1 RESOLUTION TO REQUEST LOCAL LEGISLATION (RESOLUTION # ) A RESOLUTION TO REQUEST LOCAL LEGISLATION TO PROVIDE FOR THE IMPOSITION OF TECHNOLOGY FEES BY THE PROBATE COURT OF TROUP COUNTY WHEREAS, the Troup County Board of Commissioners and the Probate Judge of Troup County desire local legislation for the imposition of certain Technology Fees to provide funding for technology hardware, software and technical service support for the court system; and WHEREAS, upon review of the technology needs and challenges facing the court system, the Troup County Board of Commissioners and the Probate Judge of Troup County believe that it would be in the best interest of the citizens of Troup County and the operations of the court system if by local Act a technology fee was collected in an amount not to exceed $10.00 for the filing of each civil action/proceeding; and WHEREAS, the Troup County Board of Commissioners as the governing authority of Troup County has, upon review, determined that any such technology fee imposed and collected will be paid into a special fund to be expended for such technology hardware, software and technical support services which will provide a reasonable and effective balance between the judicial need for technology support and the need to protect the public finances;
2 NOW, THEREFORE, the Troup County Board of Commissioners resolves that it shall, and hereby does, request the introduction of the local legislation as described above and as attached hereto and requests that the entire local delegation to the Georgia General Assembly support the same. 3 TROUP COUNTY PROBATE COURT; TECHNOLOGY FEE. NO ( Bill No. ). An Act to authorize the Probate Court of Troup County to impose and collect a technology fee for each civil case filed; to specify the uses to which said technology fee may be put; to provide for review and reports; to provide for adjustment of such fee; to provide an effective date; to repeal conflicting laws; and for other purposes. AN ACT Be it enacted by the General Assembly of Georgia: Section 1. (a) Upon the effective date of this Act, the clerk of the probate court shall charge and collect a technology fee to be set by the court, not to exceed $10.00 for the filing of each civil action/proceeding. (b) The technology fee shall be in addition to all other legal fees and costs associated with the filing of each proceeding, pleading, document, service or action. (c) Funds received from technology fees shall be maintained in a separate fund by the county finance officer and shall be used only for the technological needs of the probate court and its support offices and personnel as directed by the chief judge of the court and county governing authority. (d) The clerk of the probate court shall collaborate with the county finance officer to ensure the effective assessment, collection, reporting and maintenance of the fund. (e) Funds may be used for computer hardware and software purchases, leases and licenses; technological consultation services; the installation, maintenance, design, and integration of computer hardware and software; and the purchase, lease, maintenance, integration and installation of imaging, scanning, facsimile, communications, projection, courtroom display systems, and printing equipment and software. (f) At the end of each calendar year, the county finance officer shall provide a detailed report of all income and expenditures of the fund to the chief judge of the probate court and the county governing authority.
4 (g) On July 1 of each year following the effective date of this Act, the county manager and the chief judge of the probate court shall review the fund history and the judge shall be authorized, with the advice and consent of the county governing authority, to change the technology fee at an even dollar figure not to exceed $10.00 by an order filed with the clerk of the probate court. Section 2. This Act shall become effective on July 1, Section 3. All laws and parts of laws in conflict with this Act are repealed.
