are not be shown to the third person. d) DNA profiles and bloodtyping reports are only be sent to authorities which are approved by I.S.B.C. e) Parentage Validation tests are only going to be wanted for Turkish newborn foals. Parentage Validation testing belonging to past are not be demanded. Passports Article 8- a) After receiving the filled set of Registry Documents the foals are registered then a passport issued and will be given to the owner. This passport will accompany the horse for life. b) The passport are issued both in Turkish and English, it contains the details of passport, markings, vaccination, change of ownership, export and examination details and latest rules including parentage testing. c) In case of loss of the passports of the horses which are registered with the studbook, the horse owner will apply to the governor s office in the provinces, to the district governor s office in the districts respectively for the issuance of duplicate passport, the following documents must be completed and sent to the ministry within one-month time. 1- The application of the horse owner including the official notice address, 2- The report of horse identification & description, 3- The decree of Provincial committee of horse amelioration and the duty stamp to be affixed on such decree and the passport 4-2 new photos of the horse in dims by 9x12 cm 5- When necessary, report of blood and /or DNA Test d- The horse owner, in order to registrar the colour change, must apply to the governor s office in the provinces, to the district governor s office in the districts respectively. The documents required for the horses that the colour change will be implemented with are the following: 1- The application of the horse owner including the official notice address, 2- The report of horse identification & description, 3- The decree of Provincial committee of horse amelioration and the duty stamp 4-3 new photos of the horse in dims by 9x12 cm 5- The passport of he horse 6- When necessary, report of blood and /or DNA Test e) In case of death of any horse which is registered with the stud book, the passport and if available the certificate of Breeding must be sent to the governor s office in the provinces, to the district governor s office in the districts respectively by the horse owner within two months time as of the date of death of the subject horse. Registration of Import Horses Article 9- a) Imported horses for breeding are registered by the Stud Book Authority b) The documents required for registration of Imported Horses 1- The application of the horse owner including the legal notice address 2- Official identification card and Turkey Republic identification number 3- The passport certifying that the horse is thoroughbred 4- The report of blood and/or the DNA test 5-3 photo of the horse in dims by 9x12 cm, XV

20 6- The report of horse identification & description, 7- The decree of Provincial committee of horse amelioration and the duty stamp to be affixed on such decree and the passport 8- The export certificate sent by the exporting country direct to Turkish Stud Book 9- The customs entrance declaration 10-The customs sales certificate for the horses sold by the customs departments. c) For horses imported from those countries which do not issue ID s/passports the S.B.A would issue its own passport having first obtained fresh markings and checked them against the ID certificate issued by the S.B.A of the Country of foaling. Exportation Article 10- Prior to exporting the horses that are registered with the studbook the designation a comparative control with the available passport must be performed by the veterinarian that will be commissioned by the authorized units, and the passport and identification & description report to be used while issuing the export certificate must be sent to the ministry together with the passport. Export Certificate will be sent directly to the Authority of the Country which does the importation. Name giving to the horses to be registered in stud books Article 11- The Thoroughbred foals to be registered with the studbook may be registered in the studbook without name based on only the names of sire and dam. However, until the last day where the foal achieves its second year of age, the horse owners must register the name of the foal accordingly. The names to be given may not exceed 18 letters including the blanks. The name thus registered may not be changed. The following must be observed while giving names. a) Names, of which use, is preserved and prohibited or appears in the International list of protected names, b) Names of which use is reserved, c) Names that may cause any mixture or the names that are not appropriate for use due to religious and social reasons. d) Names intended for commercial or advertisement use, e) Nouns (private names) unless appropriate consent is obtained. f) The registered names of living horses, the names which are identical in terms of writing and reading with those names, and the names of stallions can not be used not earlier than 15 years immediately after their death, the mare names not earlier than 10 years immediately after their death, the names of other horses not earlier than 5 years immediately after their death. g) No number can be added as prefix or suffix to these names h) In the event the names of the imported horses constitute any contradiction to what is indicated above, such names may be changed by the ministry after having agreed with the stud book authority of the country where the horse was born. The Turkish Stud Book is a signatory of article 14 of I.A.B.R.W Keeping and Publishing the Stud Book Article 12- a) The stud book of the Thoroughbred horses that are born in Turkey or imported from abroad will be kept by the ministry of agriculture and rural affairs pursuant to the Turkish code about the animal amelioration 4631 paragraph 7 th the studbook, in accordance with the international bodies whose our country is a member, will be prepared and duly published once every four years. During the years where no studbook is published, the parents, date of birth, colour and the name of its breeder for the foals born in the same year will be included in the supplement for publication. The costs of such services will be satisfied from the proceeds of the breeds. XVI
