Any opration of th VEHICLE that rsults in furthr damag rlatd to th original MECHANICAL BREAKDOWN OR FAILURE, shall b considrd nglignc on YOUR part and failur to protct th VEHICLE, which damag shall not b covrd undr this CONTRACT. YOU ar rsponsibl for making sur that all VEHICLE fluids ar full and that th oil warning 4

5 light/gaug and th tmpratur warning light/gaug ar functioning bfor driving th VEHICLE. YOU ar rquird to safly pull YOUR VEHICLE off of th road and shut off th ngin immdiatly whn ithr of th lights/ gaugs indicat a problm. 3. YOU must giv authorization to a rpair facility for tar down and inspction to diagnos a problm and it is YOUR rsponsibility to pay for this srvic in th vnt such chargs ar not subjct to covrag or rimbursmnt undr this CONTRACT. YOU ar rsponsibl for complianc with all th TERMS AND CONDITIONS statd in this CONTRACT. YOU must also rport all claims to th ADMINISTRATOR at tim of occurrnc, whthr covrd by th CONTRACT (rimbursabl) or not. C. IN CASE OF MECHANICAL BREAKDOWN OR FAILURE 1. Th MECHANICAL BREAKDOWN or FAILURE must b of a covrd part of YOUR CONTRACT. d. Th total cost of th rpair / rplacmnt must not xcd $ In th vnt YOU nd to hav an Emrgncy Rpair prformd, follow ths instructions: YOU must hav th rpair facility call th ADMINISTRATOR th nxt businss day to rport th Emrgncy Rpair; Provid th ADMINISTRATOR with proof of maintnanc upon rqust and cooprat in th invstigation of any loss; Rtain all parts which YOU authoriz a rpair facility to rplac, and, if th ADMINISTRATOR rqusts, bring YOUR VEHICLE and th parts YOU had rplacd to a rpair facility of th ADMINISTRATOR S choic for inspction; Provid th ADMINISTRATOR with proof of loss (original rcipts - no photocopis) within thirty (30) days of th authorizd rpair. WE will not b liabl to YOU for consquntial damags or injuris, nor for any costs or xpnss that provid bttrmnt, upgrad, or nhancmnt to YOU or YOUR VEHICLE. SUBROGATION YOU agr that WE, aftr honoring a claim on YOUR CONTRACT, hav all rights of subrogation against thos who may b rsponsibl for YOUR MECHANICAL BREAKDOWN or FAILURE. YOU shall do whatvr is ncssary to scur such rights. YOU shall do nothing to prjudic such rights, and YOU shall xcut and dlivr to US instrumnts and paprs rquird to ithr scur or maintain such rights. All amounts rcovrd by YOU for which YOU wr prviously rimbursd undr this CONTRACT shall bcom OUR proprty or th proprty of OUR dsign and shall b forwardd to th sam by YOU, up to th total amount paid by US undr this CONTRACT. J. ARBITRATION In th vnt of any disput concrning th intrprtation of this CONTRACT by US and/or th ADMINISTRATOR, YOU agr that it shall b rsolvd by arbitration in accordanc with th Arbitration Ruls of th Bttr Businss Burau ( BBB ). If YOU want a disputd mattr to b rsolvd by BBB, YOU must notify th ADMINISTRATOR in writing within sixty (60) days of ADMINISTRATOR s final dcision. K. Rturnd Chck Charg: A rturnd chck charg of $30.00 will b assssd ach tim YOU pay for this CONTRACT with a chck or pr-authorizd chck that is rturnd unpaid. Th LIENHOLDER or funding party will post th rturn chck charg to YOUR balanc du on th CONTRACT as wll as unpaid lat fs. 5. Rfund policy for pr-authorizd chck paymnts: If paymnt has bn mad by pr-authorizd chck(s), YOU must submit all original cancld pr-authorizd chck(s) to th LIENHOLDER or funding party.
