Christopher Jordan, Planning Manager DEPARTMENT HEAD: Richard Shepard, Public Works Director / City Engineer RECOMMENDED ACTION: Staff recommends the City Council adopt a resolution finding that the Intelligent Transportation System Phase 4 Project (WTC001) (Project) is exempt from the California Environmental Quality Act (CEQA). BACKGROUND INFORMATION: The Project will upgrade and connect approximately 25 traffic signals with the Traffic Management Center, install approximately 22 closed circuit television (CCTV) monitoring cameras, upgrade and potentially relocate the Transportation Management Center Equipment, perform corridor coordination assessment studies, and optimize signal timing on major corridors in the City of Elk Grove. No ground disturbance or tree removal will occur as a result of the Project and the Project does not require any right-of-way acquisition. ENVIRONMENTAL REVIEW: The California Environmental Quality Act (Section 21000, et. seq. of the California Public Resources Code, hereafter CEQA) requires analysis of agency approvals of discretionary projects. A project, under CEQA, is defined as the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The proposed Project is a project under CEQA. 1

The proposed Project is exempt from CEQA under State CEQA Guidelines Section (Existing Facilities). This exemption applies to projects involving the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency s determination. Subsection (c) specifically describes existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities. The proposed Project consists of upgrading and connecting approximately 25 traffic signals with the Traffic Management Center, installing approximately 22 closed circuit television (CCTV) monitoring cameras, upgrading and potentially relocating the Transportation management Center Equipment, performing corridor coordination assessment studies, and optimizing signal timing on major corridors in the City of Elk Grove. The work is minor in nature in that there is no to negligible expansion of use of the facilities beyond current conditions and no ground disturbance would occur. No trees would be removed. No special circumstances exist that would create a reasonable possibility that the Project will have a significant adverse effect on the environment. Therefore, the Project qualifies for the identified exemption and is exempt under CEQA. Because of the use of federal funding for the Project, the Project also qualifies for review under the National Environmental Policy Act (42 U.S.C et seq, hereinafter NEPA). Caltrans is the NEPA lead agency for the Project. Caltrans will prepare a Categorical Exclusion for the Project pursuant to NEPA, following the completion of CEQA compliance. FISCAL IMPACT: There are no fiscal impacts associated with adoption of the resolution. Costs associated with the Project were included in the current fiscal year budget. 3 ATTACHMENT 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE FINDING THE INTELLIGENT TRANSPORATION SYSTEM PROJECT (WTC001) EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the Intelligent Transportation System Phase 4 Project (WTC001) will upgrade and connect approximately 25 traffic signals with the Traffic Management Center, install approximately 22 closed circuit television (CCTV) monitoring cameras, upgrade and potentially relocate the Transportation Management Center Equipment, perform corridor coordination assessment studies, and optimize signal timing on major corridors in the City of Elk Grove; and WHEREAS, the California Environmental Quality Act (Section et seq. of the Public Resources Code, herein after referred to as CEQA) requires that cities consider the environmental consequences of their actions before approving a project; and WHEREAS, due to the use of federal funds for this Project, the Project also qualifies for review under the National Environmental Policy Act (42 U.S.C et seq., herein after NEPA); and WHEREAS, the Project is a project under CEQA and NEPA; and WHEREAS, Section (Existing Facilities) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations) provides an exemption from CEQA for projects involving the minor alteration of existing public or private facilities when the alteration involves negligible or no expansion of an existing use; and WHEREAS, CEQA must be completed prior to Caltrans preparation of a NEPA Categorical Exclusion. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby finds this project exempt from CEQA pursuant to the following finding:.
