1 CITY OF ELK GROVE CITY COUNCIL STAFF REPORT AGENDA ITEM NO. 8.7 AGENDA TITLE: Adopt a resolution authorizing the Public Works Director / City Engineer to execute a contract time extension to December 31, 2011 with the State of California, Department of Transportation (Caltrans) for the Intercity Rail Passenger Facility contract MEETING DATE: April 13, 2011 PREPARED BY: Rick Carter, Capital Program Manager Gary Grunwald, Senior Project Manager DEPARTMENT HEAD: Richard Shepard, Public Works Director / City Engineer RECOMMENDED ACTION: Staff recommends the City Council of the City of Elk Grove adopt a resolution authorizing the Public Works Director / City Engineer to execute a contract time extension to December 31, 2011 with the State of California, Department of Transportation (Caltrans) for the Intercity Rail Passenger Facility contract. BACKGROUND INFORMATION: On December 13, 2006, the City Council authorized the City Engineer to execute a contract with Caltrans for environmental and engineering studies for the Intercity Rail Passenger Facility for a total programmed amount of $800,000. The Elk Grove Intermodal Rail Station Master Plan Initial Study / Mitigated Negative Declaration was adopted by the City Council on April 14, 2010 which was prior to the June 31, 2010 contract expiration date. 1
2 Elk Grove City Council April 13, 2011 Page 2 of 2 To meet the contract obligations required by Caltrans for the preliminary engineering, more detailed studies and public outreach were still required. No additional funding was required. Working with Caltrans and California Transportation Commission (CTC) staff, the City obtained approval for an extension of the contract to December 31, The CTC approved the time extension on June 30, At the time the extension was approved by the CTC on June , Caltrans did not require an updated signed contract with extension date included. Caltrans has recently requested an updated signed contract with the current CTC approved termination date (December 31, 2011) shown in the contract. FISCAL IMPACT: This contract is 100% State funded. No additional funding is required as this is for time extension only. ATTACHMENTS: 1. Resolution 2. Updated contract with December 31, 2011 termination date 2
3 ATTACHMENT 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT TIME EXTENSION TO DECEMBER 31, 2011 WITH THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION (CALTRANS) FOR THE INTERCITY RAIL PASSENGER FACILITY CONTRACT WHEREAS, on December 13, 2006, the City Council authorized staff to execute a contract with the State of California, Department of Transportation (Caltrans) for environmental and preliminary engineering for the Intercity Rail Passenger facility; and WHEREAS, the Elk Grove Intermodal Rail Station Master Plan Initial Study / Mitigated Negative Declaration was adopted by the City Council on April 14, 2010 prior to the June 31, 2010 contract expiration date; and WHEREAS, preliminary engineering and public outreach was still required to meet the contract obligations with Caltrans; and WHEREAS, on June 30, 2010 the California Transportation Commission (CTC) approved a time extension of the contract to December 31, 2011; and WHEREAS, Caltrans did not require an updated signed contract from the City at the time of the CTC time extension approval; and WHEREAS, Caltrans now requires an updated signed contract that includes the currently approved CTC termination date of December 31, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby authorizes the City Manager to execute a contract time extension to December 31, 2011 with the State of California, Department of Transportation (Caltrans) for the Intercity Rail Passenger Facility contract.
